Do you wish to comment on the proposed arrangements forunregistered same-sex couples in relation to child support inparagraph 8.5?4.9 68% of those that responded to this question felt that unregistered same-sexcouples should be treated in the same way as unmarried couples for thepurposes of child support.Points raised:• it is important that there will be no difference in the treatment ofopposite-sex couples and same-sex couples in the assessment of childsupport;• where an opposite-sex unmarried couple cohabits with children, anon-resident parent can apply for the child support assessment to bereduced. At the moment this does not apply with a same-sex relationshipand this should be changed to provide equal treatment across the board;• some women with children (and potentially some men with children) sharea home but are not partners. They should not have rights over each other’schildren and no assessment for child support should be reduced on thisassumption. The Government proposes that civil partners should be assessed in thesame way as married people for the purposes of child support. TheGovernment also proposes that where married and unmarriedopposite-sex couples are currently treated in the same way for thepurposes of child support, that same treatment should be extended tocivil partners and to unregistered co-habiting same-sex couples.Where married couples and unmarried couples are treated differently, which is the case in some areas of child support legislation, then thetreatment of civil partners should be the same as that of marriedcouples, while unregistered cohabiting same-sex couples shouldreceive treatment equivalent to that of unmarried cohabiting oppositesexcouples.28
