As <strong>you</strong> may know, we recently announced that two<br />
<strong>ALS</strong> <strong>Association</strong>-funded independent studies found<br />
a genetic abnormality that, according <strong>to</strong> researchers,<br />
is the most common cause of amyotrophic lateral<br />
sclerosis (<strong>ALS</strong>) and fron<strong>to</strong>temporal dementia (FTD).<br />
This is, without a doubt, an incredibly groundbreaking<br />
discovery that would not have been possible<br />
without the support of people like <strong>you</strong>.<br />
As reported in the recent online issue of the scientific<br />
journal Neuron, an unusual mutation was discovered,<br />
where a short DNA sequence is repeated<br />
many more times as compared <strong>to</strong> healthy individuals.<br />
<strong>The</strong> research projects were funded by <strong>The</strong> <strong>ALS</strong><br />
<strong>Association</strong>’s Abendroth <strong>ALS</strong> Genetic Discovery<br />
Fund, <strong>The</strong> <strong>ALS</strong> <strong>Association</strong>’s Florida Chapter and<br />
Richard Essey.<br />
“This finding has the potential <strong>to</strong> lead <strong>to</strong> significant<br />
insights in<strong>to</strong> how both of these neurodegenerative<br />
diseases develop, and may give us much needed<br />
leads in<strong>to</strong> new ways <strong>to</strong> treat our patients,” said Senior<br />
Investiga<strong>to</strong>r Rosa Rademakers,Ph.D., a neuroscientist<br />
at the Mayo Clinic campus in Florida.<br />

Investiga<strong>to</strong>rs worldwide have been committed <strong>to</strong> identifying the gene alteration, and<br />
until now it had remained elusive. This DNA sequence repeat accounts for nearly<br />
50% of familial <strong>ALS</strong> cases in Finland and more than a third of familial cases in other<br />
European populations. “<strong>The</strong> repeat expansion was highly associated with <strong>ALS</strong> and<br />
FTD in the Finnish population,” said lead investiga<strong>to</strong>r Bryan J. Traynor, M.D., Labora<strong>to</strong>ry<br />
of Neurogenetics, National Institute on Aging.<br />

Edward Kasarskis, M.D., Ph.D. is Direc<strong>to</strong>r of the multidisciplinary <strong>ALS</strong> Center at the<br />
University of Kentucky Neuroscience Center in Lexing<strong>to</strong>n, Kentucky, professor in<br />
the Department of Neurology at the University of Kentucky, and Chief of Neurology<br />
at the VA Medical Center in Lexing<strong>to</strong>n KY.<br />
Q: I know two people with <strong>ALS</strong>, and both experienced a lot of stress in their lives.<br />
Could there be a connection between experiencing a great deal of stress and getting<br />
<strong>ALS</strong> And does pseudobulbar affect the course of <strong>ALS</strong><br />
Dr. Kasarskis<br />
A: Honestly, there is so much stress in people’s lives, if there were a direct connection between<br />
stress and developing <strong>ALS</strong>, we would most likely be seeing many, many more people with <strong>ALS</strong> than<br />
we actually do. But there is very little in the medical literature on this <strong>to</strong>pic.<br />
My personal observations support the concept that people who manage their stress well, who have<br />
adapted well <strong>to</strong> changing circumstances, and who have good social support systems, make informed,<br />
timely decisions about their disease and its management. <strong>The</strong> ability <strong>to</strong> deal effectively with<br />
stress certainly after being diagnosed with <strong>ALS</strong> involves focusing the mind on constructive approaches<br />
<strong>to</strong> the illness, which contributes <strong>to</strong> better survival and quality of life. <strong>The</strong>se issues need<br />
more research. We also know that people who go <strong>to</strong> multi-disciplinary <strong>ALS</strong> clinics experience enhanced<br />
survival as compared <strong>to</strong> those going <strong>to</strong> a single practitioner’s office for care. I frequently tell<br />
patients that "<strong>you</strong> can’t do <strong>ALS</strong> by <strong>you</strong>rself,” and our multi-disciplinary clinics offer <strong>ALS</strong> patients a<br />
variety of expertise, counseling, and support.<br />
How might all this be related <strong>to</strong> pseudobulbar affect, or PBA I wrote about PBA a few months ago<br />
concentrating on the clinical findings and the new treatment for PBA. To recap, PBA can occur with<br />
many neurologic diseases, including <strong>ALS</strong>, brain injury, or stroke. Patients may find themselves crying<br />
uncontrollably at something that is only moderately sad or laughing uncontrollably at mildly<br />
amusing things. In a broader context, PBA can be part of a constellation of additional symp<strong>to</strong>ms of<br />
cognitive difficulties, impaired planning, and impulsive behaviors (<strong>to</strong>gether labeled FTD, or fron<strong>to</strong>temporal<br />
dementia). Hence some, but not all patients with PBA, may have trouble planning and<br />
executing activities or actions with an eye <strong>to</strong> the future, or can find it hard <strong>to</strong> follow simple directions.<br />
<strong>The</strong>y can have difficulty following the health team’s recommendations or seeing the consequences<br />
of their actions, or inactions in this regard. In many ways these issues likely cause stress for the patient<br />
(they certainly do for the family) as they add confusion and complexity <strong>to</strong> the patient’s environment.<br />
Although the issues of stress, PBA, and FTD have not formally been linked in the research literature,<br />
common sense argues that stress is not helping the situation at all. <strong>The</strong> bot<strong>to</strong>m line about stress<br />
and <strong>ALS</strong> is relatively simple: To the extent <strong>you</strong> can find effective coping skills for dealing with the<br />
disease, <strong>you</strong> can expect <strong>to</strong> find real benefit.<br />

This Year’s Flu Season…and You<br />
It’s almost fall, time <strong>to</strong> talk about flu shots. Updated guidance for influenza<br />
vaccination for the upcoming 2011-2012 flu season has been released by<br />
the Centers for Disease Control and Prevention (CDC). This year’s flu vaccine<br />
virus strains are identical <strong>to</strong> those in last year’s vaccine. Although the<br />
strains are the same as those used in last year’s vaccine, even people who<br />
got vaccinated last year should get the flu shot again this season.<br />
Highlights of the recommendations include:<br />
Supply is expected <strong>to</strong> be good. <strong>The</strong> CDC is anticipating that about 166 million<br />
or so doses of vaccine will be produced this year, as compared <strong>to</strong> 157<br />
million doses that were distributed last year.<br />
Your best bet is <strong>to</strong> get the flu vaccine before the flu hits <strong>you</strong>r community. Ideal months are September<br />
and Oc<strong>to</strong>ber. But should <strong>you</strong> not get vaccinated then, it’s better later than not at all.<br />
A variety of different types of influenza vaccines are expected <strong>to</strong> be available during the upcoming<br />
influenza season, all containing the same antigenic composition.<br />

Medication S<strong>to</strong>rage: Avoid Heat, Cold and Humidity<br />
Extreme temperatures and humidity can have a big effect on both prescription<br />
and over-the-counter drugs. Most pharmaceutical companies recommend<br />
their products be s<strong>to</strong>red at a temperature of 68 <strong>to</strong> 77 degrees <strong>to</strong><br />
guarantee product integrity. Some experts say anything between 58 and 86<br />
degrees is probably fine. But during the heat of summer and the cold of<br />
winter, depending on where <strong>you</strong> keep <strong>you</strong>r medications, temperatures<br />
could go outside the recommended limits and either lose potency, physically<br />
change or be dangerous <strong>to</strong> take.<br />
Test strips are very sensitive <strong>to</strong> humidity, and antibiotics, when decaying, can cause s<strong>to</strong>mach or kidney<br />
problems. Some drugs, such as anticoagulants, hormones, and insulin and seizure medications<br />
can be especially sensitive.<br />
Experts suggest <strong>you</strong> avoid keeping medications in the bathroom because it’s a high-humidity environment.<br />
S<strong>to</strong>re them in a cool dry place like a kitchen cabinet or a closet. If possible, keep the medication<br />
in its original packaging. If <strong>you</strong> take insulin, keep unopened bottles in the refrigera<strong>to</strong>r and<br />
open bottles at room temperature.

Senate Committee Approves $6 Million for the <strong>ALS</strong> Registry<br />
Great news! <strong>The</strong> Senate Appropriations Committee has voted <strong>to</strong> provide<br />
an additional $6 million for the <strong>ALS</strong> Registry in 2012!! <strong>The</strong><br />
funding will allow the Registry <strong>to</strong> continue <strong>to</strong> identify cases of <strong>ALS</strong><br />
across the country, collect additional information about the disease<br />
and expand exciting projects such as adding a bioreposi<strong>to</strong>ry and <strong>to</strong>ols<br />
<strong>to</strong> help people with <strong>ALS</strong> learn about and enroll in clinical trials.<br />
This is a tremendous vic<strong>to</strong>ry for every person with <strong>ALS</strong>. It is a clear<br />
sign that Congress recognizes the critical role the Registry can play in<br />
the fight <strong>to</strong> find the cause, treatment and cure for <strong>ALS</strong>. It also is clear<br />
that <strong>ALS</strong> is a priority for the Senate. <strong>The</strong> Committee reduced funding,<br />
or eliminated it entirely, for most other health care programs. In fact,<br />
funding for the entire Department of Health and Human Services was<br />
reduced. Yet, the Senate maintained strong support for the Registry<br />
by keeping funding at the current level.<br />

<strong>The</strong> full Senate still must vote on the Department of Health and Human<br />
Services Appropriations bill that includes the Registry funding,<br />
and the House Appropriations Committee also must vote on their version<br />
of the bill. <strong>The</strong>refore, there are a number of steps remaining in the legislative process before we can declare vic<strong>to</strong>ry this year.<br />

Protect Your Children with Maximum Credi<strong>to</strong>r and Divorce Protection—<br />
An irrevocable trust set up by someone other than the beneficiary provides ultimate credi<strong>to</strong>r protection. With divorce rate soaring, and an increase<br />
in lawsuits, credi<strong>to</strong>r protection should be a very important objective for clients who prepare an estate plan. Generally, a Gran<strong>to</strong>r of a trust can decide<br />
who may receive the benefit of the trust assets, and under what circumstances assets may be distributed. Property distributed outright <strong>to</strong> a<br />
trust beneficiary is subject <strong>to</strong> credi<strong>to</strong>rs’ claims. Property passed in trust may be protected.<br />
“I want my children <strong>to</strong> get one-third at age 25, one-third at age 30, and the final third at age 35.” STOP!! Don’t do it! This distribution scheme does<br />
not take in<strong>to</strong> account that many of our beneficiaries will at some point in life, be sued or divorce. When assets are distributed, they are unshielded<br />
from the safety-net of the trust and exposed <strong>to</strong> credi<strong>to</strong>rs and soon-<strong>to</strong>-be ex-spouses.<br />
An Estate Planning At<strong>to</strong>rney is able <strong>to</strong> draft a trust <strong>to</strong> protect trust beneficiaries, such as surviving spouses and children, from credi<strong>to</strong>rs and divorcing<br />
spouses. This means that when <strong>you</strong> die, and <strong>you</strong>r spouse remarries, the assests <strong>you</strong> left in trust are protected and directed <strong>to</strong> <strong>you</strong>r beneficiaries<br />
of choice.<br />
Beneficiaries may even serve as the trustee of Support trusts. This way, they are able <strong>to</strong> use the trust assets for nearly any reason, but still have<br />
protection from credi<strong>to</strong>rs. Language of the trust is careful <strong>to</strong> limit distributions of both trust income and principal <strong>to</strong> reasons such as health, education,<br />
maintenance, and support. Further, the trust directs the trustee not <strong>to</strong> distribute assets <strong>to</strong> the beneficiary’s estate, his credi<strong>to</strong>rs, or credi<strong>to</strong>rs of<br />
his estate. This language keeps the trust out of the beneficiaries’ estate for estate tax purposes as well as provides credi<strong>to</strong>r protection. Discretionary<br />
Trusts, which give an independent trustee complete discretion over distributions, provide the best credi<strong>to</strong>r and divorce protection. Trusts drafted<br />
with manda<strong>to</strong>ry distributions are inadequate. Forced trust distributions unnecessarily expose <strong>you</strong>r beneficiaries <strong>to</strong> credi<strong>to</strong>rs and divorce. Support<br />
Trusts do a better job, and Discretionary Trusts offer maximum protection against credi<strong>to</strong>rs and divorce.<br />

Proposed PDUFA Agreement: the Right Prescription for People with Lou Gehrig's Disease<br />
<strong>The</strong> <strong>ALS</strong> <strong>Association</strong> applauds the proposed agreement for the reauthorization of the Prescription Drug User Fee<br />
Act (PDUFA), which includes provisions that would help <strong>to</strong> encourage and expedite the approval of new treatments<br />
for rare diseases like <strong>ALS</strong>, also known as Lou Gehrig’s Disease. <strong>The</strong> proposed agreement was released by the<br />
Food and Drug Administration (FDA) on September 1.<br />
PDUFA authorizes the FDA <strong>to</strong> collect fees from companies that develop drugs and biologic products. <strong>The</strong>se fees<br />
help the agency cover the costs of drug reviews and currently account for about half of the agency’s drug review<br />
costs. <strong>The</strong> law originally was established in 1992 and has been reauthorized every five years since that time. <strong>The</strong><br />
current law expires next year unless it is reauthorized by September 30, 2012.<br />
“<strong>The</strong> reauthorization of PDUFA is critical <strong>to</strong> discovering a treatment and cure for <strong>ALS</strong>,” said Jane Gilbert, President<br />
and CEO of <strong>The</strong> <strong>ALS</strong> <strong>Association</strong>. “<strong>The</strong>re is no effective treatment for <strong>ALS</strong> and it is fatal in an average of just two<br />
<strong>to</strong> five years. By providing the agency with the resources it needs <strong>to</strong> review new treatments and ensure their efficacy<br />
and safety, PDUFA helps <strong>to</strong> make sure that funding limitations do not block innovative treatments from reaching<br />
the patients who so urgently need them.”<br />
“<strong>The</strong> additional resources and the establishment of drug review timeframes are important elements of PDUFA,”<br />
said Steve Gibson, <strong>The</strong> <strong>ALS</strong> <strong>Association</strong>’s Chief Public Policy Officer. “This proposal is particularly significant because<br />
it was developed with the input of the patient community in partnership with the FDA and industry. And it is<br />
significant because it includes key provisions that promote the development of new treatments and recognize that<br />
the practice of medicine is not a one-size-fits-all proposition, especially when it comes <strong>to</strong> a disease like Lou Gehrig’s<br />
Disease.”<br />
Since July 2010, <strong>The</strong> <strong>ALS</strong> <strong>Association</strong> participated in monthly meetings with FDA officials <strong>to</strong> bring the perspective<br />
of people with <strong>ALS</strong> <strong>to</strong> the discussion on the reauthorization of PDUFA. Three key provisions advocated by <strong>The</strong><br />
<strong>Association</strong> were included in the proposed agreement. <strong>The</strong>y include:<br />
Developing Treatments for Rare Diseases: Directs FDA <strong>to</strong> issue regula<strong>to</strong>ry policies and guidance that encourage<br />
the development of drugs <strong>to</strong> treat rare diseases and <strong>to</strong> include patients as active participants in this<br />
process.<br />
Assessing Risk-Benefit: Instructs the agency <strong>to</strong> develop an objective and qualitative framework for assessing<br />
risk and benefit during the drug review process and <strong>to</strong> ensure patient involvement. <strong>The</strong> provision takes in<strong>to</strong><br />
account the fact that people with <strong>ALS</strong> who have no treatment options and who will die in just two <strong>to</strong> five years<br />
have a much different view of risk and benefit than does someone with a treatable or chronic condition.<br />
Utilizing Biomarkers in Clinical Trials: <strong>The</strong> proposal encourages greater use of biomarkers and other markers,<br />
or “sign-posts,” <strong>to</strong> help determine risk and benefit when reviewing new drugs. Biomarkers have the potential<br />
<strong>to</strong> significantly accelerate access <strong>to</strong> new drugs by helping <strong>to</strong> determine much sooner whether a treatment<br />
works and in which patients.<br />
“Congress has authorized PDUFA four times beginning in 1992. But perhaps no other version of the law is as important<br />
<strong>to</strong> people with <strong>ALS</strong> as PDUFA V,” said Gibson. “Right now people with <strong>ALS</strong> have no way <strong>to</strong> defend themselves<br />
in the fight against the disease. It will take their lives. But PDUFA V can help them fight back. It promotes<br />
new treatments. It speeds access. And it makes sense. We urge Congress <strong>to</strong> swiftly adopt the PDUFA V proposal<br />
in 2012.”<br />

Research Indicates TDP-43 and FUS/TLS Work Together<br />
Although several new genes have now been linked <strong>to</strong> <strong>ALS</strong> including the recent exciting finding of mutations in the<br />
gene Ubiquilin-2 linked <strong>to</strong> familial <strong>ALS</strong>, exactly how these mutations cause disease remains unclear and is the focus<br />
of research in labs world-wide. Two proteins with similar structure and function, TDP43 and FUS, linked <strong>to</strong><br />
familial <strong>ALS</strong> with and without fron<strong>to</strong>temporal dementia are thought <strong>to</strong> be involved in the disease, either by causing<br />
some new <strong>to</strong>xic property or by a loss of their normal function.<br />
To identify the potential mechanism, investiga<strong>to</strong>rs led by Brian McCabe, Ph.D., assistant professor of pathology &<br />
cell biology in the Taub Institute for Research on Alzheimer’s Disease and the Aging Brain and a member of the<br />
Center for Mo<strong>to</strong>r Neuron Biology and Disease at Columbia University Medical Center used the Drosophila-fly<br />
model. <strong>The</strong>y demonstrated that these two proteins work in tandem <strong>to</strong> support the long-term survival of mo<strong>to</strong>r neurons.<br />
<strong>The</strong> findings were published in the September 1, 2011 online edition of the Journal of Clinical Investigation.<br />
<strong>The</strong> investiga<strong>to</strong>rs demonstrate that<br />
the drosophila TDP-43 and FUS/TLS<br />
proteins bind <strong>to</strong> each other, and using<br />
the mutant proteins linked <strong>to</strong> familial-<strong>ALS</strong>,<br />
they show that these proteins<br />
work <strong>to</strong>gether in a common genetic<br />
pathway. <strong>The</strong>y show that<br />
FUS/TLS mutant Drosophila can be<br />
fully rescued by wild type human<br />
FUS/TLS but not familial <strong>ALS</strong> mutant<br />
versions. Finally they show that over<br />
expression of FUS/TLS can effectively<br />
rescue TDP-43 mutants. <strong>The</strong>ir<br />
results argue that loss of a common<br />
molecular activity that requires TDP-<br />
43 and FUS/TLS could contribute <strong>to</strong><br />
<strong>ALS</strong>, in contrast <strong>to</strong> current models<br />
suggesting <strong>to</strong>xic accumulation.<br />
“<strong>The</strong> two genes make proteins with<br />
similar form and function, which suggested<br />
<strong>to</strong> us that they could work<br />
<strong>to</strong>gether, and that disruptions of either<br />
gene would affect neuronal survival,”<br />
said Dr. McCabe, who was<br />
awarded his first grant for <strong>ALS</strong> research<br />
from <strong>The</strong> <strong>Association</strong>. “I am<br />
very grateful <strong>to</strong> <strong>The</strong> <strong>ALS</strong> <strong>Association</strong><br />
for my first <strong>ALS</strong> grant on <strong>ALS</strong>2,<br />
which set us off on this path,” added<br />
Dr. McCabe.<br />

cause disease is critical for<br />
therapeutic development. Further<br />
studies <strong>to</strong>gether with this new finding<br />
will provide the necessary clues <strong>to</strong><br />
help intervene and develop appropriate<br />
