rule 4(1) of the scheme for financial assistance to the 

Hindu Religious Institutions, Pondicherry notified vide 

G.O. Ms. No. 66 /CHRI/T6(GIA), 2004–05, dated 

15–2–2005, published in Part–II Extraordinary Gazette 

No. 10, dated 15–2–2005 of the Official Gazette of 

Pondicherry and in supersession of the G.O.Rt. No.3/ 

CHRI/T6(GIA)/2002, dated 30–4–2002, the Lieutenant- 

Governor, Pondicherry, is pleased to sanction 

Rs.1,00,000 (Rupees one lakh only) as one time quantum 

of assistance to the temples located in Economically 

Weaker Section Areas/Scheduled Caste Colony Areas 

for carrying out renovation and special repair works.

ORDER 

The proposal to implement a new scheme called “Award of Additional Financial Assistance to Scheduled Castes 

Students Undergoing the Professional Courses, namely, M.B., B.S., Engineering, B.Ed., and D.T.Ed., Courses and who are 

recipient of financial assistance under the “Perunthalaivar Kamarajar Financial Assistance to the Students Studying 

M.B., B.S., Engineering, B.Ed., and D.T.Ed., Courses Scheme” implemented by the Education Department has been under 

consideration of the Government for some time past. 

2. The Lieutenant-Governor, Pondicherry, is pleased to frame the rules for the said scheme and to order that the above 

referred scheme shall be implemented in this Union Territory of Pondicherry from the year 2004-05. 

3. This issues with the concurrence of the Finance Department vide their U.O.No.104068/354/F5/A2/04, 

dated 10–1–2005.

AWARD OF ADDITIONAL FINANCIAL ASSISTANCE TO SCHEDULED CASTES STUDENTS 

UNDERGOING PROFESSIONAL COURSES 

RULES AND REGULATIONS 

I. General.— In order that no meritorious scheduled castes students is deprived of higher studies on grounds of 

financial constraints from an academic career in the field of Medicine/Engineering/Teacher Training, the Government of 

Pondicherry has decided to start an additional financial assistance scheme viz. Award of Additional Financial Assistance 

to Scheduled Castes Students Undergoing Professional Courses in M.B., B.S., Engineering, B.Ed., and D.T.Ed. 

II. Allocation of financial assistance.— The financial assistance will be open to Medical/Engineering/ 

Teacher Training to scheduled castes students who are Indian citizens and residents of this Union Territory. The 

financial assistance will be extended to the scheduled castes students who are selected through CENTAC to 

undergo the Professional Courses in Government as well as Government recognised private institutions. Students 

applying directly to the institution and got selected on their own merits to undergo the courses will not be eligible 

for consideration of this financial assistance. 

III. Eligibility.—(1) Only those scheduled castes candidates who are Indian citizens and residents of this Union 

Territory of Pondicherry (“resident” means as defined for the purpose of admission in Educational Institutions by this 

Administration from time to time) and who has passed the qualifying examination will be eligible for consideration for the 

award of this financial assistance subject to the fulfilment of other conditions of the scheme. 

(2) The candidates who have passed the qualifying examination and studying only in first year of Medicine/ 

Engineering/D.T.Ed., and B.Ed., Course during the year of the award of financial assistance (fresh) will be eligible for 

consideration: 

Provided that the candidates admitted in II year through lateral entry in B.E.,/B.Tech. will also be eligible for 

consideration of fresh award.


(3) A candidate who is in full time employment will not be eligible for award of financial assistance. If, however, 

he gives up employment or takes leave without pay for the entire duration of the course and thereafter starts his studies 

as a full time student, he will be eligible for an award under the scheme. 

(4) A financial assistance recipient shall not receive any other regular scholarship/financial assistance from 

other Departments. 

(5) Financial assistance will not be given during the internship period for Medical students. 

(6) A financial assistance recipient under the above scheme may enjoy the fee concession given by the institution 

in which he is studying or by any other authority. 

(7) Candidates studying as part-time students or studying privately or in an unrecognised institution or 

through correspondence course will not be eligible. 

(8) The scheme will come into effect from the academic year 2004-05. 

IV. Submission of application.— The application in the prescribed form as in Annexure-I may be sent to 

the Deputy Director (Students Wing), Adidravidar Welfare Department, Pondicherry, through the institutions in 

which the students are pursuing their courses alongwith a Certificate issued by the Education Department that the 

individual has been paid 60% of the fees fixed by the Committee for the Professional Course pursued by him/her for 

the year concerned and he/she is eligible for the payment of additional financial assistance under Adidravidar 

Welfare Department scheme. 

V. Tenability.—(1) The financial assistance under the scheme has to be availed of from the year it is made. The 

financial assistance will be tenable for the first Degree in Engineering/Medicine/D.T.Ed., and B.Ed., Courses. 

(2) If a candidate studying Engineering Course once selected and awarded financial assistance then shifts to 

Medical Science will be awarded the financial assistance at the rate admissible to him/her for that course of study 

suspending the number of years for which he/she was already in receipt of the financial assistance. The same principle is 

applicable to the candidates studying Medical Sciences and then shifts to Engineering Course. 

Explanation-I. – If a candidate studied I/II year of Engineering and then shifts to first year of Medicine will be 

awarded financial assistance suspending financial assistance for one/two years as the case may be. 

VI. Rates of financial assistance.— The rates of the financial assistance will be as under: 

M.B., B.S. ... Rs.25,000 per annum 

B.E.,/B.Tech. ... Rs.10,000 per annum 

B.Ed.,/D.T.Ed. ... Rs. 5,000 per annum 

The quantum of assistance viz. Rs.25,000 for Medicine and Rs.10,000 for Engineering and Rs.5,000 for 

B.Ed., / D.T.Ed., will be the maximum limit. The financial assistance will be awarded to the extent of actual tuition fee. 

VII. Income limit of parents.— (1) Only those students whose parents have an income up to Rs.3.00 lakhs per 

annum will be eligible for the financial assistance. 

(2) (i) The maximum income limit for both salaried in Government/Public and Private sector employees and nonsalaried 

persons like businessmen, self-employed and agriculturists, etc. is fixed at Rs.3.00 lakhs per annum. In case of 

salaried people, full emoluments including all allowances, honorarium, bonus, special pay, etc. (excluding H.R.A., if any), 

received in a year shall be taken into account for computing annual income. No relief for long-term savings, contribution 

to Provident Fund, Life Insurance, etc. will be allowed.


(ii) In case of non-salaried class such as businessmen/land-owners/agriculturists and self-employed, etc. their 

entire gross income will be taken into consideration for computing their annual income. 

(iii) While computing the total income, the income from all sources of both the parents and income of the 

awardees, if any, will also be taken into consideration. 

VIII. Duration of the financial assistance and its renewal.—(1) Financial assistance under the scheme is 

renewable from year to year within the same stage of education. The renewal will depend on the promotion to the 

next year of the course. 

(2) If an awardee shows unsatisfactory progress during the course of his studies, viz. failure in the promotional 

examination and being ineligible to take any supplementary examination subsequently or if he changes the course of 

study without the prior approval of the Union Territory Administration represented by the Director, Adidravidar Welfare 

Department, Pondicherry, the financial assistance will be cancelled. Good conduct and regularity in attendance are also 

the required conditions for continuance of the financial assistance. The decision of the Government of Pondicherry 

represented by the Director, Adidravidar Welfare Department, Pondicherry, will be final and binding in all such cases. 

Financial assistance once cancelled will not be restored under any circumstances. 

(3) In the case of the final University examination, if the awardee is placed in compartment, his/her financial 

assistance will not be extended beyond the final examination of the course. 

(4) The financial assistance will be renewed for each successive year subject to furnishing of a certificate from 

the Education Department that the student has passed in the annual examination as per the Annual Progress Report as 

furnished by the Head of Institution and he/she has been paid the financial assistance as per rules for the year. For the 

purpose, the institution will maintain a register indicating the names of financial assistance recipients and their academic 

progress year-wise. The certificate will enable the Director of Adidravidar Welfare Department to process the renewal of 

the financial assistance expeditiously. The Head of the Institution is expected to bring to the notice of the Director, 

Adidravidar Welfare Department any adverse report that may have been necessitated due to habitual irregularity, 

misbehaviour, participation in strikes, etc. of financial assistance recipient and if necessary suggest suspension/cancellation 

of financial assistance. 

(5) Where the Head of the Institution gives adverse comments and specifically reommends that the financial 

assistance should not be renewed the Director, Adidravidar Welfare Department should fully satisfy himself of the 

reasons for such adverse remarks and from his own opinion in the case. If the Director, Adidravidar Welfare Department 

finally decide to cancel the award, he should do so with the approval of the Secretary to Government (Welfare), Pondicherry. 

(6) A financial assistance under the scheme is renewable from year to year within the same stage of education 

till the awardees undergo study and not while they undergo training/internship. 

(7) (a) The conditions laid down above will be relaxable in the following circumstances: 

(i) If an awardee is unable to appear in the final or annual University examination owing to prolonged illness 

extending over a long period which had resulted in shortage in the required attendance as per University rules, the 

financial assistance will be renewed for next year provided, the Education Department certifies that the Head of 

Institution has certified that the awardee would have passed the University examination had he/she taken the 

examination and a Registered Medical Practitioner has certified that the awardee had been ill for a period by which the 

attendance falls short: 

(ii) When in case where an awardee appears for the annual examination within a continuous course of studies 

(but not a final University examination) and after taking examination for some papers/practicals he/she is taken ill 

and is prevented by such illness from taking examination for the remaining papers/practicals, his/her financial 

assistance would be suspended in the first instance subject to his/her producing a Certificate from the Education


Department that he/she has produced a Medical Certificate from the Registered Medical Practitioner certifying 

that owing to illness it was not possible for the awardees to take the examination during the period in which 

examination for the remaining papers/practicals was held, the financial assistance so suspended would be revived 

for the next higher class in the same continuous course of studies after the awardee has passed the same 

examination, whenever such examination takes place on the next occasion, irrespective of the fact whether it is a 

supplementary examination or another annual examination. 

(b) In the case of students who are treated to have failed for reasons of illness Rule VIII (7)(a)(i), but are 

promoted provisionally to next higher class, no suspension of financial assistance is involved. 

(8) The financial assistance for B.Ed., Course under the scheme is awardable only for one year and is not renewable. 

(9) The financial assistance for D.T.Ed., Course under the scheme is awardable for 2 years only. 

IX. Payment of financial assistance.—(1) The amount of the financial assistance will be drawn by the Director 

of Adidravidar Welfare Department, Pondicherry and will be disbursed through the Heads of Institutions. 

(2) The payment of financial assistance will start from the year the admission is obtained. In case of 

renewal of financial assistance for the succeeding year, the financial assistance will be paid from the year following 

that for which the financial assistance was paid during the previous academic year if the course of study pursued 

is continuous e.g. M.B.,B.S., (I year) to M.B.,B.S., (II year) or B.E., (I year) to B.E., (II year), B.Ed.,/D.T.Ed., on 

receipt of the Annual Progress Report. 

X. Payment of financial assistance during leave.—(1) The financial assistance during leave will be admissible 

as follows: 

If the absence is due to illness supported by the Education Department Certificate stating that the student has 

submitted necessary Medical Certificate from a Registered Medical Practitioner to the Education Department. 

(a) Full financial assistance: If the absence does not exceed two months ; 

(b) Half financial assistance, if the absence exceeds two months but not four months. For the first two months 

the financial assistance will be paid at full rates and for the period exceeding two months, the financial assistance will 

be paid at half the rates; and 

(c) No financial assistance, if the absence exceeds four months. For the first four months, however, the financial 

assistance will be paid as per sub-clause (b). 

(2) For women, the financial assistance will be admissible at full rates upto four and half a months for absence 

on grounds of maternity. No financial assistance will be paid for a period exceeding four and half a months due to absence 

on grounds of maternity. 

(3) In all the above cases, the financial assistance at the rates indicated will be paid only if the Education 

Department certifies that the Head of the Institution has recommended the application and certified that the awardee is 

likely to make up the deficiency in lectures and studies during the rest of the period of the course of studies. 

(4) The awardee will get the financial assistance as long as he/she is on the rolls of an institution subject to 

sub-paragraphs above. If on account of prolonged illness or by other valid reasons, the awardee’s name is struck off the 

rolls, he/she will be entitled to the restoration of the financial assistance on re-admission and on the recommendation of 

the Head of the Institution. 

XI. Removal of doubts.—If any doubt arises as to the interpretation of these rules, the decision of the 

Government thereon shall be final.

NOTIFICATION 

Whereas the Under Secretary, National Legal 

Services Authority, New Delhi in his letter, dated 

24-1-2005 has forwarded a copy of the model scheme 

for “Legal Aid Counsel” for implementation in terms 

of section 12(g) of the Legal Services Authorities 

Act, 1987; 

Whereupon, this Authority, after going through it, 

has decided to implement the scheme which is given 

below : 

Model scheme for “Legal Aid Counsel” in all the 

Courts of Magistrates 

According to section 12 (g) of the Legal Services 

Authorities Act, 1987 (as amended in 1994), any 

person in custody, including custody in a protective 

home or in juvenile home or in psychiatric hospital or 

psychiatric nursing home, is entitled to legal services 

for filing or defending a case. A large number of 

under-trial prisoners who are not in a position to 

engage lawyers for defending them, feel handicapped 

in their defence and remain incarcerated for long 

periods. Therefore, His Lordship Hon’ble Dr. Justice,

A.S. Anand, Judge, Supreme Court of India and 

Executive Chairman, National Legal Services Authority 

has invited suggestions/views from all the Chief 

Justices of the High Courts (Patrons-in-Chief of State 

Legal Services Authorities) on a Scheme for Legal Aid 

and Assistance to the Prisoners in Custody. His 

Lordship has pointed out that Legal Aid Counsel may 

be attached to all the Courts of Magistrates in the 

country who should give legal assistance to the 

persons in custody, for opposing remand applications, 

securing orders for bail and moving miscellaneous 

applications as may be required. According to His 

Lordship, Legal Aid Counsel should be under an 

obligation to remain present in the Court assigned to 

him during the remand hour and such other hours as 

may be directed by the Court. Thereafter when a 

challan is filed against the accused in custody in the 

Court assigned to such Advocate, the case should be 

entrusted to him for defence also. The appeals or 

revisions arising out of such challans should also be 

ordinarily entrusted to him. His Lordship is of the view 

that this system can go a long way in providing 

effective and meaningful legal assistance to under-trial 

prisoners, who feel handicapped in their defence on 

account of lack of resources or other disabilities and 

cannot engage a Counsel to defend them. His Lordship 

has desired that this scheme be followed through out 

the country.


2. The scheme lays emphasis for legal aid and 

assistance to the persons in custody at the following 

three stages:– 

(a) When in custody during investigation of the 

cases and need legal assistance for getting released 

on bail and opposing remand applications; 

(b) Legal assistance during trial for defence; 

(c) Legal assistance for preferring appeals or 

revisions in case of adverse orders. 

3. In terms of the directions issued by His 

Lordship, a model scheme has been formulated which 

may be adopted by the States with suitable 

modifications as required under the prevailing 

circumstances and needs of the respective States as 

under:— 

(i) The first step should be to identify all the 

Courts of Magistrates in each District for attaching 

Legal Aid Counsel. In case the work-load in a 

particular Court or Courts is too little, one Legal 

Aid Counsel may be attached to two Courts even. 

(ii) State Legal Services Authority or District 

Legal Services Authority to which the 

implementation of the scheme is entrusted, may 

prepare a panel of Legal Aid Counsel preferably 

with a minimum standing of five years on criminal 

side. The Advocates from this panel may be 

attached to the Courts of Magistrates and may be 

called “Legal Aid Counsel”. 

(iii) The remuneration and fee to be paid to Legal 

Aid Counsel may be determined by State Legal 

Services Authority or District Legal Services 

Authority, as the case may be. The remuneration/ 

fee may be fixed under the following counts:— 

(a) for attending the Court during remand hour 

every day (the remuneration for attending the 

Court during remand hour may be fixed at Rs. 500 

per month or more depending upon the workload); 

(b) fee schedule for acting as Defence Counsel 

for aided persons may be drawn. It may be on 

the basis of effective hearings in warrant as well as 

summon trial cases with a ceiling of maximum fee; 

(c) fixed fee with incidental expenditure for 

filing and contesting an appeal or revision. The 

appeals and revisions may be permitted to be 

filed with the approval of the Member–Secretary 

of the State Legal Services Authority or Secretary, 

District Legal Services Authority, as the case may be; 

(All payments to Legal Aid Counsel may be made 

after obtaining certificates from the concerned 

Judicial Officers regarding attendance of the Counsel 

at the time of remand or conduct of trial/appeal/ 

revision). 

(iv) Name and address of the Legal Aid Counsel 

may be displayed outside the Court to which he is 

attached with requisite information as to who are 

eligible persons under the Legal Services Authorities 

Act and no payment is required to be made by 

them to Legal Aid Counsel (in case of any complaint 

against a Legal Aid Counsel regarding demand of 

fee or any other charges from an aided person, 

prompt action by way of removal of his name from 

the panel may be taken). 

(v) The scheme of Legal Aid Counsel may be 

given wide publicity in the State. Hoardings in the 

Police Stations and Jails may be affixed. 

(vi) The scheme can be more effectively 

implemented if printed proformas of appointment 

letters to be issued to Legal Aid Counsel are 

handed over to the Courts of Magistrates with a 

request to issue the same in favour of the Legal 

Aid Counsel who takes over the defence of any 

person in custody being produced before the Court. 

On the basis of this appointment letter legal aid 

functionaries to issue required order allocating that 

case to Legal Aid Counsel to facilitate settlement 

of bills. 

(vii) to ensure that the Legal Aid Counsel remains 

present in the Court during remand hour or any 

other hour of the day as directed by the Court. 

Legal aid functionaries may insist for an attendance 

certificate issued by the Court to the Legal Aid 

Counsel before making him payment for remand hour. 

(viii) Certificates of merit/awards may be given 

to those Legal Aid Counsel whose performance is 

found to be outstanding.

Whereas the Government is of the opinion that an 

industrial dispute has arisen between the management 

of M/s. New Horizon Sugar Mills Limited, Ariyur, 

Pondicherry and the Joint Action Committee of New 

Horizon Sugar Mill Trade Unions-over charter of demands 

and payment of dues in respect of the matter mentioned 

in the Annexure to this order; 

And whereas in the opinion of the Government, it is 

necessary to refer the said dispute for adjudication; 

Now, therefore, by virtue of the authority delegated 

vide G.O.Ms. No. 20/91/Lab., dated 23-5-1991 of the 

Labour Department, Pondicherry to exercise the powers 

conferred by clause (d) of sub-section (1) of section 10 

of the Industrial Disputes Act, 1947 (Central Act XIV 

of 1947), read with first proviso of section 10 (1) of the 

Act, it is hereby directed by Secretary to Government 

(Labour) that the said dispute be referred to the 

Industrial Tribunal, Pondicherry for adjudication. 

The Industrial Tribunal, shall submit the award within 

3 months from the date of issue of reference as stipulated 

under sub-section (2-A) of section 10 of the Industrial 

Disputes Act, 1947 and in accordance with rule 10-B of 

the Industrial Disputes (Central) Rules, 1957. The party 

raising the dispute shall file a statement of claim 

complete with relevant documents, list of reliances and 

witnesses to the Industrial Tribunal, within 15 days of 

the receipt of the order of reference and also forward a 

copy of such statement to each one of the opposite 

parties involved in the dispute.
