As <strong>in</strong> <strong>the</strong> UK, this publication highlights <strong>the</strong> fact that treatment<br />

carried out without <strong>the</strong> consent of a competent patient <strong>in</strong> <strong>the</strong><br />

Republic of Ireland is considered both trespass and battery. In<br />

addition, <strong>the</strong> publication expla<strong>in</strong>s that <strong>the</strong>re is currently no<br />

provision for an <strong>in</strong>dividual <strong>in</strong> <strong>the</strong> Republic of Ireland to make<br />

a legally b<strong>in</strong>d<strong>in</strong>g advance decision, or for <strong>the</strong> appo<strong>in</strong>tment<br />

of proxy decision makers to make decisions on matters of<br />

healthcare if and when a patient lacks competence. The Law<br />

Reform Commission <strong>in</strong> <strong>the</strong> Republic of Ireland has suggested<br />

that it should be possible for advance decisions to be made<br />

legally b<strong>in</strong>d<strong>in</strong>g. They are also consider<strong>in</strong>g an amendment to<br />

<strong>the</strong> exist<strong>in</strong>g Powers of Attorney Act 1996 to enable appo<strong>in</strong>ted<br />

attorneys to make decisions on m<strong>in</strong>or and rout<strong>in</strong>e medical<br />

treatment, <strong>in</strong> addition to manag<strong>in</strong>g <strong>the</strong> property and affairs<br />

of <strong>the</strong> person who appo<strong>in</strong>ted <strong>the</strong>m, as is <strong>the</strong> case at present.<br />

Until this becomes law, <strong>the</strong>re is no provision for proxy decision<br />

mak<strong>in</strong>g for <strong>in</strong>competent <strong>in</strong>dividuals and <strong>the</strong> f<strong>in</strong>al authority to<br />

make decisions on medical treatment for <strong>the</strong>m rests with <strong>the</strong><br />

High Court <strong>in</strong> Ireland.<br />

<strong>Not</strong> surpris<strong>in</strong>gly, <strong>the</strong> lack of clarity <strong>in</strong> <strong>the</strong> legal status of advance<br />

decisions such as <strong>DNAR</strong> decisions <strong>in</strong> <strong>the</strong> Republic of Ireland has<br />

led some to express <strong>the</strong>ir dissatisfaction with <strong>the</strong> process <strong>the</strong>re<br />

[16]. The authors of this paper have requested that national<br />

guidance on <strong>DNAR</strong> decisions is provided <strong>in</strong> <strong>the</strong> Republic of<br />

Ireland.<br />
