Future Considerations – More Effective Regulation of DrugsAlthough <strong>the</strong> vast majority of citizens acknowledge <strong>the</strong> failure of <strong>the</strong> <strong>War</strong> on Drugs,<strong>the</strong>re is no consensus on any alternative policy. Fur<strong>the</strong>rmore, an impediment <strong>to</strong> anyfundamental drug policy reform is <strong>the</strong> breadth of federal drug law. Federal law shouldpermit <strong>the</strong> states <strong>to</strong> develop <strong>the</strong>ir own drug control strategies and structures, using <strong>the</strong>federal system <strong>to</strong> allow states <strong>to</strong> be labora<strong>to</strong>ries for change and improvement of public lawsand institutions. Allowing Washing<strong>to</strong>n and o<strong>the</strong>r states <strong>to</strong> experiment with different drugcontrol strategies and systems will permit <strong>the</strong> development of more effective means <strong>to</strong> dealwith <strong>the</strong> problems created by drugs in our society.The following set of principles should guide state-level efforts <strong>to</strong> develop moreeffective drug control strategies and structures:1) Any public policy <strong>to</strong>ward drug use should seek <strong>to</strong> result in no more harmthan <strong>the</strong> use of <strong>the</strong> drugs <strong>the</strong>mselves.2) Any public policy <strong>to</strong>ward drug use should address <strong>the</strong> underlying causesand <strong>the</strong> resulting harms of drug abuse instead of attempting <strong>to</strong> discouragedrug abuse through <strong>the</strong> use of criminal sanctions.3) The state should regulate <strong>the</strong> use of drugs in a manner that recognizesa citizen’s individual liberties while answering <strong>the</strong> need <strong>to</strong> preserve publichealth, public safety and public order.4) The state should regulate <strong>the</strong> use of drugs in a manner that uses scarcepublic resources as efficiently as possible.Using <strong>the</strong>se principles as a guide, <strong>the</strong> people of Washing<strong>to</strong>n can fashion a drugpolicy that is fiscally responsible and that effectively balances <strong>the</strong> exercise of civil libertieswith <strong>the</strong> maintenance of public order, while also providing compassionate treatment <strong>to</strong> thosein need.25
