CHRI/T6(GIA)/2002, dated 30–4–2002, the Lieutenant-<br />

Governor, Pondicherry, is pleased to sanction<br />

Rs.1,00,000 (Rupees one lakh only) as one time quantum<br />

The proposal to implement a new scheme called “Award <strong>of</strong> Additional Financial Assistance to Scheduled Castes<br />

Students Undergoing the Pr<strong>of</strong>essional Courses, namely, M.B., B.S., Engineering, B.Ed., <strong>and</strong> D.T.Ed., Courses <strong>and</strong> who are<br />

recipient <strong>of</strong> financial assistance under the “Perunthalaivar Kamarajar Financial Assistance to the Students Studying<br />

M.B., B.S., Engineering, B.Ed., <strong>and</strong> D.T.Ed., Courses Scheme” implemented by the Education <strong>Department</strong> has been under<br />

consideration <strong>of</strong> the <strong>Government</strong> for some time past.<br />

2. The Lieutenant-Governor, Pondicherry, is pleased to frame the rules for the said scheme <strong>and</strong> to order that the above<br />

referred scheme shall be implemented in this Union Territory <strong>of</strong> Pondicherry from the year 2004-05.<br />

3. This issues with the concurrence <strong>of</strong> the Finance <strong>Department</strong> vide their U.O.No.104068/354/F5/A2/04,<br />

dated 10–1–2005.<br />

AWARD OF ADDITIONAL FINANCIAL ASSISTANCE TO SCHEDULED CASTES STUDENTS<br />

UNDERGOING PROFESSIONAL COURSES<br />

RULES AND REGULATIONS<br />

I. General.— In order that no meritorious scheduled castes students is deprived <strong>of</strong> higher studies on grounds <strong>of</strong><br />

financial constraints from an academic career in the field <strong>of</strong> Medicine/Engineering/Teacher Training, the <strong>Government</strong> <strong>of</strong><br />

Pondicherry has decided to start an additional financial assistance scheme viz. Award <strong>of</strong> Additional Financial Assistance<br />

to Scheduled Castes Students Undergoing Pr<strong>of</strong>essional Courses in M.B., B.S., Engineering, B.Ed., <strong>and</strong> D.T.Ed.<br />

II. Allocation <strong>of</strong> financial assistance.— The financial assistance will be open to Medical/Engineering/<br />

Teacher Training to scheduled castes students who are Indian citizens <strong>and</strong> residents <strong>of</strong> this Union Territory. The<br />

financial assistance will be extended to the scheduled castes students who are selected through CENTAC to<br />

undergo the Pr<strong>of</strong>essional Courses in <strong>Government</strong> as well as <strong>Government</strong> recognised private institutions. Students<br />

applying directly to the institution <strong>and</strong> got selected on their own merits to undergo the courses will not be eligible<br />

for consideration <strong>of</strong> this financial assistance.<br />

III. Eligibility.—(1) Only those scheduled castes c<strong>and</strong>idates who are Indian citizens <strong>and</strong> residents <strong>of</strong> this Union<br />

Territory <strong>of</strong> Pondicherry (“resident” means as defined for the purpose <strong>of</strong> admission in Educational Institutions by this<br />

Administration from time to time) <strong>and</strong> who has passed the qualifying examination will be eligible for consideration for the<br />

award <strong>of</strong> this financial assistance subject to the fulfilment <strong>of</strong> other conditions <strong>of</strong> the scheme.<br />

(2) The c<strong>and</strong>idates who have passed the qualifying examination <strong>and</strong> studying only in first year <strong>of</strong> Medicine/<br />

Engineering/D.T.Ed., <strong>and</strong> B.Ed., Course during the year <strong>of</strong> the award <strong>of</strong> financial assistance (fresh) will be eligible for<br />

consideration:<br />

Provided that the c<strong>and</strong>idates admitted in II year through lateral entry in B.E.,/B.Tech. will also be eligible for<br />

consideration <strong>of</strong> fresh award.

(3) A c<strong>and</strong>idate who is in full time employment will not be eligible for award <strong>of</strong> financial assistance. If, however,<br />

he gives up employment or takes leave without pay for the entire duration <strong>of</strong> the course <strong>and</strong> thereafter starts his studies<br />

as a full time student, he will be eligible for an award under the scheme.<br />

(4) A financial assistance recipient shall not receive any other regular scholarship/financial assistance from<br />

other <strong>Department</strong>s.<br />

(5) Financial assistance will not be given during the internship period for Medical students.<br />

(6) A financial assistance recipient under the above scheme may enjoy the fee concession given by the institution<br />

in which he is studying or by any other authority.<br />

(7) C<strong>and</strong>idates studying as part-time students or studying privately or in an unrecognised institution or<br />

through correspondence course will not be eligible.<br />

(8) The scheme will come into effect from the academic year 2004-05.<br />

IV. Submission <strong>of</strong> application.— The application in the prescribed form as in Annexure-I may be sent to<br />

the Deputy Director (Students Wing), Adidravidar Welfare <strong>Department</strong>, Pondicherry, through the institutions in<br />

which the students are pursuing their courses alongwith a Certificate issued by the Education <strong>Department</strong> that the<br />

individual has been paid 60% <strong>of</strong> the fees fixed by the Committee for the Pr<strong>of</strong>essional Course pursued by him/her for<br />

the year concerned <strong>and</strong> he/she is eligible for the payment <strong>of</strong> additional financial assistance under Adidravidar<br />

Welfare <strong>Department</strong> scheme.<br />

V. Tenability.—(1) The financial assistance under the scheme has to be availed <strong>of</strong> from the year it is made. The<br />

financial assistance will be tenable for the first Degree in Engineering/Medicine/D.T.Ed., <strong>and</strong> B.Ed., Courses.<br />

(2) If a c<strong>and</strong>idate studying Engineering Course once selected <strong>and</strong> awarded financial assistance then shifts to<br />

Medical Science will be awarded the financial assistance at the rate admissible to him/her for that course <strong>of</strong> study<br />

suspending the number <strong>of</strong> years for which he/she was already in receipt <strong>of</strong> the financial assistance. The same principle is<br />

applicable to the c<strong>and</strong>idates studying Medical Sciences <strong>and</strong> then shifts to Engineering Course.<br />

Explanation-I. – If a c<strong>and</strong>idate studied I/II year <strong>of</strong> Engineering <strong>and</strong> then shifts to first year <strong>of</strong> Medicine will be<br />

awarded financial assistance suspending financial assistance for one/two years as the case may be.<br />

VI. Rates <strong>of</strong> financial assistance.— The rates <strong>of</strong> the financial assistance will be as under:<br />

M.B., B.S. ... Rs.25,000 per annum<br />

B.E.,/B.Tech. ... Rs.10,000 per annum<br />

B.Ed.,/D.T.Ed. ... Rs. 5,000 per annum<br />

The quantum <strong>of</strong> assistance viz. Rs.25,000 for Medicine <strong>and</strong> Rs.10,000 for Engineering <strong>and</strong> Rs.5,000 for<br />

B.Ed., / D.T.Ed., will be the maximum limit. The financial assistance will be awarded to the extent <strong>of</strong> actual tuition fee.<br />

VII. Income limit <strong>of</strong> parents.— (1) Only those students whose parents have an income up to Rs.3.00 lakhs per<br />

annum will be eligible for the financial assistance.<br />

(2) (i) The maximum income limit for both salaried in <strong>Government</strong>/Public <strong>and</strong> Private sector employees <strong>and</strong> nonsalaried<br />

persons like businessmen, self-employed <strong>and</strong> agriculturists, etc. is fixed at Rs.3.00 lakhs per annum. In case <strong>of</strong><br />

salaried people, full emoluments including all allowances, honorarium, bonus, special pay, etc. (excluding H.R.A., if any),<br />

received in a year shall be taken into account for computing annual income. No relief for long-term savings, contribution<br />

to Provident Fund, Life Insurance, etc. will be allowed.

(ii) In case <strong>of</strong> non-salaried class such as businessmen/l<strong>and</strong>-owners/agriculturists <strong>and</strong> self-employed, etc. their<br />

entire gross income will be taken into consideration for computing their annual income.<br />

(iii) While computing the total income, the income from all sources <strong>of</strong> both the parents <strong>and</strong> income <strong>of</strong> the<br />

awardees, if any, will also be taken into consideration.<br />

VIII. Duration <strong>of</strong> the financial assistance <strong>and</strong> its renewal.—(1) Financial assistance under the scheme is<br />

renewable from year to year within the same stage <strong>of</strong> education. The renewal will depend on the promotion to the<br />

next year <strong>of</strong> the course.<br />

(2) If an awardee shows unsatisfactory progress during the course <strong>of</strong> his studies, viz. failure in the promotional<br />

examination <strong>and</strong> being ineligible to take any supplementary examination subsequently or if he changes the course <strong>of</strong><br />

study without the prior approval <strong>of</strong> the Union Territory Administration represented by the Director, Adidravidar Welfare<br />

<strong>Department</strong>, Pondicherry, the financial assistance will be cancelled. Good conduct <strong>and</strong> regularity in attendance are also<br />

the required conditions for continuance <strong>of</strong> the financial assistance. The decision <strong>of</strong> the <strong>Government</strong> <strong>of</strong> Pondicherry<br />

represented by the Director, Adidravidar Welfare <strong>Department</strong>, Pondicherry, will be final <strong>and</strong> binding in all such cases.<br />

Financial assistance once cancelled will not be restored under any circumstances.<br />

(3) In the case <strong>of</strong> the final University examination, if the awardee is placed in compartment, his/her financial<br />

assistance will not be extended beyond the final examination <strong>of</strong> the course.<br />

(4) The financial assistance will be renewed for each successive year subject to furnishing <strong>of</strong> a certificate from<br />

the Education <strong>Department</strong> that the student has passed in the annual examination as per the Annual Progress Report as<br />

furnished by the Head <strong>of</strong> Institution <strong>and</strong> he/she has been paid the financial assistance as per rules for the year. For the<br />

purpose, the institution will maintain a register indicating the names <strong>of</strong> financial assistance recipients <strong>and</strong> their academic<br />

progress year-wise. The certificate will enable the Director <strong>of</strong> Adidravidar Welfare <strong>Department</strong> to process the renewal <strong>of</strong><br />

the financial assistance expeditiously. The Head <strong>of</strong> the Institution is expected to bring to the notice <strong>of</strong> the Director,<br />

Adidravidar Welfare <strong>Department</strong> any adverse report that may have been necessitated due to habitual irregularity,<br />

misbehaviour, participation in strikes, etc. <strong>of</strong> financial assistance recipient <strong>and</strong> if necessary suggest suspension/cancellation<br />

<strong>of</strong> financial assistance.<br />

(5) Where the Head <strong>of</strong> the Institution gives adverse comments <strong>and</strong> specifically reommends that the financial<br />

assistance should not be renewed the Director, Adidravidar Welfare <strong>Department</strong> should fully satisfy himself <strong>of</strong> the<br />

reasons for such adverse remarks <strong>and</strong> from his own opinion in the case. If the Director, Adidravidar Welfare <strong>Department</strong><br />

finally decide to cancel the award, he should do so with the approval <strong>of</strong> the Secretary to <strong>Government</strong> (Welfare), Pondicherry.<br />

(6) A financial assistance under the scheme is renewable from year to year within the same stage <strong>of</strong> education<br />

till the awardees undergo study <strong>and</strong> not while they undergo training/internship.<br />

(7) (a) The conditions laid down above will be relaxable in the following circumstances:<br />

(i) If an awardee is unable to appear in the final or annual University examination owing to prolonged illness<br />

extending over a long period which had resulted in shortage in the required attendance as per University rules, the<br />

financial assistance will be renewed for next year provided, the Education <strong>Department</strong> certifies that the Head <strong>of</strong><br />

Institution has certified that the awardee would have passed the University examination had he/she taken the<br />

examination <strong>and</strong> a Registered Medical Practitioner has certified that the awardee had been ill for a period by which the<br />

attendance falls short:<br />

(ii) When in case where an awardee appears for the annual examination within a continuous course <strong>of</strong> studies<br />

(but not a final University examination) <strong>and</strong> after taking examination for some papers/practicals he/she is taken ill<br />

<strong>and</strong> is prevented by such illness from taking examination for the remaining papers/practicals, his/her financial<br />

assistance would be suspended in the first instance subject to his/her producing a Certificate from the Education

<strong>Department</strong> that he/she has produced a Medical Certificate from the Registered Medical Practitioner certifying<br />

that owing to illness it was not possible for the awardees to take the examination during the period in which<br />

examination for the remaining papers/practicals was held, the financial assistance so suspended would be revived<br />

for the next higher class in the same continuous course <strong>of</strong> studies after the awardee has passed the same<br />

examination, whenever such examination takes place on the next occasion, irrespective <strong>of</strong> the fact whether it is a<br />

supplementary examination or another annual examination.<br />

(b) In the case <strong>of</strong> students who are treated to have failed for reasons <strong>of</strong> illness Rule VIII (7)(a)(i), but are<br />

promoted provisionally to next higher class, no suspension <strong>of</strong> financial assistance is involved.<br />

(8) The financial assistance for B.Ed., Course under the scheme is awardable only for one year <strong>and</strong> is not renewable.<br />

(9) The financial assistance for D.T.Ed., Course under the scheme is awardable for 2 years only.<br />

IX. Payment <strong>of</strong> financial assistance.—(1) The amount <strong>of</strong> the financial assistance will be drawn by the Director<br />

<strong>of</strong> Adidravidar Welfare <strong>Department</strong>, Pondicherry <strong>and</strong> will be disbursed through the Heads <strong>of</strong> Institutions.<br />

(2) The payment <strong>of</strong> financial assistance will start from the year the admission is obtained. In case <strong>of</strong><br />

renewal <strong>of</strong> financial assistance for the succeeding year, the financial assistance will be paid from the year following<br />

that for which the financial assistance was paid during the previous academic year if the course <strong>of</strong> study pursued<br />

is continuous e.g. M.B.,B.S., (I year) to M.B.,B.S., (II year) or B.E., (I year) to B.E., (II year), B.Ed.,/D.T.Ed., on<br />

receipt <strong>of</strong> the Annual Progress Report.<br />

X. Payment <strong>of</strong> financial assistance during leave.—(1) The financial assistance during leave will be admissible<br />

as follows:<br />

If the absence is due to illness supported by the Education <strong>Department</strong> Certificate stating that the student has<br />

submitted necessary Medical Certificate from a Registered Medical Practitioner to the Education <strong>Department</strong>.<br />

(a) Full financial assistance: If the absence does not exceed two months ;<br />

(b) Half financial assistance, if the absence exceeds two months but not four months. For the first two months<br />

the financial assistance will be paid at full rates <strong>and</strong> for the period exceeding two months, the financial assistance will<br />

be paid at half the rates; <strong>and</strong><br />

(c) No financial assistance, if the absence exceeds four months. For the first four months, however, the financial<br />

assistance will be paid as per sub-clause (b).<br />

(2) For women, the financial assistance will be admissible at full rates upto four <strong>and</strong> half a months for absence<br />

on grounds <strong>of</strong> maternity. No financial assistance will be paid for a period exceeding four <strong>and</strong> half a months due to absence<br />

on grounds <strong>of</strong> maternity.<br />

(3) In all the above cases, the financial assistance at the rates indicated will be paid only if the Education<br />

<strong>Department</strong> certifies that the Head <strong>of</strong> the Institution has recommended the application <strong>and</strong> certified that the awardee is<br />

likely to make up the deficiency in lectures <strong>and</strong> studies during the rest <strong>of</strong> the period <strong>of</strong> the course <strong>of</strong> studies.<br />

(4) The awardee will get the financial assistance as long as he/she is on the rolls <strong>of</strong> an institution subject to<br />

sub-paragraphs above. If on account <strong>of</strong> prolonged illness or by other valid reasons, the awardee’s name is struck <strong>of</strong>f the<br />

rolls, he/she will be entitled to the restoration <strong>of</strong> the financial assistance on re-admission <strong>and</strong> on the recommendation <strong>of</strong><br />

the Head <strong>of</strong> the Institution.<br />

XI. Removal <strong>of</strong> doubts.—If any doubt arises as to the interpretation <strong>of</strong> these rules, the decision <strong>of</strong> the<br />

<strong>Government</strong> thereon shall be final.

Whereas the Under Secretary, National Legal<br />

Services Authority, New Delhi in his letter, dated<br />

24-1-2005 has forwarded a copy <strong>of</strong> the model scheme<br />

for “Legal Aid Counsel” for implementation in terms<br />

<strong>of</strong> section 12(g) <strong>of</strong> the Legal Services Authorities<br />

Act, 1987;<br />

Whereupon, this Authority, after going through it,<br />

has decided to implement the scheme which is given<br />

below :<br />

Model scheme for “Legal Aid Counsel” in all the<br />

Courts <strong>of</strong> Magistrates<br />

According to section 12 (g) <strong>of</strong> the Legal Services<br />

Authorities Act, 1987 (as amended in 1994), any<br />

person in custody, including custody in a protective<br />

home or in juvenile home or in psychiatric hospital or<br />

psychiatric nursing home, is entitled to legal services<br />

for filing or defending a case. A large number <strong>of</strong><br />

under-trial prisoners who are not in a position to<br />

engage lawyers for defending them, feel h<strong>and</strong>icapped<br />

in their defence <strong>and</strong> remain incarcerated for long<br />

periods. Therefore, His Lordship Hon’ble Dr. Justice,<br />

Executive Chairman, National Legal Services Authority<br />

has invited suggestions/views from all the Chief<br />

Justices <strong>of</strong> the High Courts (Patrons-in-Chief <strong>of</strong> State<br />

Legal Services Authorities) on a Scheme for Legal Aid<br />

<strong>and</strong> Assistance to the Prisoners in Custody. His<br />

Lordship has pointed out that Legal Aid Counsel may<br />

be attached to all the Courts <strong>of</strong> Magistrates in the<br />

country who should give legal assistance to the<br />

persons in custody, for opposing rem<strong>and</strong> applications,<br />

securing orders for bail <strong>and</strong> moving miscellaneous<br />

applications as may be required. According to His<br />

Lordship, Legal Aid Counsel should be under an<br />

obligation to remain present in the Court assigned to<br />

him during the rem<strong>and</strong> hour <strong>and</strong> such other hours as<br />

may be directed by the Court. Thereafter when a<br />

challan is filed against the accused in custody in the<br />

Court assigned to such Advocate, the case should be<br />

entrusted to him for defence also. The appeals or<br />

revisions arising out <strong>of</strong> such challans should also be<br />

ordinarily entrusted to him. His Lordship is <strong>of</strong> the view<br />

that this system can go a long way in providing<br />

effective <strong>and</strong> meaningful legal assistance to under-trial<br />

prisoners, who feel h<strong>and</strong>icapped in their defence on<br />

account <strong>of</strong> lack <strong>of</strong> resources or other disabilities <strong>and</strong><br />

cannot engage a Counsel to defend them. His Lordship<br />

has desired that this scheme be followed through out<br />

the country.

2. The scheme lays emphasis for legal aid <strong>and</strong><br />

assistance to the persons in custody at the following<br />

three stages:–<br />

(a) When in custody during investigation <strong>of</strong> the<br />

cases <strong>and</strong> need legal assistance for getting released<br />

on bail <strong>and</strong> opposing rem<strong>and</strong> applications;<br />

(b) Legal assistance during trial for defence;<br />

(c) Legal assistance for preferring appeals or<br />

revisions in case <strong>of</strong> adverse orders.<br />

3. In terms <strong>of</strong> the directions issued by His<br />

Lordship, a model scheme has been formulated which<br />

may be adopted by the States with suitable<br />

modifications as required under the prevailing<br />

circumstances <strong>and</strong> needs <strong>of</strong> the respective States as<br />

under:—<br />

(i) The first step should be to identify all the<br />

Courts <strong>of</strong> Magistrates in each District for attaching<br />

Legal Aid Counsel. In case the work-load in a<br />

particular Court or Courts is too little, one Legal<br />

Aid Counsel may be attached to two Courts even.<br />

(ii) State Legal Services Authority or District<br />

Legal Services Authority to which the<br />

implementation <strong>of</strong> the scheme is entrusted, may<br />

prepare a panel <strong>of</strong> Legal Aid Counsel preferably<br />

with a minimum st<strong>and</strong>ing <strong>of</strong> five years on criminal<br />

side. The Advocates from this panel may be<br />

attached to the Courts <strong>of</strong> Magistrates <strong>and</strong> may be<br />

called “Legal Aid Counsel”.<br />

(iii) The remuneration <strong>and</strong> fee to be paid to Legal<br />

Aid Counsel may be determined by State Legal<br />

Services Authority or District Legal Services<br />

Authority, as the case may be. The remuneration/<br />

fee may be fixed under the following counts:—<br />

(a) for attending the Court during rem<strong>and</strong> hour<br />

every day (the remuneration for attending the<br />

Court during rem<strong>and</strong> hour may be fixed at Rs. 500<br />

per month or more depending upon the workload);<br />

(b) fee schedule for acting as Defence Counsel<br />

for aided persons may be drawn. It may be on<br />

the basis <strong>of</strong> effective hearings in warrant as well as<br />

summon trial cases with a ceiling <strong>of</strong> maximum fee;<br />

(c) fixed fee with incidental expenditure for<br />

filing <strong>and</strong> contesting an appeal or revision. The<br />

appeals <strong>and</strong> revisions may be permitted to be<br />

filed with the approval <strong>of</strong> the Member–Secretary<br />

<strong>of</strong> the State Legal Services Authority or Secretary,<br />

District Legal Services Authority, as the case may be;<br />

(All payments to Legal Aid Counsel may be made<br />

after obtaining certificates from the concerned<br />

Judicial Officers regarding attendance <strong>of</strong> the Counsel<br />

at the time <strong>of</strong> rem<strong>and</strong> or conduct <strong>of</strong> trial/appeal/<br />

revision).<br />

(iv) Name <strong>and</strong> address <strong>of</strong> the Legal Aid Counsel<br />

may be displayed outside the Court to which he is<br />

attached with requisite information as to who are<br />

eligible persons under the Legal Services Authorities<br />

Act <strong>and</strong> no payment is required to be made by<br />

them to Legal Aid Counsel (in case <strong>of</strong> any complaint<br />

against a Legal Aid Counsel regarding dem<strong>and</strong> <strong>of</strong><br />

fee or any other charges from an aided person,<br />

prompt action by way <strong>of</strong> removal <strong>of</strong> his name from<br />

the panel may be taken).<br />

(v) The scheme <strong>of</strong> Legal Aid Counsel may be<br />

given wide publicity in the State. Hoardings in the<br />

Police Stations <strong>and</strong> Jails may be affixed.<br />

(vi) The scheme can be more effectively<br />

implemented if printed pr<strong>of</strong>ormas <strong>of</strong> appointment<br />

letters to be issued to Legal Aid Counsel are<br />

h<strong>and</strong>ed over to the Courts <strong>of</strong> Magistrates with a<br />

request to issue the same in favour <strong>of</strong> the Legal<br />

Aid Counsel who takes over the defence <strong>of</strong> any<br />

person in custody being produced before the Court.<br />

On the basis <strong>of</strong> this appointment letter legal aid<br />

functionaries to issue required order allocating that<br />

case to Legal Aid Counsel to facilitate settlement<br />

<strong>of</strong> bills.<br />

(vii) to ensure that the Legal Aid Counsel remains<br />

present in the Court during rem<strong>and</strong> hour or any<br />

other hour <strong>of</strong> the day as directed by the Court.<br />

Legal aid functionaries may insist for an attendance<br />

certificate issued by the Court to the Legal Aid<br />

Counsel before making him payment for rem<strong>and</strong> hour.<br />

(viii) Certificates <strong>of</strong> merit/awards may be given<br />

to those Legal Aid Counsel whose performance is<br />

found to be outst<strong>and</strong>ing.<br />

NOTIFICATION<br />

Whereas the <strong>Government</strong> is <strong>of</strong> the opinion that an<br />

industrial dispute has arisen between the management<br />

<strong>of</strong> M/s. New Horizon Sugar Mills Limited, Ariyur,<br />

Pondicherry <strong>and</strong> the Joint Action Committee <strong>of</strong> New<br />

Horizon Sugar Mill Trade Unions-over charter <strong>of</strong> dem<strong>and</strong>s<br />

<strong>and</strong> payment <strong>of</strong> dues in respect <strong>of</strong> the matter mentioned<br />

in the Annexure to this order;<br />

And whereas in the opinion <strong>of</strong> the <strong>Government</strong>, it is<br />

necessary to refer the said dispute for adjudication;<br />

Now, therefore, by virtue <strong>of</strong> the authority delegated<br />

vide G.O.Ms. No. 20/91/Lab., dated 23-5-1991 <strong>of</strong> the<br />

Labour <strong>Department</strong>, Pondicherry to exercise the powers<br />

conferred by clause (d) <strong>of</strong> sub-section (1) <strong>of</strong> section 10<br />

<strong>of</strong> the Industrial Disputes Act, 1947 (Central Act XIV<br />

<strong>of</strong> 1947), read with first proviso <strong>of</strong> section 10 (1) <strong>of</strong> the<br />

Act, it is hereby directed by Secretary to <strong>Government</strong><br />

(Labour) that the said dispute be referred to the<br />

Industrial Tribunal, Pondicherry for adjudication.<br />

The Industrial Tribunal, shall submit the award within<br />

3 months from the date <strong>of</strong> issue <strong>of</strong> reference as stipulated<br />

under sub-section (2-A) <strong>of</strong> section 10 <strong>of</strong> the Industrial<br />

Disputes Act, 1947 <strong>and</strong> in accordance with rule 10-B <strong>of</strong><br />

the Industrial Disputes (Central) Rules, 1957. The party<br />

raising the dispute shall file a statement <strong>of</strong> claim<br />

complete with relevant documents, list <strong>of</strong> reliances <strong>and</strong><br />

witnesses to the Industrial Tribunal, within 15 days <strong>of</strong><br />

the receipt <strong>of</strong> the order <strong>of</strong> reference <strong>and</strong> also forward a<br />

copy <strong>of</strong> such statement to each one <strong>of</strong> the opposite<br />

parties involved in the dispute.<br />

the tentative seniority list <strong>of</strong> Assistant Director<br />

<strong>of</strong> Fisheries for seniority No. 26 to 28 was<br />

circulated to the concerned, calling for objections<br />

if any. Thiru M. Sivaraman, Assistant Director <strong>of</strong><br />

Fisheries, has intimated in writing his objection to the<br />

ranking in the seniority in the grade <strong>of</strong> Assistant Director<br />

NOTIFICATION<br />

Whereas the <strong>Government</strong> is <strong>of</strong> the opinion that an<br />

industrial dispute has arisen between the management<br />

<strong>of</strong> M/s. Skol Breweries Limited, Unit <strong>of</strong> Sica Breweries<br />

<strong>and</strong> the Sica Breweries Thozhilalar Sangam (CITU) - over<br />

non-employment <strong>of</strong> 30 women workers in respect <strong>of</strong><br />

the matter mentioned in the Annexure to this order;<br />

And whereas in the opinion <strong>of</strong> the <strong>Government</strong>, it is<br />

necessary to refer the said dispute for adjudication;<br />

Now, therefore, by virtue <strong>of</strong> the authority delegated<br />

vide G.O.Ms. No. 20/91/Lab., dated 23-5-1991 <strong>of</strong> the<br />

Labour <strong>Department</strong>, Pondicherry to exercise the powers<br />

conferred by clause (c) <strong>of</strong> sub-section (1) <strong>of</strong> section 10<br />

<strong>of</strong> the Industrial Disputes Act, 1947 (Central Act XIV<br />

<strong>of</strong> 1947), read with first proviso <strong>of</strong> section 10 (1) <strong>of</strong> the<br />

Act, it is hereby directed by Secretary to <strong>Government</strong><br />

(Labour) that the said dispute be referred to the Labour<br />

Court, Pondicherry for adjudication. The Labour Court,<br />

shall submit the award within 3 months from the date<br />

<strong>of</strong> issue <strong>of</strong> reference as stipulated under sub-section (2-A)<br />

<strong>of</strong> section 10 <strong>of</strong> the Industrial Disputes Act, 1947 <strong>and</strong><br />

in accordance with rule 10-B <strong>of</strong> the Industrial Disputes<br />

(Central) Rules, 1957. The party raising the dispute shall<br />

file a statement <strong>of</strong> claim complete with relevant<br />

documents, list <strong>of</strong> reliances <strong>and</strong> witnesses to the Labour<br />

Court, within 15 days <strong>of</strong> the receipt <strong>of</strong> the order <strong>of</strong><br />

reference <strong>and</strong> also forward a copy <strong>of</strong> such statement to<br />

each one <strong>of</strong> the opposite parties involved in the dispute.<br />
