<strong>TENDER</strong> No. <strong>TP</strong>/<strong>MTL</strong>/<strong>PCH</strong>/<strong>2012</strong>-<strong>2013</strong> Dt.30-<strong>04</strong>-<strong>2012</strong><br />

Sealed competitive tenders are invited in 2 Stage Bid System, viz. Part – A<br />

(Technical/Commercial Part) and Part – B (Price Part), from manufacturers of Potassium<br />

Chloride, for supply of around 70 MT of the material, on staggered delivery basis, required by us<br />

during <strong>2012</strong>-<strong>2013</strong>. Part -A contains the Technical/Commercial aspects such as, our specification<br />

of the material, Terms & Conditions etc. and Part – B is the Price Part, for the tenderers to furnish<br />

in detail, the Basic Price of Potassium Chloride, applicable Excise Duty, Sales Tax,<br />

Transportation Charge, Discount if any, Payment Terms etc. Any suggestions, remarks or terms<br />

& conditions from the part of the tenderers with regard to this tender should be enclosed along<br />

with the Part – A of the tender.<br />

Mode of Submission of Tender: Part – A and Part – B are to be submitted in separate covers. As<br />

a token of acceptance of all our terms & conditions and specification of the material as detailed in<br />

the tender, Part - A (Technical/Commercial Part) of the tender should be signed, stamped and<br />

enclosed in a cover, along with the Demand Draft towards EMD, sealed and superscribed with<br />

Tender Number, Date & Due Date and description as “Tender for Supply of Potassium<br />

Chloride”, Part – A (Technical/Commercial Part). The Part - B (Price Part) of the tender, after<br />

furnishing all the particulars in detail, shall be enclosed in another cover, sealed and superscribed<br />

with Tender Number, Date & Due Date and description as “Tender for Supply of Potassium<br />

Chloride”, Part – B (Price Part). These two covers shall be enclosed in a big cover, sealed and<br />

superscribed with Tender Number, Date & Due Date and description as “Tender for supply of<br />

POTASSIUM CHLORIDE” (Part – A & Part – B), and shall be forwarded to The Assistant<br />

General Manager (Materials), The Kerala Minerals and Metals Limited, Sankaramangalam,<br />

Chavara, Kollam, Kerala – 691 583.<br />

<strong>NO</strong>TE: Eligible parties can also submit their tender, downloading this tender document from our<br />

Web Site, provided a Demand Draft for Rs.2900/- (Rupees Two Thousand nine hundred only),<br />

inclusive of KVAT, favouring “The Kerala Minerals and Metals Limited” payable at Kollam or<br />

Chavara, being the cost of Tender Document, is enclosed along with the Part – A (Technical/<br />

Commercial Part) of the tender.<br />

The DD towards EMD should also be enclosed with the Part – A (Technical/ Commercial<br />

Bid) of the tender.<br />

Sealed Tenders will be received at our office on all working days and the last date of receipt of<br />

the same is 11 th June <strong>2012</strong> up to 2.00 p.m. Tenders received after the due date & time will<br />

not be accepted. E-mail or Fax offers also will not be considered.<br />

The Part – A (Technical/Commercial Bids) of the tender will be opened at 2.30 P.M. on 11 th<br />

June <strong>2012</strong> in the presence of the tenderers present at that time.<br />

The Part – B (Price Part) of the tender will be opened only after evaluation of the Part – A<br />

(Technical/Commercial Bids) of the tenders are completed. The date of opening of Part – B<br />

(Price Bids) of the Technically/Commercially accepted tenders will be intimated later.<br />

The above quantity is based on our present production schedule. However, the successful<br />

tenderer shall have to cater to the increase in requirement if any during the contract period,<br />

at the same price and terms & conditions, but at the same time, he shall not be entitled to<br />

raise any claim for any reduction in quantity during the contract period.<br />

4) PACKING:<br />

Packing shall be in 50 Kg. new HDPE Containers.<br />

5) PRICE:<br />

The offer shall be for per MT delivered cost basis giving in detail the Basic Price, Excise<br />

Duty, Education Cess, Sales Tax, Transportation Charge, Payment terms etc. and shall be<br />

valid for a period of 3 months from the date of opening of Price Bids (Part – B) of the<br />

tender for our acceptance and finalization of the Purchase Order. The tenderers are<br />

requested to write the price in figures as well as in words in their offer. The price quoted<br />

shall be fixed and firm during the tenure of the contract which is normally 12 months from<br />

the date of the Purchase Order. However, in case of any balance quantity to be<br />

supplied/lifted at the end of this period, then the balance quantity shall be supplied/lifted<br />

within the span of another 3 months, at the same price and terms & conditions. In such<br />

cases the successful tenderers cannot seek any hike in the price of the material within the<br />

validity of the above period.<br />

6) SAMPLE:<br />

Eligible parties, other than our present supplier, who wish to participate in the tender,<br />

should submit 5 to 10 kgs of Potassium Chloride along with Test Certificate, for which<br />

they are submitting their offer, for our laboratory analysis. Only if the sample conforms to<br />

our specification, then their offers will be considered for further processing. The sample<br />

must be submitted along with the Technical/Commercial Part (Part – A) of the tender or<br />

prior to submission of the tender.<br />

7) DELIVERY SCHEDULE:<br />

Our monthly requirement of Potassium Chloride is approximately 6 MT and the successful<br />

tenderer shall make his own arrangements to deliver the material at our Stores. However,<br />

we reserve the right to regulate supplies by increasing/decreasing/suspending dispatches<br />

according to our production schedule, which shall be intimated to the successful tenderer.<br />

The successful tenderer shall strictly adhere to our delivery schedule and in case he fail to<br />

supply the material as per this delivery schedule, KMML reserves the right to make<br />

alternate purchase at the successful tenderer’s risk and cost.<br />

8) TRANSPORTATION:<br />

The successful tenderer shall make his own arrangements to deliver Potassium Chloride at<br />

our Factory and the accepted Transportation Charge shall be fixed and firm and shall not<br />

increase on any account till completion of the entire ordered quantity. Service Tax on<br />

Transportation Charge, if applicable, shall be extra.<br />

9) UNLOADING:<br />

Unloading of the material at our end is not in the successful tenderer’s scope. We unload<br />

the material from 9.30 a.m. to 4.00 p.m. on all working days except on Company holidays<br />

and Sundays. But, in case of any rejection, the successful tenderer shall make<br />

arrangements to take back the rejected quantity at his own risk and cost.<br />

10) MATERIAL TEST CERTIFICATE:<br />

Each consignment should accompany with a Test Certificate and the same should be<br />

handed over to the authorized Officer of our Stores Department without fail. Any<br />

consignment without the above Test Certificate will not be accepted.<br />

11) INSPECTION & TESTING:<br />

Potassium Chloride supplied shall be tested at our lab and the material shall be accepted<br />

only if it conforms to the specification mentioned in Clause No.2 of this Tender, and the<br />

Company’s authorized Officers approve it. Our testing procedure shall be as follows:<br />

Potassium Chloride on receipt at our site would be sampled and tested at our Laboratory.<br />

The test result shall be compared with material specification given in the Order. If<br />

Potassium Chloride supplied by the successful tenderer is found not as per the<br />

specification and size, we reserve the right to reject the material and the successful<br />

tenderer shall take back the material at their risk and cost.<br />

In case of any dispute regarding quality, size of Potassium Chloride supplied, or testing<br />

procedure, it shall be again tested at our Laboratory as per IS Standard in the presence of<br />

the successful tenderer/representative. The result of this test shall be final.<br />

12) EARNEST MONEY DEPOSIT:<br />

The tenders must be accompanied by an Earnest Money Deposit of Rs.75, 000/- (Rupees<br />

Seventy Five Thousand only). This amount shall be submitted in the form of a Demand<br />

Draft from any Nationalized/Scheduled Bank, in favour of The Kerala Minerals and<br />

Metals Limited, payable at Kollam. The tenders without EMD will not be accepted. The<br />

EMD will not carry any interest. In case the tenderer commits any breach of the tender<br />

conditions, KMML can without any notice, forfeit the EMD. The EMD of the successful<br />

tenderer shall be returned after submission of the required Security Deposit as per the<br />

terms of our Purchase Order. In the case of the tenderers whose tender has not been<br />

accepted, their EMD will be returned without any interest, within one month from placing<br />

Order on the successful tenderer, or on written request from the unsuccessful tenderer,<br />

after expiry of the validity of the offer.<br />

13) SECURITY DEPOSIT:<br />

The successful tenderer shall remit an amount equivalent to 5% of the total value<br />

(excluding Taxes and Duties, but inclusive of Transportation Charge) of the Order as<br />

Security Deposit. The Security Deposit can be remitted either in the form of a Demand<br />

Draft from any Nationalized/Scheduled Bank payable at Kollam/Chavara, favouring The<br />

Kerala Minerals and Metals Limited, or in the form of a Bank Guarantee from any<br />

Nationalized/Scheduled Bank with a claim period of 3 months, after expiry of the Order.<br />

The Bank Guarantee shall be as per the Proforma given by KMML. The Security Deposit<br />

shall be for the due and faithful performance of the contract in all respects. Any amount<br />

due to KMML shall be recoverable from the Security Deposit and the decision of KMML<br />

in this regard shall be final. Security Deposit shall be returned without interest only after<br />

satisfactory completion of the contract in all respects, if it is not forfeited.<br />

14) PAYMENT:<br />

Payment shall be made by Account Payee ICICI at par Cheque, after receipt and<br />

acceptance of the material. Please note that, payment shall be made only for the actual<br />

quantity of the material received and accepted at our end and the actual weight of the<br />

material as per our weighbridge shall be reckoned for payment. However, a weighbridgeto-weighbridge<br />

variation of ± 0.5% in weight shall be allowed.<br />

15) JURISDICTION:<br />

Any suit or legal proceedings against the Company arising under/out of or in connection<br />

with this Tender shall be filed or instituted only in a Court having jurisdiction in the town<br />

of Kollam, Kerala.<br />

16) KMML reserves the right to accept or reject any offer including the lowest, without<br />

assigning any reason.<br />

17) KMML also reserves the right to split the Order to more than one party.<br />

18) All questions/disputes or differences arising under, out of or in connection with this<br />

Tender shall be decided by the Managing Director of the Company and his decision shall<br />

be final.<br />

19) The Technical/Commercial Bids (Part – A) of the tenders received will be opened at 2.30<br />

p.m. on 11 th June <strong>2012</strong> in the presence of the tenderers present at that time. The Price<br />

Bids (Part – B) of the tenders shall be opened only after technical and commercial<br />

evaluations of Part – A are completed and technically/commercially acceptable list is<br />

finalized. Date and time of opening of Price Bids (Part–B) of the<br />

technically/commercially acceptable tenders shall be intimated later.<br />
