BRUNEI DARUSSALAM’S RESPONSES ON THE QUESTIONNAIRE<br />

1. What actions and measures have been taken in your country to address<br />

the issues of people smuggling, trafficking in persons and related<br />

transnational crime?<br />

<strong>Brunei</strong> <strong>Darussalam</strong> recognized the problems associated with smuggling and<br />

trafficking in persons and related transnational crime, which is turning into<br />

global phenomenon and has threatens the social fabric of communities. In<br />

<strong>Brunei</strong> <strong>Darussalam</strong>, the Department of Immigrations and National<br />

Registration, as the relevant agency, has developed ways and means to<br />

combat illegal activities of trafficking in persons:-<br />

a) <strong>Brunei</strong> <strong>Darussalam</strong> is giving more emphasis in the area of<br />

information exchange in its efforts to combat people trafficking.<br />

A close working relationship with other relevant enforcement<br />

agencies was established particularly in the field of intelligence<br />

where information related to illegal activities such as trafficking in<br />

persons and smuggling of migrants is shared and concerted efforts<br />

are made in tackling the problems.<br />

b) Continuous law enforcement activities were carried out to<br />

apprehend immigration offenders.<br />

c) Various trainings were carried out for the immigration officials to<br />

enhance their capabilities and knowledge especially in enforcing the<br />

Immigration Act and Regulations and the Passport Act and<br />

Regulations.<br />

d) For the purpose of public awareness, <strong>Brunei</strong> <strong>Darussalam</strong> through<br />

the Department of Immigration and National Registration<br />

continuously publicized its current legislations and any law<br />

enforcement activities carried out through local media.<br />

2. What is your informed estimated number of people smuggled and/ or<br />

trafficked annually to, through and/ or from your country?


<strong>Brunei</strong> <strong>Darussalam</strong> has so far no cases of trafficking/smuggling in persons<br />

3. Which Ministry(s)/ Department(s)/ Agency(s) in your country are<br />

concerned in dealing with people smuggling, trafficking in persons and<br />

related transnational crime?<br />

a) Department of Immigration and National Registration<br />

b) The Royal <strong>Brunei</strong> Police Force<br />

c) Attorney General’s Chambers<br />

4. What is the system/ mechanism of information sharing existing among<br />

Ministry(s)/ Department(s)/ Agency(s) concerned in your country?<br />

Through the establishment of National Law Enforcements Committee where<br />

information is disseminated and shared.<br />

5. What are the agreements/ arrangements (bilateral, multilateral, regional,<br />

etc) in place in information sharing with other countries?<br />

Bilateral arrangements were established with various neighbouring countries<br />

in the field of information exchange on immigration matters.<br />

In ASEAN, the Meeting of the ASEAN Directors-General of Immigration<br />

Departments and Heads of Consular Affairs Divisions of the ASEAN<br />

Ministries of Foreign Affairs (DGICM) has agreed to establish an ASEAN<br />

Immigration Network especially to exchange tactical, operational and<br />

intelligence information on immigration matters. This network consists of a<br />

24-hour contact person/authority in each Member Country.<br />

With regard to the Royal <strong>Brunei</strong> Police Force, information exchange<br />

regarding trafficking and smuggling in persons is often disseminated through<br />

the Interpol and also Aseanapol.<br />

6. How effective are the existing agreements/ arrangements? What are<br />

some obstacles in implementing these measures?


The existing bilateral, multilateral and regional arrangements and<br />

agreements on information sharing prove to be useful tools and help in the<br />

efforts to combat trafficking and smuggling in persons.<br />
