As both a member <strong>of</strong>this department and thepresident <strong>of</strong> the DSA, I lookforward to working withyou for another four years.In our board meeting onJune 10, I was elected DSApresident. Effective June18, I am no longer workingas a lieutenant and will beserving the membership asyour representative.I, along with some <strong>of</strong> theother board members,plan on coming to every jail, court, andpatrol station in the county to meet with themembership. We all claim to speak for themembership, but how <strong>of</strong>ten have we come toyour work place to hear what was going on?I also hope to do more DSA business in front<strong>of</strong> the membership, so everyone can see theinner workings <strong>of</strong> the DSA.I have heard a number <strong>of</strong> concerns fromour members about having “so many”supervisors and management on the board.The DSA has a long history <strong>of</strong> involvementat all ranks, and I believe it is one <strong>of</strong> the greatthings about our organization. We have had anumber <strong>of</strong> supervisors as the DSA President,and I hope to meet the high standards theyhave set over the last fifty years. The DSArepresents every single sworn member <strong>of</strong>this department except for assistant sheriffsand the undersheriff. This includes deputysheriffs, detentions deputy sheriffs, sergeants,lieutenants, captains, and commanders. Weare in this together.I was recently asked by a member if I wanteda board full <strong>of</strong> captains and lieutenants. Myanswer was that I did not want that at all. Ialso added the fact that the membership didnot want it either, because we have never votedin a board full <strong>of</strong> captains and lieutenants. Ibelieve that the members should be able tomake the decision on who represents them,and I trust their judgment. I believe in how wevote in our membership—one member, one vote. Themembership voted for everymember <strong>of</strong> the board.Throughout historythe best tactic to defeata powerful group is todivide it. I have heardsome members suggest wesplit up our association—deputies and supervisorsor law enforcement anddetentions. Ta ke t hatfurther to law enforcement,detentions, LE supervisors, and detentionsupervisors, all with separate associations. Ibelieve all <strong>of</strong> these options leave every groupweaker than it started. I think some peoplewould benefit from this, but it will not beany <strong>of</strong> the sworn members <strong>of</strong> the DSA. Thegreatest irony is that it isn’t an outside forcethat is trying to divide us, we are doing it toourselves. I think if we start splitting int<strong>of</strong>actions, it is the beginning <strong>of</strong> the end.You may have heard a couple <strong>of</strong> our membershave started a recall against five boardmembers. I think recalls cause hard feelingsand polarization whether they work or not.Both are the last thing we need right now,because we are in for tough times. A number<strong>of</strong> police and sheriff departments around thestate are facing lay<strong>of</strong>fs, furloughs, retirementbenefit cuts, and salary cuts. We have littleroom for error as we move forward.Some people seem to enjoy the drama <strong>of</strong>conflict, while I would rather concentrateon solving issues for our membership whileensuring the pay and benefits <strong>of</strong> the men andwomen who place themselves in harm’s wayfor the public.Until next month; keepin’ the peace since1992. DIRECTOR’S REPORT ERNIE CARRILLOI’d like to clear up a few loose ends beforeI move on. In my last DSA website note aspresident, I admitted making a few mistakesalong the way. Well, as luck (bad) wouldhave it, those few lines wereturned around by a few whosaid, “We told you so.”What I was referring to(which is far from what wasincorrectly interpreted) waswhat I consider my biggestmistake during my term aspresident, which I made atthe very beginning <strong>of</strong> tenureas your voice. My articles inthe Silver Star were writtenfrom a LE perspective; Idid not consider what thatmeant for our detentionsmembers. Some very smart people took measide and brought this to my attention, andI learned that, as your voice, I needed torepresent everyone, regardless <strong>of</strong> bureau.That, my friends, was my biggest mistake, yetthrough guidance I learned from this earlyexperience and tried to more fairly representall members.I am firmly in support <strong>of</strong> Sheriff-Elect Goreand our administration; I also believe thatwe should move on. However, somethinginherently and ethically wrong happenedto me and now I wish to clear my name andhelp reestablish the name and good standing<strong>of</strong> the association that I have spent the pastnine years building.RecallIn the upcoming weeks, you, the membership,will decide where we as an association willgo from here. First, a recall petition isforthcoming and as members, you will needto decide if having management in control <strong>of</strong>your association is in the best interest <strong>of</strong> rankand file. You need to ask yourself if a captain,a lieutenant, and two sergeants, who acted ina manner to curry favor with administration,will represent you when conflict arises? Willthey fairly represent you? You only need tolook at the results from civil service hearingsto know that supervisors don’t challenge theirpeers when it comes to taking a stand in yourdefense.The recall itself is a two-part process withapproximately 580 signatures neededon petitions that will be circulating inorder to send the matter to vote in front<strong>of</strong> the membership. First, take the time tobecome informed with the true and correctinformation. The members circulating thepetitions should be able to answer many <strong>of</strong>your questions. When the petitions come yourway, signing it will onlysend the matter to vote,giving all members a voicein the matter. Second, makethe right call when and ifthe recall goes to vote.Directors ChargedA s e c ond i mp or t a ntdecision will also fall in thehands <strong>of</strong> the membership.At the June 10 associationmeeting, internal chargeswere brought forth andfiled against five directors.The charges state that theseboard members failed in a material and seriousdegree to observe the rules <strong>of</strong> conduct <strong>of</strong> thecorporation and have engaged in conductmaterially and seriously prejudicial to thepurpose and interests <strong>of</strong> the association. Hereare some guidelines to help you understandwhat is occurring. First and foremost, we are acorporation, not a social club, and thus we arelegally bound by rules and regulations foundin the Corporations code sec. 7231 GeneralStandards: Fiduciary Duty <strong>of</strong> Directors andOfficers. These rules and regulations state thatdirectors must act in good faith, act in the bestinterest <strong>of</strong> the corporation, and not engage inany activity in conflict with the interests <strong>of</strong>the corporation and its members. Stop andthink <strong>of</strong> what has happened in the last fewmonths in our association and you can cometo your own conclusions and judgment.At the membership meeting on the tenth,those present received a firsthand look at whatis in store for you when management is incontrol. Everyone present was told that theyhad a time limit for discussion <strong>of</strong> the actionstaken by the board outside the presence <strong>of</strong> themembership. I believe reference was madethat if continued discussion were allowed,it might go past midnight. Hello folks, it’syour association, if you wish to discuss anissue, you should have the ability to do ituntil everyone is fully informed and has acomplete understanding <strong>of</strong> why decisionswere made—it’s the democratic way. It’s yourright as a member to ask questions and makecomments on the record about associationbusiness.AG Response on AR-15I do have an update for those <strong>of</strong> you whohave been waiting close to a year now for theattorney general’s answer to the departmentsquestions regarding the issuance <strong>of</strong> letters forthe personal purchase <strong>of</strong> AR-15s. I spoke withAttorney General Brown about three weeksago, and was directed by him to his staff whoadvised me that an answer was forthcomingwithin 45 days from then. Someone shouldhave an answer on this soon.I almost forgot to mention that within threedays <strong>of</strong> my removal, I was transferred to<strong>San</strong>tee patrol (a good station with lots <strong>of</strong>quality people). Hopefully that clears up afinal rumor, which again I have no clue <strong>of</strong> itsorigin. I’m not retiring from the departmentor quitting the board; you must be talkingabout someone else.Take care, stay healthy, and be safe. The <strong>of</strong>fice was vacant after Ernie Carrillo was voted outduring the May 27 board meeting, six months prior to the end <strong>of</strong>his term. This left Hank’s former role vacantuntil the June 24 meeting when MattClay was elected to serve asvice president. The term <strong>of</strong>the current executive board ends in January.President Hank Turner brings over 18 years <strong>of</strong> experiencein detentions, courts, and patrol to the <strong>of</strong>fice <strong>of</strong> president. Beforejoining the department in 1992, Hank was a Sheriff’s Explorer atthe <strong>San</strong>tee Station. In late-2004, Hank was promoted to Sergeant,working a variety <strong>of</strong> assignments at the EL Cajon Jail, George BaileyDetention Facility, the <strong>San</strong>tee and Imperial Beach Patrol Station,and the Child Abuse Unit. He is currently a Lieutenant.Having stepped into the role <strong>of</strong> vice president shortly afterbeing elected as a director for his first term, Hank has taken on theresponsibility <strong>of</strong> being a director at full speed, quickly becomingone <strong>of</strong> the most active directors on the board. He has served onseveral committees and participated in each and every fundraiserand charity event the association has participated in. One <strong>of</strong> hiscommittees was meet and confer: “I have already improved workingconditions and policies for the membership, by serving on meet andconfer for over a year. I hope I can use my experience on the line,as a sergeant and as a lieutenant, to explain why we need to make achange in conditions or why a ‘policy’ causes more heartache thanit solves. A policy does not take the place <strong>of</strong> supervision. Policiesshould be a guideline not a replacement for supervisor.”As president, his focus must change as he takes on newresponsibilities: “The role <strong>of</strong> the President is to represent the‘rank and file’ while implementing the will <strong>of</strong> the board. All <strong>of</strong>us need to listen to the membership, but when the board givesdirection, I need to implement their directives because the boardapproves items and requests on behalf<strong>of</strong> the membership.”Hank moved quickly into his newposition as president, starting his full release time on June 21,hoping to keep the board focused on matters important to themembership, pointing out that, “We are in the toughest financialtimes in the county in the last 60 years.”With contract negotiations starting in just six months, theboard is already working hard to prepare. Hank says his numberone priority right now is pay and benefits. “Our ‘2 percent raisethis month’ only covers the 2 percent we lost in 2008. A <strong>Deputy</strong> istaking home less money in June <strong>2010</strong> than they were taking homein November 2007. Our entire board and the membership need toconcentrate on this issue.”He also hopes to raise the 40-hour cap on comp time. Hepoints out the flaw in the current limit: “I think it is too low. Weare trying to cut overtime but are routinely telling Deputies theyneed to take time <strong>of</strong>f because they are capped out on Vacation andComp. Time. If we raised the caps and let the Deputies bank moreit would reduce overtime costs and not cause Deputies to lose theirtime because they had to finish a case or could not get the day <strong>of</strong>fthey wanted.”As president, Hank also hopes to open up communication onthe board, both between directors and with the membership. “WeA <strong>Deputy</strong> is taking home less money in June <strong>2010</strong>than they were taking home in November 2007.are discussing holding the entiremembership meeting in front<strong>of</strong> the membership except forclosed session. My hope is toallow the membership see how we come to decisions.”Moving beyond meetings, he hopes to bring more informationdirectly to members, saying “I plan to attend briefings at the courts,jails, and patrol stations more <strong>of</strong>ten. I think it is important for thepresident to be involved with the political <strong>of</strong>fices, but not at a ratio<strong>of</strong> 50 to 1 spent with the membership. I have already been to sixbriefings in three days. I am also encouraging our board membersto get out to work locations more.”Opening the lines <strong>of</strong> communication ties in directly withthe main focus <strong>of</strong> his first few months as president, as negotiations<strong>of</strong>ten move rapidly and information needs to be disseminated asquickly as possible. While the Silver Star provides updates, decisionsthat happen mid-month <strong>of</strong>ten go unnoticed until the next issue ispublished. For instance, “90 percent <strong>of</strong> our members are not awarethat the membership dues will not be going up with the next raisebecause <strong>of</strong> the good financial management practices by the board.We approved this at our meeting on June 10, but hardly anyoneknows about it yet.”Our entire board and the membership need to concentrate on this issue.During his term, Hank also hopes to continue strengthening theDSA in the eyes <strong>of</strong> the public. He says that, “Public EmployeeUnions are the whipping boy <strong>of</strong> the media. We need to explain whythe DSA is different from all these other groups! We need to do abetter job promoting how much the DSA does for the communityon a charitable basis.”When he became a director, Hank stepped into a boardalready dealing with tough negotiations in a tough economy.With law enforcement <strong>of</strong>ficersPublic Employee Unions are the whipping boy <strong>of</strong> the media.We need to explain why the DSA is different from all these other groups!around thestate beingattacked and blamed for the budget crisis due to their pensionsand benefits, the DSA Board has had an uphill battle working forits members. Moving into the role <strong>of</strong> President will be no easierfor Hank, as he leads the board uphill in order to work for ourmembers during the next negotiation, just six months away. Recently after running a line <strong>of</strong> shooters on a new proposedqualification course I was standing in front <strong>of</strong> an <strong>of</strong>ficertalking to him about how to improve his shooting when hegrabbed his smart-phone <strong>of</strong>f his belt read a text someone had senthim and then with both thumbs, began clicking out a response.I said, "I hope that text is telling you how to shoot better," andwalked away to another shooter who had more interest inimproving his skill at arms than a non work related text.Don't get me wrong, I dig technology. Although I don't havetexting on my cell at the moment, my new phone contract willhave it. I have resisted thus far because <strong>of</strong> cost and too muchconnectivity issues (getting away from the net is sometimes anice thing). I'm typing this column on a notebook computerthat's connected to Wi-Fi. I have several e-mail accounts andexchange e-mail with other trainers and friends nationwide aswell as having my own website. I keep up with my pr<strong>of</strong>ession andassociates via Facebook. I check the news daily online. I havea GPS unit in my personal car and have had one for a number<strong>of</strong> years. Technology has improved my life, eased my work andhelps keep me in touch with family and friends. But technologyor the overuse <strong>of</strong> same can hurt you as well.There doesn't seem to be a day that goes by that I don't encounteranother driver that is distracted while they're busy talking onTextingYour LifeAwayDangers <strong>of</strong> Distracted Policingby Kevin Davis, Tactical Survival Contributor, Officer.comtheir cell phones when they should be focused on their driving.Like each one <strong>of</strong> you I'm sure, I see that they are completelyoblivious to the other cars around them or have reduced theirperipheral vision on one side. Distraction leads to disaster...Item: The engineer <strong>of</strong> a commuter train in California was textingsome young train enthusiast friends when he apparently missedthe red light that indicated another train was on the tracksahead. Failing to stop his commuter train impacted with afreight train the result was 25 dead and over 135 injured.Item: A police <strong>of</strong>ficer was killed while on an accident scene doingreconstruction work when a texting motorist hit and killed him.Item: Numerous bus and truck drivers have hit cars orpedestrians while they were texting. One internet video shows abus driver texting for six minutes prior to hitting another vehicle.Item: An <strong>of</strong>f-duty sheriff's deputy may have been texting whiledriving on an interstate prior to losing control and impacting aconcrete divider. The collision took her life.According to Jane Stutts, PhD in the AAA report Distractionsin Everyday Driving (2001) an estimated 1.2 million accidentsoccur each year due to distracted drivers."The National Highway Traffic Safety Administration reportedin 2008 that driver distraction is the cause <strong>of</strong> 16% <strong>of</strong> all fatalcrashes — 5,800 people killed — and 21% <strong>of</strong> crashes resultingin an injury — 515,000 people wounded. Distracted drivingendangers life and property and the current levels <strong>of</strong> injuryand loss are unacceptable. There's no way around it — this is anurgent problem that simply must be addressed." (Testimony <strong>of</strong>FCC Chairman Julius Genachowski to Congress Nov. 2009.)Over my police career the amount <strong>of</strong> distractions in terms <strong>of</strong>technology that have been placed in a patrol car interior haveincreased tremendously. From patrol radios with two to fourchannels, one which to turn on the overhead lights and onerotating switch for the siren, we have gone to multiple radiochannels with multiple zones and bands, multiple light and sirensettings and the MDB. All <strong>of</strong> this can require your attentionas you drive and all can create distraction. Distraction at slowspeeds can result in fender benders. Distraction and multitaskingat high speeds can result in your death or the deaths <strong>of</strong>innocents.TextingAdd to the mix the sending <strong>of</strong> texts whether on the MDBor on a cell phone and the distraction and potential forcatastrophe increases. Because the attention required to operatea keyboard is higher and requires the operator to take his or hereyes <strong>of</strong>f the road to spell-check, the distraction is greater. Ofcourse receiving texts requires taking the eyes <strong>of</strong>f the road toread the message.Car and Driver magazine conducted a test to see how sendingand receiving texts compared to driving under the influence.Rigging a car with a windshield mounted red light whichsignaled to the driver to brake, the magazine found at 70 mph:that an alcohol impaired driver traveled four feet further beforebraking; a driver reading a message traveled 36 feet further; but adriver that was sending a text traveled 70 feet before they saw thelight and came to a stop. Compare all <strong>of</strong> the distractions with asober driver who reacts in about half a second. Keep in mind thatthese tests were conducted on a straight section <strong>of</strong> an abandonedairstrip without any other additional traffic, signal lights orpedestrians.Sure valuable information can be transmitted to you fromdispatchers or other <strong>of</strong>ficers in route to a call but the first rule<strong>of</strong> emergency response driving is arrive alive and the moredistractions you deal with, the harder that is to do especially atany kind <strong>of</strong> speed.Even low speed driving on city streets or rural back-roads can beperilous as you try to text with both thumbs on your crackberrywhile steering the car.ConclusionTo sit in a law enforcement training class and text, payingmore attention to the back and forth communication thanyou do to the instructor is disrespectful and stupid (setting youup for missing the class or lecture). Even worse is to read a textin front <strong>of</strong> a firearms instructor trying to help you shoot better.Reading or sending non-work related texts while driving is justasking for trouble <strong>of</strong> the vehicle crash kind.Of course the modern police <strong>of</strong>ficer is forced to operatethe control, communications, and safety equipment <strong>of</strong> thepatrol vehicle on a daily basis. Many <strong>of</strong> these functions canbe distracting to the primary function <strong>of</strong> driving, but can bemanaged. Engaging in non-work related text messaging whileon the job exposes you and innocent citizens to unacceptablerisk. Technology should aid and assist you in your job and notexpose you to greater risk. Texting while engaging in any callthat requires your attention is reckless and especially so whiledriving—don't do it or pull over and do it safely. Listening tothe vuvuzelas reminds me <strong>of</strong> the incessantdroning from the drunk tanks on aSaturday night at the jail! Tune in andcatch a game, you will understand. Maybeduring half time, you can grab yourfavorite cocktail, take a seat, put your feetup, and relax; it’s time for this month’sedition <strong>of</strong> the “Surf Report.”MR TOAD’S WILD RIDEMost <strong>of</strong> you don’t think to much <strong>of</strong> usCoast Donkeys! After all, how tough isit to write skateboarding tickets all day?Well, for a bunch <strong>of</strong> beach bums, Sgt.Strohl’s team did a great job with a recentgang stabbing.“242 with baseball bats. Oh and by theway, it’s in the ENC ‘hood.” As Deputiesconverged on the scene, they spotted avehicle leaving the scene that matched oneentered into the call. When they tried tostop the truck, the chase was on!In a scene that resembled the Indianapolis500, the pick-up headed southbound onInterstate 5 at speeds well over 100 mph.Deputies gave chase as additional unitsresponded to the crime scene to searchfor victims. The truck exited at CarmelValley Road and decided to head west. Bigproblem here; there are a couple <strong>of</strong> reallygnarly turns at that exit. At the end <strong>of</strong> theroad is the west end <strong>of</strong> California! And Ido mean the END <strong>of</strong> California. Just asDeputies were considering terminatingthe pursuit, the driver lost control on asharp curve. The truck bounced <strong>of</strong>f a treeand into a retaining wall.When was the last time you went bowling?Remember what it looks like when yousend the bowling ball down the lane andbury a strike? Well imagine the truck’soccupants as the pins. Apparently, therewere four suspects laying flat in the bed <strong>of</strong>the truck, unseen by everyone. That wasuntil the truck started to hit things! All <strong>of</strong>a sudden it was raining crooks. Deputiesquickly set up a perimeter and startedreeling in the crooks. All eight were takeninto custody with help from Dep. BillDunford’s K-9 partner Timo. Timo didget to put the habeas chompus on, butunfortunately for Bill, it was on Bill’s chin!Back in gang land, deputies scouredthe gopher holes the crooks burrowedthrough to escape and came up with twovictims, bearing multiple stab wounds.The crooks were all Eden Gardens gangmembers, retaliating from a recentstabbing in their hood. The bad news forEG was that within a single week 11 <strong>of</strong>their members were arrested on felonycharges. The good news for me, becauseI work in Solana Beach, 11 <strong>of</strong> theirmembers were arrested!DRUNK SWEEPTo celebrate Cinco de Drinko, theEncinitas COPPS unit hosted a two nightdrunk sweep. Now I am well aware wehave an alcohol abuse problem here, but Idid not expect to see so many 10-16s. In aslittle as four to five hours each night, therewere a total <strong>of</strong> 34 arrests for 647(f) PC.The detail was well planned, with deputiesfrom the Prisoner Transportation Unitproviding “black and white” cab servicefrom Station 20 to VDF and CDF. Thisevent, coupled with a DUI checkpoint onenight, and an “Avoid the 14” sweep thenext night, really made for a much quieternight for patrol deputies!SHOW YOUR SUPPORTCapt.
