Trucking WellnessThe national prevalence <strong>of</strong> HIV&AIDS is estimated at 28%. The Wellness Fund provides antiretroviraltreatment, education and training <strong>to</strong> road freight and logistics industry employees wh<strong>of</strong>all within the Council’s registered scope.The Trucking Wellness programme has been recognised by the Departments <strong>of</strong> Transportand Health as playing a vital role in creating awareness <strong>of</strong> HIV and Aids, as well as sexuallytransmitted infections.At present, Trucking Wellness has 22 Roadside Wellness Centres complemented by five MobileWellness Centres. These centres are situated along all the South African major routes and operatemostly at night, which is the most convenient and <strong>access</strong>ible time for long-distance truck drivers.The Wellness Centres are staffed by registered nurses and counsellors who provide holisticmedical and emotional support <strong>to</strong> drivers, their partners and commercial sex-workers.For further information, please refer <strong>to</strong> the CareWorks <strong>brochure</strong> or call the Toll Free Call Centreon 0800 212 768.The NBCRFLI Wellness Fund Health PlanIn the interest <strong>of</strong> the well-being <strong>of</strong> the road freight and logistics workforce, the NBCRFLI launchedthe new NBCRFLI Wellness Fund Health Plan on the 1st July 2011. The Health Plan is available <strong>to</strong>all active NBCRFLI members who are contributing <strong>to</strong> the Wellness Fund and meet the stipulatedeligibility criteria.The NBCRFLI Wellness Fund Health Plan entitles Eligible Principal Members, <strong>to</strong>gether with oneEligible Spouse (or common law wife), <strong>to</strong> the following benefits:• Primary Healthcare Benefits such as visits <strong>to</strong> general practitioners, dentists and op<strong>to</strong>metristswithin the Universal Provider Network. OUR Service OfferingFunds AdministrationThrough <strong>our</strong> Funds Administration department, we effectively and efficiently process all fundson behalf <strong>of</strong> the NBCRFLI. This includes annual leave, sick leave and 13th cheque funds.How <strong>to</strong> submit a claim for annual leave and sick leave as well as how members are paidout their 13th cheque funds.Annual Leave• Individual employees should submit their leave application <strong>to</strong> their employer. Employerswill consolidate all employees’ monthly submitted annual leave on the Council annual leaveapplication form, either online or manually, and submit <strong>to</strong> the Council via fax, e-mail or post.Applications received by the Council will be processed based on the following calculation:- Less than 5 years completed service: a contribution will be made on 25% <strong>of</strong> an employee’sweekly wage. Employees may only apply for a maximum <strong>of</strong> 15 working days.- Between 5 and 10 years completed continuous service: a contribution will be made on28.34% <strong>of</strong> an employee’s weekly wage. Employees may only apply for a maximum <strong>of</strong>17 working days.- 10 Years completed service and longer: a contribution will be made on 33.3% <strong>of</strong> an employee’sweekly wage. Employees may only apply for a maximum <strong>of</strong> 20 working days.• A sick bonus will be paid with annual leave on completion <strong>of</strong> 504 shifts after commencingemployment in respect <strong>of</strong> the first 252 shifts <strong>of</strong> employment.Sick Benefit• Individual employees will complete a sick leave application and submit a doc<strong>to</strong>r’s note <strong>to</strong> theiremployer.• Employers will consolidate all employees’ monthly submitted sick leave on the Council sickleave application form, either online or manually, and submit <strong>to</strong> the Council via fax, email orpost.• Applications will be processed by the Council based on the following calculation.• Contributions will be made on 20% <strong>of</strong> an employee’s weekly wage.• When an employee takes sick leave, their earliest contribution will be paid out <strong>to</strong> them. This isknown as the “first contribution in, first contribution out” principle.• Employees will qualify for a sick benefit payment after his/her first 30 days <strong>of</strong> employment.Holiday Bonus/13th Cheque• Holiday bonuses will be paid in December <strong>of</strong> every year.• Employers will submit their employees’ banking details as well as a payment release date viafax, email or post.• All payments will be made directly in<strong>to</strong> employees’ bank accounts. No payments will be made<strong>to</strong> employers.• Contributions will be made on 36.8% <strong>of</strong> employees’ weekly wage.


Disputes ManagementThe Council plays a key role in ensuring compliance and enforcement <strong>of</strong> the Collective Agreementswithin the road freight and logistics industry. The NBCRFLI compulsory statu<strong>to</strong>ry functions, as se<strong>to</strong>ut in the Lab<strong>our</strong> Relations Act, 66 <strong>of</strong> 1995 (LRA) are <strong>to</strong>:• Conciliate workplace disputes; and• Arbitrate certain categories <strong>of</strong> disputes that remain unresolved after conciliation.If you are an employee in dispute with y<strong>our</strong> employer, or vice versa, over a matter such as:• Dismissal• Workplace changes• Wages and working conditions• DiscriminationYou may want <strong>to</strong> ask the NBCRFLI <strong>to</strong> conciliate or even arbitrate y<strong>our</strong> dispute. A union oremployer’s <strong>org</strong>anisation may also initiate this action. You do not need the other party’s consentbefore taking a matter <strong>to</strong> the NBCRFLI. If you would like <strong>to</strong> declare a dispute, contact a regionalcase management <strong>of</strong>ficer or y<strong>our</strong> NBCRFLI branch administra<strong>to</strong>r for further assistance. Seecontact details section.NOTE: The following disputes cannot be referred <strong>to</strong> the NBCRFLI:• Where an independent contrac<strong>to</strong>r is involved.• Where the case does not deal with an issue in the LRA or Employment Equity Act (EEA). BasicConditions <strong>of</strong> Employment Act (BCEA) issues may be linked <strong>to</strong> unfair dismissal disputes andunfair retrenchment disputes at the NBCRFLI.• Where a bargaining council or statu<strong>to</strong>ry council exists for that sec<strong>to</strong>r.• Where a private agreement exists for resolving disputes (for example: private arbitration).EnforcementThe role <strong>of</strong> designated agentsDesignated agents are appointed by the Minister <strong>of</strong> Lab<strong>our</strong> at the request <strong>of</strong> a bargaining council<strong>to</strong> promote, moni<strong>to</strong>r and enforce compliance with any collective agreement concluded in thatbargaining council. One <strong>of</strong> their key roles includes the investigation <strong>of</strong> complaints and enquiries.Their other roles include:• Educational inspections <strong>of</strong> employers in the Industry with the objective <strong>of</strong> assisting stakeholders<strong>to</strong> move <strong>to</strong>wards voluntary compliance.• Interpretation and explanation <strong>of</strong> provisions <strong>of</strong> collective agreements.• Registration <strong>of</strong> unregistered employers.• Effectively and successfully conclude enforcement, conciliation and arbitration matters.• General administration <strong>of</strong> Council matters.Designated agents are empowered, without warrant or notice at any reasonable time, <strong>to</strong> enterany workplace or any other place where an employer conducts business or keeps employmentrecords, providing it is not a home. This enables agents <strong>to</strong> moni<strong>to</strong>r or enforce compliance withthe Collective Agreements concluded in the Bargaining Council. Provident FundThe Provident Fund provides benefits for its members and their dependants, as outlinedin the Provident Fund Collective Agreement. The Fund consists <strong>of</strong>:Benefit Design• Contributions <strong>of</strong> both employer and member paid in<strong>to</strong> the Fund.• Returns derived from the investment <strong>of</strong> any moneys <strong>of</strong> the Fund.• Any moneys credited <strong>to</strong> individual members.• Interest received.Risk BenefitsDeath, disability and funeral.The Administration• The insurance side which includes death, disability and funeral benefit is administeredthrough NMG.• The retirement benefits area is administered by SALT Administra<strong>to</strong>rs.All documentation must be forwarded <strong>to</strong> y<strong>our</strong> regional funds administration <strong>of</strong>fice for allocation.To simplify this process we urge employers <strong>to</strong> register and submit their monthly returns onthe e-Business system <strong>to</strong> www.nbcrfionline.co.<strong>za</strong>. In order <strong>to</strong> place a claim in any <strong>of</strong> the twoareas, contact the relevant NBCRFLI Regional Office and place a request with the ProvidentFund Claims Section.Industry Provident Fund Shared <strong>Services</strong>In 2011, the NBCRFLI acquired approval from the Financial <strong>Services</strong> Board (FSB) <strong>to</strong>administer the industry provident fund. The Section 13B Licence allows the Council <strong>to</strong> play amore active role in provident fund management for the industry by allowing it more controlover the collection and enforcement process. The Provident Fund Board <strong>of</strong> Trustees and theCouncil <strong>to</strong>ok resolutions <strong>to</strong> formalise a shared service model in order <strong>to</strong> harness the bestmanagement abilities from both the Council and the current administra<strong>to</strong>rs.The responsibilities are allocated as follows:Current Administra<strong>to</strong>rs• Member movement and certification.• Financial reporting.• Accounting function.• Benefits statements.• Monthly reporting as per the Board <strong>of</strong> Trustees requirements as determined from time <strong>to</strong> time.• Withdrawals and retirements pay out.• Provision <strong>of</strong> a retirement scheme administration system.• Section 14 Transfers (in and out).The Council• Collection <strong>of</strong> provident fund premiums.• Enforcing non-compliance.• Member contact management in all regions and branches.• Front <strong>of</strong>fice administration.Should you require any information on the Provident Fund, please call the Provident FundCall Centre number on 0861 735 473.
