10.03 A contiguous 35 MHz of unpaired spectrum from 2.5 GHz b<strong>and</strong> (2585-2620 MHz) will be<br />

assigned to one of the licensee. The assignment of 2615-2620 MHz is to be kept as m<strong>and</strong>atory<br />

guard b<strong>and</strong> between its TDD <strong>and</strong> future FDD assignment.<br />

10.04 35 MHz contiguous channel will be allocated to each operator to provide BWA services. Per channel<br />

b<strong>and</strong>width should be either 5 or 10 MHz.<br />

10.05 The spectrum assignment will be inclusive of guard b<strong>and</strong>s needed <strong>for</strong> the operation of the<br />

equipment to avoid interference to adjacent equipment <strong>operating</strong> in adjacent b<strong>and</strong>s.<br />

10.06 In case license <strong>for</strong> BWA service is cancelled / terminated <strong>for</strong> any reason, the spectrum allocation<br />

shall st<strong>and</strong> withdrawn.<br />

10.07 The Successful Applicant(s) shall abide by the coordination agreements, either current or future,<br />

which shall ensure the harmonization of spectrum usage.<br />

10.08 The Commission reserves the rights to make any rearrangement in the assignment within the<br />

b<strong>and</strong> if required <strong>and</strong> the equipment shall have the provision to readjust according to that<br />

rearrangement.<br />

10.09 Two pairs of frequency will be assigned from <strong>and</strong> above 18 GHz b<strong>and</strong>, subject to<br />

requirement/availability to build their own point to point link <strong>for</strong> inter BTS connectivity.<br />

10.10 Spectrum Charges <strong>for</strong> BWA Services Operator License is provided in APPENDIX-1.<br />

11. SCOPE FOR THE EXISTING ISP LICENSEES<br />

11.01 The existing ISP license holders <strong>operating</strong> in 2.3, 2.5, 3.5, 5.2, 5.4 GHz, 700 MHz or any other b<strong>and</strong>s<br />

will be allowed to continue their fixed wireless Internet services. They shall not be allowed to provide<br />

mobile broadb<strong>and</strong> wireless access (BWA) services.<br />

11.02 The existing ISPs whether <strong>for</strong>ming a partnership or bidding alone <strong>and</strong> wins the BWA license, then the<br />

existing ISP license including the assigned frequency shall st<strong>and</strong> as cancelled.<br />

11.03 The BWA licensees shall not be eligible to hold additional ISP license.<br />

12. DURATION OF LICENSE<br />

The duration of the Licenses, shall initially be <strong>for</strong> a term of 15 (fifteen) years. Upon expiry of the<br />

initial term, the License may be renewed <strong>for</strong> subsequent terms, each of 5 years in duration, subject to<br />

the approval from the Commission <strong>and</strong> to such conditions, including the payment of any fees, as may<br />

be specified herein <strong>and</strong>/or by the Commission under the Act.<br />

13. FEES AND CHARGES<br />

13.01 Following fees <strong>and</strong> charges shall be applicable to the Licensees. Some of the charges or part thereof<br />

shall be in proportion to the Licensee’s annual audited gross revenue.<br />

1. Application Fee Taka 50,000.00 (Tk. Fifty thous<strong>and</strong>) only<br />

2. License acquisition fee To be fixed by auction<br />

3. Annual License Fee Taka 3 (three) crore [BDT 30 Million] only<br />

4. Gross Revenue Sharing 0% <strong>for</strong> the 1 st year<br />

2% <strong>for</strong> 2 nd year<br />

<strong>and</strong> 4% <strong>for</strong> each of the subsequent years<br />
