<strong>Attachment</strong> 1, <strong>DD</strong> FORM <strong>254</strong> Continuations of 13. Security Guidance<br />

8. It is the intent that this project be classified at the S<strong>EC</strong>RET level.<br />

Information which does not meet the criteria for classification will still be deemed sensitive and require<br />

protection against unauthorized disclosure. Such sensitive but unclassified information/items shall be<br />

categorized as “FOR OFFICIAL USE ONLY” (FOUO) and marked as applicable <strong>to</strong> reflect that status.<br />

Distribution of such materials shall be on a Need <strong>to</strong> Know basis and only <strong>to</strong> those involved in the project.<br />

9. SAFEGUARDING “FOR OFFICIAL USE ONLY” (FOUO) INFORMATION<br />

The “For Official Use Only” (FOUO) marking is used on official government information that although is<br />

not classified may be withheld from the public under exemptions 2 through 9 of the Freedom of<br />

Information Act.<br />

An unclassified document containing FOUO information will be marked “FOR OFFICIAL USE ONLY” at<br />

the bot<strong>to</strong>m of the front cover (if any). No portion marking will be shown. Within a classified document, an<br />

individual page that contains FOUO and classified information will be marked at the <strong>to</strong>p and bot<strong>to</strong>m with<br />

the highest security classification appearing on the page. If an individual portion contains FOUO<br />

information but no classified information, the portion will be marked, “FOUO”.<br />

Any “FOR OFFICIAL USE ONLY” information released <strong>to</strong> a contrac<strong>to</strong>r by a Government User Agency is<br />

required <strong>to</strong> be marked with the following statement prior <strong>to</strong> transfer:<br />

THIS DOCUMENT CONTAINS INFORMATION EXEMPT FROM MANDATORY DISCLOSURE<br />

UNDER THE FOIA. EXEMPTIONS (TO BE COMPLETED AS APPROPRIATE) ______ APPLY.<br />

Removal of the “FOR OFFICIAL USE ONLY” marking can only be accomplished by the origina<strong>to</strong>r or<br />

other competent authority. When the “FOR OFFICIAL USE ONLY” status is terminated, all known<br />

holders will be notified <strong>to</strong> the extent practical.<br />

DISSEMINATION: Contrac<strong>to</strong>rs may disseminate “FOR OFFICIAL USE ONLY” information <strong>to</strong> their<br />

employees and subcontrac<strong>to</strong>rs who have a need for the information in connection with a classified contract.<br />

STORAGE; During working hours, “FOR OFFICIAL USE ONLY” information shall be placed in an ou<strong>to</strong>f-sight<br />

location if the work area is accessible <strong>to</strong> persons who do not have a need for the information.<br />

During non-working hours, the information shall be s<strong>to</strong>red <strong>to</strong> preclude unauthorized access. Filing such<br />

material with other unclassified records in unlocked files or desks, is adequate when internal building<br />

security is provided during non-working hours. When such internal security control is not exercised,<br />

locked buildings or rooms will provide adequate after-hours protection or the material can be s<strong>to</strong>red in<br />

locked receptacles such as file cabinet, desks or bookcases.<br />

TRANSMISSION: “FOR OFFICIAL USE ONLY” information may be sent via first-class mail or parcel<br />

post. Bulky shipments may be sent by fourth-class mail.<br />

DISPOSITION: When no longer needed, FOUO information may be disposed of by tearing each copy<br />

in<strong>to</strong> pieces <strong>to</strong> preclude reconstructing, and placing it in a regular trash container or return said material <strong>to</strong><br />

the Project Security Officer.<br />

UNAUTHRORIZED DISCLOSURE: Unauthorized disclosure of “FOR OFFICIAL USE ONLY”<br />

information does not constitute a security violation but the releasing agency should be informed of any<br />

unauthorized disclosure. The unauthorized disclosure of FOUO or Controlled Unclassified Information<br />

(CUI) protected by the Privacy Act may result in criminal sanctions.<br />

10. Personnel will be instructed as <strong>to</strong> proper procedures for reviewing, handling, safeguarding, s<strong>to</strong>ring<br />

transferring, transmitting and destruction of CLASSIFIED information. All personnel will be informed that<br />

all CLASSIFIED information is <strong>to</strong> be s<strong>to</strong>red in a GSA approved security container.<br />

11. Receipts are required for transmitting/transferring CLASSIFIED information. Contrac<strong>to</strong>rs will use a<br />

governmental agency form for all transmittals, such as GSA Form1237 or HSIF 7101.<br />

The transmission of Classified information related <strong>to</strong> this project shall be in strict compliance <strong>to</strong> NISPOM,<br />

Chapter 5-Safeguarding Classified Information, Section 4 Transmission. To avoid any confusion regarding<br />

said compliance requirements, the aforementioned NISPOM, Ch. 5, Section 4, Transmission has been<br />

included as part of the attachments of this supplemental security guidance.<br />

Additionally, Industrial Security Letter 97-1, NISPOM Issues 7. Use Of Federal Express For Overnight<br />

Transmission Of Secret And Confidential Classified Information Within The Continental United<br />

States, needs <strong>to</strong> be strictly adhered <strong>to</strong>, which reads as follows:<br />

“We are pleased <strong>to</strong> approve use of the GSA commercial air contract carrier for the overnight delivery of<br />

information and material, currently Federal Express (FedEx), <strong>to</strong> transmit S<strong>EC</strong>RET and CONFIDENTIAL<br />

classified information <strong>to</strong> and among cleared contrac<strong>to</strong>r facilities and US Government agencies. Facility<br />

Security Officers must establish procedures <strong>to</strong> assure the proper protection of classified packages at each<br />

facility intending <strong>to</strong> use this service and these procedures must be formally approved by the Cognizant<br />

Security Office prior <strong>to</strong> starting such transmissions. Contrac<strong>to</strong>rs must establish an approved street address<br />

for incorporation by DIS in the Central Verification Activity (CVA) before such shipments may begin.<br />

The following requirements apply and must be reflected in the procedures approved by the CSO:<br />

a. FedEx may be used for the urgent overnight trans-mission of S<strong>EC</strong>RET and CONFIDENTIAL material<br />

within the continental United States when overnight delivery cannot reasonably be accomplished by the<br />

U.S. Postal Service. However, classified Communications Security (COMS<strong>EC</strong>) information, NATO and<br />

foreign government information may not be transmitted via FEDEX.<br />

b. FedEx carrier personnel should not be notified that the package contains classified material.<br />

c. Material must be prepared for transmission as described in NISPOM paragraph 5-401a, except that a<br />

FedEx mailing envelope may be used as the outer wrapper.<br />

d. The outer address label shall be addressed <strong>to</strong> the "Security Office" or the "Facility Security Officer" of<br />

the destination facility.<br />

e. Senders may not use a Post Office Box as the destination address because FedEx cannot deliver <strong>to</strong> a P.O.<br />

Box. Instead, a street delivery address approved for overnight shipments by the recipient's CSO shall be<br />

obtained from the CVA for contrac<strong>to</strong>rs or from the security office of a government agency. Identification of<br />

a contrac<strong>to</strong>r's address in the CVA listing as an authorized overnight delivery address indicates CSO<br />

approval of the receiving facility's ability <strong>to</strong> securely accept such packages.<br />

f. To ensure direct delivery <strong>to</strong> the addressee, the release signature block (# 7) on the FedEx Airbill Label<br />

may not be executed. The use of external (street side) collection boxes is prohibited.<br />

g. As a general rule, packages may be shipped on Monday through Thursday only <strong>to</strong> ensure that FedEx<br />

does not have possession of a package over a weekend.<br />

h. Employees who handle incoming FedEx shipments addressed <strong>to</strong> the Security Office or the Facility<br />

Security Officer must be cleared. “<br />

As with NISPOM, Chapter 5, Section 4 Transmission being included as part of this supplemental security<br />

guidance, so <strong>to</strong>o will the entire Industrial Security Letter 97-1 from July 1997, <strong>to</strong> include the<br />

aforementioned Issue 7 be made part of this supplemental security guidance as well.<br />

12. Subcontrac<strong>to</strong>rs that are involved in the classified portion of the contract are also required <strong>to</strong> have a current<br />

Secret Facility Clearance issued by the Defense Security Service as verified by the Project Security Officer.<br />

Subcontrac<strong>to</strong>rs not involved in the classified portion of the contract are not required <strong>to</strong> have a Facility<br />

Clearance.<br />

13. Personnel who will be given access <strong>to</strong> classified information on this contract must hold a Secret security<br />

clearance prior <strong>to</strong> being granted access <strong>to</strong> classified information.<br />

14. The Prime Contrac<strong>to</strong>r must review his own work assignments and those of his subcontrac<strong>to</strong>rs (if<br />

applicable) <strong>to</strong> ensure that sufficient cleared personnel are available in the required trades <strong>to</strong> prosecute the<br />

work required by the contract within the time specified for completion.<br />

15. In order <strong>to</strong> fulfill its obligations under this contract, the Contrac<strong>to</strong>r shall establish procedures for a<br />

continuing evaluation of the suitability of cleared personnel for assignment <strong>to</strong> this contract. The Contrac<strong>to</strong>r<br />

shall observe and report <strong>to</strong> the Project Security Officer any indications of changes in the following<br />

characteristics or behavior which might be relevant <strong>to</strong> an individual’s continued suitability for assignment<br />

<strong>to</strong> this contract:<br />

a. Attitude on the job or job performance.<br />

b. Special personal problems or family pressures.<br />

c. Undue pressure or emotional strain.<br />

d. Signs of overindulgence in alcohol, use of drugs, or abuse of prescribed medications.<br />

e. Change in physical ability <strong>to</strong> perform assigned duties.<br />

f. Indications of bizarre or deviate behavior.<br />

g. Frequent minor involvement with law enforcement agencies or other signs of irresponsible<br />

conduct.<br />

h. Changes in financial status such as a sudden or unexplainable affluence or heavy indebtedness.<br />

i. Changes in marital status such as marriage <strong>to</strong> a foreign national.<br />

The contrac<strong>to</strong>r shall ensure that each individual selected for assignment <strong>to</strong> this contract is instructed that the<br />

ultimate responsibility for remaining suitable for continued assignment <strong>to</strong>, detail, <strong>to</strong>, or employment in such<br />

duties as required for this contract rests with the individual. Accordingly, each individual should be<br />

encouraged <strong>to</strong> seek appropriate guidance and assistance on any personal problem or situation that may have<br />

a possible bearing on his or her suitability for continued utilization.<br />

16. Non-publicity: It is a specific condition of this contract that the Contrac<strong>to</strong>r, or any Subcontrac<strong>to</strong>rs,<br />

performing work on this project shall not use or allow <strong>to</strong> be used any aspect of this project for publicity or<br />

advertising brochures without prior written permission from the CO. Nothing associated with this project<br />

shall be used by the Contrac<strong>to</strong>r, the Contrac<strong>to</strong>r’s suppliers or subcontrac<strong>to</strong>rs for commercial purposes.<br />

Unauthorized use of The White House, The Department of the Interior, the National Park Service and the<br />

U.S. Secret Service (including “Secret Service,” “Uniformed Division”, the initials “U.S.S.S.” or “U.D.”)<br />

names, or other colorable imitation of such words or initials, pho<strong>to</strong>graphs, or insignias, for advertisements<br />

or endorsements shall not be permitted. The name “U.S. Secret Service,” and cited derivatives, are<br />

protected under United States Code, Title 18, Part I, Chapter 33, §709, and subject <strong>to</strong> penalty for misuse.<br />

17. Personnel will not discuss the project or anything about the project with other than personnel who are<br />

assigned <strong>to</strong> the project, have a need-<strong>to</strong>-know, and hold valid security clearance at the appropriate level.<br />
