• Under <strong>Annex</strong> 9, contracting states<br />

agree to cooperate with one another in<br />

removing inadmissible persons<br />

• Airlines are required to remove<br />

inadmissible persons to either the point<br />

of last departure or any place they are<br />

admissible


<strong>ICAO</strong> <strong>Annex</strong> 9<br />

• Contracting states agree to accept the<br />

return of inadmissible persons (if that<br />

person commenced their journey from its<br />

territory)<br />

• If it is not possible to return the person to<br />

the last port of embarkation the airline<br />

may seek with the agreement of the<br />

person and the state to other course of<br />

action, including another destination


Migration Act 1958 and <strong>ICAO</strong> <strong>Annex</strong> 9<br />

• <strong>ICAO</strong> is an international convention<br />

• <strong>Annex</strong> 9 is non-binding<br />

• Domestic legislation is required to<br />

underpin airline obligations<br />

• Australia has incorporated these<br />

obligations into the Migration Act<br />

Migration Act 1958<br />

• provides the power to require an<br />

airline to meet the removal and<br />

deportation costs<br />

• requires the airline (or carrier) to<br />

transport that person out of<br />

• provides the power to require the<br />

carrier to transport that person on a<br />

specific vessel and to a specific<br />

destination<br />

• Airlines have 72 hours to comply with<br />

directions. Failure to comply can incur<br />

a fine of AUD$11,000


<strong>ICAO</strong> Travel Document<br />

• In cases where a person does not<br />

hold valid travel documentation a<br />

state can, under Chapter 5, provide<br />

alternative documentation<br />

• Appendix 9 of Chapter 5 provides a<br />

format for such documentation


The way forward<br />

• Incorporate <strong>Annex</strong> 9 airline obligations<br />

into domestic legislation.<br />

– Linkage to landing rights<br />

• Engagement with airlines<br />

– Regional approach<br />

• Awareness training for border<br />

management staff at airports
