Standing rules and procedures for the election of
General Council members to serve on the NJSBA Nominating Committee
I. DATE OF ELECTION
1.1 The annual election of one member of the
General Council to serve on the New Jersey State
Bar Association Nominating Committee for a
term of two years shall be conducted at the
annual (Fall) meeting of the General Council, on
such date as is established from time to time by
the Executive Committee of the General Council.
1.2 The Executive Committee of the General Council
shall be required to establish the annual meeting
date of the General Council, and publish notice
thereof, at least 60 days prior to the date of the
meeting.
II. NOMINATING PROCEDURE
2.1 No less than 60 days prior to the annual meeting
of the General Council, the General Council
Executive Committee shall formally publish and
communicate, by notice, the date of the annual
meeting to all members and to the officers and
trustees of the New Jersey State Bar Association,
and shall solicit, from the members, nominations
for candidates to be elected by the General
Council to the Nominating Committee of the
New Jersey State Bar Association.
2.2 Any member of the General Council, otherwise
eligible and qualified to serve on the
Nominating Committee of the New Jersey State
Bar Association, may be nominated as a candidate
upon filing, with the Executive Director of
the New Jersey State Bar Association, a written
nominating petition signed by no less than ten
(10) members of the General Council.
2.3 The Executive Director of the New Jersey State
Bar Association shall determine within seven (7)
days of receipt thereof whether the nominating
petition contains the requisite number of qualified
signatures of active members of the General
Council. If the petition contains a sufficient
number of valid signatures, the Executive
Director shall certify the nomination and immediately
communicate that certification to the
nominee and to the Executive Committee of the
General Council. In the event that the petition is
deficient, the Executive Director shall immediately
notify the candidate and return the petition.
Any candidate whose petition has been
rejected for filing by the Executive Director may
solicit additional signatures of members of the
General Council in order to satisfactorily complete
the petition. A resubmitted petition is subject
to the same time requirements as an original
petition. The names of candidates will be
available upon telephone or written request by
any General Council member.
2.4 In the event that a petition is filed within seven
(7) days of the date on which nominations are
to be closed, as set forth in Section 2.6 below,
and the petition lacks the requisite number of
signatures of active members of the General
Council, filing shall be denied and the candidate
shall be without recourse. It shall be the
sole obligation of any candidate to fulfill all
petition requirements.
2.5 Any candidate who wishes to seek nomination
may obtain, without cost, a list of active members
of the General Council from the Executive
Director of the New Jersey State Bar
Association, and may rely thereon for purposes
of determining the qualified members for purposes
of a nominating petition.
2.6 No less than thirty (30) days prior to the annual
meeting of the General Council, the Executive
Committee shall communicate to all active
members of the General Council an alphabetical
list of names of those individuals certified to have
been nominated by petition to seek election for
the position of member of the New Jersey State
Bar Association Nominating Committee.
2.7 Any person certified as a nominee may submit to
the General Council, no later than thirty (30) days

prior to the annual meeting of the General
Council, biographical and background data of the
candidate’s choosing not exceeding one 8 1/2” x
11” page.
2.8 No less than fifteen (15) days prior to the annual
meeting of the General Council, the Executive
Committee shall cause to be sent to all members
in a single mailing, all biographical and background
data supplied by all qualified candidates
in accordance with Section 2.7 above.
2.9 At the annual meeting of the General Council, at
which the election of a member of the
Nominating Committee of the New Jersey State
Bar Association is to be held, the Executive
Committee shall allocate no more than a total
period of twenty (20) minutes for introducing all
candidates to the assembled members of the
General Council and for permitting such candidates
to address the assembled General Council.
III.ELECTION
3.1 The New Jersey State Bar Association shall
cause a ballot to be printed with the names of
all certified nominees listed alphabetically.
3.2 Qualified electors shall receive one printed ballot
upon registration at the annual meeting,
shall mark their preference on the ballot in the
manner set forth on the ballot, and shall deposit
the ballot in the ballot box.
3.3 The nominee with the greatest number of votes
shall be elected to serve for a term of two years,
or until his successor is elected, on the
Nominating Committee of the New Jersey State
Bar Association.
3.4 Where two or more nominees have received the
identical, highest number of votes, there shall be
an immediate runoff election to determine a single
candidate with the highest number of votes.
The runoff procedure shall be as follows: Voting
shall be by written ballot on forms provided by
NJSBA staff, who will obtain each voter’s signature
on the printout of registered General
Council members.
3.5 The two-year term of the individual elected
shall commence immediately. The term of a
previously elected member of the Nominating
Committee shall cease immediately upon the
election of a successor.
3.6 If at the time of election there are fewer than
two qualified candidates, due to withdrawal of
one or more candidate(s), then the nominating
procedure shall be reopened as follows: floor
nominations by General Council members present,
seconded by a General Council member
present, and nomination accepted by the candidate.
Biographical and background data
complying with Section 2.7 may be supplied no
later than seven (7) days after the date of the
General Council annual meeting. Such information
shall be sent to all General Council
members no later than fourteen (14) days after
the General Council annual meeting. Election
shall be by written ballot, to be sent to all
General Council members no later than fourteen
(14) days after the date of the General
Council annual meeting, and returned by mail
to be received no later than twenty-eight (28)
days after the date of the General Council
annual meeting. Except for the revised deadlines
and mail ballot described herein, other
rules and procedures of Section II shall apply.
The names of candidates will be available upon
telephone or written request by any General
Council member.
IV. MISCELLANEOUS
4.1 In the event of a vacancy of one or both of the
two General Council members on the New
Jersey State Bar Association Nominating
Committee, as a result of death, disability or
resignation, the Executive Committee of the
General Council may adopt special election
rules and procedures to fill such vacancies
which shall conform, as nearly as possible, to
these Standing Rules.
4.2 The prior Rules and Procedures, adopted by the
Executive Committee for the first election conducted
in 1985, are hereby superseded.
4.3 The Bylaws of the New Jersey State Bar
Association shall control wherever any inconsistency
exists between those Bylaws and these
Standing Rules.
4.4 These Standing Rules may be amended from
time to time by majority vote of the Executive
Committee. In the alternative, these Standing
Rules may be amended by a majority vote of
members present at any duly convened meeting
of the General Council, provided that a copy of
the proposed amendments is mailed to each
General Council member at least 30 days prior
to the annual meeting.
4.5 The General Council Executive Committee
shall designate a member of General Council to
act as Parliamen tarian for the annual meeting.
4.6 For the purpose of these Rules, “member” is
deemed to include “alternate member”
attending in lieu of the member, except for
eligibility for Nominating Committee membership
and for mail ballots, which will be sent
to members only.
