• Under Annex 9, contracting states
agree to cooperate with one another in
removing inadmissible persons
• Airlines are required to remove
inadmissible persons to either the point
ICAO Annex 9
• Contracting states agree to accept the
may seek with the agreement of the
Migration Act 1958 and ICAO Annex 9
• ICAO is an international convention
• Annex 9 is non-binding
• Domestic legislation is required to
underpin airline obligations
• Australia has incorporated these
obligations into the Migration Act
1958
Migration Act 1958
• provides the power to require an
airline to meet the removal and
deportation costs
• requires the airline (or carrier) to
transport that person out of
Australia
Migration Act 1958
• provides the power to require the
carrier to transport that person on a
specific vessel and to a specific
destination
• Airlines have 72 hours to comply with
directions. Failure to comply can incur
a fine of AUD$11,000
ICAO Travel Document
• In cases where a person does not
hold valid travel documentation a
state can, under Chapter 5, provide
alternative documentation
• Appendix 9 of Chapter 5 provides a
format for such documentation
The way forward
• Incorporate Annex 9 airline obligations
into domestic legislation.
– Linkage to landing rights
• Engagement with airlines
– Regional approach
• Awareness training for border
management staff at airports
