Note:<br />
These notes are for advice only and shall NOT form part of the bidding documents.<br />
The bidding documents prevail over any statement given here and the responsibility<br />
for interpretation rests with the reader.<br />
Bidders must read and understand these notes prior to preparing bids<br />
1 This tender will use the Ministry of Public Works Semi E-Procurement system.<br />
Site Visit will be held at 13.00 WITA on August 10 th , 2011 (meeting point-at<br />
Kota Sinjai Km.219 Kabupaten Sinjai, before departing to site).<br />
Pre-Bid meeting will be held at 10.00 WITA on August 12 th , 2011 at Jalan<br />
Mesjid Raya No.72, 2 nd Floor, Makassar.<br />
The Bidder is also advised to visit and examine the Site of Works and its<br />
surroundings and obtain for itself on its own responsibility all information that<br />
may be necessary for preparing the bid and entering into a contract for<br />
construction of the Works. The costs of visiting the Site shall be at the Bidder’s<br />
own expense. (ITB 7.2)<br />
2 There is no pre-qualification of bidders, and bidding is open to all eligible<br />
bidders.<br />
Information for post qualification of bidders will be obtained from the documents<br />
submitted with the bids or during clarification. No document/information can be<br />
added after bid opening except if asked by the Pokja / ULP during the<br />
clarification and, in case any, will not change the prices or substance of the bid.<br />
The Employer will assume that all information in bidding documents is correct<br />
and complete. If there is any omission, including misrepresentation, that<br />
knowingly or recklessly misleads, or attempts to mislead in the document, the<br />
provisions of Clause 3 ITB (Fraud and Corruption) will apply, the bid will be<br />
disqualified and the Bidder will be blacklisted for two years.<br />
Post-Qualification Important Note:<br />
Bidders must read and understand the importance of the Evaluation and Post-<br />
Qualification Criteria included in the bidding documents and must check that<br />
their submitted information will allow them to pass ALL the requirements.<br />
The post-qualification uses pass/fail on every item and failure to pass any one<br />
item will disqualify the bid.

The requirements are found in Part 1 Section III 1. Evaluation<br />
In addition to the criteria listed in ITB 34.2 (a) – (e) the following criteria shall<br />
apply:<br />
1.1 Assessment of adequacy of Technical Proposal with Requirements<br />
Evaluation of the Bidder's Technical Proposal will include an assessment of<br />
the Bidder's technical capacity to mobilize key equipment and personnel for<br />
the contract consistent with its proposal regarding work methods,<br />
scheduling, and material sourcing in sufficient detail and fully in accordance<br />
with the requirements stipulated in Section VI (Work’s Requirements).<br />
1.2 A Bidder can be awarded only one contract package, although it may submit<br />
bids for several packages, and may be the lowest evaluated substantially<br />
responsive bid on more than one bid. The Employer will evaluate and<br />
compare Bids on the basis of a total of contracts in order to arrive at the least<br />
cost combination for the Employer by taking into account discounts offered<br />
by Bidders. The determination on which contract(s) to be awarded to the<br />
lowest evaluated bidder will be based on the lowest combination of prices<br />
that will result from the different possible options of consideration for award<br />
to the second lowest bidder(s) for the contract(s) in question. The bidder<br />
shall not be involved in this determination.<br />
If your company cannot pass all of the requirements for post-qualification then do<br />
not bid but consider joining another larger company as a partner or as a subcontractor.<br />
Failure of one party in a joint operation to post-qualify will disqualify all parties<br />
and the bid will be disallowed.<br />
The requirements are found in Part 1 Section III 2. Qualification. Take<br />
particular notice of the conditions under 2.1 - Eligibility, 2.2 - Non-performance,<br />
2.3 - Financial Situation, 2.4 - Experience specially Key Activities about<br />
production Rate; and 2.5 - Personnel and 2.6 Equipment. Your company or joint<br />
venture/operation must satisfy all requirements in order to post-qualify<br />
All financial requirements in post qualification shall be presented in USD. The<br />
exchange rate to be used for determining the equivalent US$ value shall be the<br />
Transaction Selling Rate published by the Bank of Indonesia as noted in each<br />
relevant form. The exchange rate shall be obtained from the BI website at the<br />
following address:<br />

Note that methods of converting financial rupiah accounts to USD are found in<br />
the Bidding documents under each form. If your accounts are in a third currency<br />
then convert the rate by converting first to rupiah (using the rate from the BI<br />
website) and then from rupiah to USD.

3 Part 2 Section VI-1 Scope of Works<br />
This Work Package is divided into two separate Sections. Each section shall be<br />
provided with a separate team with minimum key personnel and key equipment as<br />
stipulated in the Section III. Sub-factor 2.5 and 2.6.<br />
4 All Bidders found to have a conflict of interest shall be disqualified (ITB 4.3).<br />
A bidder may be considered to have conflict of interest with one or more parties<br />
in the bidding process, if:<br />
(a) they have at least one controlling partner in common; or<br />
(b) they received or have received any direct or indirect subsidy from any of<br />
them; or<br />
(c) they have same legal representative for purposes of this bid; or<br />
(d) they have a relationship with each other, directly or through common third<br />
parties, that puts them in a position to have access to information about or<br />
influence on the bid of another Bidder, or influence to the decision of the<br />
Employer regarding this bidding process; or<br />
(e)<br />
(f)<br />
a Bidder participates in more than one bid in this bidding process; or<br />
a Bidder participated as consultant in the preparation of the design or<br />
technical specifications of the works that are subject of the bid; or<br />
(g) a Bidder or any of its affiliates has been hired (or is proposed to be hired) by<br />
the Employer as Engineer for the Contract Implementation.<br />
5 If necessary, the Pokja will check the reliability of the information and the<br />
condition of the proposed equipment, material quarry and reported on-going or<br />
past construction contracts to the site. If found that the information is incorrect,<br />
the provisions of Clause 3 ITB will apply and the bid may be disqualified.<br />
6 The original bid security must be enclosed with the bid, not held by the Bidder<br />
or submitted in a separate envelope. Photocopy of the bid security is not accepted.<br />
7 In the bidding document for which duty stamp (meterai) is required, failure to<br />
attach the stamp or to date the stamp will not cause the bid to be disqualified, but<br />
those requirements can be added following the Law No. 13/1985. The absence of<br />
Company seal does not cause the bid to be rejected.<br />
8 This is a unit price contract and selected pay items (unit prices) are subject to the<br />
price adjustment provisions of the Conditions of Contract, if the original time<br />
for completion exceeds three hundred sixty five (365) days.<br />
The Bidders shall provide unit price analysis of each selected pay item. In the<br />
event the unit price of the pay item stated in the priced Bill of Quantities is

different from unit price in the unit price analysis, the unit price in the priced Bill<br />
of Quantities shall prevail.<br />
9 This contract is unit price contract type. No condition limits that the unit rates for<br />
any item offered in the bid are only applicable up to the original quantities as<br />
stipulated in the BOQ provided in the bidding documents.<br />
Revised unit rates may be applicable referring to GC 12.3 Evaluation.<br />
10 Bidders are reminded to use the forms provided in the Section IV of Bidding<br />
Procedure for Letter of Bid and Unconditional Bid Security. If the bidder uses<br />
other forms substantially different to the forms mentioned above, the bid may be<br />
rejected.<br />
11 Bidders are reminded to submit the bid to the relevant Pokja at the address, date,<br />
time and for the validity as specified in the bid document. Failure to fulfill this<br />
provision will result in the bid being rejected.<br />
12 Bidders are reminded to submit Bid Security in the form of Unconditional Bank<br />
Guarantee in the amount and validity as specified in the bid document. Failure to<br />
fulfill this provision will result in the bid being rejected.<br />
13 Bidders are reminded to check that they attach all required supporting<br />
documentation to their bids and complete all forms that are supplied as part of<br />
the bidding documents. Failure to do so may result in the Bids being declared<br />
substantially not responsive and if so, the bids will be rejected.<br />
14 Bidders are reminded that the bid must be properly signed as specified in the<br />
Instruction to Bidders. Bidders must also initial any hand written changes in their<br />
Bid Documents, especially in their Bid or priced Bill of Quantities. Failure to do<br />
so, will result in their bids being rejected<br />
15 Bidders are reminded to check whether they have signed the blank Integrity<br />
Pact Form distributed with the bid document and included it in their Bid. Lack<br />
of a signed Integrity Pact will cause the Bid to be rejected<br />
16 Bidders are reminded that winning Contractors are auditable by an independent<br />
auditor.<br />
17 Bidders are recommended to check carefully the provisions of environment<br />
clauses in Section 1.17 of the Technical Specifications, the cost of<br />
implementation of which should be included in other Pay Items.<br />
18 Bidders are reminded that some Clauses in the General Conditions have been<br />
replaced, and the new clause is shown in the Special Conditions. The General<br />
Conditions have not been amended.

19 Information relating to the evaluation of bids and recommendation of contract<br />
award shall not be disclosed to Bidders or any other persons not officially<br />
concerned with such process until information on Contract award is<br />
communicated to all Bidders.<br />
Any attempt by a Bidder to influence the Employer in the evaluation of the bids<br />
or Contract award decisions may result in the rejection of its bid<br />
20 Communication between Bidders and Employer during bidding process and<br />
evaluation shall be in writing, in the forms of letter, fax or email. Bidders shall<br />
confirm to Pokja by fax or email immediately after receiving the information,<br />
whether it will be replied or not. Face to face contact between Bidders and Pokja<br />
is strongly prohibited.<br />
21 If there is any item which is not clear you may ask for clarification from the Pokja<br />
/ ULP in writing only. There shall be no oral or face to face contact between any<br />
bidder and any member of the Pokja.
