COMPLAINT HANDLING MECHANISM AT SPIU RELATING TO<br />

PROCUREMENT, FRAUD,CORRUPTION AND QUALITY OF<br />

CONSTRUCTION IN ACCORDANCE WITH GOVT. OF INDIA / STATE<br />

ADMINISTRATIVE PROCEDURE.<br />

Any person may make a <strong>complaint</strong> with regard <strong>to</strong> the proper<br />

implement<strong>at</strong>ion of COE Scheme under the Department of Employment and<br />

Training. Every <strong>complaint</strong> shall be made in the form of a st<strong>at</strong>ement in the form<br />

and in the manner prescribed as under:<br />

Before the Direc<strong>to</strong>r/Joint Direc<strong>to</strong>r (Training) Direc<strong>to</strong>r<strong>at</strong>e of Employment<br />

and Training, Govt. of Karn<strong>at</strong>aka.<br />

1) Name and Address of the complainant for all correspondence in respect of<br />

<strong>complaint</strong> :<br />

2) Name and Address of the Govt. servant/other person complained against :<br />

3) Brief facts rel<strong>at</strong>ing <strong>to</strong> the action complained of :<br />

4) The evidences relied upon (copies available with the complainant shall be<br />

enclosed) should be furnished :<br />

5) Were the facts st<strong>at</strong>ed in item 3 the subject m<strong>at</strong>ter of any previous <strong>complaint</strong><br />

<strong>to</strong> any authority or of any suit, petition or other proceeding wh<strong>at</strong>soever<br />

before a court of law or other tribunal or an officer of a Govt. if so give<br />

particulars of the remedies sought or granted:<br />

Procedure for disposal of the <strong>complaint</strong>:<br />

1) The Authority concerned after making preliminary inquiry as deemed fit he<br />

shall forward a copy of the <strong>complaint</strong> <strong>to</strong> the Govt. servant /other person<br />

concerned and also the competent authority concerned.<br />

2) Shall afford <strong>to</strong> such Govt. servant/other person an opportunity <strong>to</strong> offer his<br />

remarks on such <strong>complaint</strong>.<br />

3) May make such order as <strong>to</strong> the safe cus<strong>to</strong>dy of documents relevant <strong>to</strong> the<br />

investig<strong>at</strong>ion, as he deems fit.


The Authority may, in his discretion, refuse <strong>to</strong> investig<strong>at</strong>e or cease <strong>to</strong><br />

investig<strong>at</strong>e any <strong>complaint</strong> if in his opinion:<br />

a) The <strong>complaint</strong> is frivolous or vex<strong>at</strong>ious or not made in good faith.<br />

b) There are no sufficient grounds for investig<strong>at</strong>ing or the case may be for<br />

continuing investig<strong>at</strong>ion; or<br />

c) Other remedies are available <strong>to</strong> the complainant and in the circumstances of<br />

the case, it would be proper for the complainant <strong>to</strong> avail of such remedies.<br />

In any case the Authority decides not <strong>to</strong> entertain a <strong>complaint</strong> or <strong>to</strong> discontinue<br />

any investig<strong>at</strong>ion in respect of a <strong>complaint</strong> he shall record his reasons thereof and<br />

communic<strong>at</strong>e the same <strong>to</strong> the complainant and the Govt. servant/other persons<br />

concerned.<br />

CONDITIONS ;<br />

1) Complaint fee Rs.20 for making each <strong>complaint</strong>.<br />

2) The <strong>complaint</strong> will be normally disposed within a month except where<br />

the m<strong>at</strong>ter requires detailed investig<strong>at</strong>ion may require additional time.<br />

3) Indic<strong>at</strong>ing the Appell<strong>at</strong>e Authority in case for an appeal against the order<br />

passed<br />

by the Authority of investig<strong>at</strong>ion.<br />

4) Filing an affidavit along with the <strong>complaint</strong> by the Complainant.
