As you may know, we recently announced that two
ALS Association-funded independent studies found
a genetic abnormality that, according to researchers,
is the most common cause of amyotrophic lateral
sclerosis (ALS) and frontotemporal dementia (FTD).
This is, without a doubt, an incredibly groundbreaking
discovery that would not have been possible
without the support of people like you.
As reported in the recent online issue of the scientific
journal Neuron, an unusual mutation was discovered,
where a short DNA sequence is repeated
many more times as compared to healthy individuals.
The research projects were funded by The ALS
Association’s Abendroth ALS Genetic Discovery
Fund, The ALS Association’s Florida Chapter and
Richard Essey.
“This finding has the potential to lead to significant
insights into how both of these neurodegenerative
diseases develop, and may give us much needed
leads into new ways to treat our patients,” said Senior
Investigator Rosa Rademakers,Ph.D., a neuroscientist
at the Mayo Clinic campus in Florida.

Investigators worldwide have been committed to identifying the gene alteration, and
until now it had remained elusive. This DNA sequence repeat accounts for nearly
50% of familial ALS cases in Finland and more than a third of familial cases in other
European populations. “The repeat expansion was highly associated with ALS and
FTD in the Finnish population,” said lead investigator Bryan J. Traynor, M.D., Laboratory
of Neurogenetics, National Institute on Aging.

Edward Kasarskis, M.D., Ph.D. is Director of the multidisciplinary ALS Center at the
University of Kentucky Neuroscience Center in Lexington, Kentucky, professor in
the Department of Neurology at the University of Kentucky, and Chief of Neurology
at the VA Medical Center in Lexington KY.
Q: I know two people with ALS, and both experienced a lot of stress in their lives.
Could there be a connection between experiencing a great deal of stress and getting
ALS And does pseudobulbar affect the course of ALS
Dr. Kasarskis
A: Honestly, there is so much stress in people’s lives, if there were a direct connection between
stress and developing ALS, we would most likely be seeing many, many more people with ALS than
we actually do. But there is very little in the medical literature on this topic.
My personal observations support the concept that people who manage their stress well, who have
adapted well to changing circumstances, and who have good social support systems, make informed,
timely decisions about their disease and its management. The ability to deal effectively with
stress certainly after being diagnosed with ALS involves focusing the mind on constructive approaches
to the illness, which contributes to better survival and quality of life. These issues need
more research. We also know that people who go to multi-disciplinary ALS clinics experience enhanced
survival as compared to those going to a single practitioner’s office for care. I frequently tell
patients that "you can’t do ALS by yourself,” and our multi-disciplinary clinics offer ALS patients a
variety of expertise, counseling, and support.
How might all this be related to pseudobulbar affect, or PBA I wrote about PBA a few months ago
concentrating on the clinical findings and the new treatment for PBA. To recap, PBA can occur with
many neurologic diseases, including ALS, brain injury, or stroke. Patients may find themselves crying
uncontrollably at something that is only moderately sad or laughing uncontrollably at mildly
amusing things. In a broader context, PBA can be part of a constellation of additional symptoms of
cognitive difficulties, impaired planning, and impulsive behaviors (together labeled FTD, or frontotemporal
dementia). Hence some, but not all patients with PBA, may have trouble planning and
executing activities or actions with an eye to the future, or can find it hard to follow simple directions.
They can have difficulty following the health team’s recommendations or seeing the consequences
of their actions, or inactions in this regard. In many ways these issues likely cause stress for the patient
(they certainly do for the family) as they add confusion and complexity to the patient’s environment.
Although the issues of stress, PBA, and FTD have not formally been linked in the research literature,
common sense argues that stress is not helping the situation at all. The bottom line about stress
and ALS is relatively simple: To the extent you can find effective coping skills for dealing with the
disease, you can expect to find real benefit.

This Year’s Flu Season…and You
It’s almost fall, time to talk about flu shots. Updated guidance for influenza
vaccination for the upcoming 2011-2012 flu season has been released by
the Centers for Disease Control and Prevention (CDC). This year’s flu vaccine
virus strains are identical to those in last year’s vaccine. Although the
strains are the same as those used in last year’s vaccine, even people who
got vaccinated last year should get the flu shot again this season.
Highlights of the recommendations include:
Supply is expected to be good. The CDC is anticipating that about 166 million
or so doses of vaccine will be produced this year, as compared to 157
million doses that were distributed last year.
Your best bet is to get the flu vaccine before the flu hits your community. Ideal months are September
and October. But should you not get vaccinated then, it’s better later than not at all.
A variety of different types of influenza vaccines are expected to be available during the upcoming
influenza season, all containing the same antigenic composition.

Medication Storage: Avoid Heat, Cold and Humidity
Extreme temperatures and humidity can have a big effect on both prescription
and over-the-counter drugs. Most pharmaceutical companies recommend
their products be stored at a temperature of 68 to 77 degrees to
guarantee product integrity. Some experts say anything between 58 and 86
degrees is probably fine. But during the heat of summer and the cold of
winter, depending on where you keep your medications, temperatures
could go outside the recommended limits and either lose potency, physically
change or be dangerous to take.
Test strips are very sensitive to humidity, and antibiotics, when decaying, can cause stomach or kidney
problems. Some drugs, such as anticoagulants, hormones, and insulin and seizure medications
can be especially sensitive.
Experts suggest you avoid keeping medications in the bathroom because it’s a high-humidity environment.
Store them in a cool dry place like a kitchen cabinet or a closet. If possible, keep the medication
in its original packaging. If you take insulin, keep unopened bottles in the refrigerator and
open bottles at room temperature.

If providing compassionate care to people living with ALS, funding research for treatments and a cure and advancing

Blueprint Chapter. Below is language you can take to your financial advisor for including our Chapter in your will
or living trust:
General bequest.
This is an outright bequest and is usually a gift of a stated sum of money.

Percentage of remainder.

Senate Committee Approves $6 Million for the ALS Registry
Great news! The Senate Appropriations Committee has voted to provide
an additional $6 million for the ALS Registry in 2012!! The
funding will allow the Registry to continue to identify cases of ALS
across the country, collect additional information about the disease
and expand exciting projects such as adding a biorepository and tools
to help people with ALS learn about and enroll in clinical trials.
This is a tremendous victory for every person with ALS. It is a clear
sign that Congress recognizes the critical role the Registry can play in
the fight to find the cause, treatment and cure for ALS. It also is clear
that ALS is a priority for the Senate. The Committee reduced funding,
or eliminated it entirely, for most other health care programs. In fact,
funding for the entire Department of Health and Human Services was
reduced. Yet, the Senate maintained strong support for the Registry
by keeping funding at the current level.

The full Senate still must vote on the Department of Health and Human
Services Appropriations bill that includes the Registry funding,
and the House Appropriations Committee also must vote on their version
of the bill. Therefore, there are a number of steps remaining in the legislative process before we can declare victory this year.

Protect Your Children with Maximum Creditor and Divorce Protection—
An irrevocable trust set up by someone other than the beneficiary provides ultimate creditor protection. With divorce rate soaring, and an increase
in lawsuits, creditor protection should be a very important objective for clients who prepare an estate plan. Generally, a Grantor of a trust can decide
who may receive the benefit of the trust assets, and under what circumstances assets may be distributed. Property distributed outright to a
trust beneficiary is subject to creditors’ claims. Property passed in trust may be protected.
“I want my children to get one-third at age 25, one-third at age 30, and the final third at age 35.” STOP!! Don’t do it! This distribution scheme does
not take into account that many of our beneficiaries will at some point in life, be sued or divorce. When assets are distributed, they are unshielded
from the safety-net of the trust and exposed to creditors and soon-to-be ex-spouses.
An Estate Planning Attorney is able to draft a trust to protect trust beneficiaries, such as surviving spouses and children, from creditors and divorcing
spouses. This means that when you die, and your spouse remarries, the assests you left in trust are protected and directed to your beneficiaries
of choice.
Beneficiaries may even serve as the trustee of Support trusts. This way, they are able to use the trust assets for nearly any reason, but still have
protection from creditors. Language of the trust is careful to limit distributions of both trust income and principal to reasons such as health, education,
maintenance, and support. Further, the trust directs the trustee not to distribute assets to the beneficiary’s estate, his creditors, or creditors of
his estate. This language keeps the trust out of the beneficiaries’ estate for estate tax purposes as well as provides creditor protection. Discretionary
Trusts, which give an independent trustee complete discretion over distributions, provide the best creditor and divorce protection. Trusts drafted
with mandatory distributions are inadequate. Forced trust distributions unnecessarily expose your beneficiaries to creditors and divorce. Support
Trusts do a better job, and Discretionary Trusts offer maximum protection against creditors and divorce.

Proposed PDUFA Agreement: the Right Prescription for People with Lou Gehrig's Disease
The ALS Association applauds the proposed agreement for the reauthorization of the Prescription Drug User Fee
Act (PDUFA), which includes provisions that would help to encourage and expedite the approval of new treatments
for rare diseases like ALS, also known as Lou Gehrig’s Disease. The proposed agreement was released by the
Food and Drug Administration (FDA) on September 1.
PDUFA authorizes the FDA to collect fees from companies that develop drugs and biologic products. These fees
help the agency cover the costs of drug reviews and currently account for about half of the agency’s drug review
costs. The law originally was established in 1992 and has been reauthorized every five years since that time. The
current law expires next year unless it is reauthorized by September 30, 2012.
“The reauthorization of PDUFA is critical to discovering a treatment and cure for ALS,” said Jane Gilbert, President
and CEO of The ALS Association. “There is no effective treatment for ALS and it is fatal in an average of just two
to five years. By providing the agency with the resources it needs to review new treatments and ensure their efficacy
and safety, PDUFA helps to make sure that funding limitations do not block innovative treatments from reaching
the patients who so urgently need them.”
“The additional resources and the establishment of drug review timeframes are important elements of PDUFA,”
said Steve Gibson, The ALS Association’s Chief Public Policy Officer. “This proposal is particularly significant because
it was developed with the input of the patient community in partnership with the FDA and industry. And it is
significant because it includes key provisions that promote the development of new treatments and recognize that
the practice of medicine is not a one-size-fits-all proposition, especially when it comes to a disease like Lou Gehrig’s
Disease.”
Since July 2010, The ALS Association participated in monthly meetings with FDA officials to bring the perspective
of people with ALS to the discussion on the reauthorization of PDUFA. Three key provisions advocated by The
Association were included in the proposed agreement. They include:
Developing Treatments for Rare Diseases: Directs FDA to issue regulatory policies and guidance that encourage
the development of drugs to treat rare diseases and to include patients as active participants in this
process.
Assessing Risk-Benefit: Instructs the agency to develop an objective and qualitative framework for assessing
risk and benefit during the drug review process and to ensure patient involvement. The provision takes into
account the fact that people with ALS who have no treatment options and who will die in just two to five years
have a much different view of risk and benefit than does someone with a treatable or chronic condition.
Utilizing Biomarkers in Clinical Trials: The proposal encourages greater use of biomarkers and other markers,
or “sign-posts,” to help determine risk and benefit when reviewing new drugs. Biomarkers have the potential
to significantly accelerate access to new drugs by helping to determine much sooner whether a treatment
works and in which patients.
“Congress has authorized PDUFA four times beginning in 1992. But perhaps no other version of the law is as important
to people with ALS as PDUFA V,” said Gibson. “Right now people with ALS have no way to defend themselves
in the fight against the disease. It will take their lives. But PDUFA V can help them fight back. It promotes
new treatments. It speeds access. And it makes sense. We urge Congress to swiftly adopt the PDUFA V proposal
in 2012.”

Research Indicates TDP-43 and FUS/TLS Work Together
Although several new genes have now been linked to ALS including the recent exciting finding of mutations in the
gene Ubiquilin-2 linked to familial ALS, exactly how these mutations cause disease remains unclear and is the focus
of research in labs world-wide. Two proteins with similar structure and function, TDP43 and FUS, linked to
familial ALS with and without frontotemporal dementia are thought to be involved in the disease, either by causing
some new toxic property or by a loss of their normal function.
To identify the potential mechanism, investigators led by Brian McCabe, Ph.D., assistant professor of pathology &
cell biology in the Taub Institute for Research on Alzheimer’s Disease and the Aging Brain and a member of the
Center for Motor Neuron Biology and Disease at Columbia University Medical Center used the Drosophila-fly
model. They demonstrated that these two proteins work in tandem to support the long-term survival of motor neurons.
The findings were published in the September 1, 2011 online edition of the Journal of Clinical Investigation.
The investigators demonstrate that
the drosophila TDP-43 and FUS/TLS
proteins bind to each other, and using
the mutant proteins linked to familial-ALS,
they show that these proteins
work together in a common genetic
pathway. They show that
FUS/TLS mutant Drosophila can be
fully rescued by wild type human
FUS/TLS but not familial ALS mutant
versions. Finally they show that over
expression of FUS/TLS can effectively
rescue TDP-43 mutants. Their
results argue that loss of a common
molecular activity that requires TDP-
43 and FUS/TLS could contribute to
ALS, in contrast to current models
suggesting toxic accumulation.
“The two genes make proteins with
similar form and function, which suggested
to us that they could work
together, and that disruptions of either
gene would affect neuronal survival,”
said Dr. McCabe, who was
awarded his first grant for ALS research
from The Association. “I am
very grateful to The ALS Association
for my first ALS grant on ALS2,
which set us off on this path,” added
Dr. McCabe.
“Understanding how these two proteins
cause disease is critical for
therapeutic development. Further
studies together with this new finding
will provide the necessary clues to
help intervene and develop appropriate
treatments," commented ALS
