Provider country – The country supplying biological resources collected from in-situ sources, including populations of both wild <strong>and</strong><br />
domesticated species or taken from ex-situ sources which may or may not have originated in that country.<br />
Public domain information – The information <strong>and</strong> knowledge already available in published or other forms; the realm of publications,<br />
inventions <strong>and</strong> processes that are not protected by copyright or patents.<br />
Royalty – Royalties are usage-based payments made by one party to another for ongoing use of an asset, sometimes an intellectual property.<br />
Royalties are typically agreed upon as a percentage of gross or net revenues derived from the use of an asset or a fixed price per unit sold of an item.<br />
Species – A kind of animal, plant or other organism that does not normally interbreed with individuals of another kind, <strong>and</strong> includes any subspecies,<br />
cultivar, variety, geographic race, strain, hybrid or geographically separate population (Biodiversity Act).<br />
Stakeholder – According to the Biodiversity Act, a stakeholder means a person, an organ of state or a community that provides access to<br />
indigenous biological resources, or an indigenous community or a specific individual whose traditional use, knowledge of or discoveries of any<br />
indigenous biological resource initiated, will form part of, or are to be used for the proposed bioprospecting.<br />
Sustainable use – The use of an indigenous biological resource in a way <strong>and</strong> at a rate that would not lead to its long-term decline, would not<br />
disrupt the ecological integrity of the ecosystem in which it occurs <strong>and</strong> would ensure its continued use to meet the needs <strong>and</strong> aspirations of present<br />
<strong>and</strong> future generations of people (Biodiversity Act).<br />
Traditional use or knowledge – Refers to the customary utilisation or knowledge of indigenous biological resources by an indigenous<br />
community, in accordance with written or unwritten rules, usages, customs or practices traditionally observed, accepted <strong>and</strong> recognised by them, <strong>and</strong><br />
includes discoveries about the relevant indigenous biological resources by that community (BABS Regulations).<br />
Trust fund – An amount of capital which a person places in custody of a trustee to be administered for the benefit of another (the beneficiary).<br />
