September Meeting Review<br />
Below are highlights from the September 19, 2003, State Bar Board of Governors meeting. Meetings are held<br />
monthly at the Arizona Bar Center in Phoenix.<br />
3 President Pamela Treadwell-Rubin recognized<br />
staff with the “Pin a Rose on You”<br />
award going to Marnie Leinberger,<br />
Director of MCLE; Tim Eigo, Editor of<br />
Arizona Attorney magazine; and Lisa<br />
Deane, Director of CLE.<br />
3 Ernest Calderón, Immediate Past<br />
President of the State Bar, has been<br />
appointed by Governor Napolitano to the<br />
Arizona Board of Regents.<br />
3 The Board of Governors approved the list<br />
of Probable Cause Panelists: Jimmie D.<br />
Smith, Alan Bayham, Jr., and Richard<br />
Platt.<br />
3 The Board of Governors approved Marc<br />
Smiley’s proposal to assist the board and<br />
the Long Range Planning Committee in<br />
the preparation of the Strategic Plan for<br />
2003.<br />
3 Robert Van Wyck, Acting Executive<br />
Director, reported on the continuing<br />
search for a new Director for MAP and<br />
LOMAP and announced that the staffing<br />
for the Ethics Hotline and ACAP will be<br />
increased.<br />
3 Matthew Silverman, Director of<br />
Communications, reported on the modified<br />
brochure and new Client Care<br />
Guide. The State Bar cards have been<br />
redesigned with the back side containing<br />
key benefits and phone numbers.<br />
3 Larry McVey, Chief Financial Officer,<br />
reviewed financials for July and August.<br />
3 John Furlong, General Counsel, reported<br />
on insurance matters and that the<br />
Professional Liability Insurance<br />
Committee unanimously agreed to continue<br />
efforts to provide some assistance<br />
to the members of the State Bar with<br />
legal malpractice coverage.<br />
3 The Board approved the modification to<br />
the Creed of Professionalism, replacing<br />
the word “zealous” with “honorable” in<br />
sections A.1. and C.1.<br />
3 The Board approved the Consent<br />
Agenda: Resignations in Good Standing<br />
and Approval of August 2003 Board<br />
Minutes.<br />
3 Christine Thompson, Director of<br />
Government Relations, reported on possible<br />
proposed legislation.<br />
3 President Treadwell-Rubin reported that<br />
two Board monthly meetings dates have<br />
been changed to March 12 and May 14.<br />
3 President Treadwell-Rubin awarded Hon.<br />
Rebecca White Berch, outgoing Courtappointed<br />
liaison, with a plaque and<br />
thanked her for her volunteer service to<br />
the Board over the past year.<br />
3 President Treadwell-Rubin honored J.<br />
Denise Huginnie, outgoing public member,<br />
with a plaque and thanked her for<br />
her volunteer service to the Board.<br />
3 Chas Wirken, Building Committee Chair,<br />
reported the committee has hired<br />
Langdon Wilson to furnish a needs<br />
assessment. The committee is reviewing<br />
all possibilities with a set criteria, including<br />
whether a lease or purchase will better<br />
serve the Bar.<br />
3 Discipline Committee Chair Chas Wirken<br />
reported that conservatorships and the<br />
applicable Supreme Court Rule 65 are<br />
being studied.<br />
3 Treasurer Dan McAuliffe reported that<br />
the Finance Committee Manuals are<br />
being completed.<br />
3 Jim Matthews, Chair of the Human<br />
Resources/Personnel Committee, reported<br />
that the Policy Manual and salary survey<br />
are being reviewed by the<br />
Committee.<br />
3 Helen Perry Grimwood, Rules Review<br />
Committee Chair, reported the<br />
Committee would be working with the<br />
Court to ensure the timely submission of<br />
comments on rule petitions. The Rule<br />
17.2 Study Committee plans to submit its<br />
report at the November Board meeting.<br />
3 Ms. Grimwood reported on Petition 02-<br />
0007, an amendment to ARIZ.R.CIV.P.<br />
30(b) regarding the videotaping of depositions.<br />
The Board voted to adopt the<br />
report of the Civil Practice and<br />
Procedure Committee and oppose<br />
Alternative “C” as circulated by the<br />
Supreme Court.<br />
3 Theodore Campagnolo, Chair of the<br />
Mentor Committee, and Nicole Paris, a<br />
representative from the Young <strong>Lawyers</strong><br />
Division, reported on the Mentor<br />
Committee’s law school mentoring program.<br />
This proposal formulates a<br />
Mentor–Mentee relationship between the<br />
State Bar and ASU and UA law students<br />
and reduces the minimum experience for<br />
mentors from five years to three years.<br />
3 Steve Sherick, Foundation Liaison,<br />
reported on the following matters: (1)<br />
The Foundation board has decided to<br />
hire its own Executive Director; (2) The<br />
Foundation will remain at the State Bar<br />
Center through the end of the term of<br />
the lease; (3) Interest paid on funds<br />
deposited in IOLTA accounts is so low<br />
that the Foundation receives nothing.<br />
The board proposed that members report<br />
on their dues statement the financial institution<br />
that holds their IOLTA account;<br />
and (4) The Foundation’s Web site<br />
www.lawforkids.com has been a great success<br />
with 2.5 million hits.<br />
3 Phoebe Moffatt, President of the Young<br />
<strong>Lawyers</strong> Division, reported that there was<br />
a great turnout at the Division’s Long<br />
Range Planning Meeting.<br />
