(<strong>COMPANY</strong>) <strong>Mobile</strong> <strong>Device</strong> & <strong>Driving</strong> <strong>Safety</strong> <strong>Policy</strong><br />
<strong>Scope</strong><br />
<strong>This</strong> policy about cellular phone usage applies to any mobile device that makes or receives<br />
phone calls, leaves messages, sends text messages, surfs the Internet, or downloads and<br />
allows for the reading of and responding to email whether the device is company-supplied or<br />
personally owned. <strong>This</strong> policy applies to all (<strong>COMPANY</strong>) employees using mobile phones on<br />
company business or in company controlled vehicles. The use of laptops is subject to a<br />
separate policy.<br />
The company supports the provision of mobile phones and devices which include mobile phone<br />
functionality (mobile phones, Blackberries, iPhones, etc.) to employees and employees' use of<br />
personal mobile phones used on business.<br />
<strong>Policy</strong><br />
(<strong>COMPANY</strong>) is aware that employees currently use cell phones or similar devices for business<br />
purposes while driving. Research indicates that cell phone use in an uncontrolled manner while<br />
driving can be dangerous.<br />
<strong>Mobile</strong> phones can only be used in vehicles when national, state or municipal laws permit this<br />
and in accordance with the local guidelines.<br />
We recognize that other distractions occur during driving, however curbing the use of cell<br />
phones, while driving, is one way to minimize the risk, for our employees, of accidents. We<br />
respect those employees who chose to turn off their mobile devices while driving to lessen<br />
distraction.<br />

When ever possible avoid using a mobile device while driving. Pulling off to a safe stopping<br />
area and having the conversation is recommended<br />
Only use the phone in low hazard driving conditions<br />
No texting, emailing, web surfing, tweeting or key board dialling while driving (voice<br />
activated calling is preferred)<br />
No audio conferences while driving<br />
Calls which become complex or heated should be terminated and continued when parked<br />
Calls should be as concise as possible<br />
Passenger conversations on a hand held phone must not involve the driver<br />
Drivers using a phone while driving should inform the other party that they are driving<br />
All calls while driving should be with hands free equipment that complies with local<br />
guidelines.<br />
<strong>Driving</strong> is defined as:<br />
<br />
Any time while in control of a moving vehicle
Any time while in control of a vehicle which is stationary with its engine running for a short<br />
period e.g. waiting at traffic lights or in traffic jams<br />
Prohibitions<br />
Employees are prohibited from using a cell phone or similar device, hands on while driving for<br />
conducting company related business. <strong>This</strong> prohibition includes receiving or placing calls, text<br />
messaging, surfing the Internet, receiving or responding to email, checking for phone<br />
messages, or any other purpose related to your employment; the business; our customers; our<br />
vendors; volunteer activities, meetings, or civic responsibilities performed for or attended in the<br />
name of the company; or any other company or personally related activities not named here<br />
while driving.<br />
Engaging in company business using a mobile device hands on while driving a personal,<br />
company-supplied vehicle or company controlled vehicle is prohibited. The employee is<br />
responsible for the consequences of any breach of the law and subsequent prosecution or<br />
penalties.<br />
Employees who violate this policy will be subject to disciplinary actions, up to and including<br />
employment termination.<br />
Entitlement to Company Funded <strong>Mobile</strong> Phones<br />
The company will decide the type of phone and tariff and the current preferred supplier will be<br />
used.<br />
Refer to local territory policy and procedures for additional details.<br />
Private use of company phones will be managed on a local territory by territory basis in line with<br />
expense rules.
