<strong>Drug</strong>, <strong>Alcohol</strong> and Contraband <strong>Policy</strong>:<br />
NOTICE TO ALL EMPLOYEES<br />
This Company realizes the importance of providing a safe and healthy work environment<br />
for all employees and visitors. With this in mind, the Company has adopted the following<br />
policy regarding Illegal <strong>Drug</strong>s, Substances, Contraband, Weapons, Stolen Property and<br />
Unauthorized Items (referred to herein as the <strong>Policy</strong>).<br />
Purpose of the <strong>Policy</strong>:<br />
In order to (1) assist in maintaining a safe working environment for employees (defined<br />
as employees of this company and its affiliated or subsidiary companies, invitee and<br />
subcontractors and employees); (2) protect company property and, (3) cooperate with<br />
clients, contractors and subcontractors in their efforts to contribute to safe and efficient<br />
operations, this Company has established a POLICY REGARDING ILLEGAL DRUGS,<br />
SUBSTANCES, CONTRABAND, WEAPONS, STOLEN PROPERTY AND<br />
UNAUTHORIZED ITEMS.<br />
Company Premises Defined:<br />
The term "Company Premises," its affiliates or subsidiaries as used herein includes all<br />
property, facilities, land, platforms, buildings, structures, fixtures, installations, boats,<br />
aircraft, automobiles, trucks and all other vehicles, whether owned, leased or used. This<br />
may also include other work locations, including locations belonging to our clients, or to<br />
and from those locations while in the course and scope of Company employment.<br />
Company <strong>Policy</strong>:<br />
This is to notify all employees, employees of other contractors, companies and other<br />
invitee that the use of, possession, concealment, transportation, promotion or sale of the<br />
following items or substances are strictly prohibited from all of the above mentioned<br />
Company premises:<br />
* Illegal drugs, controlled substances (including trace amounts) look-alike and<br />
designer drugs.<br />
* Unauthorized alcoholic beverages<br />
* Firearms, weapons, explosives and ammunition<br />
* Unauthorized Items:<br />
- Any stolen property<br />
- <strong>Drug</strong> paraphernalia<br />
* Unauthorized prescription drugs - except under the following conditions:<br />
- Employees shall inform their supervisor prior to using prescribed drugs on<br />
the job.<br />
- Each vial shall be in the employee's name.<br />
- Each prescription shall be no older than one (1) year of the date issued.<br />
- Employee shall only possess enough medication for that normal work<br />
shift.<br />

Note:<br />
The Company, at all times, reserves the right to have its Company physician<br />
determine if a prescription drug or medication produces hazardous affects<br />
and may restrict the use of any such drug or medication accordingly. This<br />
may include restricting the employee’s work activity.<br />
Searches and Inspections:<br />
In order to accomplish the purpose of this POLICY, the Company reserves the right, at<br />
all times, while on the premises and properties described above and circumstances<br />
warrant, to have Company supervisors or authorized Search and Inspection Specialists<br />
conduct reasonable searches and inspections of individual employees, or other persons<br />
and their personal effects, including, but not limited to, lockers, living quarters, baggage,<br />
desk, tool boxes, lunch pails, clothing and personal vehicles, for the purpose of<br />
determining is such employees or other persons are in possession, use, transportation<br />
or concealment of any of the prohibited items and substances of this POLICY. All<br />
searches and inspections conducted by outside authorized specialists will be in the<br />
presence of Company supervisors.<br />
A Search and Inspection as defined in the POLICY may also include requesting<br />
employees and other persons to cooperate in unannounced "fitness for duty/under the<br />
influence" exams which consist of, but are not limited to, the rapid-eye-test, pupillary<br />
reaction test, balance test, etc. and drug/alcohol testing (using bodily fluid specimens<br />
such as urine, blood, saliva or hair). These tests may be utilized under the following<br />
conditions and situations:<br />
* Pre-Employment examinations.<br />
* Annual employee examinations or to comply with contractual agreements<br />
with other contractors or clients.<br />
* Part of an overall "Search and Inspection" of an employee's work area or<br />
location of employment.<br />
* Random unannounced substance abuse testing to assure the maintenance of<br />
a drug free work place.<br />
* When an employee's supervisor has a reasonable suspicion that an<br />
employee is intoxicated, using or under the influence of drugs or alcohol.<br />
"Reasonable Suspicion:" is a belief based on objective and articulative facts<br />
sufficient to lead a prudent supervisor to suspect that the employee is using<br />
drugs or alcohol.<br />
* When an employee or person is found in possession of suspected illicit or<br />
unauthorized drugs and/or alcohol or when any of these items are found in an<br />
area controlled or used exclusively by designated employees.<br />
* Following a serious accident or incident in which safety precautions may have<br />
been violated or careless acts were performed.<br />
Searches (including Urine <strong>Drug</strong> Screening or Blood and Plasma Sampling or "Fitness<br />
For Duty/Under The Influence" Examinations) and Inspections by Specialists and<br />
Company Supervisors may be conducted from time to time without prior announcement.<br />
Searches will be performed with concern for the personal privacy of each employee or<br />
other individual.<br />

If an employee or prospective employee of the Company questions the results of the<br />
specimen analysis performed by the Company's primary testing laboratory, they may<br />
obtain an additional analysis from another laboratory on the Company's approved list.<br />
The additional analysis must be derived from the original specimen provided for the<br />
questioned laboratory analysis. All expenses related to obtaining an additional<br />
specimen analysis must be paid by the employee or prospective employee in advance.<br />
Company Position for <strong>Policy</strong> Violators:<br />
No employee or person search, "fitness for duty/under the influence" examination, urine<br />
drug screen or inspection will be conducted without written consent. Employees have<br />
the right to refuse to be searched or have personal effects searched or to cooperate in<br />
the requested tests; however, an employee who refuses to permit such searches, or to<br />
cooperate in such permitted tests (and to provide written authorization to release test<br />
results to the Company) or is found to be in possession, use, or transportation of any<br />
illegal substance, contraband, Company property, or any of the above mentioned drugs<br />
and unauthorized items, will be removed and not allowed to return on any of this<br />
Company's properties or facilities described herein. The Company further reserves the<br />
right to discharge immediately any employee who is found to have tampered with or<br />
falsified a test sample.<br />
Entry onto this Company's property as described herein constitutes consent to the<br />
recognition of the right of this Company or its authorized representatives to conduct<br />
searches, inspections, "fitness for duty/under the influence" examinations, urine drug<br />
screens, and/or receive a blood plasma sample from the employee and/or other persons<br />
and search and inspection of their personal effects, vehicles, tool boxes, desks, clothing,<br />
boats, airplanes and any other property of employees and other persons, while entering<br />
or departing the premises of this Company.<br />
Illegal substances, drugs, stolen property and unauthorized items discovered through<br />
these searches and inspections may result in the proper law enforcement authorities<br />
being advised in this regard.<br />
This POLICY is made for the maximum safety and well-being of all employees and other<br />
personnel. Your assistance and cooperation in the achievement of this goal is vitally<br />
important.<br />
