GENERAL INSTRUCTIONS FOR BIDDERi. The office of the Chief Commissioner of Income Tax (<strong>CCA</strong>), Delhi, New Delhi, requires250 Office Bags made of leatherette/leather and 250 Gift Pack which includes set ofleather ladies clutch, leather gents wallet and leather key chain to the offices of ChiefCommissioner of Income Tax Department, Delhi-1, New Delhi.ii.iii.iv.Conditional bids shall not be considered and will be out rightly rejected at the very firstinstance.All entries in the tender form should be legible and filled clearly. If the space forfurnishing of information is insufficient, a separate sheet may be attached. Nooverwriting or cutting is permitted in the Bid Form. In such cases, the tender shall besummarily rejected. However, the cuttings, if any, in the bid Application must beinitialed by the person authorized to sign the tender bids. All the pages of the bid shall besigned by the authorized signatory in ink with rubber stamp of the agency.The envelope containing Technical Bid shall be opened first on the scheduled date andtime, in the Conference Hall, 3rd Floor, office of the Chief Commissioner of IncomeTax(<strong>CCA</strong>), Delhi, New Delhi, Central Revenue Building, Indraprastha Estate, NewDelhi-110002 in the presence of the duly authorized representatives of the Company /Firm / Agency, if any, who wish to be present on the spot at that time. The TechnicalBids shall be evaluated by a Evaluation Committee which includes samples scrutinyand their acceptance by the Tender Committee. Financial bids of only technicallyqualified which includes acceptance of samples, shall be opened on a date & place to benotified later or as decided in presence of short listed contractors or their authorizedrepresentatives.v. The envelope containing financial bid shall be opened on the scheduled date and time, inthe Conference Hall, 3rd Floor, office of the Chief Commissioner of Income Tax(<strong>CCA</strong>),Delhi, New Delhi, Central Revenue Building, Indraprastha Estate, New Delhi-110002 inthe presence of the duly authorized representatives of the Company / Firm / Agency, ifany, who wish to be present on the spot at that time.TECHNICAL REQUIREMENTS FOR <strong>THE</strong> TENDERING COMPANY / FIRM/AGENCYi. The tendering Service Provider Company / Firm / Agency should fulfill the followingtechnical specifications:ii.iii.iv.Company / Firm/ Agency should have at least sufficient experience in providing similarservices to public sector Company/ Banks and Government Departments etc.Company / Firm / Agency should have its own Bank Account, PAN No. and ServiceTax/VAT no.The Company / Firm / Agency shall submit affidavit stating that the agency is / has notbeen black listed by Central Government / State Government / any PSU.


v. Attested copy of satisfaction certificate from the previous office(s) in which the ProviderCompany/Firm/Agency is providing similar services has to be enclosed separately.vi.Sample of Office bags and Gift Packs.Non compliance with any of the above conditions by the Company/ Firm / Agencywill amount to non-eligibility for the services for which tender has been floated andits tender will be ignored summarily.i. The competent authority of Office of the Chief Commissioner of Income Tax (<strong>CCA</strong>),Delhi, New Delhi, Central Revenue Building, I.P Estate, New Delhi-110002 reserves theright to annul any or all bids without assigning any reason.ii.iii.iv.The bidder shall quote the technical and financial bids as per the format enclosed atAnnexure I.The contract is to be for One Time Basis.Vendor / Firm / Agency should have at least its own Bank Account, Service Tax/VATregistration no. and PAN.v. The Agency shall raise the bill, in triplicate after providing the desired goods to office ofDeputy Commissioner of Income Tax (Hqrs.) (Admn.), Central Revenue Building, I.PEstate, New Delhi-110002 for sanction and payment as soon as possible.vi.vii.The Office of the Chief Commissioner of Income tax (<strong>CCA</strong>), Delhi, New Delhi, CentralRevenue Building, I.P Estate, New Delhi-110002 reserves the right to withdraw/ relaxany of the terms and conditions mentioned in the tender document so as to overcome anythe problem encountered at any stage.The envelop containing financial bid and other documents must be superscribed as"Quotations/Bids for Office Bags " and bidder's address and name should also be writtenon it.FINANCIALi. The Technical Bid should be accompanied with an Earnest Money Deposit (EMD),refundable, of Rs.10,000/- (Rupees Ten thousand only) in the form of Demand Draft/Pay Order drawn in favour of the “Deputy Commissioner of Income Tax (DCIT), HeadQuarters, Administration, O/o the Chief Commissioner of Income Tax (<strong>CCA</strong>), Delhi,New Delhi” failing which the tender shall be rejected out rightly.ii.The EMD in respect of the Agency which does not qualify the Technical Bid includingsamples acceptance (First Stage) / Financial Bid (Second stage) shall be returned to itwithout any interest. Further, if the recommended/assigned Agency fails to initiate theassigned task against the initial requirement within stipulated time mentioned in thework order, the EMD shall stand forfeited without giving any further notice.


iii.The Agency shall raise the bill, in triplicate after providing the desired goods/services tooffice of Deputy Commissioner of Income Tax (Hqrs-Admn.), Central RevenueBuilding, I.P Estate, New Delhi-110002 for sanction and payment.FRAUD AND CORRUPT PRACTICESi. The applicant and their respective officers, employees, agents and advisers shall observethe highest standard of ethics during the Bidding Process. Notwithstanding anything tothe contrary contained herein, the Office may reject an Application without being liablein any manner whatsoever to the Applicant if it determines that the Applicant has,directly or indirectly or through an agent, engaged in corrupt practice, fraudulentpractice, coercive practice, undesirable practice or restrictive practice in the BiddingProcess.ii.iii.Without prejudice to the rights of this Office under Clause i. hereinabove, if anApplicant is found by the Office to have directly or indirectly or through an agent,engaged or indulged in any corrupt practice, fraudulent practice, coercive practice,undesirable practice or restrictive practice during the Bidding Process, such Applicantshall not be eligible to participate in any tender issued by this Office during a period of 2(two) years from the date such Applicant is found by the Office to have directly orindirectly or through an agent, engaged or indulged in any corrupt practice, fraudulentpractice, coercive practice, undesirable practice or restrictive practice as the case maybe.For the purposes of this clause i, the following terms shall have the meaning hereinafterrespectively assigned to then:a) “Corrupt practice” means (I) the offering, giving, receiving, or soliciting, directly orindirectly, of anything of value to influence the actions of any person connected with theBidding Process or (II) save and except as permitted, engaging in any mannerwhatsoever, whether during the Bidding Process or after the issue of the LOA or afterthe execution of the Agreement, as the case may be, any person in respect of any matterrelating to the Project or the LOA or the Agreement, who at any time has been or is alegal, financial or technical advisor of the Authority in relation to any matter concerningthe Project;b) “fraudulent practice” means a misrepresentation or omission of facts or suppression offacts or disclosure of incomplete facts, in order to influence the Bidding Process;c) “coercive practice” means impairing or harming or threatening to impair or harm,directly or indirectly, any person or property to influence to any person’s participation oraction in the Bidding Process;d) “undesirable practice” means (I) establishing contact with any person connected with oremployed or engaged by the Authority with the objective of canvassing, lobbying or inany manner influencing or attempting to influence the Bidding Process; or (II) having aConflict of Interest; and


e) “restrictive practice” means forming a cartel or arriving at any understanding orarrangement among Applicant with the objective of restricting or manipulating a full andfair competition in the Bidding Process;LEGALi. The Company, firm, agency shall be responsible for compliance of all statutoryprovisions relating to Service Tax and any other Laws/ Taxes/ Acts/ Rules etc.governing the matter/ issues.ii.iii.iv.The Service provider shall also be liable for depositing all taxes, levies, Cess etc. onaccount of service rendered by it to the office of the Chief Commissioner of Income Tax,Delhi-I, Central Revenue Building, I.P. Estate, New Delhi-110002 to concerned taxcollection authorities from time to time as per extant rules and regulations on the matter.The company, firm, agency shall maintain all statutory registers under the applicablelaws. The Agency shall produce the same, on demand, to the concerned authority of thisOffice or any other authority under Law.The Tax Deduction at Source (T.D.S.) shall be deducted as per the provisions of IncomeTax law, as amended from time to time and a certificate to this effect shall be providedto the Agency by this Office.v. In case, the tendering Agency fails to comply with any statutory provision/ taxationliability under appropriate law and as a result thereof the Office is put to any loss,/obligation, monetary or otherwise, the Office will be entitled to get itself reimbursed outof the outstanding bills, to the extent of the loss or obligation in monetary terms.vi.vii.The Office of the Chief Commissioner of Income tax (<strong>CCA</strong>), Delhi, New Delhi, CentralRevenue Building, I.P Estate, New Delhi-110002 reserves the right to withdraw/ relaxany of the terms and conditions mentioned in the tender document so as to overcome anyproblem encountered at any stage.The Department reserves the right to accept/reject any tender or all tenders withoutassigning any reason.FORCE MAJEURE1. The department/the Chief Commissioner of Income Tax (<strong>CCA</strong>), Delhi, New Delhi orthe contractor against the in case of any failure or omission due to natural calamities,hurricanes or due to any statute or regulations of the government or because of any lockouts, strikes, riots, embargos for any political reasons or otherwise beyond the control ofany party including war (whether declared or not) civil war or state of insurrection, willgive notice to other party at the earliest of the occurrence of such incident that onaccount of the above event the notifying party has delayed the performance of it wasbeyond its reasonable control and it was not due to negligence of default on its part.2. Either party as or when it gives notice of force majeure will provide confirmation ofsuch event in the form of a certificate from the govt, the department/ the Chief


Commissioner of Income Tax, Delhi-I, New Delhi or agency of Chamber of Commerce.The parties will be relieved of their respective obligation to perform, hereunder for solong as the event of force majeure continues and to the extent their performance isaffected by such an event of force majeure provided notices as above are given and theforce majeure is established as provided herein above.VALIDITYThis contract is valid for 30 days.ARBITRATION(i)(ii)(iii)(iii)In the event of any question, disputes or differences arising between the partiesrelating to the interpretation and application of these provisions of thisagreement, such disputes or differences shall be resolved amicably by mutualconsultations and on failure to do so shall be referred for arbitration to thenominees Chief Commissioner of Income Tax (<strong>CCA</strong>), Delhi, New Delhi. Thedecision of Arbitration to the agreement in this regard shall be final and bindingupon both the parties.Settlement of disputes will be as per Indian Arbitration and Conciliation Act-1996 and venue will be the Office of the Chief Commissioner of Income tax,Delhi-I, Central Revenue Building, I.P Estate, New Delhi-110002. It is clarifiedthat the sole arbitrator to adjudicate any disputes arising out of the proposedcontract shall be nominated / appointed by Chief Commissioner Delhi (<strong>CCA</strong>),and he /she shall not be a person below the rank of CIT (Commissioner ofIncome Tax).The parties shall continue to perform their obligation under this agreementduring arbitration proceedings.The Venue for arbitration will be New Delhi.

11) If in the opinion of the Department, the contractor’s supply of bags and gift packs not asper the approval or satisfaction, the Department may procure the same from a third partycontractor, cancelling his work order.12) Liaison shall be maintained with our officers-in-charge concerned for smooth andefficient supply of the required items well in time.13) In the event of any exigencies, the Department shall have discretion to send request formore or less number of items mentioned in the contract as per the rate approved.14) Any tax as per laws in force shall be paid by the Contractor.15) Any damages or loss caused during transit will have to be bear by the contractor.16) The contractor will ensure that the items supplied should be to the satisfaction of theChief Commissioner of Income Tax (<strong>CCA</strong>), Delhi, New Delhi.17) Failure by the contractor to comply with any statutory requirements and/or the terms ofthe agreement during the period of contract will result in termination of the contract andsubsequent disqualification from participation in any future tender of the department.18) In case the contractor withdraws or the Chief Commissioner of Income Tax(<strong>CCA</strong>),Delhi, New Delhi terminates the contract for violation of terms and conditions and/ordeficiency in items during the period of contract, the contractor will be penalized asdeemed fit.19) The contractor will not sublet or transfer any part of the contract.20) If the quality of any items is found not satisfactory by this office then the contractor willbe asked to replace them immediately.21) Payment will be made on satisfactorily supply of items on receipt of bill. If any penaltyis levied then that will be deducted from the bills.22) Right to decide the actual numbers of items, their quality, make, brand and biddercompletely lies with the department/ the Chief Commissioner of Income Tax (<strong>CCA</strong>),Delhi, New Delhi.23) The Income Tax Department, Delhi Region reserves the right to reject any or alltenders without assigning any reason whatsoever.24) Any time prior to the last date for opening of the bids, the Department may for anyreason, modify the Tender Document, date of submission .DEPUTY <strong>COMMISSIONER</strong> <strong>OF</strong> <strong>INCOME</strong> <strong>TAX</strong>,(HQRS.)
