Introduction
What the Publication Scheme is
This Publication Scheme is a complete guide to the information routinely published by East
Lancashire Hospitals NHS Trust. It is a description of the information about our Trust which we make
publicly available. We shall review the Scheme at regular intervals and monitor how it is operating.
It is important to us that this Scheme meets your needs and we have designed it to be a route map
so that you can find information about East Lancashire Hospitals NHS Trust easily. Under Section 19
of the Freedom of Information Act 2000 the Trust has a legal duty to adopt and maintain a
Publication Scheme for the publication of Trust information. The purpose of the Act is to promote
greater openness by public authorities.
The Publication Scheme will help you to find all the information which the Trust publishes. The
Freedom of Information Act does not change the right of patients to protection of their patient
confidentiality in accordance with Article 8 of the Human Rights Convention, the Data Protection Act
and at common law. Maintaining the legal right to patient confidentiality continues to be an
important commitment on our part. To help with this, we have appointed a Caldicott Guardian, who
has responsibility to ensure the protection of patient confidentiality throughout the Trust in
accordance with your legal rights. The Trust Caldicott Guardian is:
Rights of Access to Information
Sometimes, some or all of the information cannot be provided and we will explain the
reasons why not when this happens.
The Freedom of Information Act recognises that as a member of the public, you have the
right to know how public services such as the NHS are operated, how much they cost and
how you can make complaints if you need to. You have the right to know which services are
being provided, the targets that are being set, the standards of services that are expected
and the results achieved.
The Trust will respond to requests about the information which it holds and records in any
form and it will create a right of access to that information. The rights to request and access
this information are subject to some exemptions which the Trust has to take into
consideration before deciding what information can be released.
Under the Data Protection Act 1998, you are also entitled to access your clinical records or
any other personal information held about you and in order to do this you can contact:
The Medical Records Manager
Royal Blackburn Hospital
Haslingden Road
Blackburn
BB2 3HH
We will publish any dataset we hold that has been requested, and any updated versions we
hold , unless we are satisfied that it is not appropriate to do so; to publish the dataset,
where reasonably practicable, in an electronic form that is capable of re-use; and, if any
information in the dataset is a relevant copyright work and the public authority is the only
owner, to make the information available for re-use under a specified licence. The term
‘dataset’ is defined in section 11(5) of the Freedom of Information Act. The terms ‘relevant
copyright work’ and ‘specified licence’ are defined in section 19(8) of that Act.
Environmental Information Regulations enable similar access to environmental information
as under the Freedom of Information Act 2000.
The Trust’s commitment to publish information excludes any information which can
legitimately be withheld under the Freedom of Information Act. Where individual classes
are subject to exemptions, the main reasons are the protection of commercial interests and
personal information under the Data Protection Act 1998. This applies to most classes
within the Publication Scheme.
The appropriate limit
Section 12 of the FOIA provides an exemption from a public authority’s obligation to comply
with a request for information where the cost of compliance is estimated to exceed the
appropriate limit. The appropriate limit is the key concept concerning fees.
The Fees Regulations state that this cost limit is £600 for central government, legislative
bodies and the armed forces (ie Part 1 of Schedule 1 of the FOIA) and £450 for all other
public authorities.
A public authority must still confirm or deny whether it holds the information requested
unless the cost of this alone would exceed the appropriate limit. Assessing whether or not
the appropriate limit is exceeded
In estimating whether complying with a request would exceed the appropriate limit,
Regulation 4 (3) states that an authority can only take into account the costs it reasonably
expects to incur in:
• determining whether it holds the information;
• locating the information, or a document containing it;
• retrieving the information, or a document containing it; and
• extracting the information from a document containing it.
The four activities are sequential, covering the retrieval process of the information from the
public authority’s information store.
An authority can take into account the costs attributable to the time that persons (both the
authority’s staff and external contractors) are expected to spend on these activities. Such
costs are calculated at £25 per hour per person for all authorities regardless of the actual
cost or rate of pay, which means that the limit will be exceeded if these activities exceed 24
hours for central government, legislative bodies and the armed forces, and 18 hours for all
other authorities.
NB The figures of £450 and £600 relate only to the appropriate limit; they do not relate to
the fees that may be charged.
Section 12 makes it clear that a public authority does not have to make a precise calculation
of the costs of complying with a request. Only an estimate is required.
In relation to a subject access request under the Data Protection Act the fee for medical
records is between £10 and £50 depending on the format in which the records are held. The
fee for all other records is £10.
Who we are and what we do
We are a high performing provider of health services based in Eastern Lancashire. We are proud of
our staff, the services that they provide and those who work with us in the support and delivery of
our care. Better together. Together we are committed to the need to strive for high quality care that
produces the best outcomes within the resources at our disposal.
Our Trust is located in the heart of the North West of England, with Bolton, Bury and Rochdale to the
South, Preston to the West and Halifax and Bradford to the East. We provide a wide range of
community and hospital based services, plus a limited number of specialist services including Level 3
Neonatal Intensive Care, Hepatobiliary surgery, Head and Neck and Urological Cancer services. The
Trust is also a growing centre for Cardiology services.
Our services are provided primarily to the residents of East Lancashire and Blackburn with Darwen,
which have a combined population of 529,000. Our two main hospitals are located in Blackburn and
Burnley. Services are also provided from Pendle Community Hospital, Accrington Victoria Hospital
and Clitheroe Community Hospital plus a number of community properties across East Lancashire
and Blackburn with Darwen.
In April 2011 60% of the community services provided in East Lancashire were transferred to the
Trust, enabling us to fulfil our commitment to provide an increasing amount of care, where
appropriate, in the localities and as close as possible to the patient’s home. The transfer of
community services gives us the opportunity to develop a model of care aimed at the management
of long-term conditions across care pathways using a care and case management approach.
We also provide a limited range of specialist services including Level 3 Neonatal Intensive Care,
Hepatobiliary1 surgery, together with Head and Neck and Urological Cancer services. We are also a
growing centre for Cardiology services. We have continued to make major investments in healthcare
facilities and operate from a well-maintained, high standard of accommodation.
Vision, Values and Objectives
Our vision and values were determined through a strategic review led by the Board.
Our vision is:
Our values are based upon:
To deliver the best care with our community, locally
respecting the individual
putting patients and customers first
promoting positive change
acting with integrity
serving the community
Our values are driven through the following key operating principles:
We understand the world we live in and we deal with it
We are clinically led and management supported
Our support departments support the front line
Everything we do is delivered by and through divisions
Compliance with standards and targets are a given. They are the things we do to help secure our
independence and influence
Quality is our organising principle - driving quality up and cost down is not mutually exclusive
We deliver on our commitments
Our values are encapsulated in figure 1, which has been developed by our senior clinicians and
promulgated throughout divisions.
Clinical leadership is key to the strategic framework of the Trust. The strength in the clinical
leadership of the Trust enables us to engage with the wider clinical community to ensure that our
key underpinning clinical strategy remains relevant and focussed. Our clinical strategy of increasing
access to services locally is encapsulated in the three interrelated aims illustrated in figure 2. These
aims are very much aligned to the commissioning intentions of our two main Clinical Commissioning
Groups (CCGs).
What We Do
The Trust offers a wide and varied range of services across a number of specialties. Further
information on each of our services is available at
Role and Responsibilities of the Organisation
It is the role of the organisation to deliver the services commissioned by our partner organisations.
The Trust also has a responsibility to meet all national statutory requirements on finance, service
and quality standards and you will find details of our performance in the Quality of Service or
Performance reports which are provided to our Trust Board at each meeting. Please refer to the
Trust Board Agenda and Papers section of our website. You will also find in these papers regular
reports on other statutory requirements such as our Annual Infection Control Reports and Annual
Safeguarding reports. A Finance or Use of Resources report is also provided to each Trust Board
meeting providing information on our financial performance and management of assets.
We have a responsibility to work with our partner organisations and with the community in
delivering the highest possible quality healthcare to the local population. In addition to working with
our Commissioners we work with a wide variety of other organisations to develop and deliver
services. We work closely with statutory bodies such as the local Councils and Unitary Authorities to
fulfil these duties. Further details can be found in the section on Partnership.
Principal Activities of the Trust
The Trust’s function is to provide goods and services, namely hospital accommodation and services
and community health services. Our principal activities are to:

Provide elective (planned) operations and care to the local population in hospital and
community settings
Provide non–elective (unplanned emergency or urgent) operations and care to the local
population in hospital settings
Provide diagnostic and therapy services on an outpatient and inpatient basis to the local
health providers where these have been commissioned and agreement has been reached on
service delivery models and price.
Delivery of the principal activities is underpinned by our key clinical, performance and financial
priorities. The Assurance Framework is the main tool used by the Trust Board to monitor the risks to
the organisation in relation to achieving these strategic objectives. The framework maps the
Structures
How we fit into the NHS structure
The Trust is part of a large structure, including the Department of Health, Strategic Health Authority
etc. For further information on the NHS and its structure please visit
http://healthandcare.dh.gov.uk/system/
The East Lancashire Hospitals Trust fits into the NHS as follows:
Organisational Structure
A diagram of our Trust Board structure can be found at the following link: Trust Board In accordance
with our Establishment Order, the composition of the Board is:
Chairman
Six Non-Executive Directors
Five Executive Directors consisting of:
o The Chief Executive
o The Director of Finance
o The Medical Director
within their professional remit. The Board functions as a corporate decision-making body. Executive
and Non-Executive members are full and equal members.
The Trust Board is responsible for providing strategic leadership to the Trust and ensuring that the
Trust exercises its functions effectively, efficiently and economically. The Board monitors the
arrangements that are in place to maintain the quality and safety of the Trust’s services, including
ensuring processes are in place for managing risks.
Non-Executive Directors have a particular role in scrutinising the performance of the Trust’s
management in meeting agreed objectives, and ensuring that robust systems of financial control and
risk management are in place. The Non- Executive Directors of the Trust are appointed by the
Secretary of State for Health through the national Appointments Commission and are each
appointed for a four-year term which may be renewed subject to satisfactory performance.
Non-Executive Directors are not employees of the Trust and do not have responsibility for the day-to
day management of the Trust: - this is the role of the Chief Executive and Executive Directors - but as
a ‘unitary Board’, Executive and Non-Executive Directors share equal responsibility for the Board’s
decisions, and both share responsibility for the direction and control of the organisation.
The Trust Board meets monthly and meetings are open to the public except when confidential
information is being discussed. Details of public Board meetings are available, including minutes and
papers from previous meetings, on the Trust Board section of our website. The Trust Board
delegates its authority to take decisions about the Trust and its services in accordance with a
Scheme of Delegation which is available on our website within the publication section in our
Standing Orders and Standing Financial Instructions.
The Executive Directors are appointed by a Committee comprising the Chief Executive and Non-
Executive Directors following a competitive interview process.
Further details in relation to our Board Members and Executive Team can be found at:
Performance Evaluation Arrangements
Each Non-Executive Director is appraised by the Chairman formally on an annual basis with informal
review being undertaken bi annually. The Chairman is currently appraised by the Chair of the
National Trust Development Agency on an annual basis.
In a similar way the Executive Directors and members of the wider executive team are appraised by
the Chief Executive on a formal basis annually with ongoing one-to-one meetings taking place on at
least a monthly basis for updates to be provided on progress against objectives. The performance of
the Chief Executive in leading the organisation and being an effective member of the Trust Board is
assessed by the Chairman.
Each member of the Board has in place a personal development plan to meet their own learning and
development needs and to ensure the continuous development of the Board as a whole. The Non
Executive Directors and the Chief Executive are appraised by the Chairman. The Chief Executive
appraises the Executive Directors.
Executive Directors’ objectives mirror the strategic objectives of the Trust with an Executive lead
assigned both to the attainment of strategic objectives and the management of risks to their
achievement.
The sub committees of the Trust Board undertake an annual review of their effectiveness and the
way in which they have met the objectives set by the Trust Board. An annual report is provided to
the Trust Board from each of its formal sub committees.
Over the course of the last few years the Board has continually refined supporting structures in light
of updated and new best practice such as the Integrated Governance Handbook, the Combined Code
of Governance, The Intelligent Board series, The Healthy NHS Board and Monitor’s Code of
Governance.
We have reviewed and taken into consideration the findings of internal and external reviews and
inspections in relation to our own and other NHS and Foundation Trusts to ensure we continue to
operate to the highest possible governance standards and continually improve our effectiveness and
focus as a Board.
The Board now has four formally constituted committees:

Audit Committee
Remuneration Committee
Charitable Funds Committee
Executive Management Board
These are the groups which focus on the strategic direction of the Trust and are supported by
additional operational groups. Collectively these ensure a focus on clinical and corporate governance
Each sub-committee of the Board has agreed terms of reference defining the scope of the activities
to be undertaken on behalf of the Board and, with the exception of the Executive Management
Board, has representation from both the Executive and Non-Executive directors.
The Board maintains an overview of the activities of these groups by receiving a summary of the
minutes of the committees at Board meetings in addition to an annual report from the committees
setting out the work they have undertaken during the course of the year and the way in which they
have met the objectives laid down by the Trust Board. The reporting by way of summary decisions of
committees enables the Chair of each committee to provide additional verbal updates to the Board
as required.
What We Spend and How We Spend It
We have delivered consecutive financial surpluses for the years 2007/8 to 2012/13 whilst
experiencing activity growth, increases in complex case mix and general cost pressures throughout
the period. We achieved a surplus of £3.025m in 2011/12 and delivered cost improvement savings of
£18.9m.
There are two private finance initiative (PFI) schemes for parts of the buildings at Royal Blackburn
Hospital and Burnley General Hospital sites, valued at over £70m and £20m respectively.
We have continued to make major investments in our healthcare facilities, predominantly focusing
on our ongoing commitment to the Burnley General Hospital site, with the £32m development of
the Lancashire Women and Newborn Centre.
In April 2011, adult community services transferred to the Trust from NHS East Lancashire with an
annual turnover of around £40 million. We are progressing well with our strategy to transform the
Trust into a fully integrated healthcare provider, providing services in hospitals, in the community
and in people’s homes.
Further detailed information in relation to our annual accounts which are within our Annual Report
can be found on the Corporate Publications section of our website
Financial performance
A culture of strong financial management is embedded across the organisation. All statutory
financial duties have been achieved since 2006/07, following the turnaround of an underlying deficit.
Whilst there was a reliance on non-recurrent financial support until 2008/09, from 2009/10 we have
demonstrated good financial performance, delivering sustainable levels of savings and continuing to
achieve our statutory financial duties.
We achieved a surplus of £0.7m in 2010/11 and are reporting a surplus of £3.025m in 2011/12. At
the end of the financial year we are in a strong position both in terms of performance and finance to
meet the challenges of continuing financial restraint and increasing demand for our services.
A monthly report is presented to the Trust Board detailing our performance year to date.
Capital Programme
The Trust’s Capital Programme is agreed at the beginning of the financial year but does vary as
schemes develop during the course of the year. The agreed plans can again be found on the board
papers section of our web site.
Staff and Board Members’ Allowance and Expenses
All staff receive travel payments on authorisation of travel claims. Travel claim forms are completed
by individuals and checked by their line manager and are then submitted to East Lancashire Financial
Services for payment. The amount paid to staff depends on the mileage they undertake in the year.
A company car scheme is also available within the Trust dependant on terms of employment. The
annual salaries and benefits paid to our most senior staff are available within our Annual Report.
The current year’s budgets and financial performance is detailed in the monthly integrated
performance report provided to the Trust Board and are available on our webpages at Trust Board
We also publish information about all expenditure over £25K on a monthly basis
Information in relation to our use of charitable funds is available in Charitable Funds Annual Report
and Accounts
Other Income
We receive 95.5% of contract income from East Lancashire and Blackburn with Darwen Clinical
Commissioning Groups. East Lancashire acts as lead commissioner working closely with Blackburn
with Darwen via a consortia agreement.
National Payment by Results tariff income currently accounts for 61% of our total contract value,
with a move away from block contracts to the agreement of national and local activity currencies,
with local prices that make up a further 16% of the total contract value. Local prices have been
largely based on the adoption of national average reference costs uplifted for inflation including the
market forces factor (MFF). Block contracts currently make up 16% of the total contract value; this is
mainly related to the provision of community services, where work is on-going to determine the
most appropriate contracting currencies for the future. The remaining 7% of contract income is
made up of CQUIN (2.5%) and pass through payments for excluded drugs/devices etc.
The responsibility for commissioning clinical training and education is with the Local Education and
Training Board. The Medical and Dental Education Levy (MADEL) administered by the North West
Deanery is the largest element and this contributes part of the basic salary of our 343 doctors in
training.
In 2003, the Trust entered into a Concession Agreement under the Private Finance Initiative to
construct a 170 bed acute development on the Burnley General Hospital Site with our PFI partner
Catalyst (Vita Lend Lease). The unit opened on time and on budget in May 2006. A second
Concession Agreement under the Private Finance Initiative (PFI) was also entered into in 2003 with
Consort to construct a 668 bed acute development on the Royal Blackburn Hospital Site. The
hospital opened in July 2006, also on time and on budget.
The Concession Agreements include the delivery of estates and facilities services to the hospital. The
PFI schemes have brought considerable change in the management of estates and facilities services
and management duties that are allocated between the Trust and the service providers. Duties of
the service providers include:
• Operational management of estates maintenance, car parking and security to the main
hospital sites.
• Operational management and provision of hard facilities management services including
reactive and planned maintenance to the PFI buildings and buildings with a service lease. The
service providers at the Royal Blackburn Hospital site also manage car parking and security.
Our financial transactional processing services are provided by East Lancashire Financial Services
(ELFS). The contract reflects the national NHS financial shared services strategy.
The Trust Procurement function forms part of the East Lancashire Procurement Department and has
its own dedicated website at East Lancashire Procurement Department
This is a source of information in relation to contracts and contracting and contains information to
assist potential and current suppliers, schemes of work in relation to contracts and further details of
The Procurement function is an essential key service within NHS Trusts. The Optimum management
of the Trust Procurement service is critical to the efficiency and effectiveness of clinical and support
services. Patient care depends on the assured availability of quality equipment, materials and
services. Accountability for the expenditure of taxpayer’s money requires that sound economic
decisions are taken in relation to procurement ensuring value for money and elimination of
commercial risk.
The Trust procurement department currently provides an essential service to the East Lancashire
Hospitals NHS Trust and delivers 8 Service level agreements to other NHS Trusts
