the premises <strong>an</strong>d shall have the non-exclusive right <strong>to</strong> use of the adjacent<br />

LESSOR parking facilities.<br />

ARTICLE 12<br />

12.1 SECURITY DEPOSIT: The LESSEE shall ·fumish the LESSOR a<br />

security deposit of $6/000.00. The City acknowledges receipt of said security<br />

deposit. The security deposit shall be in the form of a cash depositl <strong>an</strong>d in<br />

case of satisfac<strong>to</strong>ry compli<strong>an</strong>ce of the Leasel the cash deposit will be returned<br />

with interest at ~e prevailing b<strong>an</strong>k interest rate. 50% of the security deposit<br />

will also be used <strong>to</strong> repair <strong>an</strong>d/or replace <strong>an</strong>d LESSOR owned equipment or<br />

furniturel if necessaryl due <strong>to</strong> the negligence of the opera<strong>to</strong>r. The other 50%<br />

of the deposit will bind the opera<strong>to</strong>r for the faithful perform<strong>an</strong>ce of the written<br />

agreement.<br />

ARTICLE 13<br />

. 13.1 INSURANCE -Without limiting LESSEE'S indemnification of the<br />

LESSOR I<br />

<strong>an</strong>d during the term of this Agreement l LESSEE shall provide <strong>an</strong>d<br />

maintain at its own expense the below described programs of insur<strong>an</strong>ce. Such<br />

programs <strong>an</strong>d evidence of insur<strong>an</strong>ce shall be satisfac<strong>to</strong>ry <strong>to</strong> the LESSOR <strong>an</strong>d<br />

shall be primary <strong>to</strong> <strong>an</strong>d not contributing with <strong>an</strong>y other insur<strong>an</strong>ce maintained by<br />

the LESSOR. Certificates or other evidence of coverage shalf be delivered <strong>to</strong>:<br />

Such certificates or other evidence of coverage shall be delivered prior <strong>to</strong><br />

. commencing perform<strong>an</strong>ce under this Agreement, <strong>an</strong>d shall specifically identify<br />

this Agreementl <strong>an</strong>d shall contain the express condition that the LESSOR is <strong>to</strong> be<br />

given written notice by certified mall at feast thirty (30) days in adv<strong>an</strong>ce of <strong>an</strong>y<br />

modification or termination of insur<strong>an</strong>ce. .<br />

13.2 The LESSEE shall maintain during the terms, except as noted, of<br />

this Agreement the following insur<strong>an</strong>ce:<br />

LESSEE Liability Insur<strong>an</strong>ce in the amount of $500,000 with<br />

deductible per claim if <strong>an</strong>y, not <strong>to</strong> exceed 50/0 of the limit of liability providing for<br />

all sums which the LESSEE shall become legally obligated <strong>to</strong> pay as damages for<br />
