MINUTES OF MEETING<br />

A meeting <strong>of</strong> the Mayor and <strong>City</strong> <strong>Council</strong> <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>West</strong> <strong>Point</strong>, <strong>Nebraska</strong> was convened<br />

in open and public session at 7:00 o'clock P.M. on September 3, 20<strong>13</strong> in the <strong>Council</strong> Chambers at<br />

the Municipal Building in <strong>West</strong> <strong>Point</strong>, <strong>Nebraska</strong>.<br />

Present were: Mayor Johnson; <strong>Council</strong>members: Paus, Swenson, Schlecht, Hugo, and<br />

Grovijohn. Absent: Ell.<br />

The Mayor stated that in accordance with State Statute Section 84-1412 the Open Meetings<br />

Act is posted on the north wall in the <strong>Council</strong> Chambers for public information.<br />

Moved by Hugo, seconded by Swenson, to approve the following consent agenda:<br />

Motion carried.<br />

The Mayor then opened a public hearing on the proposed 20<strong>13</strong>-2014 Budget. All parties<br />

were given an opportunity to be heard. No one appeared to speak in opposition <strong>of</strong> the proposed


udget and no correspondence had been filed. The Mayor then closed the public hearing. Schlecht<br />

introduced Ordinance No. <strong>13</strong>50 entitled:<br />

AN ORDINANCE OF THE CITY OF WEST POINT, IN CUMING COUNTY, NEBRASKA<br />

APPROPRIATING THE SUMS OF MONEY DEEMED NECESSARY TO DEFRAY ALL<br />

EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR COMMENCING ON<br />

THE FIRST DAY OF OCTOBER, 20<strong>13</strong> AND ENDING THE LAST DAY OF SEPTEMBER,<br />

2014; DESIGNATING THE PURPOSES FOR WHICH SAID APPROPRIATION SHALL BE<br />

USED AND APPROPRIATING THE UNEXPENDED BALANCES FOR THE VARIOUS<br />

FUNDS; REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE; AND<br />

PRESCRIBING THE TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND<br />

TAKE EFFECT, AND PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN<br />

PAMPHLET FORM,<br />

and moved that the statutory rule requiring an ordinance be read on three different days be<br />

suspended. Grovijohn seconded the motion. Motion carried. Statutory rule suspended. Schlecht<br />

moved for final passage <strong>of</strong> the ordinance, which motion was seconded by Swenson. Motion carried.<br />

Ordinance adopted.<br />

Moved by Schlecht, seconded by Hugo, to approve the State Budget Lid Computation Form<br />

showing the 20<strong>13</strong>-2014 Restricted Funds to be $692,236.99 and the Total Unused Restricted Funds<br />

Authority to be $770,316.34. Motion carried.<br />

It was further moved by Hugo, seconded by Grovijohn, to approve the increase in the total<br />

restricted funds authority by an additional 1%. Motion carried.<br />

The Mayor opened a public hearing on the Property Tax Request for the fiscal year<br />

beginning October 1, 20<strong>13</strong>. All parties were given an opportunity to be heard. No one appeared to<br />

speak in opposition <strong>of</strong> the tax request and no correspondence had been filed. The Mayor then closed<br />

the public hearing. Grovijohn introduced the following resolution and moved its adoption:<br />

WHEREAS, <strong>Nebraska</strong> Revised Statute Section 77-1601.02 provides that the property tax<br />

request for the prior year shall be the property tax request for the current year for purposes <strong>of</strong> the<br />

levy set by the County Board <strong>of</strong> Equalization unless the Governing Body <strong>of</strong> the <strong>City</strong> passes by a<br />

majority vote a resolution setting the tax request at a different amount; and<br />

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL <strong>of</strong> the <strong>City</strong><br />

<strong>of</strong> <strong>West</strong> <strong>Point</strong>, <strong>Nebraska</strong>, by a majority vote, as follows:<br />

1. That the 20<strong>13</strong>-2014 property tax request be set at $821,758.00.<br />

2. That a copy <strong>of</strong> this resolution be certified and forwarded to the County Clerk on or before<br />

October <strong>13</strong>, 20<strong>13</strong>.<br />

Seconded by Hugo. Resolution adopted.


Nancy Steffen appeared before the <strong>Council</strong> concerning the rental fee for the Nielsen<br />

Community Center for the Red Cross bloodmobiles. At the September 4, 2012 <strong>Council</strong> meeting, the<br />

<strong>Council</strong> approved waiving the rental fee for the Nielsen Community Center for the bloodmobiles for<br />

one year. She is now requesting that the rental fee again be waived for next year. Moved by<br />

Grovijohn, seconded by Swenson, to waive the rental fee for the Nielsen Community Center for the<br />

Red Cross bloodmobiles scheduled for 2014. Motion carried.<br />

The <strong>Council</strong> then proceeded to consider the request from Gary Reimers for two lot splits in<br />

the <strong>West</strong> <strong>Point</strong> South Industrial area. The Planning Commission had considered the request and was<br />

forwarding a favorable recommendation. Schlecht introduced the following resolution and moved<br />

its adoption:<br />

WHEREAS, Gary L. Reimers and Constance A. Reimers, husband and wife, own land<br />

located in Lot 1, Block 2, <strong>West</strong> <strong>Point</strong> Industrial Park; and own all <strong>of</strong> Block 3, in <strong>West</strong> <strong>Point</strong><br />

Industrial Park Second Addition; both Additions to the <strong>City</strong> <strong>of</strong> <strong>West</strong> <strong>Point</strong>, Cuming County,<br />

<strong>Nebraska</strong>, and they desire to divide such real estate in order to complete sales <strong>of</strong> said property.<br />

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Mayor and <strong>City</strong> <strong>Council</strong> <strong>of</strong><br />

the <strong>City</strong> <strong>of</strong> <strong>West</strong> <strong>Point</strong>, <strong>Nebraska</strong> that the subdivision and conveyance <strong>of</strong> said property be<br />

approved.<br />

Seconded by Grovijohn. Resolution adopted.<br />

Next the <strong>Council</strong> considered the request <strong>of</strong> Vince Maly for the removal <strong>of</strong> the sidewalks at<br />

two homes he had purchased, being 120 S. Ash Street and <strong>13</strong>0 S. Ash Street. Vince Maly appeared<br />

before the <strong>Council</strong> asking that he be allowed to remove this sidewalk and allowing this area to be<br />

without a walk. Following discussion and review <strong>of</strong> the Municipal Code Book, the <strong>Council</strong> decided<br />

that if Mr. Maly removed any sidewalks, that he would have to replace them.<br />

Taylor Went with Advanced Consulting Engineering Services appeared before the <strong>Council</strong><br />

to discuss the drainage ditch project in Neligh Park along the north side <strong>of</strong> Anderson Field at an<br />

estimated cost <strong>of</strong> approximately $54,000.00. This project includes installing a tube and covering a<br />

portion <strong>of</strong> the drainage ditch and having a water outlet on the east end. The <strong>City</strong> Administrator<br />

stated that a donor has come forward willing to pay $50,000 on this project. Following discussion,<br />

Schlecht introduced a resolution to hire Advanced Consulting Engineering Services, as engineers


for the construction <strong>of</strong> a drainage ditch in Neligh Park in the <strong>City</strong> <strong>of</strong> <strong>West</strong> <strong>Point</strong>; that the plans<br />

and specifications for the construction <strong>of</strong> the said improvements be approved; and authorizing to<br />

advertise for bids for said improvements in the <strong>West</strong> <strong>Point</strong> News, which bids will be opened at 12:00<br />

Noon on September 25, 20<strong>13</strong> and then considered by the <strong>City</strong> <strong>Council</strong> on October 7, 20<strong>13</strong>.<br />

Seconded by Grovijohn. Resolution adopted.<br />

The <strong>City</strong> Administrator advised the <strong>Council</strong> that Karen Palmer is working with Charter <strong>West</strong><br />

National Bank on refinancing. Karen Palmer currently has CDBG Revolving Loans and the bank is<br />

requesting that the <strong>City</strong> subordinate its current loan position so that it can proceed with her<br />

refinancing loan. Moved by Swenson, seconded by Schlecht, that the subordination <strong>of</strong> the <strong>City</strong>’s<br />

Revolving Loans for Karen Palmer be approved. Motion carried.<br />

The <strong>City</strong> Administrator stated that he conducted an employee wage comparability study and<br />

based on his findings presented adjustments which included a 2.5% wage increase. Following<br />

discussion, it was decided to accept the pay plan and Schlecht introduced Ordinance No. <strong>13</strong>51<br />

entitled:<br />

AN ORDINANCE OF THE CITY OF WEST POINT, NEBRASKA ADOPTING A PAY PLAN<br />

FOR CERTAIN OFFICERS AND ALL EMPLOYEES; REPEALING ORDINANCE NO. <strong>13</strong>43<br />

AND ALL OTHER MOTIONS, RESOLUTIONS AND ORDINANCES IN CONFLICT WITH<br />

THIS ORDINANCE; PRESCRIBING THE TIME WHEN THIS ORDINANCE SHALL BE IN<br />

FORCE AND TAKE EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS<br />

ORDINANCE IN PAMPHLET FORM,<br />

and moved that the statutory rule requiring an ordinance be read on three different days be<br />

suspended. Swenson seconded the motion. Motion carried. Statutory rule suspended. Schlecht<br />

moved for final passage <strong>of</strong> the ordinance, which motion was seconded by Swenson. Motion carried.<br />

Ordinance adopted.<br />

Moved by Grovijohn, seconded by Hugo, to approve the following applications for Special<br />

Designated Liquor Permits under the <strong>Nebraska</strong> Liquor Control Act:<br />

(a) Lincoln Street Market for wedding reception and dance on September 28,<br />

20<strong>13</strong>.<br />

(b) Roadhouse Lounge for the Cuming County Economic Development Dinner<br />

on September 29, 20<strong>13</strong>.<br />

(c) Lincoln Street Market for Chamber <strong>of</strong> Commerce Salad Dinner and Style<br />

Show on September 30, 20<strong>13</strong>.


(d) Lincoln Street Market for Knights <strong>of</strong> Columbus Fundraiser on October 19,<br />

20<strong>13</strong>.<br />

Motion carried.<br />

Moved by Schlecht, seconded by Grovijohn, to approve the claim <strong>of</strong> Hugo Plumbing &<br />

Heating for services and supplies in the amount <strong>of</strong> $1,379.31. Motion carried.<br />
