W hereas clause (c) of sub section
(6) of section 16A of the West Bengal
Panchayat Act, 1973 has established the fact that the goal of formation of Gram Unnayan
Samiti is to ensure active participation of the people in implementation, maintenance and
e quitable distribution of benefit with
respect to the subjects as has already been
highlighted in the West Bengal Panchayat (Gram Panchayat Administration) Rules, 2004
u nder Rule 74 ;
And whereas under sub rule (2a) of rule 74 of the West Bengal Panchayat(Gram
P anchayat Administration) Rules
2004, the Gram Unnayan Samiti shall assist the Gram
Panchayat in such manner as may be decided by the Gram Panchayat in identification of
suitable works to provide wage based employment to those living within the area, who
a re in need of employment and also provide assistance in execution of schemes taken up
b y the Gram Panchayat or other agencies for employment generation ;
And whereas a question has been raised by different Panchayat Samitis and Gram
P anchayat whether Secretary or other members of Gram
Unnayan Samitis may be
selected as Supervisor under NREGS and whether they may be allowed to participate in
t he tender process initiated by the Gram Panchayat ;
A nd whereas
a policy decision is urgently required in this respect ;
N ow, therefore, in exercise of the power conferred by section 212 of the West
Bengal Panchayat Act, 1973, the Governor, after careful consideration, is hereby pleased
to direct that no member of a Gram Unnayan Samiti including its Convener shall act as
S upervisor under NREGS
or participate in any tender process initiated by the Gram
Panchayat as long as he remains a member of the Gram Unnayan Samiti for the sake of
t ransparency and accountability in its functioning.
