Selvangivelsen er <strong>for</strong>håndsutfylt med<br />
opplysninger som <strong>Skatteetaten</strong> har fått fra<br />
arbeidsgivere, banker, <strong>for</strong>sikringsselskap mv.<br />
Når du har skattepliktig inntekt <strong>og</strong> <strong>for</strong>mue<br />
som ikke er <strong>for</strong>håndsutfylt i selvangivelsen,<br />
må du føre disse inn slik at de blir tatt med.<br />
Du må <strong>og</strong>så kontrollere at de <strong>for</strong>håndsutfylte<br />
opplysningene er fullstendige <strong>og</strong> korrekte.<br />

Levering av selvangivelsen<br />
Selvangivelsen leverer du enten elektronisk<br />
på skatteetaten.no eller altinn.no eller<br />
på papir.<br />
Næringsdrivende må i tillegg fylle ut <strong>og</strong> levere<br />
«Næringsoppgave 1» (RF‐1175) <strong>og</strong> «Personinntekt<br />
fra enkeltperson<strong>for</strong>etak» (RF‐1224).<br />

Frist <strong>for</strong> levering av selvangivelsen er<br />
30. april 2013. Næringsdrivende som leverer<br />
«Selvangivelse <strong>for</strong> næringsdrivende mv.»<br />
elektronisk samt deltaker i selskap som<br />
leverer «Selskapsoppgave <strong>for</strong> deltakerlignet<br />
selskap (KS, ANS mv.)» (RF‐1215) elektronisk,<br />
har frist til 31. mai 2013.<br />
Du kan søke skattekontoret om utsatt<br />
leveringsfrist dersom du har særlige grunner,<br />
<strong>for</strong> eksempel sykdom eller reisefravær, som<br />
gjør det svært vanskelig <strong>for</strong> deg å levere<br />
selvangivelsen innen fristen. Du kan søke om<br />
utsatt frist elektronisk. Se nærmere om dette<br />
på skatteetaten.no. Søk «RF‐1115» på<br />
skatteetaten.no <strong>for</strong> mer in<strong>for</strong>masjon om<br />
utsettelse. Du kan <strong>og</strong>så sende en skriftlig<br />
søknad med begrunnelse <strong>og</strong> opplysninger om<br />
fødselsnummer, navn <strong>og</strong> din adresse.<br />
For deg som ikke har<br />
fått en <strong>for</strong>håndsutfylt<br />
selv angivelse <strong>for</strong> 2012<br />
Personer som ikke får tilsendt en <strong>for</strong>håndsutfylt<br />
selvangivelse, skal fylle ut <strong>og</strong> levere<br />
«Selvangivelse <strong>for</strong> personer som ikke har<br />
mottatt <strong>for</strong>håndsutfylt selvangivelse <strong>for</strong><br />
2012» (RF‐1281). Denne selvangivelsen må<br />
leveres på papir. Fristen er 30. april 2013.<br />
Generelt om skatte plikten<br />
til Norge<br />
Når blir du skattepliktig i Norge<br />
Omfanget av skatteplikten er avhengig av<br />
hvor lenge du oppholder deg i Norge i en<br />
12-månedersperiode eller en 36-månedersperiode.<br />
I omtale av skatteplikten vil du møte<br />
to begreper – «begrenset skatteplikt» <strong>og</strong><br />
«skattemessig bosatt».<br />
Begrenset skatteplikt<br />
Du er begrenset skattepliktig i Norge hvis du<br />
er i Norge i en eller flere perioder som ikke<br />
overstiger 183 dager i løpet av 12 måneder,<br />
eller 270 dager i løpet av 36 måneder.<br />
Det betyr at du bare er skattepliktig <strong>for</strong> visse<br />
inntekter med tilknytning til Norge. Dette<br />
gjelder bl.a. lønn <strong>for</strong> arbeid som er utført<br />
i Norge, <strong>og</strong> inntekt av virksomhet som drives<br />
i Norge.<br />
Du er <strong>og</strong>så begrenset skattepliktig i Norge om<br />
du arbeider eller driver næringsvirksomhet på<br />
norsk kontinentalsokkel.<br />
Skatteplikten kan være begrenset som følge<br />
av bestemmelser i de skatteavtalene Norge<br />
har inngått med andre land.<br />
Skattemessig bosatt<br />
Du blir skattemessig bosatt i Norge hvis du<br />
oppholder deg i Norge i mer enn 183 dager i<br />
løpet av 12 måneder, eller mer enn 270 dager<br />
i løpet av 36 måneder. Du blir skattemessig<br />
bosatt fra det inntektsåret oppholdet<br />
overstiger 183 eller 270 dager over en<br />
periode på henholdsvis 12 eller 36 måneder.<br />
Når du er skattemessig bosatt i Norge, er du<br />
skattepliktig i Norge <strong>for</strong> all inntekt <strong>og</strong> <strong>for</strong>mue<br />
uansett om den er opptjent eller befinner seg<br />
i Norge eller utlandet. Skatteplikten kan være<br />
begrenset som følge av bestemmelser i de<br />
skatteavtalene Norge har inngått med<br />
andre land.<br />

Opplysninger om inntekt,<br />
<strong>for</strong>mue <strong>og</strong> fradrag i selvangivelsen<br />
Utfylling av postene om lønn mv. skal bygge<br />
på «Lønns- <strong>og</strong> trekkoppgave 2012», som du<br />
skal ha mottatt fra din arbeidsgiver. Har du<br />
ikke mottatt en slik oppgave, må du likevel<br />
oppgi disse inntektene.<br />
Post 2.1.1 Lønn, godtgjørelser,<br />
natural ytelser mv.<br />
Her føres lønn, honorar, sluttvederlag,<br />
feriepenger <strong>og</strong> andre ytelser fra arbeidsgiver,<br />
<strong>for</strong> eksempel <strong>for</strong>del ved fri bruk av bil, helt<br />
eller delvis fri bolig, fritt arbeidstøy mv. Her<br />
føres <strong>og</strong>så lønn mv. som du har mottatt etter<br />
at du <strong>for</strong>lot Norge.<br />
Ytelser som er innberettet i kode 112-A<br />
(trekkpliktige naturalytelser) <strong>og</strong> kode 116-A<br />
(skattepliktig del av ulykkes<strong>for</strong>sikring <strong>og</strong><br />
yrkesskade<strong>for</strong>sikring) føres her. Fordel ved fri<br />
kost, kr 79 per dag, er skattepliktig.<br />
For sokkelarbeidere er fri kost skattefri <strong>for</strong><br />
<strong>arbeidstakere</strong> med skattepliktig inntekt under<br />
kr 600 000.<br />
Ytelser som er innberettet i kode 151-A<br />
(smusstillegg) føres her etter fradrag av<br />
1/3 av beløpet, maksimalt kr 2 050.<br />
Skattepliktig <strong>for</strong>del av fri bolig i arbeids<strong>for</strong>hold<br />
som er innberettet i kode 121-A,<br />
skal føres her.<br />
Andre skattepliktige ytelser som ikke skal<br />
føres i andre poster, skal <strong>og</strong>så føres her.<br />
Fordel ved fri bil (kode 118-A) skal fastsettes<br />
til 30 prosent av bilens listepris som ny inntil<br />
kr 270 600 <strong>og</strong> 20 prosent av overskytende<br />
listepris. Fordelen beregnes med utgangspunkt<br />
i 75 prosent av bilens listepris i<br />
følgende tilfeller:<br />
• For biler eldre enn 3 år pr. 1. januar i<br />
inntektsåret.<br />
• For skattytere som godtgjør at yrkeskjøringen<br />
overstiger 40 000 km i inntektsåret.<br />
For el-biler gjelder særlige regler.<br />
• Ved fri bil i deler av inntektsåret fastsettes<br />
<strong>for</strong>delen <strong>for</strong>holdsmessig etter hvor lenge<br />
du har hatt fri bil.<br />
Post 2.1.2 Inntekt som gir rett til særskilt<br />
fradrag <strong>for</strong> sjøfolk<br />
Inntekt som gir rett til særskilt fradrag <strong>for</strong><br />
sjøfolk, vil vanligvis være <strong>for</strong>håndsutfylt i<br />
selvangivelsen. Hvis ikke, skal du føre<br />
inntekten her. Særskilt fradrag <strong>for</strong> sjøfolk<br />
føres i post 3.2.13.<br />
Post 2.1.4 Overskudd på utgiftsgodtgjørelse<br />
Utgiftsgodtgjørelse er en ytelse som skal<br />
dekke kostnader i <strong>for</strong>bindelse med arbeid,<br />
oppdrag eller verv, f.eks. kost-, reise- <strong>og</strong><br />
bilkostnader.<br />
Godtgjørelse som dekker private kostnader<br />
er vanligvis fullt ut skattepliktig, f.eks.<br />
godtgjørelse <strong>for</strong> kostnader til reiser mellom<br />
hjem <strong>og</strong> fast arbeidssted.<br />
Nærmere om behandlingen av utgiftsgodtgjørelser,<br />
herunder om brutto- <strong>og</strong> nettometoden,<br />
se temaet «Arbeidsgivers dekning<br />
av utgifter til kost, losji <strong>og</strong> besøksreiser ved<br />
pendling fra utlandet <strong>og</strong> <strong>for</strong>holdet til<br />
standardfradrag <strong>for</strong> utenlandsk arbeidstaker».<br />
Ved bruk av nettometoden skal skattepliktig<br />
overskudd beregnes etter følgende satser:<br />
Hotell:<br />
kr 576 pr. døgn. Satsen er redusert med<br />
kr 64 <strong>for</strong> frokost inkludert i losji.<br />
Pensjonat:<br />
kr 293 pr. døgn. Satsen gjelder både <strong>for</strong> gifte<br />
<strong>og</strong> enslige.<br />
Hus/leilighet:<br />
kr 190 pr. døgn <strong>for</strong> enslige pendlere, gifte<br />
med familien i utlandet <strong>og</strong> samboende med<br />
egne/felles barn i utlandet.<br />
Brakke/hybel/campingv<strong>og</strong>n:<br />
kr 190 pr. døgn <strong>for</strong> både gifte <strong>og</strong> enslige. I<br />
brakke uten kokemuligheter er fradragssatsen<br />
kr 293. Kokemulighet skal <strong>for</strong>stås slik at hvis<br />
minst ett av måltidene pr. dag, f.eks. frokost<br />
eller aftens kan lages på brakken, gis kun<br />
fradrag etter laveste sats.<br />
Post 2.7.6 Næringsinntekt<br />
Næringsdrivende overfører næringsinntekt<br />
fra «Næringsoppgave 1» (RF‐1175).<br />

Post 2.7.8 Inntekt fra KS, ANS mv. som<br />
driver annen næring<br />
Deltaker overfører inntekt fra «Deltakeroppgaven»<br />
(RF‐1221).<br />

Post 2.8.5 Inntekt av fast eiendom<br />
Inntekt av fast eiendom i Norge er alltid<br />
skattepliktig i Norge.<br />
Fast eiendom i utlandet er i utgangspunktet<br />
skattepliktig når du er skattemessig bosatt i<br />
Norge. Ligger den faste eiendommen i et land<br />
som Norge har en skatteavtale med som<br />
anvender <strong>for</strong>delingsmetoden <strong>for</strong> å unngå<br />
dobbeltbeskatning, skal inntekten av den<br />
faste eiendommen ikke beskattes i Norge.<br />
4 Selvangivelsen 2012 – <strong>Rettledning</strong>
Når inntekt av fast eiendom i utlandet er<br />
skattepliktig i Norge, skal inntekten fastsettes<br />
etter norske regler. Egen bruk av bolig/<br />
fritidsbolig i utlandet er skattefri på samme<br />
måte som når boligen/fritidsboligen ligger i<br />
Norge. For mer in<strong>for</strong>masjon, se temaet «Bolig<br />
<strong>og</strong> annen fast eiendom» <strong>og</strong> «Fast eiendom i<br />
utlandet» i «<strong>Rettledning</strong>en til postene» på<br />
skatteetaten.no.<br />
Postene 3.1.5/3.1.6/3.1.7/3.1.8/3.1.9/<br />
3.1.10 Aksjer <strong>og</strong> andeler i fond<br />
Er du ikke skattemessig bosatt i Norge, skal<br />
utbytte på/gevinst ved salg av norske <strong>og</strong><br />
<strong>utenlandske</strong> aksjer <strong>og</strong> andeler i fond ikke<br />
føres i selvangivelsen. Står det et <strong>for</strong>håndsutfylt<br />
beløp i en av disse postene, skal<br />
beløpet strykes.<br />
Er du skattemessig bosatt i Norge, er utbytte<br />
på/gevinst ved salg av norske <strong>og</strong> <strong>utenlandske</strong><br />
aksjer <strong>og</strong> andeler i fond skattepliktig i Norge.<br />
Utbytte <strong>og</strong> avkastning av andeler i fond som<br />
ikke er <strong>for</strong>håndsutfylt i postene 3.1.5 <strong>og</strong> 3.1.6,<br />
skal føres i post 3.1.7.<br />
Gevinst ved salg <strong>og</strong> annen realisasjon av<br />
norske <strong>og</strong> <strong>utenlandske</strong> aksjer <strong>og</strong> andeler i<br />
fond føres i postene 3.1.8, 3.1.9 eller 3.1.10.<br />

Er du skattepliktig i Norge <strong>for</strong> utbytte fra et<br />
utenlandsk selskap, kan du kreve fradrag<br />
(kredit) i den norske skatten <strong>for</strong> kildeskatt<br />
som er trukket ved utbetalingen (begrenset til<br />
den satsen som følger av skatteavtalen). Du<br />
må dokumentere betalt skatt <strong>og</strong> fylle ut<br />
skjemaet «Fradrag <strong>for</strong> skatt betalt i utlandet<br />
av person – kreditfradrag» (RF‐1147), se<br />
rettledningen RF‐1148.<br />
Fradragsposter<br />
3.2.1 Minstefradrag<br />
Minstefradraget er et standardfradrag i lønn,<br />
pensjon <strong>og</strong> lignende inntekt. Minstefradraget<br />
beregnes automatisk.<br />
Minstefradraget skal utgjøre 38 prosent av<br />
lønnsinntekten. Minstefradraget skal<br />
minimum settes til kr 31 800 <strong>og</strong> maksimum til<br />
kr 78 150 <strong>for</strong> en person som oppholder seg i<br />
Norge i hele inntektsåret.<br />
Har du vært bosatt i Norge bare en del av året,<br />
skal minstefradragets øvre grense (kr 78 150)<br />
<strong>og</strong> nedre grense (kr 31 800) avkortes<br />
tilsvarende det antall hele eller påbegynte<br />
måneder av inntektsåret du har vært bosatt<br />
her. Minstefradraget skal likevel ikke være<br />
lavere enn kr 4 000.<br />
Hvor stort minstefradraget blir ved opphold i<br />
Norge i mindre enn 12 måneder framgår av<br />
tabellen på neste side. Er du bosatt i et annet<br />
EU/EØS-land <strong>og</strong> begrenset skattepliktig til<br />
Norge, kan du ha en utvidet fradragsrett når<br />
minst 90 prosent av din inntekt av arbeid,<br />
pensjon eller virksomhet beskattes i Norge,<br />
se under temaet «Utvidet fradragsrett <strong>for</strong><br />
personer fra EU/EØS med begrenset<br />
skatteplikt».<br />
Post 3.2.7 Fradrag <strong>for</strong> merkostnader til kost<br />
<strong>og</strong> losji mv. ved opphold uten<strong>for</strong> hjemmet<br />
Pendler du mellom bolig i hjemlandet <strong>og</strong><br />
bolig i Norge, kan du ha krav på fradrag, se<br />
temaet «Fradrag <strong>for</strong> merkostnader ved<br />
pendling til hjemmet i utlandet».<br />
Merkostnader til kost er avhengig av hvordan<br />
du har bodd. Det gis vanligvis fradrag ut fra<br />
240 fraværsdøgn per år.<br />
Utgifter til losji (boutgifter) må dokumen teres.<br />
Krever du fradrag <strong>for</strong> merkostnader ved å<br />
pendle til ditt hjem i en annen EU/EØS-stat,<br />
kan du ikke kreve fradrag <strong>for</strong> merkostnader<br />
ved å pendle mellom boliger i Norge.<br />
Du kan ikke kreve dette fradraget samtidig<br />
med standardfradrag <strong>for</strong> utenlandsk<br />
arbeidstaker, se post 3.3.7 <strong>og</strong> temaet<br />
«Standardfradrag <strong>for</strong> utenlandsk arbeidstaker».<br />
Post 3.2.8 Fradrag <strong>for</strong> reise mellom hjem <strong>og</strong><br />
fast arbeidssted<br />
Du får fradrag <strong>for</strong> reiser mellom hjem <strong>og</strong> fast<br />
arbeidssted (arbeidsreiser) ut fra en beregnet<br />
reiseavstand i kilometer. Reiseavstanden<br />
beregnes som hovedregel med utgangspunkt<br />
i korteste strekning mellom hjem <strong>og</strong> fast<br />
arbeidssted langs bilvei eller med rutegående<br />
transportmiddel, bortsett fra fly.<br />
Fradrag gis med kr 1,50 per km. Er den<br />
samlede reiseavstanden over 50 000 km,<br />
medregnet besøksreiser (se post 3.2.9), er<br />
satsen i utgangspunktet kr 0,70 per km <strong>for</strong><br />
det antall kilometer som overstiger<br />
50 000 km. Fradraget er begrenset til den<br />
delen av beløpet som overstiger<br />
kr 13 950 (egenandelen).<br />
I praksis vil det si at om du reiser fem dager<br />
i uken tur-retur hjem <strong>og</strong> fast arbeidssted, <strong>og</strong><br />
den daglige avstanden overstiger 39 km<br />
(tur-retur), kan du ha krav på reisefradrag.<br />
Ved kortere reiseavstand, kan du <strong>og</strong>så ha krav<br />
på fradrag hvis du:<br />
• har hatt flere reiser i året enn 230<br />

Post 3.2.9 Fradrag <strong>for</strong> reisekostnader ved<br />
besøk i hjemmet<br />
Pendler du mellom bolig i hjemlandet <strong>og</strong><br />
bolig i Norge, kan du ha krav på fradrag,<br />
se temaet «Fradrag <strong>for</strong> merkostnader ved<br />
pendling til hjem i utlandet».<br />
Fradraget gis etter de samme reglene <strong>og</strong><br />
satsene som ved arbeidsreiser, se post 3.2.8,<br />
med ett unntak: Har du brukt fly ved besøksreisen,<br />
kan du i stedet <strong>for</strong> avstandsfradrag<br />
(kr 1,50/kr 0,70 per km) kreve fradrag <strong>for</strong><br />
kostnader til flybillett. I tillegg kan du kreve<br />
avstandsfradrag <strong>for</strong> resten av reisen.<br />
Kostnadene må kunne dokumenteres.<br />
Fradraget <strong>for</strong> besøksreiser er begrenset til den<br />
delen av beløpet som overstiger kr 13 950.<br />
Fradrag <strong>for</strong> besøksreiser <strong>og</strong> arbeidsreiser ses<br />
under ett.<br />
Det må legges ved en oppstilling over antall<br />
kilometer/reiser mellom hjem <strong>og</strong> arbeidssted<br />

Post 3.2.10 Fradrag <strong>for</strong> kostnader til pass <strong>og</strong><br />
stell av barn (<strong>for</strong>eldrefradrag)<br />
Har du barn som er 11 år eller yngre (født<br />
2001 eller senere), kan du kreve <strong>for</strong>eldrefradrag<br />
<strong>for</strong> kostnader til pass <strong>og</strong> stell av barn<br />
som bor hjemme (kostnader til dagmamma,<br />
barnehage, skolefritidsordning o.l.).<br />
Fradraget er begrenset til kr 25 000 <strong>for</strong> ett<br />
barn, <strong>og</strong> fradragsgrensen økes med kr 15 000<br />
<strong>for</strong> hvert ytterligere barn.<br />
Post 3.2.13 Særskilt fradrag <strong>for</strong> sjøfolk<br />
Det særskilte fradraget <strong>for</strong> sjøfolk er 30<br />
prosent av skattepliktig inntekt om bord,<br />
maksimalt kr 80 000. Fradraget kan kreves av<br />
personer som har arbeid om bord på skip i fart<br />
som hovedbeskjeftigelse,<strong>og</strong> som har arbeidet<br />
om bord i minst 130 dager i inntektsåret.<br />
Omfattes arbeids<strong>for</strong>holdet av en tariffavtale<br />
som <strong>for</strong>utsetter minst 130 dager om bord i<br />
løpet av året, er vilkåret oppfylt selv om<br />
arbeidet om bord har vart mindre enn<br />
130 dager.<br />
Krever du særskilt fradrag <strong>for</strong> sjøfolk, må du<br />
fylle ut skjemaet «In<strong>for</strong>masjon vedrørende<br />
særskilt fradrag <strong>for</strong> sjøfolk» <strong>og</strong> legge det<br />
ved selvangivelsen. Skjemaet er vedlagt<br />
denne rettledningen.<br />
Du har krav på særskilt fradrag <strong>for</strong> sjøfolk når<br />
du arbeider om bord på fartøy som driver<br />
<strong>for</strong>synings-, beredskaps- eller håndteringstjenester,<br />
seismiske eller geol<strong>og</strong>iske<br />
under søkelser <strong>og</strong> annen sammenlignbar<br />
virksomhet, samt konstruksjons-, rørleggings-<br />
eller vedlikeholdsaktivitet på<br />
kontinentalsokkelen.<br />

Er du skattemessig bosatt i Norge, har du<br />
krav på fradrag <strong>for</strong> gjeldsrenter. Har du fast<br />
eiendom eller virksomhet i utlandet som ikke<br />
kan beskattes i Norge som følge av en<br />
skatteavtale, skal rentefradraget begrenses.<br />
Har du bare fast eiendom eller virksomhet i<br />
utlandet som ikke kan beskattes i Norge <strong>og</strong><br />
ingen skattepliktig <strong>for</strong>mue i Norge, vil<br />
rentefradraget i praksis falle bort.<br />
Renter på lån i utlandet skal dokumenteres.<br />
Er du ikke skattemessig bosatt i Norge, har<br />
du i utgangpunktet bare krav på fradrag <strong>for</strong><br />
gjeldsrenter som er knyttet til fast eiendom<br />
i Norge eller næringsvirksomhet som er<br />
skattepliktig i Norge.<br />
Er du bosatt i en annen EU/EØS-stat <strong>og</strong> ikke<br />
skattemessig bosatt i Norge, kan du få fradrag<br />
<strong>for</strong> gjeldsrenter etter de samme reglene som<br />
en person som er bosatt i Norge. Dette gjelder<br />
bare når minst 90 prosent av din samlede<br />
inntekt er skattepliktig i Norge.<br />
Har du fast eiendom eller virksomhet i<br />
utlandet, som ikke kan beskattes i Norge som<br />
følge av en skatteavtale, skal rentefradraget<br />
begrenses. Innen<strong>for</strong> EU/EØS gjelder dette<br />
når du har fast eiendom i Belgia, Bulgaria,<br />
Italia, Malta, Portugal eller Tyskland. Har du<br />
fast eiendom i et av disse landene <strong>og</strong> ingen<br />
skattepliktig <strong>for</strong>mue i Norge, vil rentefradraget<br />
i praksis falle bort.<br />
Du må legge fram tilstrekkelige opplysninger<br />
om dine inntekter uten<strong>for</strong> Norge til at det kan<br />
vurderes om minst 90 prosent av inntektene<br />
er skattepliktige i Norge. Krever du fradrag <strong>for</strong><br />
gjeldsrenter, skal du beskattes <strong>for</strong> renteinntekter<br />

Personer som oppholder seg/er bosatt i Norge<br />
hele inntektsåret, vil i tillegg til standard<br />
fradraget ha krav på fullt minstefradrag <strong>og</strong><br />
personfradrag. Personer som oppholder seg/<br />
er bosatt i Norge en del av inntektsåret, vil i<br />
tillegg til standardfradraget ha krav på<br />
<strong>for</strong>holdsmessige minstefradrag <strong>og</strong> personfradrag.<br />
Følgende fradrag kan gis i tillegg til standardfradraget<br />
dersom vilkårene <strong>for</strong> øvrig er<br />

regelmessig, kan du ha krav på fradrag <strong>for</strong><br />
merutgifter til kost <strong>og</strong> losji i Norge samt<br />
reiseutgifter ved besøk i hjemmet i hjemlandet.<br />
Dette kalles «pendlerutgifter».<br />
Hovedregelen er at merkostnader ved<br />
pendling til et hjem i utlandet ikke er<br />
fradragsberettiget. EØS-avtalen sikrer<br />
imidlertid EU/EØS-borgere som arbeider i<br />
Norge, samme rettigheter som <strong>arbeidstakere</strong><br />
som pendler innen Norge. Kommer du fra et<br />
EU/EØS-land kan du der<strong>for</strong> ha krav på<br />
pendlerfradrag.<br />
Arbeidstakere fra land uten<strong>for</strong><br />
EU/EØS-området<br />
Kommer du fra et land uten<strong>for</strong> EU/EØSområdet,<br />
har du ikke krav på fradrag <strong>for</strong><br />
merutgifter til kost, losji eller besøksreiser til<br />
ditt hjem i utlandet. Betaler din arbeidsgiver<br />
slike utgifter <strong>for</strong> deg, må du betale skatt av<br />
beløpene. Er du begrenset skattepliktig i<br />
Norge, kan din arbeidsgiver likevel betale<br />
slike utgifter uten at du blir skattlagt av<br />
beløpene, se under temaet «Arbeidsgivers<br />
dekning av utgifter til kost, losji <strong>og</strong> besøksreiser<br />
ved pendling fra utlandet <strong>og</strong> <strong>for</strong>holdet<br />
til standardfradrag <strong>for</strong> utenlandsk arbeidstaker».<br />
Arbeidstakere fra land innen<strong>for</strong> EU/<br />
EØS-området<br />
Når regnes du som pendler?<br />
Er du EU/EØS-borger <strong>og</strong> har ditt hjem i et<br />
annet EU/EØS-land, kan du kreve pendlerfradrag<br />
når du oppfyller vilkårene <strong>for</strong> å<br />
regnes som pendler.<br />
Familiependler<br />
Har du felles hjem med barn <strong>og</strong>/eller ektefelle<br />
som bor i hjemlandet, regnes du som<br />
skattemessig pendler når hjemmet ligger i et<br />
EU/EØS-land. Du må kunne legge fram<br />
vigsels- eller fødselsattest som bekrefter<br />
familie<strong>for</strong>holdet. I tillegg må du kunne legge<br />
fram dokumentasjon på felles bostedsadresse<br />
i hjemlandet. Det kreves normalt <strong>og</strong>så at du<br />
har tre til fire hjemreiser med overnatting<br />
i året.<br />
Enslig (ugift) pendler<br />
Du regnes som enslig pendler når du ikke er<br />
familiependler. Er du samboer, regnes du som<br />
enslig i denne sammenhengen. Bor du i<br />
tillegg sammen med egne barn, regnes du<br />
derimot som familiependler.<br />
Er du enslig stilles det andre krav <strong>for</strong> at du kan<br />
regnes som skattemessige pendler. Enslige<br />
regnes som bosatt der de har «selvstendig<br />
bolig». Har du selvstendig bolig i Norge, blir<br />
du regnet som bosatt i Norge <strong>og</strong> får ikke<br />
fradrag <strong>for</strong> utgifter ved besøk til hjemlandet.<br />
Boligen i Norge regnes som selvstendig når:<br />
• du disponerer den <strong>for</strong> minst 12 måneder <strong>og</strong><br />
har tilgang til den alle dager i uken<br />
• bruksarealet av boligens primærdel (eller<br />
boarealet) er minst 30 kvm<br />
• bor det flere personer i boligen, er kravet<br />
ytterligere 20 kvm <strong>for</strong> hver beboer over<br />
15 år<br />
• den har innlagt vann <strong>og</strong> avløp<br />
Du kan kreve fradrag <strong>for</strong> pendlerutgifter når<br />
du pendler til ditt hjem i et EU/EØS-land <strong>og</strong><br />
følgende krav er oppfylt:<br />
• du har ikke selvstendig bolig i Norge<br />
• du har selvstendig bolig i hjemlandet, eller<br />
er under 22 år ved utgangen av inntektsåret<br />
<strong>og</strong> pendler til dine <strong>for</strong>eldre<br />
• du reiser hjem hver tredje uke. Sjeldnere<br />
hjemreiser kan godtas når særlige grunner<br />
tilsier det, <strong>for</strong> eksempel ved sykdom eller<br />
dårlig økonomi.<br />
• Du må i tillegg dokumentere din bostedsadresse<br />
i utlandet.<br />
Er du under 22 år ved utgangen av inntektsåret<br />
<strong>og</strong> pendler til <strong>for</strong>eldrehjemmet, må du<br />
kunne dokumentere familietilknytningen med<br />
fødselsattest. I tillegg må du kunne legge<br />
fram dokumentasjon på felles bostedsadresse<br />
i utlandet <strong>og</strong> kunne sannsynliggjøre antall<br />
reiser mellom bosted i hjemlandet <strong>og</strong> bosted i<br />
Norge. Normalt vil det være tilstrekkelig at du<br />
reiser hjem hver sjette uke.<br />
Du kan <strong>og</strong>så regnes som pendler selv om<br />
boligen i Norge regnes som selvstendig.<br />
Kravene er da at:<br />
• du har vært registrert som bosatt på<br />
samme sted (kommune) i hjemlandet i<br />
tre år<br />
• du ikke leier ut boligen i hjemlandet<br />
• boligen i Norge ikke er større enn halvparten<br />
av boligen i hjemlandet<br />
Hvilke fradrag kan du kreve som pendler?<br />
Har du selv betalt kostnadene, <strong>og</strong> ikke krever<br />
standardfradrag <strong>for</strong> utenlandsk arbeidstaker,<br />
kan du kreve fradrag <strong>for</strong>:<br />
• Besøksreiser til hjemmet som beregnes<br />
etter en sats per km. Antall km fastsettes<br />
etter korteste reisestrekning langs vei<br />

da ikke fradrag etter sats <strong>for</strong> ferge- eller<br />

For 2012 er satsen kr 190 per døgn. Er det<br />
ikke mulig å koke mat der du bor, er satsen<br />
kr 293 per døgn.<br />
8 Selvangivelsen 2012 – <strong>Rettledning</strong>
Har din arbeidsgiver dekket deler av kostnadene,<br />
kan du bare kreve fradrag <strong>for</strong> de<br />
kostnadene du selv har dekket. Har du f.eks.<br />
fri bolig i Norge som er dekket av arbeidsgiver,<br />
kan du kreve fradrag <strong>for</strong> kost <strong>og</strong><br />
besøksreiser som beskrevet oven<strong>for</strong>.<br />
Har din arbeidsgiver dekket pendlerutgifter,<br />
er <strong>for</strong>delen ved dette skattefri, <strong>for</strong>utsatt at du<br />
ville hatt krav på fradrag <strong>for</strong> utgiftene dersom<br />
du hadde dekket dem selv. Det samme gjelder<br />
mottatt godtgjørelse som ikke overstiger<br />
satsene <strong>for</strong> fradrag. Bare et eventuelt<br />
overskudd på godtgjørelse skal skattlegges<br />
som lønn.<br />
Har din arbeidsgiver dekket alle kostnadene<br />
til kost, enten etter regning eller ved fri kost,<br />
<strong>og</strong> du mottar dette skattefritt, skal du<br />
skattlegges <strong>for</strong> «kostbesparelse i hjemmet».<br />
For 2012 er satsen <strong>for</strong> dette kr 79 per døgn.<br />
Det er tatt hensyn til kostbesparelse i<br />
fradragssatsene.<br />
Krever du standardfradrag <strong>for</strong> utenlandsk<br />
arbeidstaker, kan du ikke kreve ytterligere<br />
fradrag. Om <strong>for</strong>holdet til standardfradraget,<br />

arbeidstaker<br />
Oppfyller du vilkårene <strong>for</strong> å regnes som<br />
pendler i <strong>for</strong>hold til et hjem i utlandet <strong>og</strong> har<br />
krav på standardfradrag, må du velge om du<br />
vil beskattes etter «nettometoden» eller<br />
«bruttometoden» når din arbeidsgiver har<br />
dekket pendlerutgifter. Du kan velge fritt<br />
mellom disse, uavhengig av hvilken metode<br />
din arbeidsgiver har brukt ved utbetaling av<br />
godtgjørelsene.<br />
Bruttometoden:<br />
Alle ytelser fra arbeidsgiver til dekning av<br />
kost, losji <strong>og</strong> besøksreiser til hjemmet skal tas<br />
med i brutto skattepliktig inntekt. Du kan<br />
velge mellom 10 prosent standardfradrag <strong>og</strong><br />
fradrag <strong>for</strong> de faktiske kostnadene, herunder<br />
merkostnader i postene 3.2.7 <strong>og</strong> 3.2.9.<br />
Nettometoden:<br />
Ytelser fra arbeidsgiver til dekning av kost,<br />
losji <strong>og</strong> besøksreiser til hjemmet skal ikke tas<br />
med i skattepliktig inntekt, bare et eventuelt<br />
overskudd. Du kan kreve fradrag <strong>for</strong> faktiske<br />
kostnader som du selv har dekket. Når du<br />
velger nettometoden, kan du ikke kreve<br />
10 prosent standardfradrag.<br />
Arbeidstakere fra et annet EU/EØS-land<br />
Har du ditt hjem i et annet EU/EØS-land, <strong>og</strong><br />
du oppfyller vilkårene <strong>for</strong> å regnes som<br />
pendler <strong>og</strong> har krav på standardfradrag, kan<br />
du velge mellom brutto- <strong>og</strong> nettometoden.<br />
Dette innebærer at du må velge enten å kreve<br />
standardfradrag <strong>og</strong> beskattes <strong>for</strong> alle ytelser<br />
fra arbeidsgiver til dekning av kost, losji <strong>og</strong><br />
besøksreiser til hjemmet, eller ikke å kreve<br />
standardfradrag <strong>og</strong> i stedet få nettometoden<br />
på ytelsene fra arbeidsgiver.<br />
Er det gunstigere <strong>for</strong> deg å få standardfradrag<br />
<strong>for</strong> utenlandsk arbeidstaker enn fradrag <strong>for</strong><br />
kostnadene, kan du velge å bli skattlagt <strong>for</strong><br />
<strong>for</strong>delen ved at arbeidsgiver har dekket<br />
kostnadene. Da må du <strong>for</strong>høye inntekten du<br />
oppgir i selvangivelsen med denne <strong>for</strong>delen.<br />
Arbeidstakere fra land uten<strong>for</strong><br />
EU/EØS-området<br />
Har du ditt hjem i et land uten<strong>for</strong> EU/<br />
EØS-området, kan du ikke kreve fradrag <strong>for</strong> de<br />
faktiske kostnadene til kost, losji <strong>og</strong> besøksreiser<br />
til hjemmet.<br />
Er du skattemessig bosatt i Norge skal alle<br />
ytelser fra arbeidsgiver til dekning av kost,<br />
losji <strong>og</strong> besøksreiser til hjemmet i utlandet<br />
tas med i brutto skattepliktig inntekt. Du har<br />
krav på 10 prosent standardfradrag de to<br />
første inntektsårene du beskattes som bosatt.<br />
Er du begrenset skattepliktig i Norge <strong>og</strong><br />
oppfyller vilkårene <strong>for</strong> å regnes som pendler,<br />
kan du velge mellom brutto- <strong>og</strong> nettometoden.<br />
Dette innebærer at du må velge<br />
enten å kreve standardfradrag <strong>og</strong> beskattes<br />
<strong>for</strong> alle ytelser fra arbeidsgiver til dekning av<br />
kost, losji <strong>og</strong> besøksreiser til hjemmet, eller<br />

Pendling mellom utlandet <strong>og</strong> norsk<br />
kontinentalsokkel<br />
Er du bosatt i en annen EU/EØS-stat, kan du<br />
velge mellom brutto- <strong>og</strong> nettometoden.<br />
Er du bosatt uten<strong>for</strong> EU/EØS-området, kan du<br />
<strong>og</strong>så velge mellom brutto- <strong>og</strong> netto-metoden.<br />
Ved valg av bruttometoden kan det bare<br />
kreves 10 prosent standardfradrag. Velger du<br />
nettometoden, kan du ikke kreve 10 prosent<br />
standardfradrag eller fradrag <strong>for</strong> faktiske<br />
kostnader du selv har dekket.<br />
Utvidet fradragsrett <strong>for</strong><br />
personer fra EU/EØS med<br />
begrenset skatteplikt<br />
Personlige <strong>og</strong> familiemessige fradrag<br />
Er du bosatt i et annet EU/EØS-land <strong>og</strong><br />
begrenset skattepliktig til Norge, kan du ha<br />
en utvidet fradragsrett når minst 90 prosent<br />
av din inntekt av arbeid, pensjon eller<br />
virksomhet beskattes i Norge. Den utvidede<br />
fradragsretten omfatter de fleste ordinære<br />
fradrag. Omfattes du av reglene om utvidet<br />
fradragsrett, har du bl.a. rett til fulle<br />
årsfradrag <strong>for</strong> fradrag som ellers begrenses<br />
i <strong>for</strong>hold til hvor lenge du oppholder deg i<br />
Norge i inntektsåret. Du kan <strong>og</strong>så ha rett på<br />
bl.a. <strong>for</strong>eldrefradrag <strong>for</strong> pass <strong>og</strong> stell av barn.<br />
Er du gift, skal din ektefelles inntekt tas med<br />
i vurderingen av om dere betaler skatt i Norge<br />
av minst 90 prosent av inntektene deres. Har<br />
du samboer <strong>og</strong> felles barn skal samboers<br />
inntekt tas med når du krever <strong>for</strong>eldrefradrag.<br />
Du må dokumentere at betingelsene <strong>for</strong> å få<br />
fradrag etter reglene <strong>for</strong> bosatte skattytere<br />
er oppfylt. Du må legge fram tilstrekkelige<br />
opplysninger om dine (<strong>og</strong> ektefellens)<br />
inntekter uten<strong>for</strong> Norge til at det kan vurderes<br />
om minst 90 prosent av inntektene ved<br />
arbeid, pensjon eller virksomhet er skattepliktige<br />
i Norge. Er du samboer <strong>og</strong> krever<br />
<strong>for</strong>eldrefradrag, må det <strong>og</strong>så gis opplysninger<br />
om samboers inntekt.<br />
Fradrag <strong>for</strong> gjeldsrenter<br />
Er du bosatt i en EØS-stat <strong>og</strong> begrenset<br />
skattepliktig til Norge, kan du <strong>og</strong>så få fradrag<br />
<strong>for</strong> gjeldsrenter etter de samme reglene som<br />
en person som er bosatt i Norge. Dette gjelder<br />
bare når minst 90 prosent av din samlede<br />
inntekt er skattepliktig i Norge. Har du fast<br />

eiendom eller virksomhet i utlandet som<br />
ikke kan beskattes i Norge som følge av en<br />
skatteavtale, skal rentefradraget begrenses.<br />
Innen<strong>for</strong> EU/EØS gjelder dette når du har fast<br />
eiendom i Belgia, Bulgaria, Italia, Malta,<br />
Portugal eller Tyskland. Har du fast eiendom<br />
i et av disse landene <strong>og</strong> ingen skattepliktig<br />
<strong>for</strong>mue i Norge, vil rentefradraget i praksis<br />
falle bort.<br />
Du må legge fram tilstrekkelige opplysninger<br />
om dine inntekter uten<strong>for</strong> Norge til at det kan<br />
vurderes om minst 90 prosent av inntektene<br />
er skattepliktige i Norge. Utenlandske renter<br />
må dokumenteres.<br />
Krever du fradrag etter disse reglene, kan du<br />
ikke kreve standardfradrag <strong>for</strong> utenlandsk<br />
arbeidstaker.<br />
Krever du fradrag <strong>for</strong> gjeldsrenter, skal du i<br />
visse tilfeller beskattes <strong>for</strong> renteinntekter mv.<br />
fra norske kilder.<br />
Næringsdrivende<br />
(eier av enkelperson<strong>for</strong>etak)<br />
Fast driftssted<br />
Du skal betale skatt i Norge når du driver<br />
virksomheten i Norge gjennom et fast<br />
driftssted i Norge.<br />
Det er bare den inntekten som knytter seg<br />
til det faste driftsstedet, som er skattepliktig<br />
i Norge. Det gis bare fradrag <strong>for</strong> kostnader<br />
som knytter seg til virksomheten i Norge.<br />
Beskatningen skjer etter norske regler.<br />
Dette innebærer bl.a. at det skal beregnes<br />
personinntekt av den inntekten som er<br />
skattepliktig i Norge. Du må fylle ut «Personinntekt<br />
fra enkeltperson<strong>for</strong>etak» (RF‐1224).<br />
Beregnet personinntekt overføres til<br />
post 1.6.2 (beregnet personinntekt annen<br />
næring) i selvangivelsen.<br />
Er du f.eks. lege, revisor, ingeniør eller<br />
konsulent (såkalt fritt yrke), kan du <strong>og</strong>så bli<br />
skattepliktig i Norge når du har oppholdt deg<br />
i Norge i mer enn 183 dager i løpet av en<br />
periode på 12 måneder. Dette gjelder selv om<br />
du ikke har noe fast driftssted.<br />
Du er i utgangspunktet <strong>og</strong>så skattepliktig i<br />
Norge når du driver virksomhet på den norske<br />
kontinentalsokkelen. Skatteavtalene har<br />
<strong>for</strong>skjellige regler som begrenser skatte plikten.<br />

Deltakere i deltaker liknede<br />
selskaper<br />
Deltakerliknet selskap (ANS, KS mv.) er ikke<br />
eget skattesubjekt etter norsk rett. Selskapets<br />
<strong>for</strong>mue <strong>og</strong> inntekt skattlegges hos deltakerne<br />
(deltakerlikning).<br />
Utenlandske deltakere beskattes i Norge hvis<br />
deltakeren gjennom selskapsdeltakelsen<br />
utøver virksomhet her gjennom fast driftssted.<br />
Dette gjelder både andel av overskudd<br />
eller underskudd (skatteloven § 10-41),<br />
eventuelt særskilt godtgjørelse <strong>for</strong> arbeidsinnsats<br />
i Norge (skatteloven § 12-2 bokstav f)<br />
<strong>og</strong> tillegg i alminnelig inntekt <strong>for</strong> personlige<br />
deltakere (skatteloven § 10-42). Gevinst ved<br />
realisasjon av andel i norsk ansvarlig selskap<br />
kan beskattes i Norge når deltakeren anses å<br />
ha drevet virksomhet her gjennom fast<br />
driftssted.<br />
Selskap som deltakerliknes plikter å levere<br />
«Selskapsoppgave <strong>for</strong> deltakerliknet selskap»<br />
(RF‐1215) <strong>og</strong> «Selskapets oppgave over<br />
deltakernes <strong>for</strong>mue <strong>og</strong> inntekt i deltakerliknet<br />
selskap» (RF‐1233). Deltakere i slike<br />
selskaper skal levere «Deltakerens oppgave<br />
over <strong>for</strong>mue <strong>og</strong> inntekt i deltakerliknet<br />

Unngåelse av<br />
dobbeltbeskatning<br />
Begrenset skattepliktig<br />
Er du begrenset skattepliktig i Norge, er det<br />
skattemyndighetene i ditt hjemland som skal<br />
sørge <strong>for</strong> at inntekt som er skattepliktig i<br />
Norge, ikke blir dobbeltbeskattet.<br />
Skattemessig bosatt<br />
Er du skattemessig bosatt i Norge etter norsk<br />
intern rett, men bosatt i ditt hjemland etter<br />
skatteavtalen, er det skattemyndighetene i<br />
ditt hjemland som skal sørge <strong>for</strong> at inntekt<br />
som er skattepliktig i Norge, ikke blir<br />
dobbeltbeskattet.<br />
Er du bosatt i Norge både etter intern rett <strong>og</strong><br />
skatteavtalen, skal norske skattemyndigheter<br />
sørge <strong>for</strong> at inntekt som kan beskattes i<br />
utlandet etter en skatteavtale, ikke blir<br />
dobbeltbeskattet.<br />
Trygdeavgift<br />
Du er i utgangspunktet omfattet av norsk<br />
trygd. Arbeidstakere skal betale norsk<br />
trygdeavgift med 7,8 prosent av inntekt<br />
opptjent i Norge. Næringsdrivende skal<br />
betale norsk trygdeavgift med 11 prosent av<br />
beregnet personinntekt. Nedre grense <strong>for</strong> å<br />
beregne trygdeavgift er kr 39 600.<br />
Arbeidstakere <strong>og</strong> næringsdrivende på den<br />
norske delen av kontinentalsokkelen er i<br />
utgangspunktet pliktige medlemmer i norsk<br />
trygd på lik linje med <strong>arbeidstakere</strong>/<br />
næringsdrivende på land i Norge.<br />
Personer som ikke er medlem av norsk<br />
folketrygd må dokumentere dette. Er du<br />
EØS-borger <strong>og</strong> medlem i trygdeordningen i en<br />
annen EØS-stat, må du legge frem blankett<br />
E-101/A1 som utstedes av trygdemyndighetene<br />
i hjemlandet. Er du medlem av<br />
trygde ordningen i hjemlandet etter en<br />
trygdeavtale mellom Norge <strong>og</strong> ditt hjemland,<br />
må du legge fram tilsvarende dokumentasjon.<br />
Du kan <strong>og</strong>så legge fram en bekreftelse fra<br />
NAV Internasjonalt om du ikke er medlem.<br />
Dersom du tidligere har levert E-101/A1<br />
eller tilsvarende dokumentasjon til<br />
NAV Internasjonalt eller <strong>Skatteetaten</strong>, må<br />
du gjøre oppmerksom på dette i post 5.0.<br />

tax return<br />
Personal taxpayers who are to be assessed by<br />
the Central Office – Foreign Tax Affairs <strong>for</strong> the<br />
income year 2012 will be sent either:<br />
• "Tax return <strong>for</strong> wage earners and<br />
pensioners etc. 2012" or<br />
• "Tax return <strong>for</strong> self-employed persons<br />
etc. 2012".<br />
Completion of tax<br />
returns<br />
In<strong>for</strong>mation received by the Norwegian Tax<br />
Administration from employers, banks,<br />
insurance companies etc. is entered in<br />
advance in the tax return.<br />
If you have taxable income and capital that<br />
have not been entered in your tax return in<br />
advance, you must enter them so that they<br />
are included. You must also check that the<br />
pre-entered in<strong>for</strong>mation is complete and<br />
correct.<br />
If there are no separate items <strong>for</strong> amounts<br />
that you wish to enter in the tax return, enter<br />
the amounts in the field "Any amounts that<br />
have not been pre-entered must be entered<br />
here". State the number of the item. Please<br />
find a list of the most relevant items below.<br />
You will find a complete list of the items in<br />
the explanation of the items in "Guidelines to<br />
the individual items". If you cannot find the<br />
number of the item, you can just omit it. In<br />
such case, write what the amount concerns.<br />
Enter new or changed deduction and debt<br />
amounts with a minus sign in front, and<br />
income and capital amounts without any sign<br />
in front. All amounts must be in whole NOK.<br />
If you are going to correct a pre-entered<br />
amount, income and deduction amounts must<br />
be entered in the first correction column and<br />
capital and debt amounts in the second one.<br />
Check that all income and deductions are<br />
included.<br />

You can apply to the tax office <strong>for</strong> an<br />
extension of the deadline if you have special<br />
reasons, <strong>for</strong> example sickness or absence due<br />
to travel, that makes it very difficult <strong>for</strong> you<br />
to submit the tax return by the deadline. You<br />
can apply <strong>for</strong> an extension of the deadline<br />

Persons who do not receive a pre-completed<br />
tax return must complete and submit the "Tax<br />

pre-completed tax return 2012" (RF-1281).<br />
This tax return must be submitted on paper.<br />
The deadline is 30 April 2013.<br />
General in<strong>for</strong>mation about<br />
tax liability to Norway<br />
When do you become liable to tax in<br />
Norway?<br />
The extent of the tax liability depends on how<br />
long you stay in Norway during a 12-month<br />
period or a 36-month period. In explanations<br />
of the tax liability, you will encounter the two<br />
terms "limited tax liability" and "tax<br />
resident".<br />
Limited tax liability<br />
You have limited tax liability to Norway if you<br />
stay in Norway <strong>for</strong> one or more periods not<br />
exceeding: 183 days during a 12-month<br />
period, or 270 days during a 36-month<br />
period.<br />
This means that you are only liable to tax <strong>for</strong><br />
certain income relating to Norway. This<br />
applies to i.e. pay <strong>for</strong> work carried out in<br />
Norway and income from business activities<br />
carried out in Norway.<br />
You also have limited tax liability to Norway if<br />
you work or engage in business activities on<br />
the Norwegian continental shelf.<br />
The tax liability may be limited as a result of<br />
the provisions of tax treaties Norway has<br />
signed with other countries.<br />
12 Selvangivelsen 2012 – <strong>Rettledning</strong>
Tax resident<br />
You will be tax resident in Norway if you stay<br />
in Norway <strong>for</strong> more than 183 days during a<br />
12-month period, or more than 270 days<br />
during a 36-month period. You will become<br />
tax resident from the income year when your<br />
stay exceeds 183 or 270 days during a period<br />
of 12 or 36 months, respectively.<br />
When you are tax resident in Norway, you are<br />
liable to tax in Norway on all income and<br />
capital, regardless of whether it has been<br />
earned or is located in Norway or abroad. The<br />
tax liability may be limited as a result of the<br />
provisions of tax treaties Norway has signed<br />
with other countries.<br />

Completion of the items about pay etc. shall<br />

(Certificate of Tax and Pay Deducted 2012),<br />
which you should have received from your<br />
employer. If you have not received such a<br />
certificate, you must nonetheless declare<br />
the income.<br />
Item 2.1.1 Pay, remuneration, payment<br />
in kind etc.<br />
Here, you enter pay, fees, severance pay,<br />
holiday pay and other remuneration from<br />
your employer, e.g. the benefit of free use of a<br />
car, wholly or partially free accommodation,<br />
free work clothes etc. You must also enter pay<br />
etc. that you have received after leaving<br />
Norway under this item.<br />
Remuneration reported under code 112-A<br />
(payments in kind subject to tax withholdings)<br />
and code 116-A (taxable part of<br />
accident insurance and occupational injury<br />
insurance) is entered here. The benefit of free<br />
board, NOK 79 per day, is taxable.<br />
For offshore workers, free board is tax-exempt<br />
<strong>for</strong> employees with a taxable income of less<br />
than NOK 600,000.<br />
Remuneration reported under code 151-A<br />
(nuisance bonus) is entered here after a<br />
deduction of one third of the amount, a<br />
maximum of NOK 2,050.<br />
The taxable benefit of free housing in<br />
employment relationships reported under<br />
code 121-A is reported here.<br />
Other taxable remuneration that is not to be<br />
entered under other items is also entered here.<br />
The benefit of free use of a car (code 118-A)<br />
shall be stipulated to be 30 per cent of the<br />
car’s list price as new up to and including NOK<br />
270,600 plus 20 per cent of the list price in<br />
excess of this amount. The benefit is<br />
calculated on the basis of 75 per cent of the<br />
car’s list price in the following cases:<br />
• <strong>for</strong> cars older than three years as of<br />
1 January of the income year<br />
• <strong>for</strong> taxpayers who can substantiate that<br />
job-related driving exceeds 40,000 km<br />
during the income year.<br />
Special rules apply to el-cars.<br />
If you have had free use of a car <strong>for</strong> part of<br />
the income year, the benefit is stipulated<br />
proportionately to how long you had free use<br />
of a car.<br />
Item 2.1.2 Income entitling you to a<br />
seafarers’ allowance<br />
Income entitling you to a special seafarers’<br />
allowance will usually have been pre-entered<br />

in your tax return. If it is not, you must enter<br />
this income here. The seafarers’ allowance is<br />
entered under item 3.2.13.<br />
Item 2.1.4 Surplus on expense allowances<br />
Expense allowances are remuneration<br />
intended to cover expenses incurred in the<br />
per<strong>for</strong>mance of your work, assignments or<br />
office, e.g. board, travel and car expenses.<br />
Allowances that cover private expenses are<br />
normally liable to tax in full, e.g. allowances<br />
<strong>for</strong> travel expenses <strong>for</strong> travel between the<br />
home and a permanent place of work.<br />

of expense allowances, including the gross<br />

When the net method is used, taxable surplus<br />
is to be calculated in accordance with the<br />
following rates:<br />
Hotel:<br />
NOK 576 per day. The rate is reduced by NOK<br />
64 because breakfast is included.<br />
Guest house:<br />
NOK 293 per day. This rate applies to married<br />
and single persons alike.<br />
House/apartment:<br />
NOK 190 per day <strong>for</strong> single commuters,<br />
married persons whose family is staying<br />
abroad and cohabitants with own/joint<br />
children abroad.<br />
Portacabin/bedsit/caravan:<br />
NOK 190 per day <strong>for</strong> married and single<br />
persons alike. The deduction rate <strong>for</strong><br />
portacabin accommodation without cooking<br />
possibilities is NOK 293. Cooking possibilities<br />
shall be understood to mean that if at least<br />
one of the daily meals, e.g. breakfast or<br />
evening meal, can be prepared in the<br />
portacabin, deduction will only be given in<br />
accordance with the lowest rate.<br />
Item 2.7.6 Income from self-employment<br />
Self-employed persons transfer their income<br />
from self-employment from <strong>for</strong>m RF-1175E<br />
"Income Statement 1 <strong>for</strong> 2012".<br />

Item 2.7.8 Income from KS, ANS etc.<br />

The partner transfers the income from <strong>for</strong>m<br />

Item 2.8.5 Income from real property<br />
Income from real property in Norway is<br />
always liable to tax in Norway.<br />
In principle, real property abroad is liable to<br />
tax when you are tax resident in Norway. If<br />
the real property is in a country with which<br />
Norway has a tax treaty that employs the<br />
exemption method in order to avoid double<br />
taxation, the income from the real property<br />
shall not be liable to tax in Norway.<br />
If the income from real property abroad is<br />
liable to tax in Norway, the income will be<br />
stipulated pursuant to Norwegian rules. Your<br />
own use of a house/holiday home abroad is<br />
tax-exempt in the same way as if the house/<br />
holiday home had been in Norway. For further<br />

Items 3.1.5/3.1.6/3.1.7/3.1.8/3.1.9/<br />
3.1.10 Shares and units in unit trusts<br />
If you are not tax resident in Norway,<br />
dividends on/gains from the sale of Norwegian<br />
and <strong>for</strong>eign shares or units are not to be<br />
entered in your tax return. Delete any amount<br />
entered in advance in these items. If you are<br />
tax resident in Norway, dividends on/gains<br />
from the sale of Norwegian and <strong>for</strong>eign shares<br />
or units are liable to tax in Norway.<br />
Dividends and yield from units in unit trusts<br />
that are not entered in advance in items 3.1.5<br />
and 3.1.6 are to be entered under item 3.1.7.<br />
Gains from the sale or other <strong>for</strong>m of<br />
realisation of Norwegian and <strong>for</strong>eign shares<br />
and units in unit trusts are entered under<br />
item 3.1.8, 3.1.9 or 3.1.10.<br />

If you are liable to tax to Norway <strong>for</strong> dividend<br />
from a <strong>for</strong>eign company, you are entitled to<br />
claim a deduction (credit) from Norwegian<br />
tax <strong>for</strong> the withholding tax deducted on<br />
payment (limited to the rate specified in the<br />
tax treaty). You must document that tax has<br />
been paid and complete <strong>for</strong>m RF-1147E<br />
"Deduction <strong>for</strong> tax paid abroad by a person<br />
(credit) 2012", see guidelines RF-1148.<br />
Deduction items<br />
3.2.1 Minimum standard deduction<br />
The minimum standard deduction is a<br />
standard deduction from wage earnings,<br />
pensions and similar income. The minimum<br />
standard deduction is calculated<br />
automatically.<br />
The minimum standard deduction is 36 per<br />
cent of your wage earnings. The minimum<br />
amount of the minimum standard deduction<br />
is NOK 31,800 and the maximum amount is<br />
NOK 75,150 <strong>for</strong> a person who has lived in<br />
Norway during the whole income year.<br />
If you have only lived in Norway <strong>for</strong> part of<br />
the year, the minimum standard deduction’s<br />
upper (NOK 75,150) and lower (NOK 31,800)<br />
limits will be reduced in proportion to the<br />
number of whole or part months you have<br />
been resident in Norway. The minimum<br />
standard deduction shall not be less than<br />
NOK 4,000, however.<br />
The minimum standard deduction <strong>for</strong> people<br />
who live in Norway <strong>for</strong> less than 12 months is<br />
shown in the table on this page. If you are<br />
resident in another EU/EEA country and have<br />
limited tax liability to Norway, you can be<br />
granted an extended right to deductions if at<br />
least 90 per cent of your income from<br />
employment, pension or business activity is<br />
liable to tax in Norway, see the topic<br />
"Extended right to deductions <strong>for</strong> persons<br />
from EU/EEA countries who have limited<br />
tax liability".<br />

Item 3.2.7 Deduction <strong>for</strong> extra expenses <strong>for</strong><br />
board and lodging etc. in connection with<br />
stays away from home<br />
If you commute between a home in your home<br />
country and housing in Norway, you may be<br />
entitled to a deduction. See the topic<br />
"Deduction <strong>for</strong> extra expenses in connection<br />
with commuting to a home abroad".<br />
Extra board expenses depend on your type of<br />
accommodation. The deduction is normally<br />
based on 240 days of absence from the home<br />
per year.<br />
Lodging expenses must be documented.<br />
If you claim a deduction <strong>for</strong> extra expenses<br />
connected with commuting to your home in<br />
another EU/EEA country, you cannot claim a<br />
deduction <strong>for</strong> extra expenses in connection<br />
with commuting between homes in Norway.<br />
You cannot claim this deduction and at the<br />
same time claim the standard deduction <strong>for</strong><br />
<strong>for</strong>eign employees, see item 3.3.7 and the<br />
topic "The standard deduction <strong>for</strong> <strong>for</strong>eign<br />
employees".<br />
Item 3.2.8 Deduction <strong>for</strong> travel between the<br />
home and permanent workplace<br />
You are entitled to a deduction <strong>for</strong> travel<br />
between your home and your permanent<br />
workplace (travel to/from work) on the basis<br />
of an estimated travel distance in kilometres.<br />
The travel distance is normally calculated on<br />
the basis of the shortest distance by road<br />
between the home and the permanent<br />
workplace or by scheduled public transport,<br />
excluding air travel.<br />
The deduction is NOK 1.50 per km. If the total<br />
travel distance, including home visits (see<br />
item 3.2.9), exceeds 50,000 km, the rate will<br />
normally be NOK 0.70 per km <strong>for</strong> kilometres in<br />
excess of 50,000 km. The deduction is only<br />
given <strong>for</strong> amounts in excess of NOK 13,950<br />
(the non-deductible amount).<br />
In practice, this means that if you make the<br />
return journey between your home and<br />
permanent place of work five days a week and<br />
the daily distance exceeds 39 km (there and<br />
back), you may be entitled to a travel<br />
deduction. You may also be entitled to a<br />
deduction <strong>for</strong> shorter distances if you:<br />
• travel back and <strong>for</strong>th more than 230 times<br />
a year, or<br />
• are entitled to a deduction <strong>for</strong> home visits<br />
in connection with stays away from home<br />
(commuter stays), see item 3.2.9.<br />
You cannot claim this deduction and at the<br />
same time claim the standard deduction <strong>for</strong><br />
<strong>for</strong>eign employees, see item 3.3.7 and the<br />
topic "The standard deduction <strong>for</strong> <strong>for</strong>eign<br />
employees".<br />
Item 3.2.9 Deduction <strong>for</strong> travel expenses in<br />
connection with home visits<br />
If you commute between a home in your home<br />
country and housing in Norway, you may be<br />
entitled to a deduction. See the topic<br />
"Deduction <strong>for</strong> extra expenses in connection<br />
with commuting to a home abroad".<br />
The deduction is granted pursuant to the<br />
same rules and rates as <strong>for</strong> travel to/from<br />
work, see item 3.2.8, but with one exception:<br />
if your home visits involved travel by air, you<br />
can claim a deduction <strong>for</strong> the air fare instead<br />
of <strong>for</strong> the distance travelled (NOK 1.50/NOK<br />
0.70 per km). You can also claim the distance<br />
deduction <strong>for</strong> the rest of the journey. You<br />
must be able to document your expenses.<br />
The deduction <strong>for</strong> home visits is limited to the<br />
amount in excess of NOK 13,950.<br />
The deduction <strong>for</strong> home visits is dealt with<br />
t<strong>og</strong>ether with the deduction <strong>for</strong> travel<br />
between the home and workplace.<br />
You must enclose a statement showing the<br />
number of kilometres/travels between your<br />
home and workplace in Norway.<br />
You cannot claim this deduction and at the<br />
same time claim the standard deduction <strong>for</strong><br />
<strong>for</strong>eign employees, see item 3.3.7 and the<br />
topic "The standard deduction <strong>for</strong> <strong>for</strong>eign<br />
employees".<br />
Item 3.2.10 Deduction <strong>for</strong> child-care<br />
expenses (child-care deduction)<br />
If you have one or more children aged eleven<br />
or younger (born in 2001 or later), you can<br />
claim a child-care deduction <strong>for</strong> expenses<br />
relating to the minding and care of children<br />
living at home (expenses relating to a<br />
childminder, day care centre, be<strong>for</strong>e and after<br />
school hours supervision scheme etc.).<br />
The deduction is limited to NOK 25,000 <strong>for</strong><br />
one child, and the maximum deduction limit<br />
is increased by NOK 15,000 <strong>for</strong> each additional<br />
child.<br />
Item 3.2.13 Seafarers’ allowance<br />
The special seafarer’s allowance is 30 per cent<br />
of their taxable income on board, a maximum<br />
of NOK 80,000. The allowance can be claimed<br />
by persons whose main occupation has been<br />
work on board vessels in service, and who<br />
have worked on board <strong>for</strong> a total of at least<br />
130 days during the income year. If the<br />
employment relationship is covered by a<br />
collective agreement which requires at least<br />
130 working days on board during the year,<br />
the requirement is still regarded as being met<br />
even if work on board has not lasted <strong>for</strong><br />
130 days.<br />

If you are claiming a seafarer’s allowance,<br />
you must complete the <strong>for</strong>m "In<strong>for</strong>mation<br />
concerning claim <strong>for</strong> the Seafarer’s allowance"<br />
and enclose it with your tax return. The <strong>for</strong>m<br />
is enclosed with these guidelines.<br />
You are entitled to a seafarer’s allowance if<br />
you work on board vessels that are engaged in<br />
supply, emergency response or anchor<br />
handling services, seismic or geol<strong>og</strong>ical<br />
surveying and other similar activities, as well<br />
as construction, pipe laying or maintenance<br />
activities on the continental shelf.<br />
You are not entitled to a seafarer’s allowance<br />
if you work on board vessels that are engaged<br />
in exploration, exploration drilling,<br />
extraction, exploitation or pipeline<br />
transportation on the continental shelf.<br />
Item 3.2.19 Deficit, other enterprise or<br />
business/Deficit, KS, ANS etc. engaged in<br />
other commercial activities<br />
Self-employed persons transfer their deficit<br />

Items 3.3.1/3.3.2 Interest on debt in<br />
Norway and abroad<br />
If you are tax resident in Norway, you are<br />
entitled to a deduction <strong>for</strong> interest on debt. If<br />
you own real property or a business abroad<br />
that may not be taxed in Norway according to<br />
a tax treaty, the deduction <strong>for</strong> interest on<br />
debt will be reduced. If you have only real<br />
property or business abroad that may not be<br />
taxed in Norway, and you do not have any<br />
taxable capital in Norway, the deduction <strong>for</strong><br />
interest on debt will in practice not apply.<br />
Interest on loans abroad must be<br />
documented.<br />
If you are not tax resident in Norway, you are<br />
normally only entitled to a deduction <strong>for</strong><br />
interest on debt relating to real property in<br />
Norway or business activities that are liable<br />
to tax in Norway.<br />
If you are resident in another EU/EEA country<br />
and are not tax resident in Norway, you can<br />
also deduct interest on debt in accordance<br />
with the same rules as a person resident in<br />
Norway. This only applies if at least 90 per<br />
cent of your total income is liable to tax in<br />
Norway.<br />
If you own real property or a business abroad<br />
that is not liable to tax in Norway due to a tax<br />
treaty, the deduction <strong>for</strong> interest on debt will<br />
be limited. In the EU/EEA area, this applies if<br />
you own real property in Belgium, Bulgaria,<br />
Italy, Malta, Portugal or Germany. If you own<br />
real property in one of these countries and do<br />
not have any taxable capital in Norway, the<br />
deduction <strong>for</strong> interest on debt will in practice<br />
not apply.<br />
You must provide sufficient in<strong>for</strong>mation about<br />
your income outside Norway <strong>for</strong> it to be<br />
possible to calculate whether at least 90 per<br />
cent of your income is liable to tax in Norway.<br />
If you are claiming a deduction <strong>for</strong> interest on<br />
debt, you will be taxed on interest income<br />
etc. from Norwegian sources.<br />
If you are claiming a deduction<br />
pursuant to these rules, you cannot claim the<br />
standard deduction <strong>for</strong> <strong>for</strong>eign employees.<br />
Item 3.3.7 Other deductions<br />
Specify what you are claiming a deduction <strong>for</strong>.<br />
Among other things, this item is used <strong>for</strong>:<br />

employees<br />
Foreign employees who have limited tax<br />
liability to Norway on wage earnings can<br />
claim the standard deduction <strong>for</strong> <strong>for</strong>eign<br />
employees. Foreign employees who stay in<br />
Norway <strong>for</strong> so long that they become tax<br />
resident here can claim the standard<br />
deduction <strong>for</strong> <strong>for</strong>eign employees in connection<br />
with their tax assessment <strong>for</strong> the first<br />
two income years <strong>for</strong> which they are assessed<br />
as resident in Norway.<br />
The deduction is 10 per cent of gross income<br />
from employment, or maximum NOK 40,000.<br />
If you claim the standard deduction, many<br />
other deductions do not apply.<br />

If you have a spouse who is also entitled to<br />
the standard deduction, either both of you or<br />
neither of you must claim the standard<br />

If you are not tax resident in Norway, you<br />
cannot claim a deduction <strong>for</strong> loss on sale of<br />
shares and units in unit trusts etc. Delete any<br />
amount entered in advance under these<br />

If you are tax resident in Norway, you can<br />
claim a deduction <strong>for</strong> loss on sale of shares<br />
and units in unit trusts etc.<br />

Capital and debt<br />
If you are not tax resident in Norway, you are<br />
only liable to tax <strong>for</strong> capital in the <strong>for</strong>m of<br />
real property and assets in business activities<br />
operated in Norway. If capital other than real<br />
property in Norway has been entered in<br />
advance in your tax return, those amounts<br />
are to be deleted.<br />
If you are tax resident in Norway, you are<br />
liable to tax in Norway <strong>for</strong> capital both in<br />
Norway and abroad. The right to levy tax can<br />
be limited by tax treaties, if any.<br />
It is your capital and debt at the turn of the<br />
year 2012/2013 that are to be stated.<br />
Item 4.1.1 Deposits in Norwegian banks<br />
If you are tax resident in Norway, deposits in<br />
Norwegian banks are liable to tax.<br />

The standard deduction <strong>for</strong> <strong>for</strong>eign employees<br />
is a deduction you can choose instead of<br />
certain other deductions to which you are<br />
entitled.<br />
Foreign employees who become tax resident<br />
in Norway are entitled to the standard<br />
deduction <strong>for</strong> <strong>for</strong>eign employees in<br />
connection with their tax assessment <strong>for</strong> the<br />

employees <strong>for</strong> as long as they have limited tax<br />
liability.<br />
The deduction is 10 per cent of gross income<br />
from employment, maximum NOK 40,000.<br />
Gross income from employment includes<br />
ordinary gross pay plus other taxable cash<br />
payments and payments in kind and any<br />
surpluses on expense allowances.<br />
If you have a spouse who is also entitled to<br />
the standard deduction, either both of you or<br />
neither of you must claim the standard<br />
deduction.<br />
Persons who stay in Norway <strong>for</strong> so long that<br />
they become tax resident here, can choose<br />
between the standard deduction and a<br />
deduction <strong>for</strong> the actual expenses covered by<br />
the standard deduction. The most relevant<br />
deductions that no longer apply when the<br />
standard deduction is used are:<br />
• deductions <strong>for</strong> actual expenses of the type<br />
that are included in the minimum<br />
standard deduction<br />
• deductions <strong>for</strong> travel to/from work<br />
• extra costs relating to stays away from<br />
home, including board, lodging and home<br />
visits. This also applies to deductions <strong>for</strong><br />
commuting expenses in connection with<br />
commuting from a home abroad.<br />
• interest on debt, including deductions <strong>for</strong><br />
the benefit of low-interest loans in<br />
employment relationships<br />
• child-care deduction<br />
• payments made into individual pension<br />
agreements (IPS) pursuant to the<br />
Taxation Act<br />
• losses on the realisation of shares<br />
• loss from business activities.<br />
Persons who are wage earners and who stay<br />
in Norway without becoming tax resident<br />
here, can choose between the standard<br />
deduction and a deduction <strong>for</strong> the actual<br />
expenses relating to the wage earnings that<br />
are taxed in Norway. The deductions that no<br />
longer apply when the standard deduction is<br />
used are:<br />
• deductions <strong>for</strong> actual expenses of the type<br />
that are included in the minimum<br />
standard deduction<br />
• deductions <strong>for</strong> travel to/from work<br />
• extra costs relating to stays away from<br />
home, including board, lodging and home<br />
visits. This also applies to deductions <strong>for</strong><br />
commuting expenses in connection with<br />
commuting from a home abroad.<br />
• interest on debt in connection with loans<br />
relating to real property in Norway (that is<br />
not covered by income from the real<br />
property).<br />

Persons who stay/are resident in Norway <strong>for</strong><br />
the whole income year will, in addition to the<br />
standard deduction, be entitled to the full<br />
minimum standard deduction and personal<br />
allowance. Persons who stay/are resident in<br />
Norway <strong>for</strong> part of the income year will, in<br />
addition to the standard deduction, be<br />
entitled to a proportionate part of the<br />
minimum standard deduction and personal<br />
allowance.<br />
The following deductions can be granted in<br />
addition to the standard deduction if the<br />
requirements are otherwise satisfied:<br />
• deductible contributions to a<br />
Norwegian public or private<br />
occupational pension scheme<br />
• deductible trade union dues<br />
• seafarers’ allowance.<br />
Deduction <strong>for</strong> extra<br />
expenses in connection<br />
with commuting to a<br />
home abroad<br />
If your work requires you to live away from<br />
home and you visit your home regularly, you<br />
may be entitled to a deduction <strong>for</strong> extra<br />
expenses <strong>for</strong> board and lodging in Norway<br />
and travel expenses in connection with home<br />
visits in your home country. These are called<br />
"commuting expenses".<br />
The main rule is that extra expenses in<br />
connection with commuting to a home<br />
abroad are not deductible. However, the EEA<br />
Agreement ensures EU/EEA nationals who<br />
work in Norway the same rights as employees<br />
who commute within Norway. If you come<br />
from an EU/EEA country, you may there<strong>for</strong>e<br />
be entitled to a commuter deduction.<br />
Employees from countries outside the<br />
EU/EEA area<br />
If you come from a country outside the EU/<br />
EEA area, you are not entitled to a deduction<br />
<strong>for</strong> extra expenses <strong>for</strong> board, lodging or travel<br />
expenses in connection with home visits to<br />
your home abroad. If your employer pays such<br />
expenses <strong>for</strong> you, you must pay tax on such<br />
payments. If you have limited tax liability to<br />
Norway, your employer can still pay such<br />
expenses without you being taxed <strong>for</strong> the<br />
payments, see the topic "Employer’s coverage<br />
of expenses in connection with board,<br />
lodging and home visits when commuting<br />
from abroad and its relationship to the<br />
standard deduction <strong>for</strong> <strong>for</strong>eign employees".<br />
Employees from countries within the<br />
EU/EEA area<br />
When are you considered a commuter?<br />
If you are an EU/EEA national and your home<br />
is in another EU/EEA country, you can claim a<br />
commuter deduction when you meet the<br />
requirements to be considered a commuter.<br />
Commuters with families<br />
If you have a joint home with children and/or<br />
a spouse who live in your home country, you<br />
are regarded as a commuter <strong>for</strong> tax purposes<br />
when your home is in an EU/EEA country. You<br />
must be able to present a marriage or birth<br />
certificate confirming the family relationship.<br />
In addition, you must be able to document a<br />
joint residential address in your home<br />
country. You are also normally required to<br />
have three to four home visits with overnight<br />
stays per year.<br />
Single (unmarried) commuters<br />
If you are not a family commuter, you are<br />
classified as a single commuter. Cohabitants<br />
are considered single in this context.<br />
However, if you also live with your own<br />
children, you are classified as a family<br />
commuter.<br />
If you are single, other requirements apply <strong>for</strong><br />
you to be regarded as a commuter <strong>for</strong> tax<br />
purposes. Single people are deemed to be<br />
resident where they have "independent<br />
housing". If you have independent housing in<br />
Norway, you will be regarded as resident in<br />
Norway and will not be entitled to a deduction<br />
<strong>for</strong> expenses relating to visits to your<br />
home country. The housing in Norway is<br />
regarded as independent when:<br />
• it is at your disposal <strong>for</strong> at least twelve<br />
months and you have access to it every day<br />
of the week<br />
• the living area is at least 30 square metres<br />
• if there are several people living in the<br />
house/apartment, the area requirement<br />
increases by 20 square metres <strong>for</strong> each<br />
additional occupant over the age of 15<br />
• it has running water and drains.<br />
You can claim a deduction <strong>for</strong> commuting<br />
expenses if you commute to your home<br />
in an EU/EEA country and the following<br />
requirements are met:<br />
• you do not have independent housing<br />
in Norway<br />
• you have independent housing in your<br />
home country, or are under 22 years of age<br />
at the end of the income year and commute<br />
to your parents’ home<br />
• you go home once every three weeks.<br />
Less frequent home visits can be accepted<br />
if there are special reasons <strong>for</strong> this, <strong>for</strong><br />
example in cases of illness or poor<br />
finances.<br />
• You must also document your residential<br />
address abroad.<br />
If you are under 22 years old at the end of the<br />
income year and commute to your parents’<br />
home, you must be able to document the<br />
family relationship with a birth certificate. In<br />
addition, you must be able to present<br />
documentation of a joint residential address<br />
abroad and be able to substantiate the<br />
number of journeys between your home<br />
abroad and your place of residence in Norway.<br />
It will normally be sufficient that you go<br />
home once every six weeks.<br />
You may also be regarded as a commuter even<br />
if your housing in Norway is deemed to be<br />
independent. The requirements are that:<br />
• you have been registered as resident in the<br />
same place (municipality) in your home<br />
country <strong>for</strong> three years<br />
• you do not let your home in your home<br />
country<br />
• the housing in Norway is not more than<br />
half the size of your home in your home<br />
country.<br />

Which deductions can you claim as a<br />
commuter?<br />
If you have paid the expenses yourself and<br />
are not claiming the standard deduction<br />
<strong>for</strong> <strong>for</strong>eign employees, you can claim a<br />
deduction <strong>for</strong>:<br />
• travel in connection with home visits<br />
calculated at a rate per kilometre. The<br />
number of kilometres is stipulated on the<br />
basis of the shortest travel distance by<br />
road between your housing in Norway and<br />
your home in your home country. You must<br />
be able to document/substantiate the<br />
number of journeys. The rate <strong>for</strong> 2012 is<br />
NOK 1.50 per km <strong>for</strong> up to 50,000 km per<br />
year. For the number of kilometres in<br />
excess of 50,000, the rate is NOK 0.70 per<br />
kilometre. You can claim a deduction <strong>for</strong><br />
the actual cost of ferry and air travel, but<br />
you cannot also claim a deduction at the<br />
standard rate <strong>for</strong> the distance travelled by<br />
ferry and air.<br />
• what you have paid <strong>for</strong> accommodation<br />
(rent costs). You must be able to present<br />
receipts <strong>for</strong> the amounts.<br />
• extra subsistence expenses at standard<br />
rates that are stipulated annually by the<br />
Directorate of Taxes. For 2012, the rate<br />
is NOK 190 per day. If it is not possible<br />
to cook food where you live, the rate is<br />
NOK 293 per day.<br />
If your employer covered some of the costs,<br />
you can only claim a deduction <strong>for</strong> the costs<br />
you covered yourself. If, <strong>for</strong> example, you<br />
have free accommodation in Norway covered<br />
by your employer, you can claim a deduction<br />
<strong>for</strong> subsistence and <strong>for</strong> travel in connection<br />
with home visits as described above.<br />
If your employer has covered commuting<br />
expenses, the benefit of this is tax-exempt<br />
provided that you would have been entitled to<br />
deduct the expenses if you had paid them<br />
yourself. The same applies to any allowances<br />
received that do not exceed the rates <strong>for</strong><br />
deductions. It is only any surplus on<br />
allowances that will be taxed as pay.<br />
If your employer covered all your subsistence<br />
costs, either on the basis of receipts or by<br />
providing free board, and you receive this<br />
tax-free, you will be taxed <strong>for</strong> "savings on<br />
household costs". For 2012, the rate is<br />
NOK 79 per day. The savings on household<br />
costs have been taken into account in the<br />
deduction rates.<br />
If you are claiming the standard deduction <strong>for</strong><br />
<strong>for</strong>eign employees, you cannot claim further<br />
deductions. For in<strong>for</strong>mation about how this<br />
relates to the standard deduction, see the<br />
topic "Employer’s coverage of expenses in<br />
connection with board, lodging and home<br />
visits when commuting from abroad and its<br />
relationship to the standard deduction <strong>for</strong><br />

expenses <strong>for</strong> board, lodging<br />

commuting from abroad<br />
and its relation ship to the<br />
standard deduction <strong>for</strong><br />
<strong>for</strong>eign employees<br />
If you meet the requirements to be considered<br />
a commuter in relation to a home abroad<br />
and are entitled to the standard deduction,<br />
you must choose whether you wish to be<br />
taxed in accordance with the "net method"<br />
or the "gross method" when your employer<br />
has covered the commuting expenses. You are<br />
free to choose between them, regardless of<br />
which method your employer has used when<br />
paying the remuneration.<br />
The gross method:<br />
All allowances from the employer <strong>for</strong> the<br />
coverage of board, lodging and travel in<br />
connection with home visits are to be included<br />
in your gross taxable income. You can choose<br />
between a 10 per cent standard deduction and<br />
deduction <strong>for</strong> the actual costs, including extra<br />
expenses in items 3.2.7 and 3.2.9.<br />
The net method:<br />
Allowances from the employer <strong>for</strong> the<br />
coverage of board, lodging and travel in<br />
connection with home visits are not to be<br />
included in taxable income, only the surplus,<br />
if any. You can claim a deduction <strong>for</strong> actual<br />
expenses that you have covered yourself. If<br />
you choose the net method, you cannot claim<br />
the 10 per cent standard deduction.<br />
Employees from another EU/EEA country<br />
If your home is in another EU/EEA country<br />
and you meet the requirements <strong>for</strong> being<br />
deemed to be a commuter and are entitled to<br />
the standard deduction, you can choose<br />
between the gross method and the net<br />
method. This means that you must choose to<br />
either claim the standard deduction and be<br />
taxed on all allowances from the employer <strong>for</strong><br />
the coverage of board, lodging and travel in<br />
connection with home visits or not claim the<br />
standard deduction and instead apply the net<br />
method to allowances from the employer.<br />
If it is more favourable <strong>for</strong> you to use the<br />
standard deduction <strong>for</strong> <strong>for</strong>eign employees<br />
than a deduction <strong>for</strong> the actual expenses, you<br />
can choose to be taxed on the benefit you<br />
derive from your employer covering the costs.<br />
You must in such case increase the income<br />
declared in your tax return by the amount of<br />
the benefit.<br />
Employees from countries outside the<br />
EU/EEA area<br />
If your home is in a country outside the EU/<br />
EEA area, you cannot claim a deduction <strong>for</strong><br />
the actual expenses relating to board, lodging<br />
and travel in connection with home visits.<br />
If you are tax resident in Norway, all<br />
allowances from the employer <strong>for</strong> the<br />
coverage of board, lodging and travel in<br />
connection with home visits abroad must be<br />
included in your gross taxable income. You<br />
are entitled to a 10 per cent standard<br />
deduction during the first two income years<br />
you are taxed as resident.<br />
If you have limited tax liability to Norway<br />
and meet the requirements <strong>for</strong> being deemed<br />
to be a commuter, you can choose between<br />
the gross method and the net method. This<br />
means that you must choose to either claim<br />
the standard deduction and be taxed on all<br />
allowances from the employer <strong>for</strong> the<br />
coverage of board, lodging and travel in<br />
connection with home visits or not claim the<br />
standard deduction and instead apply the net<br />
method to allowances from the employer.<br />
Commuting between other countries and<br />
the Norwegian continental shelf<br />
If you are resident in another EU/EEA<br />
country, you can choose between the gross<br />
method and the net method.<br />
If you are resident outside the EU/EEA area,<br />
you can also choose between the gross<br />
method and the net method. If you choose<br />
the gross method, you can only claim a<br />
10 per cent standard deduction. If you choose<br />
the net method, you cannot claim the 10 per<br />
cent standard deduction or deduction <strong>for</strong><br />
actual costs that you have covered yourself.<br />

Extended right to<br />
deductions <strong>for</strong> persons<br />
from EU/EEA countries who<br />
have limited tax liability<br />
Personal and family-related deductions<br />
If you are resident in another EU/EEA country<br />
and have limited tax liability to Norway, you<br />
can be granted an extended right to<br />
deductions if at least 90 per cent of your<br />
income from employment, pension or<br />
business activities is taxed in Norway.<br />
The extended right to deductions applies to<br />
most ordinary deductions. If you are covered<br />
by the rules on extended right to deductions,<br />
you are entitled, among other things, to the<br />
full annual deduction <strong>for</strong> deductions that are<br />
otherwise limited in proportion to how long<br />
you stay in Norway during the income year.<br />
You may also be entitled to i.e. the child-care<br />
deduction <strong>for</strong> minding and care of children.<br />
If you are married, your spouse’s income will<br />
be taken into account when considering<br />
whether you pay tax in Norway on at least<br />
90 per cent of your combined income. If you<br />
have a cohabitant with whom you have one or<br />
more joint children, your cohabitant’s income<br />
will be taken into consideration when you<br />
claim the child-care deduction.<br />
You must document that the conditions <strong>for</strong><br />
being granted deductions pursuant to the<br />
rules <strong>for</strong> resident taxpayers are met. You must<br />
provide sufficient in<strong>for</strong>mation about your<br />
(and your spouse’s) income outside Norway<br />
<strong>for</strong> it to be possible to calculate whether at<br />
least 90 per cent of your income from<br />
employment, pension or business activities<br />
was tax resident in Norway. If you are a<br />
cohabitant and are claiming a child-care<br />
deduction, you must also provide in<strong>for</strong>mation<br />
about your cohabitant’s income.<br />
Deduction <strong>for</strong> interest on debt<br />
If you live in an EEA country and have limited<br />
tax liability to Norway, you can also deduct<br />
interest on debt in accordance with the same<br />
rules as a person resident in Norway. This only<br />
applies if at least 90 per cent of your total<br />
income is liable to tax in Norway. If you own<br />
real property or are engaged in business<br />
activities abroad that are not liable to tax in<br />
Norway due to a tax treaty, the deduction <strong>for</strong><br />
interest on debt will be limited. Within the<br />
EU/EEA area, this applies if you own real<br />
property in Belgium, Bulgaria, Italy, Malta,<br />
Portugal or Germany. If you own real property<br />
in one of these countries and do not have any<br />
taxable capital in Norway, the deduction <strong>for</strong><br />
interest on debt will in practice not apply.<br />
You must provide sufficient in<strong>for</strong>mation about<br />
your income outside Norway <strong>for</strong> it to be<br />
possible to calculate whether at least 90 per<br />
cent of your income is liable to tax in Norway.<br />
Foreign interest must be documented.<br />
If you are claiming a deduction pursuant to<br />
these rules, you cannot claim the standard<br />
deduction <strong>for</strong> <strong>for</strong>eign employees.<br />
If you are claiming a deduction <strong>for</strong> interest on<br />
debt, you will in certain cases be taxed on<br />
interest income etc. from Norwegian sources.<br />
Self-employed persons<br />
(owners of sole<br />
proprietorships)<br />
Permanent establishment<br />
You are liable to tax in Norway if you are<br />
engaged in business activities through a<br />
permanent establishment in Norway.<br />
Only the income that is related to the<br />
permanent establishment is liable to tax in<br />
Norway. Deductions are only granted <strong>for</strong> costs<br />
relating to the business activities in Norway.<br />
The income is taxed pursuant to Norwegian<br />
rules. This means, among other things, that<br />
you must calculate personal income from the<br />
income that is liable to tax in Norway. You<br />
must fill in <strong>for</strong>m RF-1224E "Personal income<br />
from sole proprietorship 2012". The<br />
estimated personal income is transferred to<br />
item 1.6.2 (estimated personal income –<br />
other commercial activity) in your tax return.<br />
If you are e.g. a doctor, auditor, engineer or<br />
consultant (so-called free professions), you<br />
may also be liable to tax in Norway when you<br />
have stayed here <strong>for</strong> more than 183 days<br />
during a 12-month period. This applies<br />
irrespective of whether you have a permanent<br />
establishment.<br />
In principle, you are also liable to tax in<br />
Norway when you are engaged in business<br />
activities on the Norwegian continental shelf.<br />
The tax treaties contain various rules that<br />
limit tax liability.<br />

Partners in businesses<br />
assessed as partnerships<br />
Businesses assessed as partnerships<br />
(ANS, KS etc.) are not taxable entities under<br />
Norwegian law. The company’s capital<br />
and income are taxed with the partners<br />
(assessment of partners).<br />
Foreign partners are taxed in Norway if they<br />
are engaged in business activities through a<br />
permanent establishment in Norway through<br />
their participation in the partnership. This<br />
applies both to their share of the profit or loss<br />
(Taxation Act section 10-41), any special<br />
remuneration <strong>for</strong> work in Norway (Taxation<br />
Act section 12-2 letter f) and additional<br />
general income to personal partners<br />
(Taxation Act section 10-42). Gains on<br />
realisation of a holding in a Norwegian<br />
partnership can be taxed in Norway when the<br />
partner is deemed to have been engaged in<br />
business activities in Norway through a<br />
permanent establishment.<br />
Companies assessed as partnerships have a<br />
duty to submit <strong>for</strong>m RF-1215 "Selskapsoppgave<br />
<strong>for</strong> deltakerliknet selskap" (Partnership<br />
statement <strong>for</strong> businesses assessed as<br />
partnerships 2012 – in Norwegian only) and<br />
<strong>for</strong>m RF-1233 "Selskapets oppgave over<br />
deltakernes <strong>for</strong>mue <strong>og</strong> inntekt i deltakerliknet<br />
selskap" (Partnership statement of<br />
partners’ capital and income in a business<br />
assessed as a partnership 2012 – in Norwegian<br />
only). Partners in such businesses must<br />
submit <strong>for</strong>m RF-1221 "Deltakerens oppgave<br />
over egen <strong>for</strong>mue <strong>og</strong> inntekt i deltakerliknet<br />
selskap" (Partner’s statement of own capital<br />
and income in businesses assessed as<br />

Avoidance of double<br />
taxation<br />
Limited tax liability<br />
If you have limited tax liability to Norway, it<br />
is the responsibility of the tax authorities of<br />
your home country to ensure that income<br />
liable to tax in Norway is not subject to<br />
double taxation.<br />
Tax resident<br />
If you are tax resident in Norway pursuant to<br />
Norwegian domestic law, but resident in your<br />
home country pursuant to the tax treaty, it is<br />
the responsibility of the tax authorities of<br />
your home country to ensure that income<br />
liable to tax in Norway is not subject to<br />
double taxation.<br />
If you are resident in Norway both pursuant<br />
to Norwegian domestic law and the tax treaty,<br />
it is the responsibility of the Norwegian tax<br />
authorities to ensure that income that can be<br />
taxed abroad pursuant to a tax treaty is not<br />
subject to double taxation.<br />
National Insurance<br />
contributions<br />
In principle, you are covered by the Norwegian<br />
National Insurance scheme. Employees<br />
must pay Norwegian National Insurance<br />
contributions of 7.8 per cent of the income<br />
earned in Norway. Self-employed persons<br />
must pay Norwegian National Insurance<br />
contributions of 11 per cent of their<br />
estimated personal income. The lower income<br />
limit <strong>for</strong> calculating National Insurance<br />
contributions is NOK 39,600.<br />
As a rule, employees and self-employed<br />
persons on the Norwegian part of the<br />
continental shelf are obliged to be members<br />
of the Norwegian National Insurance scheme<br />
in the same way as onshore employees/<br />
self-employed persons in Norway.<br />
Persons who are not members of the<br />
Norwegian National Insurance scheme must<br />
document this. If you are a EEA citizen and<br />
member of another EEA country’s national<br />
insurance scheme, you must submit an<br />
E 101/A1 issued by the national insurance<br />
authorities in your home country. If you are<br />
a member of a national insurance scheme in<br />
your home country according to a national<br />
insurance agreement between Norway and<br />
your home country, your must submit similar<br />
documentation. You can also submit a<br />
confirmation from NAV International<br />
(Norwegian Labour and Welfare<br />
Administration) that you are not a member.<br />
If you have previously submitted E 101/A1 or<br />
similar documentation to NAV International<br />
or the Norwegian Tax Administration, you<br />
must state this in item 5.0 (Additional<br />
in<strong>for</strong>mation).<br />

100 YEARS<br />
of tax return<br />
1913 was the first year in which the<br />
country's inhabitants had to fill in a<br />
tax return. The centenary marks an<br />
important event in Norway's history.<br />
For the first time, people had to<br />
submit in<strong>for</strong>mation concerning their<br />
finances themselves, a change which<br />
would make the tax assessment<br />
process more accurate and fairer. The<br />
tax return is based on trust between<br />
the government and the individual<br />
and represented a milestone in the<br />
