If we have the right to recover any amount payable
under this policy from any other person, you must cooperate
with us in any action we may take.
10. Our rights of recovery
a. We have the right to recover from any person, in
your name, the amount of any claim paid under this
policy and we have full discretion in the conduct,
settlement or defence of any claim in your name. If
we recover more than the amount we have paid to
you or on your behalf, we will pay you the balance.
b. The amount of excess you have paid will only be
refunded when we have recovered the total amount
we have paid under your claim, unless we have
agreed otherwise.
11. Salvage of your vehicle when it is a total loss
If your vehicle is a total loss and we have agreed to pay
the market value or agreed value for your vehicle:
• the wreckage of your vehicle will become our
property, and
• we will keep the proceeds of any salvage sale.
12. Payment of unpaid premium when your
vehicle is a total loss
If your vehicle is a total loss and we have agreed to pay
the market value or agreed value for your vehicle:
• the amount of any unpaid premium for the period
of insurance will be deducted from the amount
payable to you, and
• if we are replacing your vehicle, you must pay us the
balance of any unpaid premium or instalments for
the period of insurance.
