BUSINESS NEWS 

New Powers to Fine Supermarkets 

The Groceries Code Adjudicator is 

being given new powers to enforce the 

Groceries Code which applies to large 

supermarkets with a turnover in the 

groceries market in excess of £1bn. If 

the Adjudicator finds these are treating 

their suppliers unlawfully or unfairly, he 

or she will be able to apply a range of 

sanctions from ‘naming and shaming’ 

to imposing fines on the retailer. The 

Adjudicator is being set up through the 

Groceries Code Adjudicator Bill which is 

currently passing through Parliament.

Number of Failed Firms Falling 

Research by Experian shows that the 

number of business insolvencies in 

the UK fell by almost 9% in October 

2012 compared with a year earlier. 

The greatest improvement was among 

medium-sized firms while insolvencies 

among larger firms showed a year on 

year increase. More detailed research

New Chief Executive for D2N2 LEP 

D2N2 Local Enterprise Partnership has 

appointed David Ralph as its new Chief 

Executive. David, who has had a long 

career in economic regeneration, latterly 

in Suffolk and Essex, will take up his new 

appointment in March 2013. 

Consultation on New Science 

Academy 

Nottingham University Academy of 

Science and Technology (NUAST) is 

a new educational development to 

provide academic, vocational and 

professional qualifications in science, 

information technology and engineering 

for students aged 14-19 in partnership 

with international, national and regional 

employers who will help to develop and 

deliver the curriculum. It will open its 

doors in 2014 with a catchment area of a 

25 mile radius of Nottingham. The NUAST 

Trust, together with sponsors Djanogly 

Learning Trust, Sir Harry Djanogly 

CBE, The University of Nottingham and 

employer partner Toshiba Information 

Systems (UK) Ltd, is seeking views from 

local employers. All feedback is welcome

New Online Support for Charities 

The Charity Commission now has a new 

service on its website to help charities 

identify other sources of support and 

umbrella organisations that could offer 

particular advice. The new service can be

Results of Quarterly Economic 

Survey Q4: Economic Growth 

Remains Weak 

The results from the Chamber’s latest 

QES survey show that local firms 

reported an improvement in both UK 

and export sales for 2012, but that 

while orders for the beginning of 2013 

are holding up, export orders are down. 

Employment levels fell back slightly at 

the end of 2012 and there was also a 

slight drop in the number of businesses 

recruiting, but 21% of Derbyshire and 

Nottinghamshire firms still expect to 

increase the size of their workforce in Q1 

2013. 25% of firms are under pressure

M1 J28-31 Managed Motorway 

Project 

The Highways Agency proposes to 

improve the M1 by making it a ‘managed 

motorway’ between junctions 28 and 

31. Managed motorways help relieve 

congestion by using technology to vary 

speed limits and allow the hard shoulder 

to be used as a running lane at peak 

times to create additional capacity.

HMRC PAYE Real Time Information 

from April 

From April 2013, when the Real Time 

Information System takes effect, 

employers must submit Pay As You Earn 

(PAYE) returns to HMRC on a monthly

Funding to Support Improving 

Patient Experience 

The Department of Health has opened 

two new SBRI competitions to fund 

the development of technological and 

innovative solutions that can improve 

experience for people with mental health 

illnesses, or improve experience for 

people at the end of their life. Open to 

single companies or organisations from 

the private, public and third sectors, 

including charities, the competition for 

funding will close on 28 February 2013.

Tackling Unfair Practices for Pubs 

The Government has announced plans for 

an independent Adjudicator to address 

unfair practices in the pub industry. 

There will also be a new statutory Code 

to look at the relationship between large 

pub companies and publicans, which will 

be enforced by the Adjudicator. This new 

Code is intended to look at a number of 

issues including rents, abuse of the beer 

tie, the prices publicans pay for beer, 

disputes between pub companies and 

publicans, and in some cases have the 

power to fine. A consultation document is 

expected in the spring. 

Community Entertainment Licence 

Following a Government consultation, 

community venues such as schools, 

village halls and hospitals will be free to 

put on cultural events like dance displays 

and concerts without having to apply to 

the local council for a licence. The change 

to the 2003 Licensing Act also means 

that the process will be simpler for local 

businesses and cultural organisations 

that wish to host a live music band or put 

on a play.

Extra Support for Firms from 

Trading Standards 

Nottinghamshire County Council 

Trading Standards operates a Primary 

Authority Partnerships Scheme for 

businesses that trade across Council 

boundaries. This means that qualifying 

businesses can enter into a legally 

recognised partnership and receive a 

bespoke package of advice and support 

chargeable on a cost-recovery only basis. 

Companies operating in a number of 

local authority areas have a single 

point of contact in their own area 

and local regulators in areas outside 

Nottinghamshire must respect the 

advice of the Primary Authority when 

carrying out inspections or dealing with

SKILLS AND TRAINING 

Chamber Training Update 

Graduate Apprenticeships for the 

Professions 

Graduate and post graduate level 

apprenticeships (levels six and seven) 

will be available for the first time shortly 

in professional subjects such as law, 

accountancy and advanced engineering. 

These will offer a vocational route to 

qualifications in these professions, 

alongside the more traditional higher 

education route.

Grant for Employing Apprentices 

Businesses across Derbyshire and 

Nottinghamshire are benefiting from a 

number of different financial incentives 

when employing their first apprentice. 

Businesses have already benefited 

from recent changes made to the 

Apprenticeship Grant for Employers (AGE 

16 to 24). With AGE 16 to 24 businesses 

can take advantage of a £1,500 grant 

when employing an apprentice aged 

between 16 and 24. Each business can 

apply for up to 10 grants. In addition, 

businesses in Derbyshire can take 

advantage of a £1,000 as Derbyshire 

County Council has reintroduced its 

Apprenticeship Grant for Employers 

for a limited period only. To find out

Loans for Individuals 24+ 

The Government is introducing 24+ 

Advanced Learning Loans for learners 

aged 24 and above in further education 

or training, studying at Level 3 and 

above. Learners starting their course 

or Apprenticeship (includes advanced 

and higher Apprenticeship) on or after 

1 August 2013 will be affected. 24+ 

Advanced Learning Loans will cover the 

cost of tuition, so learners do not have 

to pay upfront. Interest on the loans 

will be minimal and linked to inflation 

with any balance outstanding being 

written off after 30 years. Learners under 

the age of 24 plus learners seeking to 

gain basic qualifications at Level 2 and 

below will continue to be funded by the 

Government. 

National Apprenticeship Week 11 – 

15 March 2013 

Now in its sixth year, National 

Apprenticeship Week is the time when 

all eyes are on Apprenticeships. Further

£150 million for Training Schemes 

Businesses can bid for a share of £150 

million for training schemes from the 

Government’s 2nd round of the Employer 

Ownership Pilot (EOP). The fund is open 

to businesses of all sizes that want to 

make sure they have the right skills 

for the future. The money can be used 

for setting up training schemes such as 

new apprenticeship programmes and 

specialist training academies. 34 projects 

were successful from round one bidding, 

including Nissan’s training for more than 

3,600 technical staff and supply chain

Learners Need More than 

Qualifications to Find Work 

Ofsted’s report ‘Promoting enterprise 

in college vocational courses’ shares 

the experiences of 15 high performing 

colleges that excel in teaching enterpriserelated 

skills and maintain strong links 

with local employers. These colleges 

recognised that the future success of

their young people depended not only 

on academic qualifications, but also 

on a range of enterprise skills. Ofsted 

makes a number of recommendations 

in the report, including collecting the 

destination data of where the young 

people have gone after college so that 

trends and success in enterprise training

Young Person’s Loan Fund 

The Government is giving additional 

funding to the Young Person’s Loan 

Fund which can now offer loan funding 

up to £5,000 to individuals aged 18 

to 30 (extended from the previous 18 

– 24 age group) who are thinking of 

starting a business, on completion of a 

viable business plan. The Loan Fund is 

delivered exclusively in the East Midlands 

by First Enterprise Business Agency, 

in partnership with the Derbyshire 

Enterprise Agency and DNCC. For further

Innovation Vouchers 

A second wave of Innovation Vouchers 

is available through the Technology 

Strategy Board, for ideas relevant to the 

five areas of agri-food, built environment, 

space, energy, water and waste and open 

data innovators and inventors. 

The Vouchers are available to UK startup, 

micro, small or medium-sized 

businesses and can provide up to £5,000 

for the help of an external expert to 

develop your ideas.

Talent Retention Solution 

The Talent Retention Solution (TRS) 

has launched a new website. TRS was 

set up in response to a Government 

request to provide an industry-led and 

sector focused programme through which 

to support recruitment and deployment 

of key advanced manufacturing and 

engineering skills across the UK. 

Through the website 

www.talentretention.biz companies 

can search for candidates for vacancies 

without being registered beforehand, 

and potential recruits can register as 

graduates or apprentices. 

Growth Funding from the Derby 

Enterprise Growth Fund 

Derby City Council is inviting funding 

applications from businesses in Derby 

and the City’s travel to work area for 

two programmes; innovation, mainly 

for the aerospace, automobile and rail 

industries; expansion, for businesses in 

all sectors that have growth potential. 

In addition, a co-investment fund to 

invest risk capital in early stage growth 

businesses will be established. This 

will offer risk capital and equity for 

investments in the region of £50k to 

£1 million for high growth potential 

and early stage businesses where the 

investment will support the creation 

and selling of a new product or service.

Shorter Consultations on Large 

Scale Redundancies 

Changes to collective redundancy 

rules have been announced by the 

Government. From April this year the 

90 day consultation period for firms 

making over 100 employees redundant 

will be reduced to 45 days. New nonstatutory 

Acas guidance to address a 

number of key issues affecting collective 

redundancies consultation will also be 

introduced. The rules remain unchanged 

for the 30 days consultation period if 20 

to 100 staff are to be made redundant 

and if fewer than 20 staff are to be made 

redundant when the consultation period 

is at the discretion of the employer.
