September Meeting Review
Below are highlights from the September 19, 2003, State Bar Board of Governors meeting. Meetings are held
monthly at the Arizona Bar Center in Phoenix.
3 President Pamela Treadwell-Rubin recognized
staff with the “Pin a Rose on You”
award going to Marnie Leinberger,
Director of MCLE; Tim Eigo, Editor of
Arizona Attorney magazine; and Lisa
Deane, Director of CLE.
3 Ernest Calderón, Immediate Past
President of the State Bar, has been
appointed by Governor Napolitano to the
Arizona Board of Regents.
3 The Board of Governors approved the list
of Probable Cause Panelists: Jimmie D.
Smith, Alan Bayham, Jr., and Richard
Platt.
3 The Board of Governors approved Marc
Smiley’s proposal to assist the board and
the Long Range Planning Committee in
the preparation of the Strategic Plan for
2003.
3 Robert Van Wyck, Acting Executive
Director, reported on the continuing
search for a new Director for MAP and
LOMAP and announced that the staffing
for the Ethics Hotline and ACAP will be
increased.
3 Matthew Silverman, Director of
Communications, reported on the modified
brochure and new Client Care
Guide. The State Bar cards have been
redesigned with the back side containing
key benefits and phone numbers.
3 Larry McVey, Chief Financial Officer,
reviewed financials for July and August.
3 John Furlong, General Counsel, reported
on insurance matters and that the
Professional Liability Insurance
Committee unanimously agreed to continue
efforts to provide some assistance
to the members of the State Bar with
legal malpractice coverage.
3 The Board approved the modification to
the Creed of Professionalism, replacing
the word “zealous” with “honorable” in
sections A.1. and C.1.
3 The Board approved the Consent
Agenda: Resignations in Good Standing
and Approval of August 2003 Board
Minutes.
3 Christine Thompson, Director of
Government Relations, reported on possible
proposed legislation.
3 President Treadwell-Rubin reported that
two Board monthly meetings dates have
been changed to March 12 and May 14.
3 President Treadwell-Rubin awarded Hon.
Rebecca White Berch, outgoing Courtappointed
liaison, with a plaque and
thanked her for her volunteer service to
the Board over the past year.
3 President Treadwell-Rubin honored J.
Denise Huginnie, outgoing public member,
with a plaque and thanked her for
her volunteer service to the Board.
3 Chas Wirken, Building Committee Chair,
reported the committee has hired
Langdon Wilson to furnish a needs
assessment. The committee is reviewing
all possibilities with a set criteria, including
whether a lease or purchase will better
serve the Bar.
3 Discipline Committee Chair Chas Wirken
reported that conservatorships and the
applicable Supreme Court Rule 65 are
being studied.
3 Treasurer Dan McAuliffe reported that
the Finance Committee Manuals are
being completed.
3 Jim Matthews, Chair of the Human
Resources/Personnel Committee, reported
that the Policy Manual and salary survey
are being reviewed by the
Committee.
3 Helen Perry Grimwood, Rules Review
Committee Chair, reported the
Committee would be working with the
Court to ensure the timely submission of
comments on rule petitions. The Rule
17.2 Study Committee plans to submit its
report at the November Board meeting.
3 Ms. Grimwood reported on Petition 02-
0007, an amendment to ARIZ.R.CIV.P.
30(b) regarding the videotaping of depositions.
The Board voted to adopt the
report of the Civil Practice and
Procedure Committee and oppose
Alternative “C” as circulated by the
Supreme Court.
3 Theodore Campagnolo, Chair of the
Mentor Committee, and Nicole Paris, a
representative from the Young Lawyers
Division, reported on the Mentor
Committee’s law school mentoring program.
This proposal formulates a
Mentor–Mentee relationship between the
State Bar and ASU and UA law students
and reduces the minimum experience for
mentors from five years to three years.
3 Steve Sherick, Foundation Liaison,
reported on the following matters: (1)
The Foundation board has decided to
hire its own Executive Director; (2) The
Foundation will remain at the State Bar
Center through the end of the term of
the lease; (3) Interest paid on funds
deposited in IOLTA accounts is so low
that the Foundation receives nothing.
The board proposed that members report
on their dues statement the financial institution
that holds their IOLTA account;
and (4) The Foundation’s Web site
www.lawforkids.com has been a great success
with 2.5 million hits.
3 Phoebe Moffatt, President of the Young
Lawyers Division, reported that there was
a great turnout at the Division’s Long
Range Planning Meeting.
