SEVERAL CONSIDERATION ON THE LATEST CHANGES IN REGULATIONS MADE ONCONSTRUCTION`S AUTHORIZATIONAbstractLecturer Ph.D. in progress Flavia GHENCEASpiru Haret University, ConstanțaFaculty of Law and Public AdministrationUrban population is 55% from entire contry and only in capital lives over 16% of them.Now, 181 towns and municipalities have an General Urbanistic Plan (PUG), maded before 2004,who must renewed and updated to the present dinamism of social life.After 19 years of chaos in building, after some „big” scandals maded by unbelievable situation –Platza Cathedral, Bordei Park etc, the latest changes in buiding reglementation try to make order and togive back the city to the cititzen.Authorizations and opinions are the only methods by which the administrative body can controlcompliance with the rules issued by it.In this paper, we try to show which are the major changes in buiding rules, with special overview onconstruction`s authorization.We will try to see what was happened in our legal sistem, for what reason do we need so manychanges in this domain – after the 1990 when was adopted the Building law, it changed at least twice a year,the latest one was in december 2008, and in the same time Ministry has developed and proposed for debate aproject for a „Buiding Code”.We analise, on the one hand, the impact of this new rules on real estate developers businesses, theirreaction and, on the other hand what is the authotity`s position on this „war”, between the cititzens - whowant good condition of life - and the builders – who want mesures for reduction the bureaucracy.GALAŢI, 24 th -25 th of April 2009 37
