technical pool would be accessed by all programmes 

under NRHM for providing specific programme support 

related to logistics, financial management, MIS, tracking 

of funds etc. 

The tenure of the Puducherry State Health Mission 

and the Puducherry State Health Society shall be 

three years or end of the mission period. 

The non-official members will be paid travelling 

allowance / dearness allowance as eligible to the officers 

as per NRHM guidelines.

NOTIFICATION 

Whereas the proposal to fix the minimum rates of 

wages payable to the employees engaged in the 

Tailoring Industries in the Union territory of Puducherry, 

was published as required by clause (b) of sub-section (1) 

of section 5 of the Minimum Wages Act, 1948 

(Central Act 11 of 1948) in the Labour Department’s 

notification issued under G.O. Ms. No. l0/AIL/Lab./G/2009, 

dated 26-8-2009 in Part-I of the Extraordinary 

Gazette No. 37, dated 15-9-2009 inviting objections and 

suggestions from all persons likely to be affected 

thereby within sixty days from the date of publication 

of the said notification in the official gazette, 

Puducherry; 

2. And whereas, the said gazette notification was 

made available to the general public on 15-9-2009; 

3. And whereas, no objections or suggestions have 

so far been received within the abovesaid stipulated time 

limit and therefore the Government have decided to fix 

the minimum rates of wages; 

4. Now, therefore, in exercise of the powers conferred 

by clause (a) of sub-section (1) of section 3 read with 

sub-section (2) of section 5 and, sub-section (1) 

of section 13 of the Minimum Wages Act, 1948 (Central 

Act 11 of 1948), the Lieutenant-Governor, Puducherry, 

is pleased to fix the minimum rates of wages payable to 

each category of employees engaged in the employment 

in the Tailoring Industries of the Union territory of 

Puducherry as specified in column (2) of the Schedule 

annexed hereto at the rates and for such hours of work 

per day as specified against each in the said column 

of the said Schedule:—

G. O. Ms. No. l6/AIL/Lab./G/2009, dated 11-11-2009 in

be affected thereby within sixty days from the date of 

publication of the said notification in the official 

gazette, Puducherry; 

2. And whereas, the said gazette notification was 

made available to the general public on 24-11-2009;

and therefore the Government have decided to confirm

NOTE 

1. The employees shall be paid dearness allowance 

as indicated below: 

(i) The dearness allowance is linked to the 

Puducherry City Consumer Price Index for the month 

of July 2009 i.e., 164 points with base year 2001=100 

and every raise of 1 point over and above 164 points 

an increase of Rs. 6.70 (Rupees six and paise seventy only) 

per point per month shall be paid as dearness allowance. 

(ii) The dearness allowance shall be calculated 

every year on the basis of the average of the indices 

for the proceeding twelve months that is from 

January to December. 

(iii) The first calculation shall thus be effective 

from the date of issue of this notification in the 

Puducherry Government Gazette, based on the 

average of the Puducherry City Consumer Price Index 

for the previous year as explained in item (ii). 

2. Where the nature of work is the same, 

no discrimination in the payment of minimum rates of 

wages should be made in respect of the male and female 

workers irrespective of their sex. 

3. Where a workman is paid monthly wages dividing 

the monthly wages by 26 shall arrive at the daily wage. 

4. To arrive at the monthly rates of wages, the daily 

rate of wages shall be multiplied by 30. 

5. Wherever the existing wages are higher than the 

minimum wages fixed herein, the same shall be 

continued to be paid.

Whereas Thiru V.M.C.S. Manogaran has came up with a proposal to set up a retail petrol bunk by 

way of leasing a portion of 200 Kuzhies of Melaiyur Revenue Village, comprised in R.S.No. 98/2 to the 

out of the total extent of 3H-88A-00Ca. in Karaikal region, belonging to Sri Abiramiamman Sameda 

Sri Rajasolleeswarar Devasthanam, T.R. Pattinam, Karaikal; 

And whereas, the said Devasthanam represented by the Board of Trustees / Special Officer, has 

conveyed their consent to lease the said land to Indian Oil Corporation through Thiru V.M.C.S. Manogaran, 

for setting up of a retail petrol bunk; 

And whereas, a notification under section 25(1) of the Puducherry Hindu Religious Institutions 

Act, 1972 was published in the “Dina Mani”, dated 25-12-2009, in Karaikal region, inviting objections or 

suggestions, if any, from the public regarding the proposed lease of land, within 30 days from the date of 

publication; 

And whereas, two objections were received one from Thiru O.A.T. Aathiappan, Karaikal and another 

from the President, Thirupattinam Senguntha Marabinar Association, Karaikal have given their objections. 

Both of them were called for personal hearing on 26-4-2010, out of which, Thiru O.A.T. Aathiappan has 

appeared and deposed mainly if such lease has been allowed others will also claim for such kind of lease in future. 

Thirupattinam Senguntha Marabinar Association, Karaikal has not appeared for personal hearing. The above said 

two objections have been set aside by the undersigned, in the light of the deposition made by Thiru O.A.T. Aathiappan 

on 26-4-2010 and by the present Board of Trustees on 23-4-2010 and also it is found that the proposed land to 

be leased is not earning any income to the temple. Accordingly , the said objections have also been set aside 

by the undersigned in the better interest of the temple; 

Now, therefore, in exercise of the powers conferred to the undersigned under section 25 (1) of the 

Puducherry Hindu Religious Institutions Act, 1972 , permission is hereby accorded to the temple authority of 

Sri Abiramiamman Sameda Sri Rajasolleeswarar Devasthanam, T.R.Pattinam, Karaikal, to lease out the said temple 

land as described in the Schedule below to Indian Oil Corporation, Trichy, Tamil Nadu through 

Thiru V.M.C.S Manogaran for setting up of a Petrol Bunk, with the following terms and conditions. 

(a) Monthly rent of Rs. 8,665. 

(b) Advance amount of Rs. 86,650.

Lease agreement has to be renewed once in 3 years.

hindrance to the temple in a reasonable time limit without any laches on the part of the lessee. 

All taxes/ levy, duty, licence fee in respect of the business has to be paid by the lessee in proper time 

without any default; and other secondary terms and conditions are to be indicated in the lease deed.

Whereas complaints have been received by the Government to the effect that M/s. Thirumala Benefit Fund 

Limited, Puducherry a financial establishment as defined under section 2(d) of the Pondicherry Protection of Interests 

in Financial Establishments Act, 2004 ( Act No.l of 2005 ) had allegedly cheated its depositors and that such 

depositors are not able to realise their deposits from the said financial establishment even after expiry of the maturity 

period; 

And whereas, a case has been registered in Crime No. 10/2005, dated 25-4-2005 against the said financial 

establishment under sections 409 and 420 of the Indian Penal Code read with 34 of the Indian Penal Code in the 

Crime Investigation Department, Puducherry; 

And whereas, after conducting the investigation on the aforesaid allegations, the Government is satisfied 

that a prima facie case has been established to the effect that the said financial establishment had failed to—

Return deposits or other assured benefits and 

Pay interest or other assured benefits and 

Render requisite service against such deposits to its depositors; 

And whereas, in order to protect the interest of depositors of the aforesaid financial establishment, it has

appended to this notification; 

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 4 and for purpose of 

sub-section (3) of section 5 of the Pondicherry Protection of Interests of Depositors in Financial Establishments

The present Board of Trustees of Sri Guru Sithananthaswamy Devasthanam, Karuvadikuppam, have 

proposed to alienate temple land comprised in R.S. No. 160/1 of Karuvadikuppam Revenue Village in Puducherry 

region to an extent of 0.25.36 hectares, in favour of 30 residents who are living on the said temple land. 

2. The temple authorities have resolved to alienate the land as per the extent they have occupied 

at present. These residents have been allowed to reside in the temple lands in R.S. No. 160/1 more than 40 years 

back and have been in continuous occupation of these lands by putting up their houses. Therefore, the temple 

authorities have come forward to alienate the land to these occupants as per the Annexure. The GLR value for 

R.S.No. 160/1 for the year 2006-07 in Karuvadikuppam Revenue Village is Rs.220 per square feet. A notification 

as per rule was issued in the Tamil Daily “Dina Malar” on 23-1-2007, under section 25(1) of the Pondicherry 

Hindu Religious institutions Act, 1972. Since no objections were received on the proposed alienation, the subject 

matter was placed before the Council of Ministers, for a decision on the request for alienation of the temple 

land. The Council of Ministers vide their Resolution No. 2009/M.15/142 have resolved to fix a uniform rate 

of Rs.220 per square feet for alienation of the temple lands to the present residents. 

3. Therefore, in exercise of the powers conferred on the Commissioner, Hindu Religious Institutions, 

under section 25(1) of the Pondicherry Hindu Religious Institutions Act, 1972, sanction is hereby accorded 

to the Trustees of the abovesaid temple to sell the land, present in R.S. No. 160/1 of Karuvadikuppam Revenue 

Village in favour of the 30 residents as per the Annexure to this order on the proposed conditions as below: 

(a) The temple authority shall alienate and sell the land to each individual resident as per the 

Annexure to this order at Rs.220 per square feet. 

(b) The sale proceeds received from the intended purchaser from time to time have to be remitted 

into a nationalised bank in one account and thereafter the total amount should be converted as fixed 

deposit in favour of “The Commissioner, Hindu Religious Institutions on account of Sri Guru 

Sithananthaswamy Devasthanam, Karuvadikuppam, Puducherry”. 

(c) The fixed deposit shall not be withdrawn from the bank on any account and shall be reinvested 

again and again perpetuating the asset. 

(d) The transaction shall be completed within three months from the date of issue of this order. If 

delay occurs beyond the said period of three months in payment of sale proceeds, interests at 12% per 

annum to the balance amount or sale amount shall be collected from the intended purchaser concerned, 

as the case may be. However, this order will be in vogue for a period of 12 months from the date of 

issue of this order. 

(e) The progress report on the alienation of the temple land shall be sent to this office by every 

month till the completion of this alienation.

Whereas, the Government is of the opinion that an 

industrial dispute has arisen between the management 

of Pondicherry Institute of Medical Sciences, Puducherry 

and its workman Thiru S. Gopalakrishnan over 

non-employment in respect of the matter mentioned in 

the Annexure to this order; 

And whereas, in the opinion of the Government, it 

is necessary to refer the said dispute for adjudication; 

Now, therefore, by virtue of the authority delegated 

vide G. O. Ms. No. 20/91/Lab., dated 23-5-1991 of the 

Labour Department, Puducherry to exercise the powers 

conferred by clause (c) of sub-section (1) of section 10 

of the Industrial Disputes Act, 1947 (Central Act XIV 

of 1947), it is hereby directed by Secretary to 

Government (Labour) that the said dispute be referred 

to the Labour Court, Puducherry for adjudication. 

The Labour Court, Puducherry shall submit the award


within 3 months from the date of issue of reference as 

stipulated under sub-section (2-A) of section 10 of the 

Industrial Disputes Act, 1947 and in accordance with 

rule 10-B of the Industrial Disputes (Central) Rules, 

1957. The party raising the dispute shall file a statement 

of claim complete with relevant documents, list of 

reliances and witnesses to the Labour Court, Puducherry 

within 15 days of the receipt of the order of reference 

and also forward a copy of such statement to each one 

of the opposite parties involved in the dispute.
