NOTICE AND AGENDA OF PUBLIC MEETING OF THE BOARD OF<br />

DIRECTORS OF THE YUMA COUNTY INTERGOVERNMENTAL PUBLIC<br />

TRANSPORTATION AUTHORITY<br />

Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the Board of<br />

Directors of the <strong>Yuma</strong> <strong>County</strong> Intergovernmental Public Transportation Authority<br />

(“YCIPTA”) and to the general public that the Board of Directors will hold a meeting on:<br />

Wednesday, January 23, 2012<br />

Unless otherwise noted, meetings held at the above location are open to the public.<br />

The Board of Directors may vote to go into executive session during the noticed meeting<br />

concerning any of the agenda items mentioned above. If authorized by the requisite vote<br />

of the Directors, the executive session will be held immediately after the vote and will not<br />

be open to the public. The executive session, if held, will be at the same meeting location<br />

set forth above. The discussion may relate to personnel, public records, confidential legal<br />

advice or counsel, litigation, real estate or other matters permitted pursuant to A.R.S. §§<br />

38-431.03(A)(1)-(7). The Chairman or other presiding officer shall instruct the persons<br />

present at the executive session regarding the confidentiality requirements of the Open<br />

Meeting Laws.<br />

The <strong>Yuma</strong> <strong>County</strong> Intergovernmental Public Transportation Authority<br />

(YCIPTA) met in Regular Session on October 24, at 2351 S. 26 th Street,<br />

<strong>Yuma</strong>, Arizona.<br />

CALL TO ORDER: Chairman Pickels called the meeting to order at<br />

1:34 p.m. Members present were: Robert L. Pickels, Jr./<strong>Yuma</strong> <strong>County</strong>;<br />

Greg Wilkinson/City of <strong>Yuma</strong>; Ralph Velez/City of San Luis;<br />

Rodney Rinehart/Town of Wellton; Bill Lee/City of Somerton; and<br />

Dr. Larry Gould/<strong>Yuma</strong> Branch-Northern Arizona University. Also present<br />

were: Dr. Glenn Mayle, President/Arizona Western College (AWC); John<br />

Andoh, <strong>Transit</strong> Director; Charlene FitzGerald, Executive Director/<strong>Yuma</strong><br />

Metropolitan Planning Organization (YMPO); Jim Dickey, Arizona <strong>Transit</strong><br />

Association; Don Kilner, General Manager/First <strong>Transit</strong>; <strong>Yuma</strong> <strong>County</strong><br />

Department of Development Services Planning Director Paul Melcher; and<br />

Recording Secretary Ginger Hamilton.<br />

Mr. Rinehart led the Pledge of Allegiance.<br />

CALL TO THE PUBLIC: Delores Gowre (no address given), lives in the<br />

apartments behind the Big Curve Shopping Center and asked if the YCAT bus<br />

stop could be reinstated because there are a lot of people who use the bus.<br />

Mr. Pickels responded that adjustments and options for routes were being<br />

explored.<br />

PRESENTATIONS:<br />

P1: Arizona <strong>Transit</strong> Association, presentation by Jim Dickey,<br />

Director.<br />

Mr. Dickey gave a power point presentation and stated that a public poll had<br />

been conducted throughout the state to get a feel for what people are<br />

thinking. Responses indicated that the two top issues are: 1) Education, and<br />

2) Health care, in that order. He stated that AzTA’s goal is to educate<br />

people on public transportation and there is a lot of information offered on<br />

their website which is www.azta.org.<br />

Discussion ensued on the following: <strong>Transit</strong> issues; loss of Local<br />

Transportation Assistance Funding (LTAF), and if restored, having shelf<br />

ready projects; Modal competition; and Reauthorization of *Safe Tea-Lu and<br />

the possible appropriation/re-authorization of funds and current legislation<br />

regarding same. (*Safe, Accountable, Flexible, Efficient Transportation<br />

Equity Act.)<br />

Mr. Kilner stated that Ricardo Guevara had been selected citing a positive<br />

attitude, a positive manner in improved service through actions/suggestions,<br />

not having any accidents within the past thirty (30) days,<br />

P3. <strong>Yuma</strong> Regional <strong>Transit</strong> Study Update.<br />

Mr. Melcher summarized the keys points of the update as follows:<br />

1) Public Outreach; 2) Goals and Objectives; 3) Deficiencies; 4) Service<br />

Alternatives; and 5) Next Steps which entails public comments due by<br />

October 28 th regarding deficiencies and routing; a public meeting in<br />

November; Service Alternatives Report (November); Draft Report and Final<br />

Report (December).<br />

Discussion ensued on services needs; survey results; proposed service<br />

alternatives and funding; alternatives operations and design.<br />

It was noted that there will be public meeting on November 17, 2011 to<br />

review alternatives and identify public preferences. After the public hearing<br />

the three service alternatives would be revised to reflect comments.<br />

Mr. Andoh stated he hopes to implement the new college/university fees and<br />

have the plan finalized by January, 2012; and that he is working on a<br />

dedicated route between the San Luis and AWC campuses.<br />

Mr. Pickels asked that this item be pulled from the consent calendar. He<br />

asked for clarification about the inclusion of all <strong>County</strong> Rules when all did not<br />

apply to the Transportation Authority’s needs. He asked Mr. Andoh to modify<br />

the document as per the Board’s discussion and direction, and to return it to<br />

the November agenda for action.<br />

DISCUSSION & ACTION ITEMS:<br />

D1: Discussion Regarding Draft <strong>Transit</strong>ion Plan.<br />

Mr. Andoh asked if this item could be deferred to the next YCIPTA meeting<br />

and permission was granted. Therefore, no action was taken on this item.<br />

D2: Discussion and Possible Action Regarding Cocopah Tribe<br />

Membership with the <strong>Yuma</strong> <strong>County</strong> Intergovernmental Public<br />

Transportation Authority.<br />

Mr. Andoh stated that he had met with Cocopah Tribal Chairwoman Sherry<br />

Cordova and she would like to designate Paul Soto as representative, if the<br />

YCIPTA Board approves the Cocopah Tribe as a member.<br />

Mr. Andoh stated that he has been working with the WACOG and the <strong>Yuma</strong><br />

Metropolitan Planning Organization (YMPO) to address concerns regarding<br />

Dial-a-Ride increased services hours over budgeted hours. Effective<br />

November 7 th new measures will be implemented to ensure that the budget<br />

is kept in line with revenue vehicle service hours. In three months if the<br />

new measures prove unsuccessful, and the budget is on target with the<br />

WACOG budget, alternative funding will be explored. He will provide an<br />

update the next YCIPTA meeting in November.<br />

Mr. Pickles stated they are trying to find some balance with the system<br />

economically and still provide services needed by individuals with disabilities<br />

and Americans Disability Act (ADA) eligible passengers. They don’t it to<br />

become a service of convenience and the systems are scaling back to reflect<br />

more appropriate needs of the community. There are certain adjustments<br />

that will need to be made. Service areas being eliminated and will still<br />

receive services, but the types of services will be different.<br />

MOTION (WILKINGSON/GOULD): Approve as recommended.<br />

PROGRESS REPORTS:<br />

Progress Report No. 1: First <strong>Transit</strong> Operations Report – Don Kilner,<br />

First <strong>Transit</strong> General Manager. No action is required.<br />

Mr. Kilner reviewed the “First <strong>Transit</strong> Operations Report”, covering the<br />

following topics: safety/injury reports to date; maintenance activities;<br />

staffing (no new hires/fires); night time performance, and the positive<br />

results of adding a third bus on the Yellow Route. He added that they are<br />

still working on route revisions and suggested schedule changes.<br />

No legal action was taken on Progress No. 1.<br />

Progress Report No. 2: <strong>Transit</strong> Director Report & <strong>Transit</strong> Ridership<br />

Report – John Andoh, YCIPTA <strong>Transit</strong> Director. No action is required.<br />

Mr. Andoh summarized the report as follows: 1) Telephone interviews<br />

have been conducted for Contract Administrator. Out of twenty-five (25)<br />

applicants, staff has narrowed it down to four individuals, and then the final<br />

two candidates will be recommended to the <strong>Transit</strong> Director for selection.<br />

2) The first transit Intergovernmental Agreement has been executed with<br />

YMPO. 3) Greyhound Lines has approved YCIPTA’s request for buses to stop<br />

at the <strong>Yuma</strong> Palms Regional Center. The request for YCIPTA partnership<br />

with Greyhound will be presented to the YMPO Executive Board and if<br />

approved, will take effect November 15, 2011. A partnership has been<br />

formed with Jack in the Box (fast food chain) for service for three of five<br />

Greyhound stops. 4) Staff has completed student/faculty surveys at Arizona<br />

Western College and Northern Arizona University on the possibility of an<br />

unlimited fee for rids on YCAT fixed routes if services are improved.<br />

Responses indicated support from students and faculty at 78% for AWC and<br />

64% for NAU. Staff will be at AWC on Tuesday (10-25) to present proposed<br />

route changes and fee schedules. 5) Staff is working with several social<br />

services agencies regarding fees and the provision of unlimited rides for<br />

students and faculty. 6) Staff is working on the provision of benefits for<br />

YCIPTA employees as per the <strong>County</strong> Attorney’s determination for the<br />

provision of same. 7) Title VI documents have been finalized and submitted<br />

to the FTA for review and approval. Once it has been approved, it will be<br />

valid for three years. 8) Draft documents have been submitted to the<br />

Federal <strong>Transit</strong> Administration (FTA) for review. Staff has asked for a<br />

meeting with FTA to review documents and discuss grant status while they<br />

are in San Francisco next week for a workshop. 9) Staff is working on the<br />

National <strong>Transit</strong> Database (NTD) document which is due to the FTA on<br />

October 31, 2011. They are waiting on additional information from YMPO.<br />

10) Staff is working with member agencies on a master IGA. The goal is to<br />

consolidate all comments into a final document that will also include the<br />

Cocopah Tribe and NAU.<br />

No legal action was taken on Progress Report No. 2.<br />

Progress Report No. 3: Financial Report – John Andoh, YCIPTA<br />

<strong>Transit</strong> Director. No action is required.<br />

Mr. Andoh presented the financial report, noting that legal expenses are<br />

coming in high at 31% of the budget, adding that legal services are needed<br />

to review Intergovernmental Agreements and Memorandums of<br />

Understanding. Mr. Wilkinson suggested holding off on legal review until the<br />

City of <strong>Yuma</strong> reviews it. Hopefully that will cut down on some of the costs.<br />

In addition, Mr. Andoh stated that federal funds are being reimbursed<br />

through the Extended Care Health Option (ECHO) Program and have used<br />

2% of the operating budgeting.<br />

Don Kilner introduced George Ibarra, driver for Dial-A-Ride since 2001,<br />

as the employee of the month. The Authority thanked Mr. Ibarra for<br />

his service and presented him with a certificate of appreciation. Mr.<br />

Ibarra thanked the authority for this honor, stating he loves his job.<br />

No. 2: Authorize the <strong>Transit</strong> Director to execute a Memorandum<br />

of Understanding (MOU) with Aztec High School, <strong>Yuma</strong> Private<br />

Industry Council and SMILE.<br />

Mr. Andoh reviewed the MOUs for each of the three (3) entities, noting<br />

that termination clauses have been added.<br />

Mr. Pickels reported none of these MOUs are funded from the <strong>Yuma</strong><br />

<strong>County</strong> General Fund.<br />

Discussion ensued regarding the three-year notification of termination,<br />

and the advisability of a future language amendment for a shorter<br />

termination clause.<br />

MOTION: (WILKINSON/LEE): Approve Item No. 2.<br />

VOICE VOTE: The motion carried 5-0, with members Gould, Velez and<br />

Mayle being excused.<br />

No. 3: Adopt the City of <strong>Yuma</strong>’s Benefits Package through the<br />

<strong>Yuma</strong> <strong>Area</strong> Benefits Consortium and Authorize <strong>Transit</strong> Director<br />

to <strong>Transit</strong>ion Benefits Plan for Employees.<br />

Mr. Andoh presented the proposed benefits package as an adjunct to<br />

the City of <strong>Yuma</strong>’s employee benefits plan. All costs would be<br />

reimbursed to the city, which would in turn be paid to the third party<br />

administrator. The consortium board of directors is schedule to<br />

approve this on January 18, 2011, and it would be effective February<br />

1, 2012.<br />

Discussion ensued regarding the purpose of the proposed “employee<br />

plan benefit statement” and the “Summary Benefit” page. By<br />

service options; funding commitment, if any, from the tribal council,<br />

and whether to delay action until the tribal council has first taken<br />

reviewed remediation efforts to correct the previously inadequately<br />

maintained fleet, noting that procedures and training have been<br />

implemented with the result that the fleet is now properly maintained<br />

and operating safely.<br />

Discussion ensued regarding projected useful life of the fleet; the<br />

impact of previous inadequate maintenance upon the useful life<br />

expectancy of the fleet, and monitoring efforts for same for life<br />

Background and Summary: The Transportation Authority is presently using <strong>Yuma</strong> <strong>County</strong><br />

and <strong>Yuma</strong> Metropolitan Planning Organization (YMPO) as a conduit for passing through<br />

funds to Greyhound Lines, Inc based on funds collected through ticket sales and package<br />

express shipments. The Transportation Authority’s revenues and expenditures are managed<br />

by YMPO in conjunction with <strong>Yuma</strong> <strong>County</strong> and Transportation Authority staff.<br />

Presently, due to the sales volume of the <strong>Yuma</strong> location, Greyhound has requested the<br />

Transportation Authority to remit funds weekly. This request is cumbersome as once the<br />

reports are submitted by staff to YMPO, YMPO does a Treasurer’s Receipt to <strong>Yuma</strong> <strong>County</strong>.<br />

<strong>Yuma</strong> <strong>County</strong> in turns reviews the report and then transmits the revenues back to YMPO.<br />

YMPO in turn mails a check to Greyhound Lines, Inc. This process takes approximately four<br />

weeks, which makes the Transportation Authority three weeks late in remitting funds each<br />

week.<br />

Based on a request by Greyhound Lines, Inc for the Transportation Authority to remit funds<br />

more timely and a suggestion by <strong>Yuma</strong> <strong>County</strong> Financial Services Department, staff would<br />

like to create a separate bank account for the deposit and withdrawal of funds that solely<br />

would be transmitted to Greyhound Lines, Inc. The separation of these funds from the<br />

Transportation Authority funds will allow staff to manage Greyhound funds more efficiently.<br />

Staff intends to use the same bank as <strong>Yuma</strong> <strong>County</strong>, which is Chase and open an interest<br />

bearing checking account that is available to non-profit organizations and public agencies.<br />

Background and Summary: <strong>Yuma</strong> Metropolitan Planning Organization (YMPO) procured a<br />

smart card system from Acumen <strong>Transit</strong> in 2009 for the purposes of implementing an<br />

electronic fare collection system. The system was established based on the previous fare<br />

structure when the transit system was under contract to <strong>Yuma</strong> <strong>Transit</strong>, LLC. The system’s<br />

business rules have never correlated properly with the fare structure of the transit system<br />

and as a result, the AcuFare Smart Card system was used on a limited basis.<br />

In order to get the full value, including the implementation of a 31-Day Pass, 10-Ride Pass,<br />

Day Pass and e-cash system, the business rules require updating to match the current<br />

adopted fare structure that took effect on January 9, 2012. Once the system is fully<br />

functional, staff would be able to track passenger usage more effectively, develop reports<br />

and understand passenger trip habits. In addition, it is the intent of the Transportation<br />

Authority to have Aztec High School, Cocopah Tribe, Arizona Western College, Northern<br />

Arizona University and <strong>Yuma</strong> Private Industry Council to transition their identification cards to<br />

the smart card so that they can be used on the transit system and function as an<br />

identification card for the entities purposes. It is anticipated that this transition will be<br />

completed by September 2012 once the AcuFare system is fully functioning and additional<br />

smart cards have been ordered.<br />

Financial Impacts: The cost to modify the business rules, reprogram the equipment and train<br />

staff to use the system is $43,950. This project will be amended in to the present Surface<br />

Transportation Program (STP) grant that is in place for transit capital projects later this fiscal<br />

Winter 2011-2012 YCAT Business Rule changes to AcuFare System<br />

This document describes the tasks to be performed by Acumen Building Enterprise, Inc.<br />

(Acumen) to implement changes to the AcuFare System (System) currently in use by<br />

the <strong>Yuma</strong> <strong>County</strong> Intergovernmental Public Transportation Authority (YCIPTA). YCIPTA<br />

has requested changes to the business rules as implemented in the original system as<br />

delivered to Arizona Bus Sales.<br />

Changes to the System business rules are based the YCIPTA document entitled ‘<strong>Yuma</strong><br />

<strong>County</strong> <strong>Area</strong> <strong>Transit</strong> Proposed Fare and Service Changes Effective Winter 2011-2012’.<br />

AcuFare 200 Device Firmware Modifications<br />

1. Addition/Removal of Routes<br />

Acumen will modify the AcuFare 200 firmware to accommodate the addition of<br />

the Violet, Gold and Silver routes. The firmware will be modified to exclude the<br />

Blue and Grey routes and invalidate the Blue and Grey Route Configuration<br />

Cards. The route names will be amended to add the numeric suffixes as<br />

described in the document.<br />

2. Express Route<br />

Acumen will modify the AcuFare 200 firmware to accommodate the addition of an<br />

Express route will be implemented. An AcuFare 200 will be configured to<br />

Express operation by the presentation of an Express Route Configuration Card.<br />

3. Transfer Policy Revision<br />

The current transfer policy will be completely removed from the Business Rules<br />

embedded in the AcuFare 200 firmware and replaced by the Pass Products<br />

functionality to be added.<br />

4. Addition of Pass Products<br />

Acumen will modify the AcuFare 200 firmware to accommodate the addition of<br />

Pass Products including a Day CATPass, a 10-Ride CATPass and a 31-Day<br />

CATPass.<br />

a) The Day CATPass will allow for unlimited boarding of YCAT busses on the<br />

day of first presentation. There will be a separately configurable passback<br />

time interval placed in the fare table to allow YCAT to configure the time<br />

interval between valid presentations of this fare product. There will be a non-<br />

Express and an Express version of this fare product.<br />

b) The 10-Ride CATPass will allow for the use of 10 boardings. There will be a<br />

separately configurable passback time interval placed in the fare table to<br />

allow YCAT to configure the time interval between valid presentations of this<br />

fare product, although it is unlikely that a passback time will be used since<br />

each presentation will result in the consumption of a ride, unlike a time based<br />

pass product. There will be a non-Express and an Express version of this fare<br />

product.<br />

c) The 31-Day CATPass will allow for unlimited boarding of YCAT busses for a<br />

period of 31 calendar days from the day of first presentation, inclusive. There<br />

will be a separately configurable passback time interval placed in the fare<br />

table to allow YCAT to configure the time interval between valid presentations<br />

of this fare product. There will be a non-Express and an Express version of<br />

this fare product.<br />

d) The Class Pass will allow for the boarding of an individual YCAT bus by up to<br />

5 adults and 40 students. The determination of student and adult will need to<br />

be made by the driver to assure conformance to this Business Rule. The<br />

intended operation is for the card to be tagged consecutively up to 45 times<br />

(once per student or adult) before a message appears indicating that the rider<br />

capacity has been reached and that the pass will not be valid again until the<br />

passback time period has elapsed. The card will then be available for<br />

presentation within the same calendar day for re-use without removing an<br />

additional Class Pass. Upon first presentation on a subsequent calendar day,<br />

a Class Pass will be decremented from the card. There will be a separately<br />

configurable passback time interval placed in the fare table to allow YCAT to<br />

configure the time interval between valid presentations of this fare product.<br />

5. Rider Class Removal Products<br />

Acumen will modify the AcuFare 200 firmware to accommodate the removal of<br />

the following Rider Classes:<br />

a) The Cocopah Tribe Member rider class will remain, but all Business Rules<br />

associated with the Cocopah Tribe Member rider class will be removed.<br />

b) The College Student rider class will remain, but all Business Rules associated<br />

with the College Student rider class will be removed<br />

c) The K-12 Student rider class will remain, but all Business Rules associated<br />

with the K-12 Student rider class will be removed.<br />

6. Items not directly specified in the ‘<strong>Yuma</strong> <strong>County</strong> <strong>Area</strong> <strong>Transit</strong> Proposed Fare and<br />

Service Changes Effective Winter 2011-2012’<br />

a) Vending of passes on board – The AcuFare 200 and AcuFare 200 Fare<br />

Selector firmware will be modified in a manner to allow the YCAT driver to<br />

select the type of pass product to be purchased by a passenger and the next<br />

card presented to the AcuFare 200 will write the pass product to the next valid<br />

YCAT smart card presented. There is still some detail to be determined, but<br />

this is the requested functionality based upon our current understanding.<br />

Note: Acumen is not responsible for the remuneration or funds collected for<br />

fare products sold on vehicles.<br />

AcuFare 200 Frontend Application<br />

a) All rider classes can add trips. Currently, only student rider classes are<br />

allowed to add trips.<br />

execute a Memorandum of Understanding (MOU) with Cocopah Tribe for Funding of <strong>Transit</strong><br />

Services.<br />

Background and Summary: Since 2006, the Cocopah Tribe has applied for and been<br />

successful in receiving grant funds through the Federal <strong>Transit</strong> Administration (FTA) Section<br />

5311 (c) Tribal <strong>Transit</strong> Funding Program. The amounts received in the past are listed below:<br />

These funds have been used to fund the Purple Route which presently operates between the<br />

North Cocopah Reservation and Cocopah RV Resort to West Cocopah Reservation via<br />

western <strong>Yuma</strong>, Walmart on Avenue B, Cocopah Casino and the City of Somerton. When the<br />

route was created in 2007, it used the FTA Section 5311 (C) funding to cover its operating<br />

costs as this funding source does not require a local match component. Historically, YMPO<br />

invoiced the Cocopah Tribe the fully allocated operating costs paid to the transit contractor<br />

for the costs associated with the Purple Route (year 1 – Grey Route was funded).<br />

The Purple Route operated Monday through Saturday previously from 6:00 am to 9:00 pm<br />

until service reductions occurred in October 2010 which reduced the service span to 6:00<br />

pm. The route operates every 2 hours with one bus.<br />

In July 2011, the Federal <strong>Transit</strong> Administration (FTA) issued a solicitation notice for Tribal<br />

<strong>Transit</strong> Funding for FY 2011. A total of $15,075,000 was available for allocation nationwide<br />

to Indian Tribes. The application was due on September 26, 2011. The Cocopah Tribe had<br />

a change in staff during this period and as a result, while an application was filed for FY 2011<br />

for funding, it was filed in TEAM as compared to www.grants.gov as the instructions in the<br />

solicitation stated. As a result, the application for funding in the amount of $237,000 did not<br />

get processed by FTA. Staff became aware of the situation in December when the FTA<br />

issued the notice of intent to award funding for the Tribal <strong>Transit</strong> Program.<br />

The Cocopah Tribal Council met on January 16, 2012 and January 17, 2012 to discuss the<br />

situation and continued funding of the Transportation Authority services through June 30,<br />

2012. The Tribal Council believed that keeping the status quo was important for their<br />

membership and voted to implement Option #2 which was:<br />

With the service restructuring – The Transportation Authority would use its<br />

excess FTA Section 5307 funding that would be carried over to FY 2012-2013 to<br />

cover 50% of the operating expenses of the Purple Route and the Cocopah Tribe<br />

contributes the local match of 50% from its General Fund.<br />

This matter was discussed at the last Transportation Authority Board of Directors in<br />

December and the Board of Directors voted to continue this matter to the January 2012<br />

meeting or hold a special meeting based on the actions of the Cocopah Tribal Council. At<br />

that time, it was since determined by the FTA that there was sufficient balance to continue<br />

transit services using the FTA Section 5311 (c) until Saturday, January 21, 2012 and that the<br />

local match provided by Cocopah Tribe would begin on Monday, January 23, 2012.<br />

Based on the new funding from the Cocopah Tribe, the exisiting Memoradum of<br />

Understandings between YMPO and Cocopah Tribe would be terminated upon receipt of<br />

payment for the Purple Route expenses through January 20, 2012 and today’s Board of<br />

Directors’s action authorize the Transportation Authority to enter into a MOU with the<br />

Cocopah Tribe. This authority has been granted by the YMPO Executive Board at its<br />

December 1, 2012 meeting to allow the Transportation Authority to enter into financial<br />

arrangements with other parties.<br />

Financial Impacts: From the <strong>Yuma</strong> Urbanized <strong>Area</strong> – there is $251,348 remaining in Section<br />

5307 funds to be carried over to FY 2012-2013 that requires a match. Should the Board of<br />

Directors approve and the Cocopah Tribe provides the match revenue, this funding could be<br />

used to cover the deficit for FY 2011-2012.<br />

The cost for implementing option 2 is $52,466, which would come from the Cocopah Tribe<br />

General Fund and FTA Section 5307 would cover the balance, net any fares collected from<br />

non-tribal members. The Transportation Authority will assume the balance of the deficit,<br />

which is anticipated to be $52,466 net any fares collected.<br />

2012, the balance available for FY 2012-2013 in Federal Funding will be reduced to<br />

$198,882.<br />

to combine the MOU with the Intergovernmental Agreement or add termination date for the<br />

COUNTY INTERGOVERNMENTAL PUBLIC TRANSPORTATION AUTHORITY FOR THE<br />

PROVISION OF TRANSPORTATION FUNDING<br />

This MEMORANDUM OF UNDERSTANDING (MOU) is entered into this ________ day of<br />

___________, 2012, by and between YUMA COUNTY INTERGOVERNMENTAL PUBLIC<br />

TRANSPORTATION AUTHORITY (YCIPTA), a political subdivision of the State of Arizona, whose business<br />

address is 2715 East 14 th Street, <strong>Yuma</strong>, AZ 85365 and COCOPAH INDIAN TRIBE (COCOPAH), whose<br />

business address is 14515 S Veterans Drive, Somerton, AZ 85350-7001, to set forth the following:<br />

That YCIPTA is the administrator of the public transit service in <strong>Yuma</strong> <strong>County</strong> on behalf of the <strong>Yuma</strong><br />

Metropolitan Planning Organization (YMPO), which is known to the general public as <strong>Yuma</strong> <strong>County</strong> <strong>Area</strong><br />

<strong>Transit</strong> (YCAT) and provides public transit services within and between the Cities of <strong>Yuma</strong>, San Luis,<br />

Somerton, Arizona, the Cocopah Tribal Reservations lands, unincorporated <strong>Yuma</strong> <strong>County</strong> areas, and the Town<br />

of Wellton, Arizona;<br />

That the MOU will be effective from January 23, 2012 and continue in full force until June 30, 2012 or<br />

terminated by either party with sixty (60) days in advance notification to each other to the addresses listed<br />

above;<br />

That the YCIPTA will provide, through contracted transit operator, public transit routes that serves<br />

Cocopah Tribal Reservations lands in Exhibit A:<br />

That the YCIPTA will provide, through contracted transit operator, public transit route(s) that serves<br />

Cocopah Tribe Reservations with connections to the Cities of <strong>Yuma</strong>, San Luis, Somerton, Arizona,<br />

unincorporated <strong>Yuma</strong> <strong>County</strong> areas, and the Town of Wellton, Arizona, Monday through Saturday routes<br />

identified in Exhibit A;<br />

That YCAT operating hours shall be from approximately 6:30 a.m. to 7:30 p.m. daily, Monday through<br />

Friday, approximately 9:30 a.m. to 5:30 p.m., Saturday. YCAT transit services does not operate on the<br />

following holidays: New Years Day, Dr. Martin Luther King Jr. Day, Presidents Day, Memorial Day,<br />

Independence Day, Labor Day, Veterans Day, Thanksgiving Day, and Christmas Day;<br />

That COCOPAH will contribute to YCIPTA, funding, on a monthly basis based on the following<br />

formula defined in Exhibit A. COCOPAH shall pay invoice within a 30-day period after receipt of an invoice<br />

from YCIPTA;<br />

That the initial formula for determining the contribution by COCOPAH to YCIPTA is defined in Exhibit<br />

That annually during the budgeting process, COCOPAH and YCIPTA shall meet to determine if an<br />

increase in the contribution is necessary. Any contribution increase shall be approved by COCOPAH and take<br />

effect after the start of the fiscal year beginning on July 1;<br />

That all tribal members of COCOPAH shall ride all YCAT routes at no charge, unrestricted by showing<br />

an official COCOPAH Tribe ID card. Tribal members that fail to show an official COCOPAH Tribe ID card<br />

shall pay regular YCAT fares. All companions traveling with COCOPAH Tribe members shall pay regular<br />

YCAT fares if not a COCOPAH Tribe member with COCOPAH Tribe ID card. The contributed funding from<br />

COCOPAH to YCIPTA does not include free access to Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride and all COCOPAH<br />

Tribe members shall pay regular fares for that service. COCOPAH shall advise YCIPTA 30 day prior to the<br />

change of the identity and color of the COCOPAH Tribe ID card;<br />

That each party shall indemnify and hold harmless the other party, against any and all claims arising<br />

from bodily injury, including death or property damages, to any person or persons caused in whole or in part by<br />

the negligence or misconduct of the other party;<br />

That to the extent applicable under Arizona Revised Statutes §41-4401, YCIPTA warrants compliance<br />

with all Federal immigration laws and regulations that relate to their employees and compliance with the e-<br />

Verify requirements under A.R.S. §23-214(A). YCIPTA’s breach of the above-mentioned warranty shall be<br />

deemed a material breach of this MOU and will result in immediate termination;<br />

That this MOU contains the entire MOU between COCOPAH and YCIPTA and no term or provision<br />

may be changed, waived, discharged or terminated unless the same is in writing executed by both COCOPAH<br />

and YCIPTA;<br />

That YCIPTA acknowledges that this MOU is subject to cancellation pursuant to A.R.S. §38-511;<br />

That in the event suit is brought or an attorney is retained by any party to this MOU to seek<br />

interpretation or construction of any term or provision of this MOU, to enforce the terms of this Agreement, to<br />

collect any money due, or to obtain any money damages or equitable relief for breach, or to seek recourse in a<br />

bankruptcy proceeding, the prevailing party shall be entitled to recover, in addition to any other available<br />

remedy, reimbursement for reasonable attorneys' fees including attorney’s fees for representation in the<br />

bankruptcy court, court costs, costs of investigation, and other related expenses;<br />

That this MOU shall be binding upon and inure to the benefit of the parties hereto and their respective<br />

heirs, successors and assigns;<br />

That this MOU may be executed in counterparts, each of which shall be deemed an original, but all of<br />

which shall constitute one and the same instrument;<br />

That this MOU contains the entire agreement between the parties on the subject matter set forth herein.<br />

All prior and contemporaneous agreements, representations, and understandings, written or oral, are superseded<br />

by and merged into this MOU. No promises or assurances have been made which is not part of this MOU. Any<br />

previous agreements, whether written or oral, entered into between the parties are null and void unless<br />

specifically incorporated herein. No supplement, modification, or amendment of this MOU shall be binding<br />

unless in writing and executed by the parties hereto;<br />

That the parties agree this MOU shall be construed in accordance with the laws of the State of Arizona,<br />

and any controversy, dispute or litigation shall be brought or commenced only in the Superior Court of <strong>Yuma</strong><br />

COCOPAH shall contribute $41,196 for fiscal year 2011-2012 ending June 30, 2012 as a local contribution<br />

towards the operation of the <strong>Yuma</strong> <strong>County</strong> <strong>Area</strong> <strong>Transit</strong> (YCAT) system, which includes free transportation<br />

unrestricted on all YCAT fixed routes for tribal members only and the operational costs of the Grey Route or<br />

Violet Route 7 as defined in this Exhibit.<br />

COCOPAH shall contribute to the fully allocated operating costs of Purple Route or Purple Route 6 as defined<br />

below for fiscal year 2011-2012:<br />

• Purple Route - From October 1, 2010 to January 20, 2012: 10.97 operating hours times $67.49 per<br />

revenue vehicle hour times the number of operating days for that particular month in service. This<br />

amount shall not exceed $242,860, the amount of the Federal <strong>Transit</strong> Administration (FTA) Section<br />

5311 (c) grant received by COCOPAH in Federal Fiscal Year 2010.<br />

• Purple Route 6 - From January 23, 2012 to June 30, 2012: 10.92 weekday operating hours times<br />

$67.49 per revenue hour times the number of weekday operating days plus 6.88 Saturday operating<br />

hours times $67.49 per revenue hour times the number of Saturday operating days for that particular<br />

month in service. This amount shall not exceed $104,932. YCIPTA shall provide FTA Section 5307<br />

funding in the amount of $52,466 towards the operational costs of this route. COCOPAH shall pay<br />

$52,466 through a non-Federal funding source to match YCIPTA’s FTA Section 5307 grant.<br />

For the purposes of this Exhibit and MOU, a revenue vehicle hour is defined as the times during which the<br />

vehicle is available to carry passengers, and which includes only those times between the time or scheduled<br />

time of the first passenger pick-up and the time or scheduled time of the last passenger drop-off during a period<br />

of the vehicle’s continuous availability.<br />

This exhibit may be amended each fiscal year as agreed upon by COCOPAH and YCIPTA to reflect the<br />

new operational costs for the operation of transit services to COCOPAH.<br />

Background and Summary: The Transportation Authority bylaws adopted in 2011 states that<br />

each calendar year, the Board shall formally elect a Chairperson and Vice Chairperson. The<br />

last election was held in January 2011, which designated Robert Pickels, Chairman and Greg<br />

Wilkinson, Vice Chairman.<br />

The process for conducting the elections shall consist of nominations and a motion made to<br />

elect a Chairperson and Vice Chairperson.<br />

Study for meeting requirements of Arizona Revised Statues 28-9123 and Federal <strong>Transit</strong><br />

Administration purposes.<br />

Background and Summary: The <strong>Yuma</strong> Regional <strong>Transit</strong> Study identifies transit needs within<br />

southwestern <strong>Yuma</strong> <strong>County</strong> and presents recommended transit system improvements based<br />

on three funding scenarios. This study examined current and projected population,<br />

demographics, and employment for the region, conducted extensive public outreach and<br />

data collection, identified transit deficiencies and developed recommended transit<br />

improvements based on the identified deficiencies. Recommendations have been developed<br />

assuming current funding levels, a 1/10 cent county-wide sales tax and a 1/5 cent countywide<br />

sales tax. A corresponding 5-year financial plan accompanies the recommendations.<br />

The study area comprises the southwestern region of <strong>Yuma</strong> <strong>County</strong>. Located in the<br />

southwestern region of the State of Arizona along the Mexico border, <strong>Yuma</strong> <strong>County</strong> covers<br />

5,522 square miles and includes the Town of Wellton, the Cities of <strong>Yuma</strong>, Somerton, and<br />

San Luis, parts of the Cocopah and Fort <strong>Yuma</strong> Indian Reservations located in the State of<br />

Arizona, and several unincorporated communities, referred to as Census Designated Places<br />

(CDP). According to the 2010 U.S. Census and to <strong>Yuma</strong> <strong>County</strong>’s General Plan, several<br />

CDPs have experienced both commercial and residential developments over the past years.<br />

This study specifically focuses on areas with more than 500 residents.<br />

As required by Arizona Revised Statutes 28-9123 – A. The board shall conduct a periodic<br />

survey of public transportation needs in the authority and determine an appropriate public<br />

transportation system to meet those needs and the means to finance the system. The board<br />

shall consider whether to operate the system directly or to contract with outside parties for<br />

the operation of all or part of the system.<br />

B. Each year the board shall produce a five year public transportation program that is<br />

consistent with the regional transportation plan approved by the regional council of<br />

governments. The five year program shall:<br />

1. Contain public transportation projects financed with monies from federal, state and<br />

local funding.<br />

2. Contain a description of each project, including a schedule of expenditures and a<br />

source of funding for each project.<br />

3. Identify the entity that is responsible for implementing each project or phase of the<br />

public transportation program.<br />

4. Define and identify regional public transportation corridors.<br />

5. Define the public transportation problems, goals and needs for each corridor and<br />

policies and priorities for meeting those goals and needs.<br />

6. Determine a mix of public transportation modes appropriate for development in light<br />

of the public transportation goals and needs for each corridor.<br />

7. Locate routes and access points to the public transportation systems.<br />

8. Determine the ridership capacity and use of public transportation systems.<br />

C. The five year public transportation program shall include, in addition to the appropriate<br />

items prescribed in subsection B of this section, the following items presented on an<br />

individual fiscal year basis:<br />

1. The capital and operating costs of the public transportation system.<br />

2. The revenue needed by source, according to section 28-9142, to fund the public<br />

transportation system.<br />

Staff has done an analysis of <strong>Yuma</strong> Metropolitan Planning Organization (YMPO) Regional<br />

Transportation Plan – <strong>Transit</strong> Element Pages 88-108 to determine consistency and staff<br />

believes that the <strong>Yuma</strong> Regional <strong>Transit</strong> Study is consistent with YMPO’s RTP. Staff will<br />

submit the <strong>Yuma</strong> Regional <strong>Transit</strong> Study to YMPO for an official letter stating its concurrence<br />

with the RTP.<br />

In addition, several of the recommendations identified in the <strong>Yuma</strong> Regional <strong>Transit</strong> Study<br />

have been implemented as of January 9, 2012 based on separate actions by the Board of<br />

Directors. Since the study has a five year focus, staff intends to review the study periodically<br />

to determine other implementation measures that can be done based on available funding<br />

and demands for service.<br />

Requested Action: Staff recommends that the <strong>Yuma</strong> <strong>County</strong> Intergovernmental Public<br />

Transportation Authority (YCIPTA) Board of Directors provide direction regarding Greater<br />

<strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride services.<br />

Background and Summary: Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride has been in operation since<br />

1999 and was the first public transit system in <strong>Yuma</strong> <strong>County</strong>. This service has evolved over<br />

the years, from transporting all passengers, including general fare passengers, to solely<br />

seniors and persons with disabilities in 2002 to today, providing complementary paratransit<br />

service for those that meet the definitions of the Americans with Disabilities Act (ADA). This<br />

change was made in response to the available budget for the dial-a-ride program which is<br />

9,500 revenue vehicle service hours and the continuing increase in the subsidy per<br />

passenger as the passenger per hour rate declined.<br />

In order for a passenger to meet the eligibility requirements for DAR, a passenger must meet<br />

the following criteria as defined ADA:<br />

1. Individual, because of their disability, cannot independently board, ride, and/or<br />

disembark from any bus in the <strong>Yuma</strong> <strong>County</strong> <strong>Area</strong> <strong>Transit</strong> (YCAT) fixed route<br />

system.<br />

2. Individual has a disability related condition that prevents using YCAT because the<br />

YCAT route is not yet 100% accessible.<br />

3. Individual has a disability related condition that prevents getting to or from an<br />

YCAT bus stop.<br />

Certifications are done by the <strong>Transit</strong> Director as he has been through ADA certification<br />

training by the National <strong>Transit</strong> Institute (NTI) and Easter Seals. At this time, verifications on<br />

a person’s disability are provided by medical and social service professionals.<br />

Eligibility requests can be temporary or permanent depending on the ability of the passenger.<br />

The eligibility can also be conditional, which means the passenger would only ride when<br />

conditions prevent the boarding of an YCAT bus or accessing an YCAT bus stop.<br />

If a potential client has been denied eligibility, there is an appeals process, which the<br />

applicant can request for a redetermination on the eligibility. A committee of three will review<br />

the eligibility and make a determination if the eligibility determination by the <strong>Transit</strong> Director<br />

stands or if an alternative eligibility determination is needed.<br />

In addition, based on an existing memorandum of understanding between <strong>Yuma</strong> Metropolitan<br />

Planning Organization (YMPO) and Western Arizona Council of Governments (WACOG), as<br />

long as passengers are within the service area of DAR, the following passengers are able to<br />

ride by meeting the following criteria:<br />

1. Seniors age 60 years and older and persons with disabilities, Monday through Friday<br />

For the following trip purposes based on their requirement from WACOG<br />

a. Senior nutrition<br />

b. Dialysis<br />

c. Shopping<br />

d. Pharmacy.<br />

If the WACOG client is not ADA eligible, then the passenger can ride based on available<br />

space only, as ADA clients must take first priority since the ADA does not allow for trip<br />

denials.<br />

A three phased approach was taken to implement changes to DAR to bring the program in<br />

line with the available budget. Highlights of the changes made are listed below:<br />

1. On November 7, 2011, a reduction of service area by eliminating <strong>Yuma</strong> Proving<br />

Grounds, Tacna, Dateland and Wellton, requalification of the fare policy,<br />

reservation hours and prioritization of DAR clients based on four eligibility criteria’s<br />

– ADA, ADA/WACOG, DAR and DAR/WACOG. Recertification applications were<br />

due on November 20, 2011 and if the passenger did not recertify, their service was<br />

suspended until recertification has been completed. Passengers were also notified<br />

that only those that have ADA eligibility will receive priority on DAR rides, those<br />

that are not ADA eligible would be served on a space available basis. The DAR<br />

peak fleet was also reduced from 8 vehicles to 4 vehicles or 33 hours on weekdays<br />

and 16 hours on Saturday.<br />

2. On January 9, 2012, a further reduction of the service area occurred by eliminating<br />

zones and going towards a complementary paratransit system that complements<br />

YCAT. Service area is only available within a ¾ mile radius of YCAT routes in<br />

operation at the time of pick up or drop off time. As YCAT routes go out of service<br />

for the day in a particular area of the service area, so does DAR. Staff no longer<br />

certifies those that are senior or have a non-ADA eligible disability. Letters have<br />

been sent to all existing eligible senior and those that have a non-ADA eligible<br />

disability advising that on February 1, 2012, if they do not certify for ADA<br />

paratransit, their services will be discontinued. The DAR hours were further<br />

reduced to 26 hours on weekdays and 12 hours on Saturday.<br />

3. On February 1, 2012, all existing eligible senior and those that have a non-ADA<br />

eligible disability will be eliminated from the DAR program. Only those that meet<br />

the ADA eligibility criteria or approved through WACOG would be able to ride DAR.<br />

In the past there was over 1,500 different people eligible for DAR service (list dated back to<br />

1999 and was not updated). Based on the recertification, there are a total of 216 passengers<br />

as defined below:<br />

While passengers that do not live in the service area can still be determined eligible for<br />

services, based on the reduction of service area to the ¾ mile radius of YCAT fixed routes,<br />

passengers would need to be delivered to the beginning of the service area before they can<br />

be served by DAR.<br />

The service area reduction has in effect eliminated many former passengers that live in the<br />

Fortuna Foothills, south of 32 nd Street in the southern <strong>Yuma</strong> foothills and some passengers<br />

in northern Somerton. This has caused many complaints from the “snowbirds” that live in the<br />

Fortuna Foothills area.<br />

Three passengers did make contact with the Board Chairman or Vice Chairman and<br />

contacted the newspaper regarding eligibility on dial-a-ride. One passenger does not meet<br />

the ADA eligibility requirements and the two passengers do not live within the service area,<br />

but is eligible for DAR service based on the ADA requirements.<br />

While the changes to the DAR program has caused some hardship to riders that were used<br />

to the specialized services traveling countywide, there has been significant performance<br />

increases to the dial-a-ride program. The cost per passenger has trending downward and<br />

the passenger per hour is trending upward. The revenue hours has significant reduced<br />

which will allow the DAR program to return back to its original budget of 9,500 revenue<br />

vehicle service hours by June 30, 2012. Had these changes not been made, there could<br />

have been a deficit of approximately $247,000.<br />

Saguaro Foundation in conjunction with assistance from <strong>Yuma</strong> Metropolitan Planning<br />

Organization (YMPO) and Arizona Department of Transportation (ADOT) are working on a<br />

new mobility management program that would basically assume picking up former DAR<br />

passengers that live outside the service area or former DAR passengers that are no longer<br />

ADA eligible. They are using a Federal <strong>Transit</strong> Administration (FTA) Section 5317 funding<br />

source to cover the cost of this service. Saguaro Foundation is developing a fare policy and<br />

service area perimeters for this new service and it is anticipate that they will begin<br />

transporting passengers starting in February. Staff is coordinating a joint press release on<br />

this new service.<br />

Budgeted: Yes – 8808-07-7301-42141 (Contract Costs) for 9,500 revenue vehicle service hours<br />

for the dial-a-ride program. 8,500 revenue vehicle service hours are budgeted for weekdays and<br />

1,000 revenue vehicle service hours are budgeted for Saturday.<br />

Recommended Motion: Staff recommends that the <strong>Yuma</strong> <strong>County</strong> Intergovernmental Public<br />

Transportation Authority (YCIPTA) Board of Directors provide direction regarding Greater<br />

<strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride services to staff.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride is the provider of Americans with Disabilities Act<br />

(ADA) paratransit door-to-door public transportation service within the southwest<br />

area of <strong>Yuma</strong> <strong>County</strong>. Service is provided to residents and visitors who have<br />

qualified through an application process in accordance with the ADA. Greater <strong>Yuma</strong><br />

<strong>Area</strong> Dial-A-Ride may be used for work, medical, appointments, school, meetings,<br />

shopping, recreation, senior services, events and much more. Vehicles are<br />

wheelchair accessible for two wheelchairs. The service is a two-tiered service, which<br />

means other passengers utilize Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride is available to passengers that have been certified<br />

by the Western Arizona Council of Governments (WACOG). The WACOG program<br />

is available to seniors age 60 years old or older and persons with disabilities<br />

traveling for shopping, pharmacy, medical appointments and senior center trips that<br />

are local to their area, Monday through Friday only.<br />

Important things to know about Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride Service:<br />

• Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride is a door to door demand responsive service<br />

and complements the non commuter fixed route service of YCAT buses. This<br />

service is not structured to accommodate your transportation needs in<br />

case of an emergency. If you have an emergency of any nature, call 911.<br />

• Same day scheduling is not a requirement under the ADA.<br />

• Subscription service is not a requirement of the ADA. Subscription service is<br />

a premium service and may be offered at the discretion of YCAT.<br />

• Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride is a shared-ride service. This means that other<br />

passengers may be on board during part of the transit to the passenger’s<br />

destination, and that your scheduled pick up times or routes of travel may be<br />

altered so another passenger can be accommodated.<br />

• In all instances, traveling outside the Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride service<br />

area will require you to transfer to fixed route buses and other ADA<br />

paratransit services operated by other transit providers to complete your trip.<br />

• ADA paratransit services may include feeder service to and from an<br />

accessible bus stop for individuals who are unable to access a fixed route bus<br />

stop only.<br />

• Distance from regular YCAT non commuter fixed route buses route does not<br />

itself make a person eligible for Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride ADA service.<br />

• Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride ADA eligible rides may only be provided<br />

service within an area that is 3/4 of a mile on either side or 3/4 of a mile of the<br />

end of a non-commuter bus route.<br />

• YCAT does not allow a child under the age of nine (9) to ride unaccompanied<br />

on any regular fixed route or demand responsive vehicle. These individuals,<br />

unescorted are not considered a "public transit user".<br />

• YCAT revises regular bus service at least twice a year. Any changes to the<br />

fixed route transit system can result in changes to the ADA paratransit<br />

service.<br />

Western Arizona Council of Governments (WACOG) offers a transportation<br />

or a persons with disabilities for life essential needs such as trips to the<br />

pharmacy, shopping, senior nutrition and medical appointments. This program<br />

operates Monday through Friday only and is available local to your area. No<br />

fare is required; however a $2.00 donation is requested. Reservations for this<br />

service must be made 24 hours in advance between 8 am and 4:30 pm Monday<br />

through Saturday. WACOG certified passengers making any other trips or<br />

making trips on Saturdays must be ADA certified in order to ride and must pay<br />

fare if ADA certified. WACOG certified passengers also must be prepared if<br />

able to ride an YCAT bus instead of a Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride bus if<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride is a door-to-door demand responsive service.<br />

Passengers will not be assisted inside their home or building. Passengers<br />

needing mobility assistance must provide their own Personal Care Attendant<br />

(PCA). Bus operators may only assist passengers to the door of a home,<br />

building or entrance of a facility as long as they are within the line of sight of<br />

their vehicle. Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride vehicles cannot be left<br />

unattended.<br />

ADA passengers are given first priority over all other trips made by other<br />

passengers. ADA eligibility is determined by completing an ADA application<br />

form. Every attempt must be made to accommodate ADA passengers no<br />

matter what the trip purpose is. There are no trip denials for ADA passengers.<br />

Visitors to the <strong>Yuma</strong> <strong>County</strong> area that are ADA-certified by another transit<br />

system may ride Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride for 21 service days. Visitors<br />

requiring service beyond 21 service days must be certified on Greater <strong>Yuma</strong><br />

The boundaries for this service includes the cities of <strong>Yuma</strong>, Somerton, San<br />

Luis, unincorporated area of <strong>Yuma</strong> <strong>County</strong>, including Gadsden, Fortuna<br />

Foothills, west of Telegraph Pass, Cocopah Tribe areas within a ¾ mile radius<br />

of either side of YCAT routes. Service to Wellton and Ligurta is available<br />

through route deviation services on YCAT Gold Route 8. No other areas of<br />

<strong>Yuma</strong> <strong>County</strong> are served. If you live outside the service area and can get to an<br />

area within the YCAT service area, Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride can pick<br />

you up.<br />

YCAT Gold Route 8 provides route deviated services to passengers that live<br />

within the Town of Wellton and within ¾ mile radius between Wellton and <strong>Yuma</strong><br />

Palms Regional Center, including Fortuna Foothills and Ligurta. YCAT Violet<br />

Route 7 and Purple Route 6 (on Saturday only) will also deviate within a ¾ mile<br />

radius of its entire route. For details on when the bus can pick you up, please<br />

consult the YCAT Rider’s Guide. No more than four (4) total deviations per one<br />

way trip, provided that 4 deviations can be made at the discretion of dispatch or<br />

bus operator. ADA passengers have first priority and may bump others.<br />

• Deviations are to be reserved at least 60 minutes in advance up to seven<br />

(7) days in advance.<br />

• The bus will only wait two minutes before proceeding on.<br />

• A passenger may only request up to two (2) deviations, unless<br />

passengers loads are light to warrant more deviations based on the<br />

dispatcher or bus operator discretion, based on one (1) deviation for the<br />

start of the trip and one (1) deviation for the end of the trip.<br />

• Fare is $2.00 on top of the regular route fare.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride can make transfers to:<br />

Bus operators are not able to accept or change reservations. If you need to<br />

make changes to your reservation, please call Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride<br />

reservation. Passengers may change an existing trip during reservation hours<br />

on the day before travel; however, they will be accommodated on a space<br />

available basis.<br />

Passengers that miss their dial-a-ride reservation or need immediate service<br />

may request to be placed on a will call list. If a ride is available, the dispatcher<br />

will contact you 60 minutes prior to picking you up. This service may not be<br />

available often and it is encouraged that passengers find alternative<br />

transportation arrangements.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride may deny any WACOG passengers based on<br />

availability of vehicles since ADA eligible passengers always receive priority.<br />

We apologize if we are not able to provide you with the desired trip. ADA<br />

eligible trips will be provided and may bump non ADA eligible trips to ensure a<br />

zero denial rate for ADA eligible passengers.<br />

Canceling a trip without notice deprives others a trip. Passengers are asked to<br />

cancel as soon as possible, but no later than two hours prior to your trip. You<br />

may cancel anytime during the reservations hours or call after hours to leave a<br />

cancellation message, be sure to leave your name, address and the scheduled<br />

date & time of the trip that you are canceling. If you cancel less than two hours<br />

of your scheduled pick up window, you are a Late Cancellation. Passengers<br />

who receive five (5) late cancels within a 30-day period will be suspended for<br />

seven (7) days. Passengers who make more than five late cancels on a<br />

continuous basis may be suspended from service for up to one year.<br />

If you do not present yourself when the bus arrives (within the two (2) minute<br />

wait time) or if you cancel your trip after the bus has arrived, you are a no-show.<br />

This deprives others a trip and wastes the time of passengers already on the<br />

bus. Passengers who receive three (3) no-shows within a 30-day period will be<br />

suspended for seven (7) days. Passengers who make more than three noshows<br />

on a continuous basis may be suspended from service for up to one<br />

year. A door hangar will be left on the door, if the driver was unable to locate or<br />

identify the passenger.<br />

YCAT offers Mobility Training for passengers who would like to learn how to<br />

ride a fixed route bus. Training includes visiting a bus stop, riding a bus, reading<br />

schedules/materials and identifying bus stop locations. The service is free and<br />

upon successful completion of the program, the passenger will receive 10 Ride<br />

YCATPass for use on YCAT fixed route buses. For more information, please<br />

The bus will wait two (2) minutes maximum upon arrival for a pickup. The bus<br />

operator will attempt to locate you and will notify dispatch. The bus operator will<br />

not search the interior of your home, a business or medical facility. Passengers<br />

must be conspicuously located at the pickup location. Bus operators will make<br />

an effort to ensure that passengers are picked up. This includes knocking on<br />

the door, calling the passengers and using the horn. The wait time will not take<br />

effect before the Be Ready Window. If the bus is late it will wait two (2) minutes<br />

maximum, however, the passenger will not be penalized for a no-show if the<br />

passenger does not show up.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride is a shared ride service, so we remind you; the<br />

passenger is to be ready 30 minutes before or after your scheduled pickup<br />

time. This applies to return trips as well. The bus is considered on time when it<br />

arrives within the “Be Ready” Window. Since YCAT buses operate every 60<br />

minutes, dial-a-ride buses can operate within a 60 minute window.<br />

Since YCAT buses may take 60 minutes or more for a passenger to get from<br />

one location to another, Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride may reserve the right<br />

to extend travel times based on the equivalent trip made on YCAT. Please<br />

expect to be on the bus for 30 minutes or greater as a result.<br />

Passengers that need a mobility device or aid to travel must notify dispatch<br />

when scheduling a trip. Passengers using a wheelchair or scooter will be<br />

secured to their chairs. The wheelchair or scooter must have locking brakes or<br />

motors. Passengers using a scooter may be asked to transfer to a seat on the<br />

bus. All mobility aids must be able to fit within the allocated space, have working<br />

brakes and cannot exceed 600 pounds (total passenger and mobility device or<br />

aid). If the mobility device or aid cannot fit the lift platform, the passenger will<br />

not be able to ride. Mobility devices or aid with leaking batteries or fluids, faulty<br />

brakes, flat or bent wheels will not be allowed to ride. If a concern is expressed<br />

by YCAT, the passenger may be required to be weighed or transfer from the<br />

mobility device to a regular passenger seat by climbing the stairs of the bus.<br />

Passengers that need a mobility device to travel must notify dispatch when<br />

scheduling a trip. Passengers using a wheelchair or scooter will be secured to<br />

their chairs. Passengers using a scooter may be asked to transfer to a seat on<br />

the bus. All mobility devices must be able to fit within the allotted space on the<br />

bus and have working brakes. The allocated space may not exceed the<br />

common wheelchairs size of 30 by 48 inches.<br />

Subscription service refers to regular, repetitive trips. Subscription trips may<br />

take up to 50% of the overall service capacity. Reservations for subscription<br />

service can be made by calling (928) 539-7076 during reservation hours.<br />

Should there not be any space for subscription service; passengers will be<br />

placed on a waiting list. Passengers must notify dispatch of any exception to<br />

their ongoing subscription service. Passengers who repeatedly no show or late<br />

cancel may be subject to suspension of service of up to one year depending on<br />

Some passengers are unable to get around without the help of another person.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride bus operators will assist passengers from their<br />

door to the door of their destination. Bus operators will not assist the passenger<br />

inside a home or building. Bus operators are not permitted to help riders using a<br />

wheelchair up stairs, over curbs or over any other physical barrier. Passengers<br />

who need assistance to get in or out of buildings, up stair, on elevators or other<br />

obstacles must provide their own Personal Care Attendant (PCA). The bus<br />

operator at his/her discretion may determine that a rider requires assistance<br />

beyond what the passenger is able to provide. If this determination is made, all<br />

future trips will require the passenger use the services of a PCA. The PCA ride<br />

free. However, the PCA must travel with the passenger from the start to the end<br />

of the trip.<br />

Companions that ride with an ADA certified or non-ADA passengers must pay<br />

the same fare as the passenger that they are traveling with. Companions are<br />

carried on a space available basis. Passengers must notify the dispatcher when<br />

making a reservation that a companion will be riding along.<br />

All children under the age of five (5) or less than 60 pounds are required by<br />

State law, to travel in a child safety or booster seat provided by the parent or<br />

guardian as. An adult attendant at least 16 years old or older must accompany<br />

all children. Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride does not provide child safety seats.<br />

Passengers are encouraged to wear seatbelts when riding in Greater <strong>Yuma</strong><br />

<strong>Area</strong> Dial-A-Ride vehicles.<br />

Service animals are welcome at all times. Please advise the dispatcher when<br />

making your reservation that you will be bringing a service animal.<br />

Passengers are advised to limit their carry-on bags or packages to five (5).<br />

Each package must be no heavier than 30 pounds. Bus operators may provide<br />

assistance upon request. No large object that cannot be held by the passenger<br />

placed under seat or of the aisle way is allowed on board the bus. Strollers are<br />

permitted inside all Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride vehicles provided that they<br />

do not constitute as a hazard.<br />

Bus operators may not physically assist a passenger without first asking<br />

permission. If a passenger appears to need assistance or guidance into or out<br />

of a vehicle, the bus operator will ask the rider for permission to touch his or her<br />

arm or hand for assistance. Passenger must give active permission before<br />

being touched by a bus operator. If the passenger is not capable of giving the<br />

person permission, a PCA must ride with that passenger.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride has the right to deny service if the transport of<br />

a passenger is deemed unsafe or inappropriate.<br />

Passengers may eat or drink on board, provided that they do not spill or make a<br />

mess inside the bus. No smoking, loud or profane language, loud electronic<br />

devices, flammable or hazardous materials (except oxygen), weapons, refuse,<br />

vandalism, graffiti or littering on the buses. Shoes and shirts must be worn in<br />

order to ride buses. Passengers must observe and follow the YCAT Rules of<br />

the Road while riding Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride. Physical contact with<br />

other passengers or the bus operator is a violation of Arizona Revised Statutes<br />

13-1204 & is not allowed.<br />

Passengers who cannot regularly contain their bodily fluids are asked not to use<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride until they can insure that they contain their<br />

fluids. Passengers who accidentally lose bodily fluids will not have to clean up<br />

1. Service <strong>Area</strong>: Dial-A-Ride service must be provided to all origins and<br />

destinations within a corridor ¾ mile on each side of the fixed route. Service<br />

beyond this area may be provided at YCIPTA’s discretion. YCIPTA must<br />

coordinate where service areas overlap or are contiguous.<br />

Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride meets this requirement.<br />

2. Response Time: Next-day service must be provided for requests made any<br />

time during the preceding day. Requests for service must be taken when<br />

administrative offices are open and must arrange to accept reservations on<br />

days or times when administrative offices are closed if service is provided on<br />

the following day.<br />

Next-day service is provided on Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride for requests made<br />

any time during the preceding day prior to 4:30 pm, Monday through Saturday.<br />

Reservations are taken seven days a week for next-day service and can be made up to<br />

seven days in advance. Reservations will be taken by an answering machine on days<br />

when the administrative/dispatch office is closed.<br />

3. Fares: Fares can be no more than twice the fixed route adult fare.<br />

The ADA fare is $4.00 on Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride and $2.00 on YCAT fixed<br />

routes. An attendant is permitted to accompany an ADA-eligible rider at no charge,<br />

and a companion may ride at the same fare charged the ADA rider only if they have<br />

the same origin and destination as the ADA-eligible rider.<br />

4. Service Days and Hours: Days and hours of operation must be at least the<br />

same as the fixed route system.<br />

Service is operated the same as the YCAT fixed route system. Like the fixed route,<br />

service is offered Monday through Friday 6:30 A.M. to 7:30 P.M.; Saturday from<br />

9:30 A.M. to 6:30 P.M. Service on either the fixed route or Dial-A-Ride is not<br />

provided on major holidays. As fixed route service ends in a particular area, so does<br />

Dial-A-Ride.<br />

5. Trip Purpose: Trips must be accepted and handled on an equal basis. There<br />

can be no restrictions on trip purposes or prioritizing by trip type.<br />

Trips are not prioritized or restricted by trip purpose for ADA riders.<br />

6. Capacity Constraints: Service cannot be limited because of capacity<br />

constraints. No waiting lists can be maintained, and the number of trips<br />

provided to an individual cannot be restricted.<br />

When Dial-A-Ride changed its policy in December to limit the<br />

service to disabled and certified passengers only, ending<br />

eligibility for seniors 60 and over, 90-year-old Jeanne Goodell<br />

turned to her niece for rides to the doctor.<br />

Goodell received a letter notifying her that she had until Jan. 31<br />

to become certified through either the Americans with Disabilities<br />

Act or the Western Arizona Council of Governments to continue<br />

using the service.<br />

But before she could submit her papers to become certified,<br />

Karen Flynn, Goodell's niece, said her aunt broke her leg getting<br />

into Flynn's car for a ride to her doctor. Now she's bed bound.<br />

“How am I going to transport her I can no longer put her in my<br />

car,” Flynn said.<br />

“They gave her a letter for her doctor to sign, confirming she<br />

needs rides to get to the doctor, but she needs a ride to get to the<br />

doctor for him to sign it.”<br />

Flynn said her aunt needs stitches taken out and “we don't have<br />

an option but to wait.” She contacted an ambulance and was told<br />

insurance won't cover it.<br />

“We can't make an appointment with the doctor until we know<br />

(Dial-A-Ride) can transport her. Who knows when that will be”<br />

Flynn said she was told it could take up to three weeks to<br />

process the paperwork. She believe the program director should<br />

expedite special cases, such as her aunt's.<br />

“It's an issue that needs to be addressed. They're putting a<br />

hardship on people. It's inhumane.”<br />

On Friday, Flynn learned her aunt is not eligible for service<br />

because they live a quarter-mile out of the service area. In<br />

November, the board eliminated service to Dateland, Tacna,<br />

Wellton and the <strong>Yuma</strong> Proving Ground, restricted routes to<br />

specific locations and implemented other modifications to the<br />

program.<br />

Nevertheless, transit director John Andoh said a broken leg<br />

would not have made Goodell eligible for the program.<br />

“Just because you're a senior citizen or broke your leg doesn't mean you can use Dial-A-Ride,” Andoh said,<br />

noting, “We are not an emergency service, just regular transportation.”<br />

He also explained that Goodell might be able to use the <strong>Yuma</strong> <strong>County</strong> <strong>Area</strong> <strong>Transit</strong> (YCAT) bus system, which is<br />

handicapped accessible.<br />

“It's wheelchair accessible. It has a lift and a low floor, so there's no stepping up. And now that we have restored<br />

service to all of <strong>Yuma</strong>, it's more accessible.”<br />

Andoh said the changes were necessary due to lack of funding. “We could no longer afford the old system<br />

anymore.”<br />

In the past, any senior citizen was allowed to use the Dial-A-Ride service.<br />

The <strong>Yuma</strong> Metropolitan Planning Organization authorized the changes to offset budget cuts and inefficiencies.<br />

Officials said the changes were made to ensure continued service to the most in need and to make the program<br />

more cost effective.<br />

Now Dial-A-Ride only carries people with ADA-certified disabilities. To become ADA-certified, people need<br />

verification from a medical professional or social service organization.<br />

By law, Andoh has up to 21 days to review the paperwork and classified them as eligible, deny eligibility or ask<br />

for more information.<br />

Even after receiving certification requests, he has to verify the information with a medical professional and wait<br />

for them to get back to him.<br />

Andoh said he has already recertified 150 customers and many more are still waiting, although he couldn't say<br />

how many more were waiting.<br />

“Unfortunately, I'm a staff of one. I can only do my best,” he said.<br />

But he noted that he can't give preferential treatment or expedite anyone's certification over others.<br />

If not enough information is given in the paperwork, Andoh might request the person verify the disability in<br />

person. He has the option to take the person to an YCAT bus stop to see if he or she can get on and off a bus.<br />

Andoh also has the option of denying the request if the person doesn't clearly explain the disability.<br />

Dear YCIPTA governing board members:<br />

Let me begin by offering our sincere thanks for nearly ten years of Dial-a-Ride services provided<br />

four our son, Edward Perry. We have been delighted with the opportunity for Eddie to work<br />

and feel independent.<br />

Eddie is 30 years old and has mild mental retardation, which prevents him from driving on his<br />

own. He physically able and requires no assistance when riding other than a qualified driver.<br />

Eddie uses Dial-a-Ride to get to and from work three days each week, on Mondays,<br />

Wednesdays and Fridays. We live at 14791 South Blanco Avenue which is off 4E, past <strong>County</strong><br />

14th. He travels to the Border Patrol Station on Avenue A, where he works as a custodian for<br />

Achieve Human Services.<br />

The nearest YCAT bus stop is 7 miles from our home and there are no sidewalks for safe walking<br />

along the country roads. The distance from his workplace to the nearest bus stop is about 2.5<br />

miles.<br />

Nevertheless, Eddie is adept in using the bus when he is near enough to a bus stop to avail<br />

himself of the service. On his days off he enjoys riding to work with his mother and walking<br />

from her workplace to the nearby bus stop. He then travels to the bank, does his shopping,<br />

catches a movie and walks from the final bus stop to his uncle’s home to wait for a ride home<br />

with a family member.<br />

Eddie loves Dial-a-Ride because the drivers are friendly and it offers him the ability to travel to<br />

and from work. It gives him a chance to employ a great deal of control over his work day,<br />

something a disabled individual is not always able to do. Please consider allowing Eddie to<br />

continue to use Dial-a-Ride services.<br />

<strong>Transit</strong> Director Report<br />

• Contract Administrator<br />

Staff has completed the process for the Contract Administrator position.<br />

<strong>Yuma</strong> <strong>County</strong> received 35 applicants. Of the 35 applicants, 17 were<br />

recommended by Human Resources. Staff interviewed 12 applicants via<br />

telephone, including 4 that were not recommended by Human Resources<br />

because they had transit experience that seemed relevant for the position.<br />

That was narrowed down to five applicants that were interviewed by a<br />

panel of two. They narrow the applicant pool to two to be interviewed.<br />

One was not recommended and two were recommended to be held for the<br />

future Finance Manager position. Of the two recommended for interview,<br />

a third applicant also was interviewed with transit experience. One<br />

dropped out, one would like additional salary over the budgeted amount<br />

and the final applicant was not recommended. Based on this exercise,<br />

staff has concluded that the position needs to be redefined and reopened<br />

under a different job description. Staff is planning to proceed with hiring<br />

the Administrative Assistant position instead at a salary range as<br />

approved by the Board of Directors at a salary range of $37,245 to<br />

$41,112 and defer the Contract Administrator until after FTA grantee<br />

status is relieved. Staff has more of a clerical support need at this time.<br />

This will be a quick hiring process – based on the timeline below:<br />

• January 30 to February 24, 2012 Post Administrative Assistant<br />

position.<br />

• Between February 26, 2012 and March 9, 2012 conduct two<br />

interviews (telephone and in person).<br />

• Offer Position – March 12, 2012.<br />

• Start Position – No later than March 26, 2012.<br />

Staff will advertise on YCIPTA, AzTA and <strong>Yuma</strong> <strong>County</strong> websites, Arizona<br />

Western College Career Center and in the <strong>Yuma</strong> Sun.<br />

• Quechan Tribe<br />

Red Route 1 service has begun to Winterhaven stopping at Hub Liquor on<br />

the corner of Winterhaven Drive and Railroad Avenue, four times per<br />

weekday and three times on Saturday and at Paradise Casino all other<br />

times. It is envisioned that this route will connect with future services<br />

established by the Quechan Tribe.<br />

At this time, the Quechan Tribe is still considering how to deliver its<br />

transportation services via three options – 1. Joining the Transportation<br />

Authority as a full member, 2. Entering into a service Intergovernmental<br />

Agreement with the management of their transit services or providing<br />

support for them to procure a transit operator or 3. Quechan Tribe<br />

operates the services themselves or with a private contractor that can<br />

operate the service for them. Upon receipt of that decision, staff will return<br />

to the Board for direction on this matter.<br />

• Mid-Year Budget Review<br />

At the next month Board meeting, staff will provide a mid-year budget<br />

review for consideration on any necessary amendments to cover<br />

expenses made from July 2011 to January 2012. Revenues would be<br />

increased to reflect funding from Arizona Western College, Northern<br />

Arizona University, Cocopah Tribe, Greyhound, Aztec High School, <strong>Yuma</strong><br />

Private Industry Council and SMILE. Expenses would be modified to<br />

reflect payments to Greyhound, legal service expenses that have<br />

increased, and any other miscellaneous expenses that may need<br />

adjustments.<br />

• First <strong>Transit</strong> Change Order #1<br />

Staff has finalized renegotiation with First <strong>Transit</strong> regarding the service<br />

hour renegotiation rate for the remainder of fiscal year 2011-2012 is as<br />

defined below:<br />

Effective Saturday, January 21, 2012, the new hourly rate for <strong>Yuma</strong> <strong>County</strong><br />

<strong>Area</strong> <strong>Transit</strong> (YCAT) fixed route services shall be $47.30 per revenue vehicle<br />

service hour and $32.00 per revenue vehicle service hour for special events<br />

and the new hourly rate for Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride (DAR) shall be<br />

$47.99 per revenue vehicle service hour for fiscal year 2012 ending June 30,<br />

2012. The above rates shall amend Section 17.4 of the Agreement. FY<br />

2013-2016 rates and revenue vehicle service hour changes shall be finalized<br />

through a formal contract amendment to be completed in April or May of<br />

2012. Until such time, the current contract rates listed in the July 1, 2011<br />

agreement shall apply for FY 2013-2016 minus the costs associated with the<br />

position changes listed above, plus the additional holiday pay for the bus<br />

operators.<br />

The renegotiation in rates will save the Transportation Authority<br />

approximately $22,160.99 for the reminder of the fiscal year. YCAT<br />

service will grow by approximately $27,068 based on the addition of the<br />

Silver Route 9 for direct service between AWC and San Luis. Staff will<br />

continue to monitor the Road Supervisor and has the option to discontinue<br />

this position, which would yield a savings of $13,256.25 to the operating<br />

budget if necessary. A change order letter has been signed by the <strong>Transit</strong><br />

Director and First <strong>Transit</strong> Senior Vice President for the contract file.<br />

At this time, there was no job losses as most of the people in the<br />

eliminated positions transferred to bus driving positions.<br />

• Federal <strong>Transit</strong> Administration Sections 5316 and 5317 Funding<br />

Staff is preparing an application for this funding to cover the costs<br />

associated with the provision of Saturday service, early morning service,<br />

NightCAT service and a circulator within San Luis to connect to the<br />

regional transit system. Applications are due to YMPO on February 15,<br />

2012.<br />

• Trapeze<br />

Staff has discontinued the use of Trapeze effective January 9, 2012. First<br />

<strong>Transit</strong> will issue a credit for $1,247 for the reminder of the fiscal year.<br />

This is due to the significant decline in dial-a-ride use and it does not<br />

warrant the need for Trapeze at this time.<br />

• Service Changes<br />

Staff with First <strong>Transit</strong> has implemented the service changes effective<br />

Monday, January 9, 2012. These changes placed transit service on major<br />

thoroughfares in <strong>Yuma</strong>, restored service to northwestern <strong>Yuma</strong>, improved<br />

frequencies to 60 minutes, placed bus stops every ¼ of mile, added new<br />

service to Winterhaven, eastern San Luis and Paradise Casino,<br />

implemented a true hub and spoke system with three transfer hubs<br />

(Cocopah Casino, <strong>Yuma</strong> Palms Regional Center and West <strong>Yuma</strong> Transfer<br />

Hub) and reduced dial-a-ride from a service that carried seniors and<br />

persons with disabilities to a service that is an ADA complementary<br />

paratransit system that is complementary to YCAT fixed routes. On the<br />

fixed route side – passengers have been receptive to the changes. While<br />

there was confusion during the first week, weekday ridership is now<br />

exceeding on the average 1,200 passengers per day. This same period<br />

last year, weekday ridership was on the average 800 passenger per day.<br />

Saturday ridership has declined, which is expected based on the reduced<br />

service hours, which is averaging 450 passenger trips as compared to this<br />

same time last year, 500 passenger trips. Overall, system wide<br />

productivity is improving, as several Orange Route 2 and Yellow Route 95<br />

trips are experiencing large crowds. Violet Route 7 is performing far<br />

superior to the former Grey Route. Revenue is also up – on the average<br />

day, $1,200 today as compared to $1,000 this same time last year. Staff<br />

is continuing to monitor ridership on Purple Route 6, Silver Route 9, Gold<br />

Route 8 and evening trips on Red Route 1 and may make further<br />

adjustments in March 2012 based on demand.<br />

There has been several articles related to the Transportation Authority in<br />

the <strong>Yuma</strong> Sun, AZTA Advocate and Quechan News regarding transit<br />

service changes, transit study approved by <strong>Yuma</strong> <strong>County</strong> and dial-a-ride<br />

service changes.<br />

• Presentations<br />

Staff has made presentations regarding the Transportation Authority and<br />

its status to the <strong>Yuma</strong> City Council on January 3, 2012, <strong>Yuma</strong> <strong>County</strong><br />

Board of Supervisors on January 4, 2012, Good Morning <strong>Yuma</strong> on<br />

January 12, 2012, Cocopah Tribal Council on January 13, 2012 and at the<br />

Rural Transportation Summit on January 19, 2012. The feedback was<br />

good and there is exciting regarding the actions that the Transportation<br />

Authority has made to date.<br />

• Saguaro Foundation<br />

Staff continues to meet with Saguaro Foundation and YMPO regarding<br />

how to develop a new service that will cover passengers that were<br />

previously eligible for Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride service based on<br />

service area or age. Saguaro Foundation has agreed using its FTA<br />

Section 5317 funding from ADOT to start a program to pick up these<br />

passengers. It is anticipated that ADOT will provide additional funding so<br />

that they can continue to fund these trips through the rest of the fiscal<br />

year. This effort is through their mobility management program called<br />

SARA Rides.<br />

• Legislative Report<br />

HB2208 is at the Arizona House of Representatives under review to<br />

restore Local Transportation Assistance Fund to all cities and counties in<br />

Arizona in addition to Maricopa <strong>County</strong>. Should this legislative action be<br />

approved, while LTAF would be included in Arizona Revised Statutes<br />

(ARS), 28-810, legislative budget authority is still required. The Arizona<br />

<strong>Transit</strong> Association is lobbying to ensure that the legislative action and the<br />

budget authority are available so that LTAF can be distributed. It is<br />

projected that $18 million to $23 million will be available from Powerball<br />

proceeds provided that the Arizona State General Fund receives its funds<br />

first. <strong>Yuma</strong> <strong>County</strong> and its municipalities can receive between $250,000<br />

and $350,000 per year from LTAF collectively.<br />

In addition, HB2347 will amend ARS 28-9121 so that if a Community<br />

College or Indian Nation is a member of an intergovernmental public<br />

transportation authority, the President of the College and Nation(s) shall<br />

appoint one member to the Board. This is a technical clean up to ARS 28-<br />

9102 which allowed community college districts and Indian nations to join<br />

IPTAs.<br />

• Bus Stop Planning<br />

Staff is working with the municipalities and the <strong>County</strong> regarding bus stop<br />

placement for the new routes that will take effect in January 2012. Bus<br />

shelter will also be relocated to busy stop locations as the majority of the<br />

bus shelters are located in areas where ridership demand is low. A new<br />

replacement bus shelter has been purchased to replace the bus shelter<br />

that was damaged in an accident in 2010 with insurance proceeds. Staff<br />

has outreached to all municipalities and has retained a consultant to<br />

address the bus stop placement issues. Once the stop locations are<br />

approved, staff will install permanent signage.<br />

• Request For Proposals<br />

Staff will bring before the Board of Directors in February a<br />

recommendation to award a contract for advertising on buses and bus<br />

shelters. Staff has released a request for proposals for transit advertising<br />

services. This request for proposals will allow for advertising on transit<br />

buses, transit bus shelters on the website and inside the Rider’s Guide.<br />

Proposals are due on December 30, 2011. A recommendation for an<br />

award will be brought before the Transportation Authority Board of<br />

Directors in January 2012. Staff will release the Legal Counsel Request<br />

For Proposals on December 26, 2011.<br />

• <strong>Yuma</strong> <strong>Area</strong> Benefits Consortium<br />

At the regularly scheduled meeting on Wednesday, January 18, 2012, the<br />

YABC Board of Trustees discussed and voted to allow the Transportation<br />

Authority to be included under the “umbrella” of the City of <strong>Yuma</strong>. The<br />

effective date is February 1, 2012. The Board voted to allow the<br />

administrative staff of the Transportation Authority (not to exceed 5<br />

employees) to be eligible for the benefits. If this number is exceeded, then<br />

the Transportation Authority would need to re-petition the YABC Board of<br />

Trustees. SEGAL (Third Party Administrator) is working to make a plan<br />

change to the City of <strong>Yuma</strong>’s Benefit Plan at this time.<br />

Once the Master IGA is finalized, the City will entertain an IGA for the<br />

provision of these benefits to the Transportation Authority.<br />

• Master IGA<br />

Legal Counsel and staff continue to work on the Master IGA. The City of<br />

<strong>Yuma</strong> has requested more items to be placed back into the Master IGA.<br />

Staff has a meeting with Legal Counsel scheduled for today to discuss<br />

these additional matters and to determine if a new strategy needs to be<br />

taken since this effort is becoming costly and complicated. Some issues<br />

that have arisen that are being resolved includes which is the controlling<br />

document, the bylaws or the Master IGA and the Board of Directors<br />

composition, including seats on the Board of Directors for community<br />

college districts and Indian nations (this will be resolved through amending<br />

Arizona Revised Statutes 28-9121 to be consistent with 28-9102).<br />

• Imperial Valley <strong>Transit</strong><br />

The Transportation Authority is working with Imperial <strong>County</strong><br />

Transportation Commission to improve the connectivity between Red<br />

Route 1 and IVT Route 350 at Hub Liquor in Winterhaven. Presently the<br />

buses miss each other by 15 minutes (when daylight savings time<br />

resumes). In addition ICTC would like to further understand the transit<br />

demands in the Winterhaven community for future transit implementation<br />

beyond the one day a week service. With the YCAT-IVT connection, a<br />

passenger can travel from <strong>Yuma</strong> to El Centro in the same day<br />

(Wednesdays) at this time. IVT Route 350 leaves Winterhaven at 6:26 am<br />

(pacific time) and arrives back in Winterhaven at 7:25 pm (pacific time) as<br />

Route 300. YCAT Red Route 1 arrives in Winterhaven at 5:43 am (pacific<br />

time) and at 7:30 pm (pacific time via NightCAT) upon request. The fare<br />

on IVT to El Centro is $1.00.<br />

• <strong>Yuma</strong> Regional <strong>Transit</strong> Study<br />

The <strong>Yuma</strong> <strong>County</strong> Board of Supervisors on January 4, 2012 formally<br />

accepted the <strong>Yuma</strong> Regional <strong>Transit</strong> Study and as a result of this study<br />

being accepted, the project is now closed. It is staff intention to pursue a<br />

PARA grant in the future to develop a Five Year Short Range <strong>Transit</strong> Plan<br />

using the study as a basis to provide a plan for implementing its elements.<br />

• Marketing<br />

Staff continues to work on a new Rider’s Guide in English and Spanish to<br />

feature the new service changes. The Guide should be available by<br />

February. The website work is progressing along and should be<br />

completed in January. Staff is also developing an interim system map and<br />

route maps for posting online and distribution to riders so that there is an<br />

understanding on where buses travel. Starting in the Spring of 2012, staff<br />

will perform aggressive outreach to increase YCAT usage. Staff is also<br />

ordering paper 10-Ride and 31-Day passes for the interim until the<br />

AcuFare Smart Card system is operational.<br />

The Transportation Authority did sponsor the chamber’s Good Morning<br />

<strong>Yuma</strong> this past month and the Rural Transportation Summit to increase<br />

awareness of YCAT and the Transportation Authority. Free shuttles were<br />

provided on Thursday, January 18, 2012 to transport government officials<br />

on various tours. At Good Morning <strong>Yuma</strong>, five raffle prizes were provided.<br />

• WACOG Audit<br />

WACOG will be doing an audit of Greater <strong>Yuma</strong> <strong>Area</strong> Dial-A-Ride on<br />

Monday, February 6, 2012 to ensure the program compliance for the grant<br />

that WACOG receives. This audit will begin at 1:30 pm and First <strong>Transit</strong><br />

will be present to provide additional assistance.<br />

• Contractor’s Employee of the Month<br />

First <strong>Transit</strong> has selected the first employee of the month. His name is<br />

Fernando Lopez, a Dispatcher/Reservationist that has been with First<br />

<strong>Transit</strong> since September 2010. Below are the criteria to receive<br />

employee of the month:<br />

• Employee(s) who exhibit a positive attitude towards customers and<br />

fellow employees<br />

• Employee(s) who contribute in a positive manner to improving<br />

service through actions and or suggestions<br />

• Employee(s) who are accident free (preventable) in the last 90 days<br />

• Employee(s) who have received commendations/citations from the<br />

public<br />

• Employee(s) maintain zero absences for 90 days<br />

This person is selected by the First <strong>Transit</strong> General Manager. Any<br />

individual who receives the “YCAT Award of Excellence” will receive a<br />

certificate of appreciation. A flyer will be placed on board the buses<br />

honoring the employee of the month and a lunch with the <strong>Transit</strong> Director,<br />

General Manager and Operations Manager will be provided of the<br />

employee’s choosing. The Chairman and <strong>Transit</strong> Director will also provide<br />

a certificate to the employee as part of the Board of Directors meeting.<br />

In addition, staff intends to recommend an Employee of the Year at the<br />

June 2012 YCIPTA Board of Directors meeting. This program is meant to<br />

provide incentives for good employees to encourage positive energy while<br />

representing the transit system.<br />

LEGISLATIVE REPORT JANUARY 18, 2012<br />

LEGISLATURE BEGINS CENTENNIAL YEAR SESSION: On Monday, January 9, the Second<br />

Regular Session of the 50 th Legislature kicked off its work with the Governor’s Annual State of the<br />

State Address. Though these annual speeches usually provide a review of the year prior and an<br />

outline of the Governor’s legislative priorities for that year, Governor Brewer spent most of her time<br />

remembering Arizona’s pioneers and heroes in honor of our State’s Centennial year of statehood.<br />

Though some policy items were referenced, the substance of her plan for this coming year was<br />

summarized in her Four Cornerstones of Reform plan released during the speech – link below - and<br />

her Fiscal Year 2013 budget released on Friday – also attached below.<br />

In planning for the FY ’13 budget and beyond, the Governor does not see a “double dip” recession in<br />

our future but instead slow, steady growth. However, she notes that this steady growth will coincide<br />

with increased demands in future years due to health care reform and a need to be cautious due to<br />

economic uncertainty. As such, she does not propose widespread reinvestment into state<br />

government, but rather targets her priorities in education, behavioral health, and replacements and<br />

upgrades of certain aging state data systems that log and process millions of state transactions per<br />

year. Though the Executive Budget does see a growth in revenues over and above the amount of<br />

these investments, growth is allowed to accumulate to address expected revenue gaps in fiscal years<br />

2014 and 15.<br />

In summary, there was not any major focus on Transportation. Though there are modest increases in<br />

the growth of the State Highway Fund and HURF, HURF assignments to DPS and MVD continue at<br />

last year’s level of $62 million. A $9 million portion of VLT is proposed to be used to cover a portion of<br />

a state employee pay increase for those employees opting to move to “uncovered” status.<br />

LEGISLATIVE PRIORITIES: Limiting the growth of spending and preparing for the uncertainties of<br />

future years is the primary goal of most legislators. However, a vigorous debate about transportation<br />

funding and the impact sweeps and repeals have had on our system is underway at the state<br />

Legislature. Both HURF and LTAF are receiving their fair share of attention and the House<br />

Transportation Chair, Tucson Republican Vic Williams, spent time on the road during the legislative<br />

break listening to communities and what they need for transit and road infrastructure. Whether there<br />

will be new funds or reforms to limit future sweeps remains to be seen. But it is nice to see that as we<br />

see the beginnings of economic recovery, that the importance of transportation systems in moving<br />

goods and people in a robust economy has the attention of many of our elected representatives. IN<br />

fact, Rep. Williams, alongside other legislators, held a transportation stakeholder meeting at the<br />

Capitol to revisit our priorities for this session.<br />

As part of this ongoing dialogue, AzTA will be making a presentation on the loss of LTAF dollars and<br />

the role of transit in our rural and urban economies on Thursday January 26. This day just so<br />

happens to be <strong>Transit</strong> Day at the Capitol and we hope you can join us for this presentation as well<br />

HB2152: Vehicle Title database (Seel) – Creates a database to monitor vehicle titles and sales of<br />

cars in part to enforce sales tax payments. Schedule for hearing on Thursday in House Technology<br />

HB2320: Municipal Elections (S. Smith, others) – Prohibits municipal elections from being held in<br />

March or May. (See HB2043)<br />

HB2347: Public Transportation Authorities; Board Membership – If a Community College or Indian<br />

Nation is a member of a public transportation authority, the President of the College and Nation(s)<br />

shall appoint one member to the Board<br />

HB2358: PPP; Toll Authorities (Fann) – Amends and substantially adds to public-private partnership<br />

and toll statutes. Apparently intended to both improve current authority as well as to address situation<br />
