StandardsQ & AExpert Advice on NCCHC Standardsby Jennifer E. Kistler, MPH, andR. Scott Chavez, PhD, MPA, CCHP-ANo-Smoking PolicyQOur state passed a law that prohibits smoking in allpublic spaces. Our facility is now smoke-free. Do westill need to have a policy?AYes. Standard F-03 Use of Tobacco requires that smokingis prohibited in all inside areas, and if the facilityallows smoking outside, specific areas are designated. In addition, the standard requires that, at a minimum, theprevention and abatement program includes nicotinereplacement products and written materials on preventionand abatement of tobacco use. The written materialsshould be available in areas accessible to all inmates (suchas the clinic, library and housing). Since all applicableNCCHC standards should be addressed in policy, even ifyour facility is officially smoke-free, your policy still shouldaddress the standard’s compliance indicators.Medical DirectorFlorida Department of CorrectionsThe Florida Department of Corrections isseeking a Medical Director with administrativeexperience and proven leadership tooversee all clinical and administrative aspectsof a $440 million health care delivery system for over 100,000inmates. Florida license required pursuant to Chapter458, Florida Statutes. Can you please explain this?AA clinical performance enhancement review isfocused on the quality of the clinical care provided;a health professional’s work is reviewed by anotherprofessional of at least equal training in the same generaldiscipline, such as the review of the facility’s physicians bythe responsible physician. An annual performance reviewmight address areas such as punctuality, teamwork, attitudes, goals, etc.; those types of reviews do not apply to thisstandard.HSA EligibilityQIs it OK for our sergeant to be the health servicesadministrator?AStandard A-02 Responsible Health Authority statesthat a health administrator is a person who by virtueof education, experience or certification (e.g., MSN,MPH, MHA, FACHE, CCHP) is capable of assuming responsibilityfor arranging all levels of health care and ensuringquality and accessible health services for inmates. If the sergeantis a Certified Correctional Health Professional (CCHP)or has other relevant educational credentials, then by virtueof his or her education, experience or certification this positionwould be appropriate.Pharmacy InspectionsQSince we do not have a staff pharmacist, standardD-01 Pharmaceutical Operations says that a consultingpharmacist should be used for documentedinspections and consultation on a regular basis, not less thanquarterly. Does a pharmacist have to be the one to physicallyconduct the inspections, or can a pharmacy tech dothe inspection as long as it is reviewed and signed off by apharmacist?ANo. The intention of this standard is that a consultingpharmacist actually conducts the inspections. A situationwhere another type of staff member conductsthe inspection and then has a pharmacist sign off wouldnot be in compliance with the standard.Jennifer E. Kistler, MPH, is NCCHC’s director of accreditation.R. Scott Chavez, PhD, MPA, CCHP-A, is NCCHC’s vicepresident and liaison to the policy and standards committee. If you have a question about the NCCHC standards, pleasewrite to info@ncchc.org or call 773-880-1460.28<strong>Fall</strong> 2009 • CorrectCarewww.ncchc.org
