(iv) One entity will be allowed to get only one BWA Services License. One person can apply <strong>for</strong> only<br />

one license either as his individual entity or as a partner or shareholder.<br />

(v) The Licenses will be awarded by auction subject to fulfillment of other conditions.<br />

(vi) The licensee has to file <strong>for</strong> Initial Public Offering (IPO) within 03 (three) years of the issuance of<br />

license. The licensee shall not be allowed to transfer any share be<strong>for</strong>e issuance of IPO without<br />

prior written permission from the Commission.<br />

5. AVAILABILITY OF THE LICENSING GUIDELINE<br />

These guidelines are also available at www.btrc.gov.bd <strong>for</strong> in<strong>for</strong>mation only.<br />

6. LAST DAY OF SUBMISSION OF BIDDING DOCUMENTS<br />

Last day <strong>for</strong> submission of the bidding documents is by 12:00 hours on 11 th September, 2008.<br />

7. LICENSE AWARDING PROCESS<br />

7.01 A selection method <strong>for</strong> the evaluation of applications based on submission of m<strong>and</strong>atory documents,<br />

as per APPENDIX: 2 (enclosed herewith), will be used to evaluate the Applicant(s). The<br />

Commission, upon evaluation, will select the appropriate Applicant(s) who shall fulfill the<br />

eligibility criteria to participate in the 2 nd stage i.e. open auction.<br />

7.02 Selected Applicant(s) i.e. selected bidders will be invited to participate in the 2 nd stage i.e. open<br />

outcry auction process <strong>for</strong> BWA license. The auction shall be <strong>for</strong> License Acquisition Fee. The<br />

bidding shall start at Tk. 25 Crore [BDT 250 Million]. The topmost bidder shall have the liberty to<br />

choose his preferred b<strong>and</strong> from the offered spectrum. The bidding <strong>and</strong> auction procedure <strong>for</strong> selecting<br />

the three BWA service operators is provided in APPENDIX-6 in greater detail.<br />

8. NETWORK AND SERVICES<br />

8.01 The Licensee(s) is authorized to develop <strong>and</strong> operate a broadb<strong>and</strong> network to provide nationwide<br />

BWA services based on IEEE 802.16e st<strong>and</strong>ards. The adoption of future evolution is subject to<br />

approval of the Commission. The system can be point-to-multipoint or mesh radio systems consisting<br />

of BWA distribution hub stations <strong>and</strong> their associated subscriber stations (or BWA access devices).<br />

8.02 At least 128 kbps download rate with upload download ratio of 1:4 per subscriber should be ensured at<br />

all time. The contention ratio must be 1:8 (maximum) at the backbone connectivity (both domestic <strong>and</strong><br />

international) <strong>and</strong> the said throughput must be ensured up to the first overseas internet entry point. For<br />

concurrent voice <strong>and</strong> data application, voice calls should be provided with adequate additional<br />

b<strong>and</strong>width to ensure QoS.<br />

8.03 The operators <strong>and</strong> end-users are allowed to use their equipment in fixed locations, in a nomadic<br />

manner or with a fully mobile capability, at their choice. BWA licensees shall not require a separate<br />

ISP (Internet Services Provider) license. The licensees are allowed to use cable, fiber or any other<br />

means appropriate in conjunction with WiMAX as last mile solution. However, cable <strong>and</strong> fiber<br />

connectivity as last mile solutions are not allowed in Dhaka <strong>and</strong> Chittagong Metropolitan area. The<br />

end user distribution may be done in conjunction with WiFi (2.4 <strong>and</strong> 5.7 GHz ISM b<strong>and</strong>).<br />

8.04 Technical characteristics of equipment used in BWA systems shall be in con<strong>for</strong>mity with the WiMAX<br />

<strong>for</strong>um st<strong>and</strong>ards <strong>and</strong> International Telecommunications Union (ITU) <strong>and</strong> its radio regulations. The<br />

operator must deploy certified equipment from the accredited/certified vendors (e.g. WiMAX Forum<br />

Certification). The certification must con<strong>for</strong>m to IEEE 802.16e st<strong>and</strong>ard. However, the licensees, who<br />

would be <strong>operating</strong> in 2.3 GHz b<strong>and</strong>, must produce the required documentation as <strong>and</strong> when the<br />

equipment are certified. They must also provide enough documentary evidence that the manufacturers<br />

have applied <strong>for</strong> such certification to WiMAX Forum.<br />

8.05 BWA services are intended <strong>for</strong> providing wireless broadb<strong>and</strong> connectivity to subscribers including<br />

voice application. Other value added services are subject to the approval of the Commission.<br />
