1. INTERPRETATIONS AND DEFINITIONS<br />
The interpretations <strong>and</strong> definitions of the terms used in this document are annexed herewith<br />
as SCHEDULE -1.<br />
2. COMMENCEMENT AND DURATION OF THE LICENSE<br />
2.01 The license shall come into <strong>for</strong>ce on this ............day of ......................., 2008 (two thous<strong>and</strong> eight).<br />
2.02 The duration of the Licenses, shall initially be <strong>for</strong> a term of 15 (fifteen) years.<br />
3. RENEWAL OF THE LICENSE<br />
Upon expiry of the initial term of 15 (fifteen) years, the License may be renewed by the Commission<br />
<strong>for</strong> subsequent terms, each of 5 (five) years in duration, subject to the satisfaction of the Commission<br />
upon fulfillment of necessary conditions, including the payment of any fees, as may be specified<br />
herein <strong>and</strong>/or by the Commission under the Act. The Licensee shall submit the renewal application 6<br />
(six) months prior to the expiry date of each term, initial or subsequent whatsoever.<br />
4. SCOPE OF THE LICENSE<br />
4.01 The licensee shall establish, operate <strong>and</strong> maintain nationwide Broadb<strong>and</strong> Wireless Access (BWA)<br />
Services in ………………………………spectrum b<strong>and</strong>.<br />
4.02 This Broadb<strong>and</strong> Wireless Access Services Operator License is a st<strong>and</strong>-alone License which is<br />
independent of other types of <strong>operating</strong> Licenses. Licensee shall not require any separate Internet<br />
Service Provider (ISP) License <strong>and</strong> IP Telephony Services License.<br />
4.03 The provisions of the Act shall regulate the License. The Wireless Telegraphy Act 1933 <strong>and</strong> the<br />
Telegraph Act 1885 as amended from time to time shall also be applicable on matters not covered in<br />
the Act. In addition, the Regulations published in gazette, the <strong>Guideline</strong>s set <strong>for</strong>th, Directives <strong>and</strong> the<br />
Executive Orders issued from time to time by the Commission in respect of the services shall also be<br />
applicable <strong>and</strong> binding on the Licensee.<br />
5. FEES AND CHARGES<br />
5.01 Following fees <strong>and</strong> charges shall be paid by the Licensee. Some of the charges or part thereof shall be<br />
in proportion to the Licensee’s annual audited gross revenue.<br />
1. License acquisition fee [To be fixed by auction]<br />
2. Annual License Fee Taka 3 (three) crore (BDT 30 million)<br />
3. Gross Revenue Sharing 0% <strong>for</strong> the 1 st year<br />
2% <strong>for</strong> 2 nd year<br />
<strong>and</strong> 4% <strong>for</strong> each of the subsequent years<br />
4. Annual Spectrum Charge As per the Spectrum <strong>for</strong>mula<br />
5. Per<strong>for</strong>mance Bank Guarantee. Taka 15 (fifteen) crore (BDT 150 million)<br />
5.02 The Licensee shall pay all the required fees within the stipulated time frame given hereafter. All fees,<br />
charges etc. paid by the Licensee are non-refundable <strong>and</strong> are payable in favour of Bangladesh<br />
Telecommunication Regulatory Commission in the <strong>for</strong>m of bank draft or pay order from any<br />
scheduled bank of Bangladesh.<br />
5.03 The License Acquisition Fee: BDT………………. ………………………..... (50% payable within<br />
10 working days of notification <strong>and</strong> the rest within 3 months thereof)<br />
