Purpose<br />

People credited with this <strong>unit</strong> <strong>standard</strong> are able to: identify legal<br />

rights and obligations relating to owning and operating a motor<br />

vehicle; describe legal rights, obligations, and protection when<br />

purchasing a motor vehicle and when selling or otherwise<br />

disposing <strong>of</strong> a motor vehicle.<br />

2 Definitions<br />

Private motor vehicle and motor vehicle, for the purposes <strong>of</strong> this <strong>unit</strong> <strong>standard</strong>, are<br />

defined as a light motor vehicle, for which a Class 1 driver licence is required.<br />

Person in charge <strong>of</strong> a motor vehicle is the person who has legal responsibility for the<br />

vehicle at the time an <strong>of</strong>fence has been committed.<br />

Outcome 1<br />

Identify legal rights and obligations relating to owning and operating a motor vehicle.<br />

Evidence requirements<br />

1.1 Legal obligations are identified in terms <strong>of</strong> ownership <strong>of</strong> a motor vehicle.<br />

Range<br />

vehicle licensing, vehicle inspection certificate, safety <strong>of</strong> vehicle.<br />

1.2 Legal obligations are identified in terms <strong>of</strong> motor vehicle operation.<br />

Range<br />

consumption <strong>of</strong> alcohol and/or other drugs, licensed as a driver,<br />

compliance with road rules.<br />

1.3 Legal rights and obligations are identified in relation to road traffic crashes.<br />

1.4 Consequences for the person in charge <strong>of</strong> a motor vehicle are described in<br />

2.1 A motor vehicle purchaser’s legal protection is described.<br />

auction, purchase from a licensed motor vehicle dealer, legal<br />

private sale, purchase from an unlicensed dealer.<br />

2.2 Legal obligations are described in terms <strong>of</strong> selling or otherwise disposing <strong>of</strong> a<br />

motor vehicle.<br />

Please note<br />

Providers must be granted consent to assess against <strong>standard</strong>s (accredited) by <strong>NZQA</strong>, or<br />

an inter-institutional body with delegated authority for quality assurance, before they can<br />

report credits from assessment against <strong>unit</strong> <strong>standard</strong>s or deliver courses <strong>of</strong> study leading<br />

to that assessment.<br />

Industry Training Organisations must be granted consent to assess against <strong>standard</strong>s by<br />

<strong>NZQA</strong> before they can register credits from assessment against <strong>unit</strong> <strong>standard</strong>s.<br />

Providers and Industry Training Organisations, which have been granted consent and<br />

which are assessing against <strong>unit</strong> <strong>standard</strong>s must engage with the moderation system that<br />

applies to those <strong>standard</strong>s.<br />

Consent requirements and an outline <strong>of</strong> the moderation system that applies to this<br />

<strong>standard</strong> are outlined in the Accreditation and Moderation Action Plan (AMAP). The<br />

AMAP also includes useful information about special requirements for organisations<br />

wishing to develop education and training programmes, such as minimum qualifications for<br />

tutors and assessors, and special resource requirements.<br />
