Department <strong>of</strong> Animal Husbandry and Animal Welfare<br />

at <strong>Puducherry</strong> and Karaikal shall hereafter be changed<br />

as “Veterinary Dispensary’’ as per the norms <strong>of</strong> the<br />

Veterinary Council <strong>of</strong> India Act, 1984.<br />

The Programme Committee will also act as the State<br />

Programme Management Support Unit (SPMSU).<br />

This will provide the technical support to the State<br />

Health Mission through its pool <strong>of</strong> skilled pr<strong>of</strong>essional<br />

like MBA, CA, MIS Specialist and Consultant for RCH<br />

and other National Disease Control Programmes. This<br />

technical pool would be accessed by all programmes<br />

under NRHM for providing specific programme support<br />

related to logistics, financial management, MIS, tracking<br />

<strong>of</strong> funds etc.<br />

The tenure <strong>of</strong> the <strong>Puducherry</strong> State Health Mission<br />

and the <strong>Puducherry</strong> State Health Society shall be<br />

three years or end <strong>of</strong> the mission period.<br />

The non-<strong>of</strong>ficial members will be paid travelling<br />

allowance / dearness allowance as eligible to the <strong>of</strong>ficers<br />

as per NRHM guidelines.<br />

NOTIFICATION<br />

Whereas the proposal to fix the minimum rates <strong>of</strong><br />

wages payable to the employees engaged in the<br />

Tailoring Industries in the Union territory <strong>of</strong> <strong>Puducherry</strong>,<br />

was published as required by clause (b) <strong>of</strong> sub-section (1)<br />

<strong>of</strong> section 5 <strong>of</strong> the Minimum Wages Act, 1948<br />

(Central Act 11 <strong>of</strong> 1948) in the Labour Department’s<br />

notification issued under G.O. Ms. No. l0/AIL/Lab./G/2009,<br />

dated 26-8-2009 in Part-I <strong>of</strong> the Extraordinary<br />

Gazette No. 37, dated 15-9-2009 inviting objections and<br />

suggestions from all persons likely to be affected<br />

thereby within sixty days from the date <strong>of</strong> publication<br />

<strong>of</strong> the said notification in the <strong>of</strong>ficial gazette,<br />

<strong>Puducherry</strong>;<br />

2. And whereas, the said gazette notification was<br />

made available to the general public on 15-9-2009;<br />

3. And whereas, no objections or suggestions have<br />

so far been received within the abovesaid stipulated time<br />

limit and therefore the <strong>Government</strong> have decided to fix<br />

the minimum rates <strong>of</strong> wages;<br />

4. Now, therefore, in exercise <strong>of</strong> the powers conferred<br />

by clause (a) <strong>of</strong> sub-section (1) <strong>of</strong> section 3 read with<br />

sub-section (2) <strong>of</strong> section 5 and, sub-section (1)<br />

<strong>of</strong> section 13 <strong>of</strong> the Minimum Wages Act, 1948 (Central<br />

Act 11 <strong>of</strong> 1948), the Lieutenant-Governor, <strong>Puducherry</strong>,<br />

is pleased to fix the minimum rates <strong>of</strong> wages payable to<br />

each category <strong>of</strong> employees engaged in the employment<br />

in the Tailoring Industries <strong>of</strong> the Union territory <strong>of</strong><br />

<strong>Puducherry</strong> as specified in column (2) <strong>of</strong> the Schedule<br />

annexed hereto at the rates and for such hours <strong>of</strong> work<br />

per day as specified against each in the said column<br />

NOTE<br />

1. The employees shall be paid dearness allowance<br />

as indicated below:<br />

(i) The dearness allowance is linked to the<br />

<strong>Puducherry</strong> City Consumer Price Index for the month<br />

<strong>of</strong> July 2009 i.e., 164 points with base year 2001=100<br />

and every raise <strong>of</strong> 1 point over and above 164 points<br />

an increase <strong>of</strong> Rs. 6.70 (Rupees six and paise seventy only)<br />

per point per month shall be paid as dearness allowance.<br />

(ii) The dearness allowance shall be calculated<br />

every year on the basis <strong>of</strong> the average <strong>of</strong> the indices<br />

for the proceeding twelve months that is from<br />

January to December.<br />

(iii) The first calculation shall thus be effective<br />

from the date <strong>of</strong> issue <strong>of</strong> this notification in the<br />

<strong>Puducherry</strong> <strong>Government</strong> Gazette, based on the<br />

average <strong>of</strong> the <strong>Puducherry</strong> City Consumer Price Index<br />

for the previous year as explained in item (ii).<br />

2. Where the nature <strong>of</strong> work is the same,<br />

no discrimination in the payment <strong>of</strong> minimum rates <strong>of</strong><br />

wages should be made in respect <strong>of</strong> the male and female<br />

workers irrespective <strong>of</strong> their sex.<br />

3. Where a workman is paid monthly wages dividing<br />

the monthly wages by 26 shall arrive at the daily wage.<br />

4. To arrive at the monthly rates <strong>of</strong> wages, the daily<br />

rate <strong>of</strong> wages shall be multiplied by 30.<br />

5. Wherever the existing wages are higher than the<br />

minimum wages fixed herein, the same shall be<br />

continued to be paid.<br />

Explanations :— (1) During the rainy seasons, if after<br />

the commencement <strong>of</strong> the work, the workers are forced<br />

allowed 50% <strong>of</strong> the wages normally they would have<br />

earned on completion <strong>of</strong> the work.<br />

(2) The daily rates <strong>of</strong> wages and dearness allowance<br />

include the element <strong>of</strong> holiday wages also.<br />

(3) To arrive at daily rates <strong>of</strong> wages the monthly<br />

wages shall be divided by 26.<br />

(4) Where the nature <strong>of</strong> work is the same, no<br />

published as required under clause (b) <strong>of</strong> sub-section (1)<br />

<strong>of</strong> section 5 <strong>of</strong> the said Act for information <strong>of</strong> all persons<br />

likely to be affected thereby and notice is hereby given<br />

that the said draft proposal will be taken into<br />

consideration by the <strong>Government</strong> <strong>of</strong> <strong>Puducherry</strong> after<br />

the expiry <strong>of</strong> sixty days from the date <strong>of</strong> publication <strong>of</strong><br />

the said proposal in the <strong>of</strong>ficial gazette, <strong>Puducherry</strong>.<br />

2. Any objections or suggestions, which may be<br />

received from any person with respect to the proposal<br />

Auto Drivers in the Union territory <strong>of</strong> <strong>Puducherry</strong>.<br />

Whereas Thiru V.M.C.S. Manogaran has came up with a proposal to set up a retail petrol bunk by<br />

way <strong>of</strong> leasing a portion <strong>of</strong> 200 Kuzhies <strong>of</strong> Melaiyur Revenue Village, comprised in R.S.No. 98/2 to the<br />

out <strong>of</strong> the total extent <strong>of</strong> 3H-88A-00Ca. in Karaikal region, belonging to Sri Abiramiamman Sameda<br />

Sri Rajasolleeswarar Devasthanam, T.R. Pattinam, Karaikal;<br />

And whereas, the said Devasthanam represented by the Board <strong>of</strong> Trustees / Special Officer, has<br />

conveyed their consent to lease the said land to Indian Oil Corporation through Thiru V.M.C.S. Manogaran,<br />

for setting up <strong>of</strong> a retail petrol bunk;<br />

And whereas, a notification under section 25(1) <strong>of</strong> the <strong>Puducherry</strong> Hindu Religious Institutions<br />

Act, 1972 was published in the “Dina Mani”, dated 25-12-2009, in Karaikal region, inviting objections or<br />

suggestions, if any, from the public regarding the proposed lease <strong>of</strong> land, within 30 days from the date <strong>of</strong><br />

publication;<br />

And whereas, two objections were received one from Thiru O.A.T. Aathiappan, Karaikal and another<br />

from the President, Thirupattinam Senguntha Marabinar Association, Karaikal have given their objections.<br />

Both <strong>of</strong> them were called for personal hearing on 26-4-2010, out <strong>of</strong> which, Thiru O.A.T. Aathiappan has<br />

appeared and deposed mainly if such lease has been allowed others will also claim for such kind <strong>of</strong> lease in future.<br />

Thirupattinam Senguntha Marabinar Association, Karaikal has not appeared for personal hearing. The above said<br />

two objections have been set aside by the undersigned, in the light <strong>of</strong> the deposition made by Thiru O.A.T. Aathiappan<br />

on 26-4-2010 and by the present Board <strong>of</strong> Trustees on 23-4-2010 and also it is found that the proposed land to<br />

be leased is not earning any income to the temple. Accordingly , the said objections have also been set aside<br />

by the undersigned in the better interest <strong>of</strong> the temple;<br />

Now, therefore, in exercise <strong>of</strong> the powers conferred to the undersigned under section 25 (1) <strong>of</strong> the<br />

<strong>Puducherry</strong> Hindu Religious Institutions Act, 1972 , permission is hereby accorded to the temple authority <strong>of</strong><br />

Sri Abiramiamman Sameda Sri Rajasolleeswarar Devasthanam, T.R.Pattinam, Karaikal, to lease out the said temple<br />

land as described in the Schedule below to Indian Oil Corporation, Trichy, Tamil Nadu through<br />

Thiru V.M.C.S Manogaran for setting up <strong>of</strong> a Petrol Bunk, with the following terms and conditions.<br />

(a) Monthly rent <strong>of</strong> Rs. 8,665.<br />

(b) Advance amount <strong>of</strong> Rs. 86,650.<br />

shall vacant the premises without any controversy and to remove all the hoardings without any<br />

hindrance to the temple in a reasonable time limit without any laches on the part <strong>of</strong> the lessee.<br />

All taxes/ levy, duty, licence fee in respect <strong>of</strong> the business has to be paid by the lessee in proper time<br />

without any default; and other secondary terms and conditions are to be indicated in the lease deed.<br />

Whereas complaints have been received by the <strong>Government</strong> to the effect that M/s. Thirumala Benefit Fund<br />

Limited, <strong>Puducherry</strong> a financial establishment as defined under section 2(d) <strong>of</strong> the Pondicherry Protection <strong>of</strong> Interests<br />

in Financial Establishments Act, 2004 ( Act No.l <strong>of</strong> 2005 ) had allegedly cheated its depositors and that such<br />

depositors are not able to realise their deposits from the said financial establishment even after expiry <strong>of</strong> the maturity<br />

period;<br />

And whereas, a case has been registered in Crime No. 10/2005, dated 25-4-2005 against the said financial<br />

establishment under sections 409 and 420 <strong>of</strong> the Indian Penal Code read with 34 <strong>of</strong> the Indian Penal Code in the<br />

Crime Investigation Department, <strong>Puducherry</strong>;<br />

And whereas, after conducting the investigation on the aforesaid allegations, the <strong>Government</strong> is satisfied<br />

that a prima facie case has been established to the effect that the said financial establishment had failed to—<br />

Pay interest or other assured benefits and<br />

Render requisite service against such deposits to its depositors;<br />

become necessary to attach certain properties <strong>of</strong> the said financial establishment more fully described in the Schedule<br />

appended to this notification;<br />

Now, therefore, in exercise <strong>of</strong> the powers conferred by sub-section (2) <strong>of</strong> section 4 and for purpose <strong>of</strong><br />

sub-section (3) <strong>of</strong> section 5 <strong>of</strong> the Pondicherry Protection <strong>of</strong> Interests <strong>of</strong> Depositors in Financial Establishments<br />

ORDER<br />

<strong>Puducherry</strong>, the 5th July 2010.<br />

The present Board <strong>of</strong> Trustees <strong>of</strong> Sri Guru Sithananthaswamy Devasthanam, Karuvadikuppam, have<br />

proposed to alienate temple land comprised in R.S. No. 160/1 <strong>of</strong> Karuvadikuppam Revenue Village in <strong>Puducherry</strong><br />

region to an extent <strong>of</strong> 0.25.36 hectares, in favour <strong>of</strong> 30 residents who are living on the said temple land.<br />

2. The temple authorities have resolved to alienate the land as per the extent they have occupied<br />

at present. These residents have been allowed to reside in the temple lands in R.S. No. 160/1 more than 40 years<br />

back and have been in continuous occupation <strong>of</strong> these lands by putting up their houses. Therefore, the temple<br />

authorities have come forward to alienate the land to these occupants as per the Annexure. The GLR value for<br />

R.S.No. 160/1 for the year 2006-07 in Karuvadikuppam Revenue Village is Rs.220 per square feet. A notification<br />

as per rule was issued in the Tamil Daily “Dina Malar” on 23-1-2007, under section 25(1) <strong>of</strong> the Pondicherry<br />

Hindu Religious institutions Act, 1972. Since no objections were received on the proposed alienation, the subject<br />

matter was placed before the Council <strong>of</strong> Ministers, for a decision on the request for alienation <strong>of</strong> the temple<br />

land. The Council <strong>of</strong> Ministers vide their Resolution No. 2009/M.15/142 have resolved to fix a uniform rate<br />

<strong>of</strong> Rs.220 per square feet for alienation <strong>of</strong> the temple lands to the present residents.<br />

3. Therefore, in exercise <strong>of</strong> the powers conferred on the Commissioner, Hindu Religious Institutions,<br />

under section 25(1) <strong>of</strong> the Pondicherry Hindu Religious Institutions Act, 1972, sanction is hereby accorded<br />

to the Trustees <strong>of</strong> the abovesaid temple to sell the land, present in R.S. No. 160/1 <strong>of</strong> Karuvadikuppam Revenue<br />

Village in favour <strong>of</strong> the 30 residents as per the Annexure to this order on the proposed conditions as below:<br />

(a) The temple authority shall alienate and sell the land to each individual resident as per the<br />

Annexure to this order at Rs.220 per square feet.<br />

(b) The sale proceeds received from the intended purchaser from time to time have to be remitted<br />

into a nationalised bank in one account and thereafter the total amount should be converted as fixed<br />

deposit in favour <strong>of</strong> “The Commissioner, Hindu Religious Institutions on account <strong>of</strong> Sri Guru<br />

Sithananthaswamy Devasthanam, Karuvadikuppam, <strong>Puducherry</strong>”.<br />

(c) The fixed deposit shall not be withdrawn from the bank on any account and shall be reinvested<br />

again and again perpetuating the asset.<br />

(d) The transaction shall be completed within three months from the date <strong>of</strong> issue <strong>of</strong> this order. If<br />

delay occurs beyond the said period <strong>of</strong> three months in payment <strong>of</strong> sale proceeds, interests at 12% per<br />

annum to the balance amount or sale amount shall be collected from the intended purchaser concerned,<br />

as the case may be. However, this order will be in vogue for a period <strong>of</strong> 12 months from the date <strong>of</strong><br />

issue <strong>of</strong> this order.<br />

(e) The progress report on the alienation <strong>of</strong> the temple land shall be sent to this <strong>of</strong>fice by every<br />

month till the completion <strong>of</strong> this alienation.

industrial dispute has arisen between the management<br />

<strong>of</strong> Pondicherry Institute <strong>of</strong> Medical Sciences, <strong>Puducherry</strong><br />

and its workman Thiru S. Gopalakrishnan over<br />

non-employment in respect <strong>of</strong> the matter mentioned in<br />

is necessary to refer the said dispute for adjudication;<br />

Now, therefore, by virtue <strong>of</strong> the authority delegated<br />

vide G. O. Ms. No. 20/91/Lab., dated 23-5-1991 <strong>of</strong> the<br />

Labour Department, <strong>Puducherry</strong> to exercise the powers<br />

conferred by clause (c) <strong>of</strong> sub-section (1) <strong>of</strong> section 10<br />

<strong>of</strong> the Industrial Disputes Act, 1947 (Central Act XIV<br />

<strong>of</strong> 1947), it is hereby directed by Secretary to<br />

<strong>Government</strong> (Labour) that the said dispute be referred<br />

to the Labour Court, <strong>Puducherry</strong> for adjudication.<br />
