What the <strong>Publication</strong> <strong>Scheme</strong> is<br />
This <strong>Publication</strong> <strong>Scheme</strong> is a complete guide to the information routinely published by <strong>East</strong><br />
<strong>Lancashire</strong> <strong>Hospitals</strong> <strong>NHS</strong> <strong>Trust</strong>. It is a description of the information about our <strong>Trust</strong> which we make<br />
publicly available. We shall review the <strong>Scheme</strong> at regular intervals and monitor how it is operating.<br />
It is important to us that this <strong>Scheme</strong> meets your needs and we have designed it to be a route map<br />
so that you can find information about <strong>East</strong> <strong>Lancashire</strong> <strong>Hospitals</strong> <strong>NHS</strong> <strong>Trust</strong> easily. Under Section 19<br />
of the Freedom of Information Act 2000 the <strong>Trust</strong> has a legal duty to adopt and maintain a<br />
<strong>Publication</strong> <strong>Scheme</strong> for the publication of <strong>Trust</strong> information. The purpose of the Act is to promote<br />
greater openness by public authorities.<br />
The <strong>Publication</strong> <strong>Scheme</strong> will help you to find all the information which the <strong>Trust</strong> publishes. The<br />
Freedom of Information Act does not change the right of patients to protection of their patient<br />
confidentiality in accordance with Article 8 of the Human Rights Convention, the Data Protection Act<br />
and at common law. Maintaining the legal right to patient confidentiality continues to be an<br />
important commitment on our part. To help with this, we have appointed a Caldicott Guardian, who<br />
has responsibility to ensure the protection of patient confidentiality throughout the <strong>Trust</strong> in<br />

Rights of Access to Information<br />
Sometimes, some or all of the information cannot be provided and we will explain the<br />
reasons why not when this happens.<br />
The Freedom of Information Act recognises that as a member of the public, you have the<br />
right to know how public services such as the <strong>NHS</strong> are operated, how much they cost and<br />
how you can make complaints if you need to. You have the right to know which services are<br />
being provided, the targets that are being set, the standards of services that are expected<br />
and the results achieved.<br />
The <strong>Trust</strong> will respond to requests about the information which it holds and records in any<br />
form and it will create a right of access to that information. The rights to request and access<br />
this information are subject to some exemptions which the <strong>Trust</strong> has to take into<br />
consideration before deciding what information can be released.<br />

We will publish any dataset we hold that has been requested, and any updated versions we<br />
hold , unless we are satisfied that it is not appropriate to do so; to publish the dataset,<br />
where reasonably practicable, in an electronic form that is capable of re-use; and, if any<br />
information in the dataset is a relevant copyright work and the public authority is the only<br />
owner, to make the information available for re-use under a specified licence. The term<br />
‘dataset’ is defined in section 11(5) of the Freedom of Information Act. The terms ‘relevant<br />
copyright work’ and ‘specified licence’ are defined in section 19(8) of that Act.<br />
Environmental Information Regulations enable similar access to environmental information<br />
as under the Freedom of Information Act 2000.<br />
The <strong>Trust</strong>’s commitment to publish information excludes any information which can<br />
legitimately be withheld under the Freedom of Information Act. Where individual classes<br />
are subject to exemptions, the main reasons are the protection of commercial interests and<br />
personal information under the Data Protection Act 1998. This applies to most classes<br />
within the <strong>Publication</strong> <strong>Scheme</strong>.<br />

Section 12 of the FOIA provides an exemption from a public authority’s obligation to comply<br />
with a request for information where the cost of compliance is estimated to exceed the<br />
appropriate limit. The appropriate limit is the key concept concerning fees.<br />
The Fees Regulations state that this cost limit is £600 for central government, legislative<br />
bodies and the armed forces (ie Part 1 of Schedule 1 of the FOIA) and £450 for all other<br />
public authorities.<br />
A public authority must still confirm or deny whether it holds the information requested<br />
unless the cost of this alone would exceed the appropriate limit. Assessing whether or not<br />
the appropriate limit is exceeded<br />
In estimating whether complying with a request would exceed the appropriate limit,<br />
Regulation 4 (3) states that an authority can only take into account the costs it reasonably<br />
expects to incur in:<br />
• determining whether it holds the information;<br />
• locating the information, or a document containing it;<br />
• retrieving the information, or a document containing it; and<br />
• extracting the information from a document containing it.<br />
The four activities are sequential, covering the retrieval process of the information from the<br />
public authority’s information store.<br />
An authority can take into account the costs attributable to the time that persons (both the<br />
authority’s staff and external contractors) are expected to spend on these activities. Such<br />
costs are calculated at £25 per hour per person for all authorities regardless of the actual<br />
cost or rate of pay, which means that the limit will be exceeded if these activities exceed 24<br />
hours for central government, legislative bodies and the armed forces, and 18 hours for all<br />
other authorities.<br />
NB The figures of £450 and £600 relate only to the appropriate limit; they do not relate to<br />
the fees that may be charged.<br />
Section 12 makes it clear that a public authority does not have to make a precise calculation<br />
of the costs of complying with a request. Only an estimate is required.<br />
In relation to a subject access request under the Data Protection Act the fee for medical<br />
records is between £10 and £50 depending on the format in which the records are held. The<br />
fee for all other records is £10.<br />

Who we are and what we do<br />
We are a high performing provider of health services based in <strong>East</strong>ern <strong>Lancashire</strong>. We are proud of<br />
our staff, the services that they provide and those who work with us in the support and delivery of<br />
our care. Better together. Together we are committed to the need to strive for high quality care that<br />
produces the best outcomes within the resources at our disposal.<br />
Our <strong>Trust</strong> is located in the heart of the North West of England, with Bolton, Bury and Rochdale to the<br />
South, Preston to the West and Halifax and Bradford to the <strong>East</strong>. We provide a wide range of<br />
community and hospital based services, plus a limited number of specialist services including Level 3<br />
Neonatal Intensive Care, Hepatobiliary surgery, Head and Neck and Urological Cancer services. The<br />
<strong>Trust</strong> is also a growing centre for Cardiology services.<br />
Our services are provided primarily to the residents of <strong>East</strong> <strong>Lancashire</strong> and Blackburn with Darwen,<br />
which have a combined population of 529,000. Our two main hospitals are located in Blackburn and<br />
Burnley. Services are also provided from Pendle Community Hospital, Accrington Victoria Hospital<br />
and Clitheroe Community Hospital plus a number of community properties across <strong>East</strong> <strong>Lancashire</strong><br />
and Blackburn with Darwen.<br />
In April 2011 60% of the community services provided in <strong>East</strong> <strong>Lancashire</strong> were transferred to the<br />
<strong>Trust</strong>, enabling us to fulfil our commitment to provide an increasing amount of care, where<br />
appropriate, in the localities and as close as possible to the patient’s home. The transfer of<br />
community services gives us the opportunity to develop a model of care aimed at the management<br />
of long-term conditions across care pathways using a care and case management approach.<br />
We also provide a limited range of specialist services including Level 3 Neonatal Intensive Care,<br />
Hepatobiliary1 surgery, together with Head and Neck and Urological Cancer services. We are also a<br />
growing centre for Cardiology services. We have continued to make major investments in healthcare<br />
facilities and operate from a well-maintained, high standard of accommodation.<br />

Clinical leadership is key to the strategic framework of the <strong>Trust</strong>. The strength in the clinical<br />
leadership of the <strong>Trust</strong> enables us to engage with the wider clinical community to ensure that our<br />
key underpinning clinical strategy remains relevant and focussed. Our clinical strategy of increasing<br />
access to services locally is encapsulated in the three interrelated aims illustrated in figure 2. These<br />
aims are very much aligned to the commissioning intentions of our two main Clinical Commissioning<br />
Groups (CCGs).<br />

Our <strong>Trust</strong> has a total of over 950 inpatient beds at Burnley General Hospital and Royal Blackburn<br />
Hospital. Inpatient rehabilitation services are also provided at Pendle Community Hospital and at the<br />
Rakehead Unit at Burnley General Hospital, which specialises in neurological rehabilitation.<br />
Outpatient and diagnostic services are also provided at the Accrington Victoria, Clitheroe <strong>Hospitals</strong>,<br />
Rossendale and St Peter’s Primary Health Care Centres and various premises and Health Centres<br />
throughout <strong>East</strong> <strong>Lancashire</strong>.<br />
We are a major employer within <strong>East</strong> <strong>Lancashire</strong> and currently employ 5,334.35 whole time<br />
equivalent staff.<br />
In 2007 we opened two major PFI schemes, the new Royal Blackburn Hospital and the Phase 5<br />
development (on the Burnley General Hospital Site).<br />
We are currently in the process of an application for Foundation <strong>Trust</strong> status which we anticipate<br />
will be successfully achieved in 2013.<br />

Our <strong>Hospitals</strong><br />
Royal Blackburn Hospital<br />
The Royal Blackburn Hospital provides a full range of hospital services to adults and children. This<br />
includes general and specialist medical and surgical services along with a full range of diagnostic (e.g.<br />
MRI, CT scanning) and support services.<br />
The new Royal Blackburn Hospital opened in July 2006. In addition to the modern facilities within the<br />
first stage of the hospital the new building includes state of the art new inpatient facilities,<br />
centralised outpatients department, new operating theatres and Accident and Emergency<br />
Department.<br />
Burnley General Hospital<br />
Burnley General Hospital provides a full range of hospital services. This includes general and<br />
specialist medical and surgical services along with a full range of diagnostic (e.g. MRI, CT scanning)<br />
and support services.<br />
Burnley General Hospital is <strong>East</strong> <strong>Lancashire</strong> <strong>Hospitals</strong> <strong>NHS</strong> <strong>Trust</strong>’s “cold site”, specialising in planned<br />
(elective) treatment. It provides range of hospital services during working hours including general<br />
and specialist medical and surgical services along with a full range of diagnostic (e.g. MRI, CT<br />
scanning) and support services.<br />
The hospital includes an urgent care centre for unscheduled care of minor injuries and illnesses. It<br />
does not include an emergency department or supporting facilities such as out-of-hours intensive<br />
care – these services are provided from the Royal Blackburn Hospital.<br />
In November 2010, the <strong>Trust</strong> opened the £32 million <strong>Lancashire</strong> Women and Newborn Centre. This<br />
state-of-the-art building includes <strong>East</strong> <strong>Lancashire</strong>’s centralised consultant-led maternity unit, as well<br />
as a Level 3 Neonatal Intensive Care Unit, a midwife-led birth centre and a purpose-built<br />
gynaecology unit.<br />
In May 2006 the trust opened the Phase 5 development, a £33 million investment in new treatment<br />
areas, including new inpatient and outpatient facilities.<br />
Pendle Community Hospital<br />
A modern community hospital Pendle Hospital provides inpatient intermediate care and medical<br />
beds. There is also an outpatient and day hospital for the elderly<br />
Accrington Victoria Hospital<br />
The Accrington Victoria Hospital is a community hospital providing in-patient services and a Minor<br />
Injuries Unit for the local population.<br />
The hospital also has access to dedicated specialist services such as Physiotherapy, Podiatry and<br />
Renal services together with a range of out-patient services<br />
Clitheroe Community Hospital<br />

Clitheroe Community Hospital is situated in the Ribble Valley and provides a high standard of nursing<br />
care within a homely relaxed environment.<br />
The hospital has two wards providing 24 hour nursing care to people requiring rehabilitation, post<br />
operative nursing care, ongoing medical care, palliative care and blood transfusions. The wards are<br />
staffed by a highly skilled team of qualified nurses, auxiliary nurses, health care assistants, house<br />
keepers, ward clerks, porters and domestic staff, all of whom work together to make your stay as<br />
comfortable as possible. To complement the team, access is available to our dedicated teams of<br />
Physiotherapists, Occupational Therapists and other specialities. This is a GP-led service - if you are<br />
admitted to these wards it will be via your own GP or the <strong>East</strong> <strong>Lancashire</strong> out of hours medical<br />
service.<br />
The hospital also houses our Out-patient facility where patients will be seen by a team of dedicated<br />
staff who will assess and plan care to meet individual needs. Many various consultants and<br />
specialities use this busy facility which allows local people to be seen within their community. There<br />
is also a dental specialist unit and X-ray facilities<br />
Community Locations<br />
We provide services from a range of community locations ensuring where possible the services our<br />
community require are available close to their homes.<br />

What We Do<br />
The <strong>Trust</strong> offers a wide and varied range of services across a number of specialties. Further<br />
information on each of our services is available at<br />
Role and Responsibilities of the Organisation<br />
It is the role of the organisation to deliver the services commissioned by our partner organisations.<br />
The <strong>Trust</strong> also has a responsibility to meet all national statutory requirements on finance, service<br />
and quality standards and you will find details of our performance in the Quality of Service or<br />
Performance reports which are provided to our <strong>Trust</strong> Board at each meeting. Please refer to the<br />
<strong>Trust</strong> Board Agenda and Papers section of our website. You will also find in these papers regular<br />
reports on other statutory requirements such as our Annual Infection Control Reports and Annual<br />
Safeguarding reports. A Finance or Use of Resources report is also provided to each <strong>Trust</strong> Board<br />
meeting providing information on our financial performance and management of assets.<br />
We have a responsibility to work with our partner organisations and with the community in<br />
delivering the highest possible quality healthcare to the local population. In addition to working with<br />
our Commissioners we work with a wide variety of other organisations to develop and deliver<br />
services. We work closely with statutory bodies such as the local Councils and Unitary Authorities to<br />
fulfil these duties. Further details can be found in the section on Partnership.<br />
Principal Activities of the <strong>Trust</strong><br />
The <strong>Trust</strong>’s function is to provide goods and services, namely hospital accommodation and services<br />

has been reached on service delivery models and price<br />
Provide support services to deliver the above activity and support the activity of other local<br />
health providers where these have been commissioned and agreement has been reached on<br />

Delivery of the principal activities is underpinned by our key clinical, performance and financial<br />
priorities. The Assurance Framework is the main tool used by the <strong>Trust</strong> Board to monitor the risks to<br />
the organisation in relation to achieving these strategic objectives. The framework maps the<br />

organisation’s objectives to principal and subordinate risks, controls and assurances. The complete<br />
Assurance Framework is reviewed against the CQC and Monitor compliance and regulatory<br />
requirements on an ongoing basis. The Assurance Framework and changes as a result of risk<br />
mitigation plans are presented to the <strong>Trust</strong> Board on a quarterly basis and further details can be<br />

How we fit into the <strong>NHS</strong> structure<br />
The <strong>Trust</strong> is part of a large structure, including the Department of Health, Strategic Health Authority<br />

within their professional remit. The Board functions as a corporate decision-making body. Executive<br />
and Non-Executive members are full and equal members.<br />
The <strong>Trust</strong> Board is responsible for providing strategic leadership to the <strong>Trust</strong> and ensuring that the<br />
<strong>Trust</strong> exercises its functions effectively, efficiently and economically. The Board monitors the<br />
arrangements that are in place to maintain the quality and safety of the <strong>Trust</strong>’s services, including<br />
ensuring processes are in place for managing risks.<br />
Non-Executive Directors have a particular role in scrutinising the performance of the <strong>Trust</strong>’s<br />
management in meeting agreed objectives, and ensuring that robust systems of financial control and<br />
risk management are in place. The Non- Executive Directors of the <strong>Trust</strong> are appointed by the<br />
Secretary of State for Health through the national Appointments Commission and are each<br />
appointed for a four-year term which may be renewed subject to satisfactory performance.<br />
Non-Executive Directors are not employees of the <strong>Trust</strong> and do not have responsibility for the day-to<br />
day management of the <strong>Trust</strong>: - this is the role of the Chief Executive and Executive Directors - but as<br />
a ‘unitary Board’, Executive and Non-Executive Directors share equal responsibility for the Board’s<br />
decisions, and both share responsibility for the direction and control of the organisation.<br />
The <strong>Trust</strong> Board meets monthly and meetings are open to the public except when confidential<br />
information is being discussed. Details of public Board meetings are available, including minutes and<br />
papers from previous meetings, on the <strong>Trust</strong> Board section of our website. The <strong>Trust</strong> Board<br />
delegates its authority to take decisions about the <strong>Trust</strong> and its services in accordance with a<br />
<strong>Scheme</strong> of Delegation which is available on our website within the publication section in our<br />
Standing Orders and Standing Financial Instructions.<br />
The Executive Directors are appointed by a Committee comprising the Chief Executive and Non-<br />
Executive Directors following a competitive interview process.<br />

Performance Evaluation Arrangements<br />
Each Non-Executive Director is appraised by the Chairman formally on an annual basis with informal<br />
review being undertaken bi annually. The Chairman is currently appraised by the Chair of the<br />
National <strong>Trust</strong> Development Agency on an annual basis.<br />
In a similar way the Executive Directors and members of the wider executive team are appraised by<br />
the Chief Executive on a formal basis annually with ongoing one-to-one meetings taking place on at<br />
least a monthly basis for updates to be provided on progress against objectives. The performance of<br />
the Chief Executive in leading the organisation and being an effective member of the <strong>Trust</strong> Board is<br />
assessed by the Chairman.<br />
Each member of the Board has in place a personal development plan to meet their own learning and<br />
development needs and to ensure the continuous development of the Board as a whole. The Non<br />

The sub committees of the <strong>Trust</strong> Board undertake an annual review of their effectiveness and the<br />
way in which they have met the objectives set by the <strong>Trust</strong> Board. An annual report is provided to<br />
the <strong>Trust</strong> Board from each of its formal sub committees.<br />
Over the course of the last few years the Board has continually refined supporting structures in light<br />
of updated and new best practice such as the Integrated Governance Handbook, the Combined Code<br />
of Governance, The Intelligent Board series, The Healthy <strong>NHS</strong> Board and Monitor’s Code of<br />
Governance.<br />
We have reviewed and taken into consideration the findings of internal and external reviews and<br />
inspections in relation to our own and other <strong>NHS</strong> and Foundation <strong>Trust</strong>s to ensure we continue to<br />
operate to the highest possible governance standards and continually improve our effectiveness and<br />
focus as a Board.<br />

These are the groups which focus on the strategic direction of the <strong>Trust</strong> and are supported by<br />

Each sub-committee of the Board has agreed terms of reference defining the scope of the activities<br />
to be undertaken on behalf of the Board and, with the exception of the Executive Management<br />
Board, has representation from both the Executive and Non-Executive directors.<br />
The Board maintains an overview of the activities of these groups by receiving a summary of the<br />
minutes of the committees at Board meetings in addition to an annual report from the committees<br />
setting out the work they have undertaken during the course of the year and the way in which they<br />
have met the objectives laid down by the <strong>Trust</strong> Board. The reporting by way of summary decisions of<br />
committees enables the Chair of each committee to provide additional verbal updates to the Board<br />
as required.<br />

A Board development programme has been put in place to build upon the strengths of the individual<br />

What We Spend and How We Spend It<br />
We have delivered consecutive financial surpluses for the years 2007/8 to 2012/13 whilst<br />
experiencing activity growth, increases in complex case mix and general cost pressures throughout<br />
the period. We achieved a surplus of £3.025m in 2011/12 and delivered cost improvement savings of<br />
£18.9m.<br />
There are two private finance initiative (PFI) schemes for parts of the buildings at Royal Blackburn<br />
Hospital and Burnley General Hospital sites, valued at over £70m and £20m respectively.<br />
We have continued to make major investments in our healthcare facilities, predominantly focusing<br />
on our ongoing commitment to the Burnley General Hospital site, with the £32m development of<br />
the <strong>Lancashire</strong> Women and Newborn Centre.<br />
In April 2011, adult community services transferred to the <strong>Trust</strong> from <strong>NHS</strong> <strong>East</strong> <strong>Lancashire</strong> with an<br />
annual turnover of around £40 million. We are progressing well with our strategy to transform the<br />
<strong>Trust</strong> into a fully integrated healthcare provider, providing services in hospitals, in the community<br />
and in people’s homes.<br />

Financial performance<br />
A culture of strong financial management is embedded across the organisation. All statutory<br />
financial duties have been achieved since 2006/07, following the turnaround of an underlying deficit.<br />
Whilst there was a reliance on non-recurrent financial support until 2008/09, from 2009/10 we have<br />
demonstrated good financial performance, delivering sustainable levels of savings and continuing to<br />
achieve our statutory financial duties.<br />
We achieved a surplus of £0.7m in 2010/11 and are reporting a surplus of £3.025m in 2011/12. At<br />
the end of the financial year we are in a strong position both in terms of performance and finance to<br />
meet the challenges of continuing financial restraint and increasing demand for our services.<br />
A monthly report is presented to the <strong>Trust</strong> Board detailing our performance year to date.<br />
Capital Programme<br />
The <strong>Trust</strong>’s Capital Programme is agreed at the beginning of the financial year but does vary as<br />
schemes develop during the course of the year. The agreed plans can again be found on the board<br />
papers section of our web site.<br />
Staff and Board Members’ Allowance and Expenses<br />
All staff receive travel payments on authorisation of travel claims. Travel claim forms are completed<br />
by individuals and checked by their line manager and are then submitted to <strong>East</strong> <strong>Lancashire</strong> Financial<br />
Services for payment. The amount paid to staff depends on the mileage they undertake in the year.<br />
A company car scheme is also available within the <strong>Trust</strong> dependant on terms of employment. The<br />
annual salaries and benefits paid to our most senior staff are available within our Annual Report.<br />

Other Income<br />
We receive 95.5% of contract income from <strong>East</strong> <strong>Lancashire</strong> and Blackburn with Darwen Clinical<br />
Commissioning Groups. <strong>East</strong> <strong>Lancashire</strong> acts as lead commissioner working closely with Blackburn<br />
with Darwen via a consortia agreement.<br />
National Payment by Results tariff income currently accounts for 61% of our total contract value,<br />
with a move away from block contracts to the agreement of national and local activity currencies,<br />
with local prices that make up a further 16% of the total contract value. Local prices have been<br />
largely based on the adoption of national average reference costs uplifted for inflation including the<br />
market forces factor (MFF). Block contracts currently make up 16% of the total contract value; this is<br />
mainly related to the provision of community services, where work is on-going to determine the<br />
most appropriate contracting currencies for the future. The remaining 7% of contract income is<br />
made up of CQUIN (2.5%) and pass through payments for excluded drugs/devices etc.<br />
The responsibility for commissioning clinical training and education is with the Local Education and<br />
Training Board. The Medical and Dental Education Levy (MADEL) administered by the North West<br />
Deanery is the largest element and this contributes part of the basic salary of our 343 doctors in<br />
training.<br />
In 2003, the <strong>Trust</strong> entered into a Concession Agreement under the Private Finance Initiative to<br />
construct a 170 bed acute development on the Burnley General Hospital Site with our PFI partner<br />
Catalyst (Vita Lend Lease). The unit opened on time and on budget in May 2006. A second<br />
Concession Agreement under the Private Finance Initiative (PFI) was also entered into in 2003 with<br />
Consort to construct a 668 bed acute development on the Royal Blackburn Hospital Site. The<br />
hospital opened in July 2006, also on time and on budget.<br />
The Concession Agreements include the delivery of estates and facilities services to the hospital. The<br />
PFI schemes have brought considerable change in the management of estates and facilities services<br />
and management duties that are allocated between the <strong>Trust</strong> and the service providers. Duties of<br />
the service providers include:<br />
• Operational management of estates maintenance, car parking and security to the main<br />
hospital sites.<br />
• Operational management and provision of hard facilities management services including<br />
reactive and planned maintenance to the PFI buildings and buildings with a service lease. The<br />
service providers at the Royal Blackburn Hospital site also manage car parking and security.<br />
Our financial transactional processing services are provided by <strong>East</strong> <strong>Lancashire</strong> Financial Services<br />
(ELFS). The contract reflects the national <strong>NHS</strong> financial shared services strategy.<br />
