I. STATE PROJECT DIRECTOR, <strong>JEPC</strong>, Jharkhand, invites sealed Technical & Financial Bids on behalf of<br />
Jharkhand Education Project Council (<strong>JEPC</strong>), for Supply, Installation & Maintenance of<br />
Equipments/Materials for Block Level Resource Room for CWSN in nearly 259 Blocks of Jharkhand<br />
divided in two packages –<br />
1. Package 1 – Physiotherapeutic & Occupational Therapeutic Equipments<br />
2. Package 2 – Sensory Motor<br />
3. Package 3- Learning Kit<br />
II. A complete set of Bid Document may be purchased by any interested eligible bidder on the submission of a<br />
written application to the STATE PROJECT DIRECTOR, <strong>JEPC</strong>, Jharkhand and upon payment of a non<br />
refundable cost of Rs. 1,000.00 (Rupees One Thousand) only in the form of Demand Draft in favour of<br />
JHARKHAND EDUCATION PROJECT COUNCIL payable at Ranchi. The Bid Document may be purchased<br />
personally during office hours on all working days. It may also be downloaded from www.jepc.nic.in or<br />
www.jharkhand.gov.in in which case the fee must be enclosed with the bid document in form of Demand Draft<br />
at the time of submission.<br />
III. Interested eligible Bidders may obtain further information from office of the STATE PROJECT DIRECTOR,<br />
<strong>JEPC</strong>, RANCHI, Jharkhand.<br />
IV. Interested and eligible Bidders are required to submit the Technical and Financial Bids in two separate sealed<br />
envelopes. The Technical and Financial Bids must be accompanied by a bid security as specified in this Bid<br />
Document. The Bid Security (In the form of Demand Draft or Bank Guarantee) must be included in the same<br />
envelope containing the Technical Bid. The Technical and Financial Bid along with the Bid Security must be<br />
submitted to the Office of STATE PROJECT DIRECTOR, <strong>JEPC</strong>, located in the New Cooperative Building<br />
Shyamli Colony, Doranda, Ranchi on or before 15/01/2013 at 2:00 PM.<br />
V. The envelope containing the Technical Bid and the Bid Security will be opened on the specified date & time in<br />
presence of Bidders or their authorized representative who may like to attend. In the event of the date specified<br />
for bid receipt and opening being declared as a holiday for the Office of STATE PROJECT DIRECTOR, <strong>JEPC</strong><br />
the due date for submission and opening of bids will be the following working day at the appointed time.<br />

SECTION - II<br />
INSTRUCTIONS TO BIDDERS<br />
1.1. Introduction<br />
Under Sarva Shiksha Abhiyan the prime goal of Inclusive Education is to mainstream the disabled<br />
children into the formal schooling system. To ensure this objective it is important to provide proper<br />
support for the school preparedness in Resource Room. On this basis Jharkhand Education Project<br />
Council has established 259 Resource Room across the state. <strong>JEPC</strong> requires equipments/materials for<br />
these Resource Room.<br />
1.2. About Work<br />
The proposal is that selected Agency will have to supply, install & maintenance of<br />
equipments/materials in 259 blocks.<br />
Supply as required by the <strong>JEPC</strong> and specified in this tender document shall be carried out by the<br />
Agency and <strong>JEPC</strong> shall release payments against the supply as prescribed in Bid document. As the<br />
Agency will be responsible for smooth functioning of the Equipments/Materials supplied by the<br />
agency, availability of spares will be taken care of by the Agency to maintain the agreed level of<br />
service.<br />
1.3. Basic Qualification Criteria<br />
Technical and Financial Bids are invited from eligible companies/firms, to participate in the Bidding<br />
process. Basic pre qualification criteria for the agency for participation in the Bid process as on<br />
31 st March, 2012 are as under:<br />
a. Should be a registered Firm/Company/Manufacturer.<br />
b. Should be registered with Sales Tax, Service Tax dept as per existing rules.<br />
c. Should have an annual Turnover of Minimum Rs.50 Lakhs in each of the last 3 financial years<br />
i.e. 2009-10, 2010-11 & 2011-12. No turnover is required for Package-2 & 3.<br />
d. Should have an ISO certified Company/Firm/Manufacturer in case of Package 1 only.<br />
e. Should have under taken similar nature of work related to supply, install & maintenance of<br />
Equipments/Materials over last three years and the value of any one such work done must be at<br />
least Rs. 50 lakhs for package 1 and Rs. 3 Lakh for package 2 & 3.<br />
1.4. The bidder must bid for complete quantity of Package 1, 2 or 3. Partial bidding will disqualify the<br />
bidder. Any Bidder can bid either for all packages (1, 2 or 3) or any one package (1, 2, and 3).<br />
1.5. Sub contracting will not be allowed.<br />
1.6. All bids must be accompanied by Bid security as specified below and submitted on or before the<br />
prescribed date, at place and time given in section I of this document. Bids submitted without Bid<br />
security will be summarily rejected<br />
1.7. Cost of Bid Document<br />
Interested and eligible Bidders may obtain the prescribed Bid Document by paying Rs. 1,000/- (Rs.<br />
One thousand Only) in the form of a Demand Draft drawn from a Nationalized Bank and in favour of<br />
the JHARKHAND EDUCATION PROJECT COUNCIL, payable at Ranchi, from the office of State<br />
Project Director, <strong>JEPC</strong>. It may also be downloaded from www.jepc.nic.in or www.jharkhand.gov.in,<br />

in which case the fee in the form of Demand Draft should be enclosed with the bid document at the<br />
time of submission.<br />
Bid Document can be collected from the Office in person by paying the cost of Bid Document. Bid<br />
document can be sent to the firm after getting proper request letter along with DD of Rs. 1000/- and<br />
Rs. 250/- for the postage charge in advance to the office. It will be sent by Post, Courier or mail.<br />
Interested and eligible Bidders may obtain further information or clarification from the office of the<br />
State Project Director, <strong>JEPC</strong>.<br />
2 Cost of Bidding<br />
2.1 The bidder shall bear all costs associated with the preparation and submission of its bid, and the State<br />
Project Director, <strong>JEPC</strong> herein after referred to as “the Purchaser” will in no case be responsible or<br />
liable for these costs, regardless of the conduct or outcome of the bidding process.<br />
3. The Bidder is expected to examine all instructions, forms, terms and specifications in the Bid Document.<br />
Failure to furnish all information required by the Bid Document or submission of a Bid not substantially<br />
responsive to the Bid Document in every respect will be at the Bidder's risk and may result in rejection of<br />
its Bid.<br />
4. Pre Bid Meeting:<br />
4.1 The Bidder or his official representative is invited to attend a pre Bid meeting which will take place at<br />
State Project Office, <strong>JEPC</strong>, Shyamli colony, Doranda, Ranchi on Dt: 02/01/2013 at 04:00 PM.<br />
4.2 The purpose of the meeting will be to clarify issues and to answer questions on any matter that may<br />
be raised at this stage.<br />
4.3 Any modification of the Bid Document listed may become necessary as a result of the pre bid<br />
meeting shall be made by the purchaser exclusively by issuing a corrigendum pursuant to Clause 6<br />
and not through the minutes of the pre bid meeting.<br />
4.4 Non attendance at the pre bid meeting will not be a cause for disqualification of a bidder.<br />
5. Amendment of Bid Document<br />
5.1 At any time prior to the deadline for submission of Bids, the Purchaser may, for any reason, whether<br />
at its own initiative or in response to a clarification requested by a prospective bidder, modify the Bid<br />
Document by amendment.<br />
5.2 The amendment will be notified as corrigendum to all prospective bidders who have purchased the<br />
Bid Document from the office of <strong>JEPC</strong>.<br />
5.3 In order to allow prospective bidders reasonable time in which to take the amendment into account in<br />
preparing their bid, the Purchaser may, at its discretion, extend the deadline for the submission of<br />
bids.<br />
6. Language of Bid<br />
6.1 The Bid prepared by the Bidder and all correspondence and documents relating to the bid exchanged<br />
by the Bidder and the Purchaser, shall be written in English language only.<br />
7. Documents Comprising the Bid<br />
The Bid prepared by the Bidder shall be submitted in 'Two Envelopes' comprising the following<br />
components:<br />

7.1 First Envelope shall contain:<br />
Attested copies of documents showing that the bidder has the Financial, Technical and Servicing<br />
capability necessary to perform the contract and meet the Basic pre qualification criteria outlined in the<br />
qualification requirements and to fulfill this all Bids submitted shall include the following information:<br />
1. Proof of registration of Company/Firm/Manufacturer.<br />
2. Attested copies showing the legal status, place of registration, principal place of business and<br />
memorandum of association of the firm/Company/Manufacturer.<br />
3. Audited Financial Statement for last 3 Financial Years i.e. 2009-10, 2010-11 & 2011-12.<br />
4. Proof of Income Tax return submitted in last three Financial Years i.e. 2009-10, 2010-11 & 2011-<br />
12 along with PAN Card<br />
5. Proof of Sales Tax Registration.<br />
6. Sales Tax Clearance Certificate up to March 2012.<br />
7. Proof of Service Tax Registration.<br />
8. Service Tax Clearance Certificate up to March 2012.<br />
9. Proof of supplying the same nature of equipments/materials as satisfactory completion certificate<br />
and work order.<br />
10. Proof of Installation of Equipments/Materials as satisfactory completion certificate and work order.<br />
11. Original copy of the tie-ups with manufacturers(OEM) in the name of State Project Director,<br />
Jharkhand Education Project Council, Ranchi mentioning <strong>Tender</strong> No.<br />
12. The letter of acceptance from Original Equipment Manufacturer (OEM) clearly stating that they<br />
will supply the quality material within the specified time.<br />
13. An EMD of Rs 1, 00,000/- (One Lakh only) for each Package-1 and Rs. 50,000/- for Package 2 & 3<br />
separately in the form of Demand Draft or Bank Guarantee from any nationalized bank in favour of<br />
Jharkhand Education Project Council ,Ranchi, payable at Ranchi must be valid up to 3 months from<br />
the date of opening of technical bid.<br />
14. Details of accreditation, if any, under DOE/any affiliation/recognition by GOI or GOJ.<br />
15. All other proofs to satisfy the pre qualification criteria and made them eligible for this tender<br />
16. Filled table I, III, IV, V and VI attached to this bid document.<br />
7.2 Sample of Equipments/Materials<br />
The bidder shall submit sample of items with their Technical Specification along with Technical Bid. The<br />
successful bidders have to supply the same items as per the sample submitted by them. Any discrepancy, if<br />
found will be liable to the cancellation of contract as a whole. In such case no financial liability will lie with<br />
Jharkhand Education Project Council.<br />
7.3 The Second Envelope<br />
Sealed and Signed Financial proposal must accompanied with the rate per items in the tables given below mentioning<br />
following conditions –<br />
CONDITIONS:<br />
1) We agree to abide by this <strong>Tender</strong> for a period of 90 days after the date fixed for opening of Second<br />
Envelope and shall remain binding upon us and may be accepted at any time before the expiry of that<br />
period.<br />
2) Until a formal contract is prepared and executed, this tender, together with your written acceptance<br />
thereof and your notification of award, shall constitute a binding contract between us.<br />
3) We understand that in competing for and if the award is made to us, in executing the above contract we<br />
will strictly observe the laws against fraud and corruption in force in India namely “ Prevention of<br />
corruption act 1988”.<br />
4) The <strong>Tender</strong> is valid for a period of 90 days from the date of opening of <strong>Tender</strong>.<br />

Note: The number of Block/Resource Room may vary (increase or decrease) to any extent at the time of<br />
final allotment or during the operations at the discretion of the <strong>JEPC</strong> authorities.<br />
8. Fixed price: Prices quoted by the Bidder shall be fixed during the bidder's performance of the contract<br />
and not subject to variation on any account. A bid submitted with an adjustable price quotation will be<br />
treated as non-responsive and rejected<br />
9. The Bidder must submit all the documents listed under clause 7 along with the signed Bid<br />
Document in the First Envelope, in order to qualify for consideration in the opening of the<br />
Second Envelope containing the PRICE SCHEDULE.<br />
10. Bid Security<br />
10.1 All the bidder shall submit the Bid security in the form of Demand Draft drawn from a Nationalized<br />
Bank or Bank Guarantee for the prescribed sum of Rs. 1, 00,000/- for package 1 and Rs. 50,000/- for<br />
package 2& 3 separately.<br />
10.2 The Bid security is required to protect the purchaser against risk of Bidder’s conduct, refusal,<br />
withdrawal which would warrant the forfeiture of security.<br />
10.3 The Bid security shall be in Indian Rupees and shall be in one of the following forms<br />
a) Demand draft drawn on a Nationalized Bank in favour of Jharkhand Education Project Council, Ranchi<br />
payable at Ranchi or<br />
b) A Bank Guarantee issued by a Nationalized Bank and valid for 135 days from the date of opening of<br />
technical Bid i.e. 15/01/2013 and can be get extended whenever required.<br />
10.4Unsuccessful Bidder’s bid security will be discharged/returned at the expense of the bidder as promptly<br />
as possible but not later than 30 days after the expiration of the period of bid validity prescribed by the<br />
purchaser.<br />
10.5 Any Interlineations, erasures or overwriting shall be valid only if they are initialed by the person or<br />
persons signing the Bid.<br />
10.6 The successful Bidder’s Bid security will be adjusted towards performance security to be furnished by<br />
the Bidder before signing the contract agreement<br />
10.7 The Bid security may be forfeited:<br />
(a) If a Bidder withdraws his Bid during the period of Bid validity specified by the Bidder on the Bid<br />
Form; or<br />
(b) In case of a successful Bidder, if the Bidder fails or refuses<br />
(i) To sign the contract agreement or<br />
(ii) To furnish performance security.<br />
11. Period of Validity of Bids<br />
11.1 Bids shall remain valid for 90 days from the date of opening of Second Envelope. A Bid valid for a<br />
shorter period shall be rejected by the Purchaser as non-responsive.<br />
11.2 In exceptional circumstances, the Purchaser may solicit the Bidder’s consent to an extension of the<br />
period of validity. The bid security provided under Clause 10 shall also be suitably extended. A Bidder<br />
may refuse the request without forfeiting its bid security. A Bidder granting the request will not be<br />
required nor permitted to modify its bid.<br />
12 Format and Signing of Bid<br />
12.1 The Bidder shall prepare and submit two copies of the bid, clearly marking each “Original Bid” and<br />
“Copy Bid”, as appropriate. In the event of any discrepancy between them, the original shall govern.<br />
12.2 The original and all copies of the bid shall be typed or written in indelible ink and shall be signed by the<br />
Bidder or a person or persons duly authorized to bind the Bidder to the Contract. The letter of<br />
authorization shall accompany the Bid. All pages of the Bid shall be initialed by the person or persons<br />
signing the bid. Unsigned bids will be summarily rejected.<br />

12.3 The bidder shall submit the Bids in Table XII price schedule. However, the STATE PROJECT<br />
DIRECTOR, <strong>JEPC</strong> reserves the right to allot another package within the same District for the same<br />
price.<br />
13 Sealing and Marking of Bids<br />
13.1 The bidder shall submit the Envelope in the following manner.<br />
First Envelope which is sealed and should contain the original documents and duplicate, and shall<br />
be super scribed as “Supply, Installation & maintenance of Equipments/Materials for Block<br />
Level Resource Room for CWSN" along with the "Packages applied for –……………."<br />
Second Envelope which is sealed and should contain the original document and shall be super<br />
scribed as “Supply, Installation & maintenance of Equipments/Materials for Block Level<br />
Resource Room for CWSN" along with the "Packages applied for – ………………"<br />
13.2 The First and Second sealed Envelopes shall be addressed to the purchaser at the following address:<br />

13.3 All the sealed envelopes as mentioned in clause 13.1 shall indicate the name and address of the Bidder<br />
to enable the purchaser to return the same unopened to the bidders in case it is declared late<br />
13.4 If the two Envelopes are not sealed and marked as required by Clause 13 the purchaser will assume<br />
no responsibility for the bid’s misplacement or premature opening.<br />
14. Mode of submission of bids.<br />
14.1 The Bids could be sent by Speed Post or Registered Post or Courier or Dropped personally in the<br />
boxes kept at the above address in person. In any circumstances the bid must reach to the office on or<br />
before last date and time of submission of Bid.<br />
14.2 Bids sent by Telex or Fax or E-mail etc will be rejected.<br />
15. Deadline for Submission of Bids<br />
15.1 Bids must be received by the Purchaser at the address specified under Clause 13.2 not later than the<br />
time and date specified in the Invitation for Bids (Section I). In the event of the specified date for the<br />
submission of Bids being declared a holiday for the Purchaser, the Bids will be received up to the<br />
appointed time on the next working day.<br />
15.2 If the Bids are sent by Speed Post or Registered post or courier, it should reach the purchaser on or<br />
before the scheduled last Date and Time fixed for receipt of Bids as per Section I. The purchaser shall<br />
not be responsible for any delay in transit when Bids are sent through post/ Courier.<br />
15.3 The Purchaser may, at its discretion, extend this deadline for submission of bids by amending the Bid<br />
Documents in which case all rights and obligations of the Purchaser and Bidders previously subject to<br />
the deadline will thereafter be subject to the deadline as extended.<br />
16. Late Bids<br />
16.1 Any Bid received by the Purchaser after the deadline for submission of bids prescribed by the Purchaser<br />
pursuant to clause 15, will be rejected and/or returned unopened to the Bidder.<br />
17. Modification and Withdrawal of Bids<br />
17.1. The Bidder may modify or withdraw its bid after the bid’s submission, provided that written notice of<br />
the modification or withdrawal is received by the Purchaser prior to the deadline prescribed for<br />
submission of bids.<br />

17.2 The Bidder’s modification or withdrawal notice shall be prepared, sealed, marked and dispatched in<br />
accordance with the provisions of Clause 13. A withdrawal notice may also be sent by Fax but<br />
followed by a signed confirmation copy, post marked not later than the deadline for submission of bids.<br />
17.3 No bid may be modified subsequent to the deadline for submission of bids<br />
17.4 No bid may be withdrawn in the interval between the deadline for submission of bids and the expiration<br />
of the period of bid validity specified by the Bidder on the Bid Form. Withdrawal of a bid during this<br />
interval may result in the Bidder’s forfeiture of its bid security.<br />
18. Opening of Bids by the purchaser.<br />
18.1 The Purchaser will open the FIRST ENVELOPE of the Bidder, in the presence of Bidder’s<br />
representatives who choose to attend, at 3.00 PM on 15/01/2013 at Jharkhand education Project<br />
Council, New Cooperative Building, Shyamali Colony, Doranda, Ranchi-834002.<br />
The date on which SECOND ENVELOPE would be opened and the date and time for the conduct of<br />
demonstration of some of the items (for assessing their capability as per the Technical specifications<br />
mentioned in Section V) Will be intimated to the qualified bidders by the Purchaser on the day of<br />
opening of first cover or on subsequent days through Telephone/Fax/Post/Telegram/Phonogram/<br />
Courier/E-mail.<br />
The Bidders or representatives who are present shall sign a register evidencing their attendance. In the<br />
event of the specified date of Bid opening being declared a holiday for the Purchaser, the Bids shall be<br />
opened at the appointed time and location on the next working day.<br />
18.2. The Bidders Names, Bid Modifications, or Withdrawals, Bid prices, Discounts and the presence or<br />
absence of the requisite Bid security and such other details as the Purchaser, at its discretion, may<br />
consider appropriate will be announced at the time of opening. No Bid shall be rejected at bid opening,<br />
except for late bids, which shall be returned unopened to the bidder pursuant to Clause 16.<br />
18.3 Second Envelope of unqualified bidders will be returned and will not be opened under any<br />
circumstances.<br />
18.4 Bids (and modifications sent pursuant to Clause 17.2) that are not opened and read out at bid opening<br />
shall not be considered further for evaluation, irrespective of the circumstances. Withdrawn bids will be<br />
returned unopened to the bidders.<br />
18.5 The Purchaser will prepare minutes of the Bid opening.<br />
18.6 The Bidder shall be responsible for properly super scribing and sealing the First and Second Envelopes<br />
and the purchaser shall not be responsible for accidental opening of Envelopes that are not properly<br />
super scribed and sealed as per clause 13, before the time appointed for opening of Envelopes as per<br />
clause 18<br />
19. Clarification of Bids<br />
19.1 During evaluation of Bids, the purchaser may, at its discretion, ask the Bidder for a clarification of its<br />
bid. The request for clarification must be immediately resolved by the bidder.<br />
20. Preliminary Examination<br />
20.1 The purchaser will examine the Bids to determine whether they are complete, whether any<br />
computational errors have been made, whether required sureties have been furnished, whether the<br />
documents have been properly signed, and whether the bids are generally in order.<br />
20.2 Arithmetical errors will be rectified on the following basis.<br />
(a) If there is a discrepancy between words and figures, the amount in words will prevail and the<br />
bid shall stand corrected to that effect.<br />
(b)<br />
If the bidder does not accept the correction of errors, its bid will be rejected.<br />

(c) The purchaser may waive any minor infirmity or non conformity or irregularity in a bid,<br />
which does not constitute a material deviation, provided such a waiver does not prejudice or affect the<br />
relative ranking of any bidder.<br />
20.3 Prior to the detailed evaluation, pursuant to Clause 21, the Purchaser will determine the substantial<br />
responsiveness of each bid to the Bid Document. For purposes of these Clauses, a substantially<br />
responsive bid is one which conforms to all the terms and conditions of the Bid Document without<br />
material deviations. Deviations from or objections or reservations to critical provisions such as those<br />
concerning Performance Security, Warranty, Applicable Law and taxes and duties will be deemed to<br />
be a material deviation. The purchaser’s determination of a bid’s responsiveness is to be based on the<br />
contents of the bid itself without recourse to extrinsic evidence.<br />
20.4 If a bid is not substantially responsive, it will be rejected by the Purchaser and may not subsequently be<br />
made responsive by the Bidder by correction of the non-conformity.<br />
21. Evaluation and Comparison of Bids<br />
21.1 The Purchaser will evaluate and compare the bids previously determined to be substantially<br />
responsive, pursuant to clause 21.3 for each package.<br />
21.2 The Technical Evaluation Committee (comprising of technical experts) constituted by the<br />
Purchaser will evaluate the substantially responsive Technical Bids in pursuant of the basic<br />
Qualification Criteria. The Committee, on their discretion, may inspect the premises of the bidder for<br />
evaluation of their capability with reference to physical infrastructure available and other technical<br />
capabilities etc.<br />
21.3 Bidders may be invited to demonstrate at short notice their programme to the Technical<br />
Evaluation Committee in any one or more identified hard spots in the subjects for which bids are<br />
submitted. The date and venue for this demonstration will be determined by the Purchaser and will<br />
be intimated to the prospective Bidder either through fax or through letter from the State Project<br />
Director, <strong>JEPC</strong> or any of his authorized officials. Failure to demonstrate the equipments on the<br />
prescribed date will entail disqualification of the Bidder at that stage.<br />
21.4 The Technical Evaluation Committee, in pursuant to clause 21.2 & 21.3 will evaluate the<br />
technical competency of the prospective Bidders and prepare a panel of Bidders, technically<br />
qualified to carry out the assignment of Supply, Installation & maintenance of<br />
Equipments/Materials for Block Level Resource Room for CWSN. The assessment by the<br />
Technical Evaluation Committee constituted by the purchaser as to the Technical Competency of the<br />
bidder will be final and binding to all substantially responsive Bidders.<br />
21.5 Financial bid will be opened only of technically qualified bidders. The Commercial<br />
Evaluation Committee, constituted by the Purchaser will compare and evaluate the Commercial Bids<br />
of the technically qualified Bidder<br />
22. ACCEPTANCE OR REJECTION OF BIDS:<br />
a) The STATE PROJECT DIRECTOR, <strong>JEPC</strong> reserves the right to accept or reject any bid and to<br />
annul the bidding process and reject all bids at any time prior to award of contract, without<br />
thereby incurring any liability or any obligation to inform the affected bidder or bidders of the<br />
grounds for the said action.<br />
b) Any Bid with incomplete information is liable for rejection.<br />
c) For each category of basic qualification criteria, the documentary evidence is to be produced duly<br />
attested by the bidder, serially numbered and enclosed with the bids. If the documentary proof is<br />
not enclosed for any/all criteria the Bid is liable for rejection.<br />
d) If any information given by the bidder is found to be false/ fictitious, the bidder will be debarred<br />
for 3 years from participating in any other tenders of Govt. of Jharkhand.<br />

23(a).Award of Contract<br />
23.1 Subject to clause 21, the Purchaser will award the contract to the technically and financially<br />
qualified Bidder who has quoted the minimum price in different packages.<br />
23.2 The Purchaser reserves the right at the time of Contract award to increase or decrease the<br />
quantity of goods and services to any extent originally specified in the Schedule of Requirements<br />
without any change in unit price or other terms and conditions as per State Govt. rules.<br />
23(b). Signing of Contract / MOU<br />
23.3 At the time, prior to the expiration of the period of bid validity, as the Purchaser will issue the work<br />
order incorporating all agreement between the parties.<br />
23(c). Performance Security<br />
The Bidder will be required to furnish 5% of the total work value awarded to the bidder as Performance<br />
Security in accordance with the Conditions of Contract in the form of Bank Guarantee valid for the contract<br />
period of 3 years drawn in favour of the <strong>JEPC</strong> within 21 days of receipt of the Work Order in case of package<br />
1 only.<br />
23.4 If the Bidder fails to furnish the Performance Security within 21 days and sign the contract agreement,<br />
the Bid security furnished by such bidder will be forfeited.<br />
23.5 The performance security furnished by the successful Bidder in respect of his/her bid will be returned to<br />
him/her at the end of the contract period subject to the satisfactory performance of the contractual<br />
obligations.<br />
23.6 If the successful Bidder after receiving the work order fails to perform any contractual obligation, the<br />
Performance Security furnished by the Bidder will be forfeited.<br />
24. Dispute<br />
(i) If any dispute arises between the Block and the bidder, it will be settled by mutual negotiations<br />
failing which the matter will be referred to DPO, SSA at District Level Office and its decisions shall<br />
be final.<br />
(ii) If any dispute arises out of the contract with regard to the interpretation, meaning and breach of the<br />
terms of the contract and any decision of DPO, the matter shall be referred by the bidder to the sole<br />
arbitrator that will be State Project Director, <strong>JEPC</strong> whose decision shall be final.<br />
(iii) All legal proceedings, if necessary, related to any of the parties (<strong>JEPC</strong> or Bidder) shall to be lodged in<br />
the High-Court, Ranchi, Jharkhand and not elsewhere.<br />
(iv) Any fact or condition which may not have been mentioned in terms and conditions and may arise<br />
during the contract period shall be decided as per the State Government policy rules. In case rules do<br />
not provide any such situation, the issue will be decided by the State Project Director, <strong>JEPC</strong><br />
25. Provision for Unsatisfactory Services<br />
Equipments/Materials supplied and services of bidder are not found satisfactory at any stage during<br />
the project period by <strong>JEPC</strong> or any competent authority, in such situations the bidder will be bound to<br />
remove the deficiencies at his own cost within the time period fixed by <strong>JEPC</strong>. In case the bidder is<br />
not able to remove and rectify the deficiencies within the given time period, <strong>JEPC</strong> will be competent<br />
to make alternative arrangements of complete work at the risk and cost of the bidder and the costs so<br />
incurred shall be deducted from security deposit and/or due amount payable to the bidder.<br />

Warranty and Service of the Equipments/Materials Supplied<br />
The total warranty period of the Equipments/Materials supplied by the successful bidder will be 1 year for<br />
the package 1 only. Any Fault arising in the equipments supplied will be consolidated at district level & the<br />
bidder will be asked for repairing or replacement. The bidder has to repair/replace all the faulty equipments<br />
and return back the equipments in good working condition to district office within 15 days of the receiving of<br />
the equipments failing which the equivalent amount as decided by Director, <strong>JEPC</strong> would be deducted from<br />
the performance guarantee or the amount payable to the bidder. The bidder has to provide this service for<br />
entire service period of 1 year.<br />

SECTION -IV<br />
TERMS AND CONDITIONS OF CONTRACT<br />
The following are the General Conditions of Contract for Supply & Installation of Equipments/Materials for<br />
Resource Room in 259 blocks in the state of Jharkhand.<br />
a) Bidder should comply with all the tests and inspection specified by Director, <strong>JEPC</strong> or any other<br />
officer authorized for this purpose, satisfactorily. The Bidder shall ensure timely delivery and<br />
commissioning of the systems as per the implementation schedule given in the work order.<br />
b) The Delivery of the Equipments/Materials for Resource Room shall be done at the risk and cost<br />
of the Bidder.<br />
c) If the supply & installation don't take place as per the time line specified in the work order <strong>JEPC</strong><br />
shall have the right to cancel the contract and take such other action as may be deemed fit at the<br />
risk and cost of the Bidder.<br />
d) If any manufacturing or other technical defects are found within the contract period from the date<br />
of acceptance of the Equipments/Materials, the same will have to be replaced or rectified free of<br />
cost by the Bidder.<br />
e) <strong>JEPC</strong> shall not pay any higher costs over and above the agreed value of the contract, on account<br />
of any revision due to increase in duties, taxes and surcharges during the contract period.<br />
2. PAYMENT:<br />
The terms of payment will be as follows:<br />
No payment will be made in advance.<br />
Payment will be made only after successful supply, installation & demonstration thereafter considering<br />
penalty clauses. The successful bidder will have to submit the Satisfactory Work Completion Certificate as<br />
prescribed by the <strong>JEPC</strong> duly certified by the block level officers and counter certified by the District<br />
Programme Officers along with Bill.<br />
District Programme Officer of respective districts will verify all the reports, claims & give their<br />
recommendation about the payment to be made to the bidder for each Children & Block considering Penalty<br />
Clauses.<br />
Service tax, Income tax and any other taxes led by Central/State Government will be deducted at source as<br />
per rules.<br />
3. PENALTY AND TERMINATION FOR NON-FULFILMENT OF CONTRACT:<br />
3(a) PENALTY FOR NON SUPPLY OF EQUIPMENTS/MATERIALS<br />
In case of Non supply or delay in supply of the Equipments/Materials within prescribed time line (45<br />
days from the date of work order) penalty will be recovered from the Bill/performance security<br />
deposit @ 5% per month of the total cost of the equipments individually.<br />
3 (b) In case of not providing the repair / replacement (maintenance) services within 15 days of the call<br />
Locking, 1%of the payment to be made per week will be deducted.<br />
4. OTHER CONDITIONS<br />
a) The contract shall be for the Package wise only. The bidder can apply for any number of<br />
packages & accordingly price should be quoted Package wise.<br />
b) All products should be quoted with 3 years warranty pack.<br />

c) Bid price should be quoted inclusive of all taxes, installation and transporting up to block level<br />
destination.<br />
d) The rate quoted by the bidder shall be fixed for the entire duration of 1 year. There shall be no<br />
inter item rate adjustment during the contract period.<br />
e) The price should be quoted in Indian Rupees only.<br />
f) The rate should be quoted only in the prescribed format as annexed.<br />
g) The Bidder has to submit an undertaking in the prescribed format in the bid that he accepts all<br />
the technical and commercial conditions of the bidding and shall abide by the same fully.<br />
h) Conditional or Unsigned bids will be summarily rejected.<br />
i) No bid will be accepted by Mail/Fax.<br />

THE CONDITIONS of this obligation are:<br />
1. If the Bidder withdraws its Bid during the period of bid validity specified by the Bidder on the Bid Form;<br />
or<br />
2. If the Bidder, having been notified of the acceptance of its bid by the Purchaser during the period of bid<br />
validity:<br />
(a)Fails or refuses to execute the Contract Form if required; or<br />
(b) Fails or refuses to execute the allotted work; or<br />
(b)Fails or refuses to furnish the Performance Security, in accordance with the Instruction to Bidders.<br />
We undertake to pay the Purchaser up to the above amount upon receipt of its first written demand, without<br />
the Purchaser having to substantiate its demand, provided that its demand the purchaser will note that the<br />
amount claimed by it is due it owing to the occurrence of one or both of the two conditions, specifying the<br />
occurred condition or conditions.<br />
The guarantee will valid for 180 days or six months from the date of opening of technical bid i.e. ……….<br />
