ASPECTS OF THE STAFF REGULATIONS OF OFFICIALS AND STATUS OF CIVIL SERVANTSIN ROMANIAAbstractAssistant Lecturer Elisabeta SLABUDunărea <strong>de</strong> <strong>Jos</strong> University, GalaţiFaculty of LawThe concept of public office is closely linked to government activity. A public authority inclu<strong>de</strong>sgenerally three elements: power, material and financial means and staff. Staff, in turn, is divi<strong>de</strong>d into<strong>de</strong>partments, functions and hierarchical lines. But some functions are public. The staff of an institution orpublic authority is limited, practically, in two categories: contract staff - operating un<strong>de</strong>r the contract ofemployment, and public officials - operating un<strong>de</strong>r the civil service appointment. The hol<strong>de</strong>r of a publicoffice shall be known as a public official and legal relationship established by this institution or publicauthority where the operating name of the service.Within the European Community bodies operate as agents subject to special rules, called officials orEuropean Community as well as contract staff. A potential mo<strong>de</strong>l for structuring the minimum requirementsmust be met by the public in European countries can be consi<strong>de</strong>red the Staff Community, anticipating thefuture shape of a common administrative area of civil service.Adoption of a statute of the general influence of the civil service community, as it is inten<strong>de</strong>d togroup the main issues involved provi<strong>de</strong>d notice to the employee. There are, outsi<strong>de</strong> of this unique status,some special regulations that concern officials of scientific and technical <strong>de</strong>partments.Romanian civil servants provi<strong>de</strong>s that the public is "all the powers and responsibilities establishedun<strong>de</strong>r law, in or<strong>de</strong>r to achieve the cre<strong>de</strong>ntials of public power by the central public administration and localgovernment", and the public servant is "the person appointed to public office." Between the two statutes aresimilarities and differences that must be consi<strong>de</strong>red thoroughly if there is a real integration of the Romanianlegal system in Europe.GALAŢI, 24 th -25 th of April 2009 51
