Existing Laws Lenient <strong>on</strong> Domestic Violence<br />
The Kenyan law does not specifically<br />
criminalise wife beating. The existing<br />
laws are lenient and tolerant of domestic<br />
violence.<br />
The earliest public c<strong>on</strong>cern was<br />
expressed in 1966 when the Commissi<strong>on</strong><br />
<strong>on</strong> the Law of Marriage and Divorce was<br />
set up. The Commissi<strong>on</strong> was charged<br />
with, am<strong>on</strong>g other things, looking into<br />
the status of women in society. This<br />
mandate was interpreted by the<br />
Rape as Defined by Law<br />
Secti<strong>on</strong> 375 and Secti<strong>on</strong> 376 of the<br />
Indian Penal Code (IPC) have defined<br />
and prescribed punishment for rape as<br />
follows:<br />
“A man is said to commit ‘rape’ who,<br />
except in the case hereinafter excepted,<br />
has sexual intercourse with a woman<br />
under circumstances falling under any of<br />
the six following descripti<strong>on</strong>s:<br />
FIRST: Against her will.<br />
SECOND: Without her c<strong>on</strong>sent.<br />
THIRD: With her c<strong>on</strong>sent, when her<br />
c<strong>on</strong>sent has been obtained by putting her<br />
or any pers<strong>on</strong> in whom she is interested<br />
in fear of death or hurt.<br />
FOURTH: With her c<strong>on</strong>sent, when the<br />
man knows that he is not her husband,<br />
C<strong>on</strong>veying C<strong>on</strong>cerns: Women <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> G<strong>ender</strong>-b<strong>ased</strong> Violence<br />
Commissi<strong>on</strong> to include the problem of<br />
wife beating. The commissi<strong>on</strong> recommended<br />
that a proposed bill explicitly<br />
outlaw wife beating. All male members<br />
of Parliament opposed it. Not <strong>on</strong>ly was<br />
this crime c<strong>on</strong>sidered a private affair, it<br />
was rati<strong>on</strong>alized in the name of “traditi<strong>on</strong>.”<br />
As a result, Kenyan women have<br />
had to rely <strong>on</strong> the general criminal law<br />
of assault in seeking legal redress for wife<br />
beating. ■<br />
and that her c<strong>on</strong>sent is given because she<br />
believes that he is another man to whom<br />
she is or believes herself to be lawfully<br />
married.<br />
FIFTH: With her c<strong>on</strong>sent, when, at the<br />
time of giving such c<strong>on</strong>sent, by reas<strong>on</strong> of<br />
unsoundness of mind or intoxicati<strong>on</strong> or<br />
the administrati<strong>on</strong> by him pers<strong>on</strong>ally or<br />
through another of any stupefying or<br />
unwholesome substance, she is unable to<br />
understand the nature and c<strong>on</strong>sequences<br />
of that to which she gives c<strong>on</strong>sent.<br />
SIXTH: With or without her c<strong>on</strong>sent,<br />
when she is under 16 years of age.<br />
EXPLANATION: Penetrati<strong>on</strong> is sufficient<br />
to c<strong>on</strong>stitute the sexual intercourse necessary<br />
to the offence of rape.” ■<br />
