ARTICLE 8<br />

8.1 FACILmES, EQUIPMENT AND SERVICES PROVIDED BY THE<br />

LESSEE: The LESSEE shall provIde <strong>an</strong>d/or maintain within the premises, in<br />

accord<strong>an</strong>ce with all legal requirements:<br />

A. J<strong>an</strong>i<strong>to</strong>rial <strong>an</strong>d trash pick-up<br />

B. SeIVices or registers for recording original sales<br />

C. Pest Control<br />

ARTICLE 9<br />

9.1 MAINTENANCE RESPONSIBIUTIES:<br />

A. APPEARANCE OF FACIliTIES: The LESSEE shall, at its sole<br />

cost <strong>an</strong>d expense, be responsible for maintaining <strong>an</strong>d inspecting the grease<br />

trap, kitchen hood/exhaust system, <strong>an</strong>d the kitchen s<strong>to</strong>ve at least quarterly.<br />

The LESSEE shall be responsible for maintaining the food seIVice operation in a<br />

cle<strong>an</strong> <strong>an</strong>d s<strong>an</strong>itary m<strong>an</strong>ner <strong>an</strong>d be responsible for all the Health Department<br />

Certification requirements.<br />

B. OTHER MAINTENANCE: The LESSOR will be responsible for<br />

the general mainten<strong>an</strong>ce of the physical pl<strong>an</strong>t, the mainten<strong>an</strong>ce of the City<br />

owned appli<strong>an</strong>ces such as air conditioning, freezer coolers, dish washer, ice<br />

machine <strong>an</strong>d a limited amount of J<strong>an</strong>i<strong>to</strong>rial SeIVices <strong>to</strong> Include cle<strong>an</strong>ing of areas<br />

around the snack bar.<br />

ARTICLE 10<br />

10.1 QUIET ENJOYMENT OF PROPERTY: The LESSOR coven<strong>an</strong>ts <strong>an</strong>d<br />

agrees that so long as no default exists in the perform<strong>an</strong>ce of the LESSEE'S<br />

coven<strong>an</strong>ts <strong>an</strong>d agreements contained herein r the LESSEE shalf peaceably <strong>an</strong>d<br />

quietly hold' <strong>an</strong>d enjoy the premises <strong>an</strong>d all parts thereof free from eviction or<br />

disturb<strong>an</strong>ce by the LESSOR or <strong>an</strong>y persons claiming under, by, or through the<br />

LESSOR •.<br />

ARTICLE 11<br />

11.1 INGRESS AND EGRESS: Subject <strong>to</strong> the rules, regulations, statutes<br />

<strong>an</strong>d ordin<strong>an</strong>ces governing the use of the facility, the LESSEE, all agents <strong>an</strong>d<br />

seIV<strong>an</strong>ts r patrons <strong>an</strong>d invitees, <strong>an</strong>d all suppliers of seIVice <strong>an</strong>d furnishers of<br />
