廉 政 專 員 湯 顯 明 先 生Mr Timothy Tong Hin-ming, Commissioner湯 顯 明 先 生 於 2007 年 7 月 獲 委 任 為 廉 政 專 員 。 湯 先 生畢 業 於 香 港 中 文 大 學 , 就 任 廉 政 專 員 之 前 , 出 任 海 關關 長 三 年 半 。 湯 先 生 經 驗 豐 富 , 曾 出 任 保 安 局 副 局長 , 並 在 多 個 決 策 局 和 部 門 擔 任 高 職 , 包 括 香 港 駐 日內 瓦 經 濟 貿 易 辦 事 處 、 民 政 事 務 總 署 、 政 務 總 署 、 教 育 統 籌 科 、 市 政 總 署 和 貿 易署 。湯 先 生 喜 愛 閱 讀 和 高 爾 夫 球 。執 行 處 全 體 人 員 恭 賀 新 任 廉 政 專 員 , 並 期 待 與 他 建 立 緊 密 的 工 作 關 係 。In July 2007, Mr. Timothy Tong was appointed Commissioner of the ICAC.Mr. Tong is a graduate of the Chinese University of Hong Kong. Priorto heading the Commission, Mr. Tong was Commissioner of Customsand Excise for three and a half years. He has extensive governmentexperience. His previous roles have included that of Deputy Secretaryfor Security, and various senior positions in a number of bureaux anddepartments, including the Hong Kong Economic and Trade Officein Geneva, Home Affairs Department, the City and New TerritoriesAdministration, the Education and Manpower Branch, the Urban ServicesDepartment and the Trade Department.His hobbies include reading and playing golf.All staff of the Operations Department extend our congratulations toour new Commissioner and we look forward to a productive workingrelationship with him.

AssistantDirector Rebecca LI was awarded the ICAC Medal for Distinguished Servicewhilst Principal Investigator Alan WU and Chief Investigator Vitus CHUNGwere awarded the ICAC Medal for Meritorious Service.丘 樹 春 先 生 擢 升 為 助 理 處 長 , 三 名 調 查 人 員 晉 升 為 首 席 調 查 主 任 , 六 名 晉 升 為 總 調查 主 任 , 另 20 名 初 級 人 員 晉 升 至 調 查 主 任 級 。Mr. Ricky YAU was promoted to Assistant Director and 3 officers werepromoted to Principal Investigator along with 6 other officers who werepromoted to Chief Investigator. Sixteen officersreceived Directorate Commendations and 41 officers Assistant DirectorCommendations for their high degree of professionalism and dedication toduty.A total of 93 staff received long service awards, with 29 of those staffhaving served the Commission for more than 30 years. Three staff alsoreceived Hong Kong Government Meritorious Service Certificates.10

I received very important information,theory and experience from this well organized course".「 有 機 會 在 一 個 學 習 環 境 中 , 和 代 表 不 同 機 關 的 未 來 領 袖 , 圍 繞 着 不 同 講 者 闡 述 的 議 題 , 就 各 自 面 對的 困 難 , 作 詳 細 和 坦 誠 的 交 談 , 實 在 十 分 有 意 義 。」"The opportunity, in a learning environment, to have full and frank discussions withrepresentatives of the future leaders of organizations about the issues they areconfronting was most useful. These discussions took place around a framework ofdiverse and eclectic presenters".17

調 查 工 作Investigations19

公 營 機 構Public Sector廉 潔 的 選 舉 與 政 治 制 度 對 香 港 和 世 界 各 地 人 民 都 同 樣 重 要 。 廉 署 負 責 監 察 由 村 代表 以 至 區 議 會 、 立 法 會 和 行 政 長 官 的 各 級 選 舉 。 香 港 有 健 全 和 具 透 明 度 的 選 舉 制度 , 因 此 涉 及 各 級 選 舉 的 貪 污 個 案 已 減 至 最 少 。2007 年 , 廉 署 共 接 獲 861 宗 有 關年 內 舉 行 的 各 級 選 舉 而 又 可 追 查 的 貪 污 舉 報 。 當 中 大 部 份 , 共 548 宗 , 涉 及 區 議會 選 舉 。 整 體 而 言 , 祇 有 7 人 因 為 觸 犯 與 選 舉 有 關 的 罪 行 而 被 檢 控 , 另 4 人 則 因 在各 級 選 舉 中 輕 微 或 技 術 上 觸 犯 了 選 舉 法 例 而 被 施 行 警 誡 。 雖 然 有 關 選 舉 的 貪 污 數字 偏 低 , 廉 署 絕 不 會 因 此 稍 有 鬆 懈 , 會 與 選 舉 事 務 處 緊 密 合 作 , 監 察 所 有 選 舉 活動 , 並 迅 速 處 理 任 何 觸 犯 《 選 舉 ( 舞 弊 及 非 法 行 為 ) 條 例 》 的 罪 行 。選 民 對 當 選 人 的 個 人 操 守 有 很 高 的 期 望 ; 假 如 他 們 以 權 謀 私 , 辜 負 了 選 民 的 期望 , 法 庭 定 必 予 以 嚴 懲 。 以 下 是 其 中 兩 個 例 子 :The probity of our electoral and political system is always a matter of greatconcern not only to our own community but also to a wider internationalaudience. ICAC monitors all levels of the electoral process from VillageRepresentatives through District Councils to the Legislative Council as wellas the Chief Executive elections. Due to a robust and transparent electoralsystem, corruption at all elections in Hong Kong is kept to a minimum. In2007, ICAC received a total of 861 pursuable allegations of corruption inthe various elections that took place. Most of these, 548, concerned theDistrict Council elections. Overall, only seven persons were prosecutedfor election related offences and four persons given official cautionsfor minor and technical breaches of election legislation in the variouselections. However, this low level of corruption at elections does not leadto complacency. The ICAC, along with the Electoral Affairs Commission,monitors all elections closely and quickly acts to deal with any offencesdisclosed under the Elections (Corrupt and Illegal Conduct) Ordinance.Elected officials are expected to have a high level of personal integrityand the courts take a stern line with those that fail to live up to theexpectations of voters when they abuse their positions for personal gain asthe two following examples show.20

區 議 員 偽 造 帳 目False Accounting by District Councillor署 調 查 一 宗 貪 污 案 , 發 現 一 名 觀 塘 區 議 員 與 一 個 青 年 組 織 的 主 席 利 用 虛 假 報 價 單 申 領 發 還廉 多 項 地 區 活 動 的 開 支 , 歷 時 兩 年 , 涉 款 逾 十 二 萬 元 。 裁 判 官 判 刑 時 表 示 , 該 名 區 議 員 嚴 重違 反 選 民 對 他 的 信 任 , 與 同 案 另 一 被 告 有 預 謀 地 長 時 間 串 謀 進 行 有 關 勾 當 。 該 區 議 員 被 判 入 獄三 個 月 , 而 另 一 被 告 則 被 判 入 獄 九 個 月 。During a corruption investigation, a Kwun Tong District Councillor was found to haveconspired with the chairman of a youth organisation to make false claims of expensesrelating to bogus quotations for community activities over a two-year period. Thefalse claims totalled over $120,000. The sentencing magistrate stated that the casewas a serious breach of trust by an elected District Councillor. He sentenced thecouncillor to three months' imprisonment and his co-accused to nine months in prisonfor a premeditated conspiracy that had taken place over a long period of time.區 議 員 虛 報 開 支District Councillor in False Expenses Claims一 宗 貪 污 案 的 調 查 顯 示 , 一 名 區 議 員 因 為 財 政 困 難 , 無 力 向 他 的 助 理 發 放 薪 金 , 向 沙 田 區另 議 會 秘 書 處 遞 交 發 還 開 支 申 請 表 , 訛 稱 已 支 付 助 理 的 薪 金 , 要 求 發 還 有 關 款 項 。 他 經 審 訊後 被 裁 定 罪 名 成 立 , 判 入 獄 四 個 月 , 並 須 向 政 府 歸 還 一 萬 四 千 元 。In another corruption investigation, a District Councillor who was in financialdifficulties was found to be unable to pay his assistant his monthly salary andsubmitted expenses claims to the Shatin District Council Secretariat falsely claimingthat the salary had been paid and requesting re-imbursement of those expenses. Hewas convicted after trial and sentenced to 4 months' imprisonment and ordered torepay $14,000 in restitution to the government.21

The Hong Kong Jockey Club is rightlyproud of the honesty and professionalism of those involved in the racingcommunity. However, where large sums of money are involved, greed canlead to temptation and dishonesty.騎 師 用 賽 馬 情 報 換 取 投 注 被 判 入 獄Jockey Jailed for Tips-for-Bets Scandal名 香 港 賽 馬 會 聘 約 騎 師 被 裁 定 貪 污 罪 名 成 立 , 判 入 獄 兩 年 半 , 廉 署 人 員 拘 捕 他 時 在 他 身 上一 搜 到 的 二 十 五 萬 元 現 金 也 被 充 公 。 該 名 騎 師 被 控 與 另 外 三 人 串 謀 收 受 非 法 利 益 , 即 接 受 免費 投 注 和 來 自 賽 馬 的 派 彩 獎 金 , 作 為 提 供 賽 馬 情 報 和 在 比 賽 時 以 符 合 該 等 情 報 的 方 式 來 策 騎 的報 酬 。 案 情 透 露 , 該 名 騎 師 在 無 需 付 出 任 何 賭 注 的 情 況 下 , 接 受 約 共 七 十 至 八 十 萬 元 的 派 彩 獎金 , 作 為 提 供 機 密 資 料 的 報 酬 。 廉 署 人 員 秘 密 監 察 該 騎 師 向 其 中 一 名 串 謀 者 收 取 派 彩 獎 金 的 會面 , 然 後 將 他 拘 捕 。A retained jockey of the Hong Kong Jockey Club was convicted of bribery andsentenced to two and a half years’ imprisonment and to forfeit the $250,000 in cashseized from him at the time of his arrest during an ambush operation by ICAC. Thejockey had conspired with three others to receive illegal advantages in the form offree bets and dividends from winnings on horse races in return for supplying racingtips and riding his horses in a manner consistent with the tips supplied. The DistrictCourt was told that the jockey had accepted winnings of $700,000 to $800,000 asrewards for supplying confidential information, but he was not required to contributeany money for the bets. He was arrested after ICAC officers covertly monitored ameeting between the jockey and a co-conspirator where the winnings were handedover.22

雖 然 公 務 員 隊 伍 , 尤 其 是 紀 律 部 隊 人 員 , 再 沒 有 集 團 式 貪 污 行 為 , 但 仍 有 個 別 公務 員 以 身 試 法 。 社 會 依 然 面 對 某 些 有 權 位 人 士 企 圖 濫 用 職 權 , 以 權 謀 私 的 可 能 。社 會 賦 予 公 職 人 員 權 力 以 服 務 大 眾 , 公 職 人 員 理 應 行 使 這 些 權 力 為 社 會 謀 求 福祉 。Although syndicated corruption in the civil service is very much a thing ofthe past, especially within the disciplined services, problems with individualofficers can still be found. There is always a risk that some people, whenput into a position of power over others, will attempt to misuse thatposition. Public officers are entrusted with powers by the public to servethe public interest and to exercise those powers for the public good.警 員 企 圖 詐 騙 罪 名 成 立Policeman Guilty of Attempted Fraud署 調 查 一 名 偵 緝 警 員 涉 嫌 貪 污 案 , 該 名 警 員 負 責 調 查 一 宗 在 九 龍 城 一 個 住 宅 單 位 發 生 的 爆廉 竊 案 , 後 來 被 發 現 曾 企 圖 詐 騙 爆 竊 案 受 害 人 十 萬 元 , 訛 稱 他 的 線 人 可 以 尋 回 被 竊 物 件 , 但需 要 受 害 人 支 付 十 萬 元 作 為 「 餌 」 錢 , 以 贖 回 贓 物 。 該 名 警 員 在 有 關 款 項 交 收 前 被 拘 捕 , 判 入獄 一 年 。Whilst investigating an allegation of corruption against a Detective Police Constablewho was the officer in charge of a burglary investigation at a residential property inKowloon City, ICAC discovered that the officer had attempted to cheat the victim outof $100,000. The officer falsely claimed that he could recover the property stolen inthe burglary by using an informant, but he needed $100,000 from the victim as "bait"money to pay for the stolen property. The officer was arrested before any moneychanged hands and was sentenced to one year in prison.23

公 營 機 構 ... 續Public Sector...continued警 員 向 色 情 光 碟 舖 「 通 風 報 信 」Police Protection for Pornographic Disc Shop名 隸 屬 旺 角 警 署 重 案 組 的 偵 緝 警 長 , 在 區 域 法 院 被 裁 定 六 項 貪 污 罪 名 成 立 , 判 入 獄 十 六 個一 月 。 警 方 懷 疑 該 名 警 長 的 行 為 操 守 出 現 問 題 , 於 是 將 案 件 轉 介 廉 署 。 調 查 發 現 , 被 告 索 取並 接 受 共 八 萬 元 賄 款 和 女 伴 遊 服 務 , 以 保 護 一 家 色 情 光 碟 店 免 受 黑 社 會 成 員 滋 擾 , 又 事 先 向 該店 東 主 提 供 有 關 警 方 掃 蕩 行 動 的 消 息 。 案 發 期 間 , 警 方 曾 對 該 店 進 行 至 少 三 十 次 掃 蕩 行 動 , 在其 中 二 十 七 次 被 告 有 參 與 的 行 動 中 , 警 方 在 該 店 並 沒 有 搜 獲 任 何 物 件 , 但 在 餘 下 三 次 由 其 他 警員 進 行 的 掃 蕩 行 動 中 , 則 從 該 店 搜 獲 逾 一 萬 三 千 張 不 雅 及 淫 褻 光 碟 。 該 店 兩 名 東 主 也 因 本 案 而被 判 入 獄 。A Detective Sergeant of a District Crime Squad in Mongkok was sentenced to 16months in prison after being convicted of six counts of bribery at the District Court.As a result of suspicions about his conduct, the police had referred the case to ICACfor investigation. Enquiries showed that the Sergeant had solicited and acceptedbribes amounting to $80,000 and hostess escort services in return for protectinga pornographic disc shop from triads and for giving the operators of the shop priorwarnings of police raids. During the relevant period, the shop had been raided atleast 30 times. The Sergeant was involved in 27 of those raids when nothing hadbeen seized, whereas on the three occasions when raids had been conducted byother police teams, over 13,000 indecent and obscene discs had been found on thepremises. A Singap o r e a n e n gineering c o m p a ny wa sawarded a $445 million contract to supply a newmobilising system for the Hong Kong Fire ServicesDepartment, which was designed to optimise the deployment of fire engines andambulances. A Senior Divisional Fire Officer was the project manager. On the fireofficer’s recommendation, an advertising company was hired to organise a contractsigningceremony to mark the launch of the new system at a cost of $487,000.However, he failed to declare that he had a conflict of interest as his sister was a 50%shareholder in the advertising company. Enquiries also revealed that he had arrangedfor his daughter to complete an internship at the Singaporean engineering company'sheadquarters in Singapore, with all the costs of air-fares, hotel rooms and otherexpenses borne by the Singapore contractor. Again, he failed to declare his conflictof interest and solicitation of these privileges for his daughter to the Fire ServicesDepartment. The officer was jailed for six months on three charges ofaccepting illegal advantages from the prisoners and one prisoner was convicted ofaiding and abetting the offences and sentenced to a further four months in prison.25

Whilst investigating a complaint of corruption against the discjockey, ICAC enquiries revealed the fraud offence. The disc jockey had told his sisterthat a freelance writer had provided script-writing and research services for a RTHKradio programme, but the freelancer could not use her name to make the claims. Hetherefore requested his sister to falsely represent to RTHK that the services wererendered by her so that he could obtain the service payments for the freelancer.Over a three-month period, the disc jockey and his sister submitted three claims forpayment to RTHK, purportedly showing that the sister had provided either scriptwritingor research services for a radio programme when she had not, in fact, doneso. As a result of the false representations, RTHK had paid the sister $10,600 forservices that she had not supplied. The disc jockey was sentenced to 150 hours ofcommunity service.26

The enquiry showed that the trio, all involvedin family owned businesses in the areas of engineering and pool maintenance, hadsubmitted false resumés, reference letters, customer questionnaires and accountingrecords to win the contract for which they had no experience and were not qualifiedto tender. Convicting the defendants for the offence of conspiracy to defraud,the judge said that "The system was not an ordinary recording and transcriptionsystem, because it involved the production of important judgments with far-reachingconsequences. Law reports are produced as a result of the transcription system, andthey make the foundation of our Common Law". On sentencing the trio to prison,the judge said that he took into consideration "the detailed planning, the degree ofsophistication, the benefits to the defendants, the amount of money involved and thenegative impact on the tendering process" that the scam had involved.27

Thelecturer had purchased an apartment and conspired with a friend to falsely claim thatthe apartment was owned by the friend so that she could claim the rental allowancefrom the university. Both women were convicted under the Prevention of BriberyOrdinance for a conspiracy to use false documents to deceive the lecturer’s principal,the university. They both received prison sentences of 9 months, suspended for twoyears.清 潔 外 判 商 剋 扣 工 人 工 資Cleaning Contractor Exploiting Wages from Workers名 受 聘 於 食 物 環 境 衛 生 署 ( 食 環 署 ) 清 潔 外 判 商 的 僱 員 , 聲 稱 根 據 政 府 合 約 支 付 最 低 工 資三 予 清 潔 工 人 , 但 卻 不 誠 實 地 每 月 剋 扣 他 們 八 百 至 一 千 元 工 資 , 被 判 入 獄 兩 個 月 至 十 三 個 半月 不 等 。 三 人 非 法 剋 扣 十 九 名 在 食 環 署 轄 下 四 個 街 市 工 作 的 清 潔 工 人 合 共 十 七 萬 七 千 元 。 廉 署調 查 涉 及 清 潔 工 人 須 賄 賂 食 環 署 人 員 以 繼 續 留 任 的 貪 污 案 件 時 , 揭 發 逼 使 工 人 退 回 部 分 工 資 的是 外 判 商 , 不 是 食 環 署 人 員 。 法 庭 裁 定 三 人 串 謀 偷 竊 和 盜 竊 等 各 項 罪 名 成 立 。Three staff of a cleaning contractor employed by the Food and Environmental HygieneDepartment (FEHD) was sentenced to terms of imprisonment ranging from twomonths to thirteen and a half months for dishonestly deducting between $800 and$1000 per month from the salaries of cleaning workers whilst claiming that, underthe government contract, they were paying them a minimum monthly salary. In all,the three staff had illegally taken about $177,000 from some 19 cleaners working infour markets supervised by the FEHD. Whilst investigating an allegation of corruptionthat cleaners were being required to bribe officers of the FEHD to continue theiremployment, the ICAC discovered that the contractors, not FEHD staff, had beenforcing the workers to rebate part of their salary to them. The trio was convicted ofvarious charges of conspiracy to steal and theft.28

However, there are always unscrupulousindividuals who will make malicious or false allegations against others inan attempt to cause them trouble or inconvenience or as revenge for aperceived slight. Whilstentering Hong Kong through the Lo Wu Control Point, the defendant was stopped bytwo Customs officers who found him in possession of several packets of Duty-Not-Paid cigarettes. When taken to a room for a search, the man alleged that the officersassaulted him and also accepted $1,500 in cash to let him go free. Enquiries showedthat the report was completely false. The court stated that a jail sentence waswarranted to serve as a deterrent to others not to make false reports of corruption.29

Seven persons, including two former managers of an insurance company and aninsurance agent, were sentenced to terms of imprisonment ranging from 21 monthsto five and a half years for their roles in making false insurance claims totaling over$23 million by deliberately inflicting eye injuries on co-conspirators. The defendantswere convicted of twelve charges including bribery, conspiracy to defraud, possessingforged identity cards and using documents to deceive.The conspirators took out insurance policies with various insurance companies usingthe names of persons who had either lost or sold their Hong Kong identity cards(HKICs) to a criminal syndicate. Several Mainland residents were then recruited andagreed to be deliberately blinded in one eye in return for a share of the insurancepayout. Staged traffic accidents were set up in the Mainland and reported toauthorities, enabling them to obtain official records and medical reports used tomake the false claims in Hong Kong. Over $8 million had been paid out by insurancecompanies before ICAC discovered the scheme.(Pending appeals)31

During the course of a corruption investigation into the listings of public companies onThe Stock Exchange of Hong Kong Limited (Stock Exchange), the ICAC discovered thatthe directors of two listed companies had inflated the sales turnover and profit figuresof the companies and their subsidiaries. Fraudulent misrepresentations were made tohave Letters of Credit issued and financial and auditing records falsified. Six persons,including the former chairman, vice-chairman, directors and an accountant weresentenced to between eight and ten years imprisonment in respect of one company.The scheme was deliberately hatched to inflate the business turnover and profitfigures of the company so that the listing requirements of the Stock Exchange couldbe satisfied. ICAC investigators examined over 7,700 documents and exhibits showingthat there was an overstatement of profits amounting to more than $50 million in athree-year period. The trial lasted 219 days, being one of the longest trials in HongKong history.This case was also the first time that the e-bundle exhibit system was used in a HongKong court.In relation to the other company, the former chairman and two senior executiveswere sentenced to jail terms ranging from six years and nine months to nine anda half years for conspiracy to defraud in relation to the listing of that company andfraudulent applications for Letters of Credit. The Court of First Instance pointed outthat the defendants’ actions had undermined the integrity of the listing system of theStock Exchange.(Pending appeal)33

The money was then disbursed to relatives of thetwo men. The chairman told the chief accountant of the listed company that the$2 million was being used by a subsidiary in the Mainland. After the scheme wasdiscovered, the chairman absconded from bail and a warrant for his arrest has beenissued. The consultant was convicted of theft and sentenced to imprisonment for oneyear.(Pending appeal)34

Uponsentencing, the judge described the corruption offences committed by thedefendants as cancers, which had to be eradicated from society. The judge alsoordered that $400,000 in bribe money accepted from the then chairman of the listedcompany should be forfeited to the government. The chairman of the companyabsconded from court bail and was found guilty in his absence. A warrant ofarrest has been issued for him. The banker, who was a director of the bank, wasresponsible for providing investment advice to clients. He accepted the $400,000bribe for causing four clients to acquire 6 million shares of the company. Thebroker was also bribed to ensure that an investment analyst of his company wrotea favourable review of the share placement and the investment section of thecompany purchased 5 million shares of the listed company.(Pending appeal)35

The foodsupplier pleaded guilty to 12 charges of paying regular bribes to various purchasingofficers and chefs in return for not complaining about the quality of the foodstuffssupplied. He also conspired with an accounting supervisor of a supermarket chain tofalsify invoices showing overstated quantities for goods supplied to the supermarket.36

Enquiries showed that the supplier organized monthly mahjong gatherings where hedistributed the bribes to hotel and catering staff. When the ICAC raided one of themahjong sessions, they arrested the supplier and three hotel staff. The subordinate, a senior cook at the hotel, was sentencedto five months in prison. The court heard that the senior cook had paid for theprostitution services over a period of eight years, amounting to about $130,000, inreturn for good appraisals and a better duty roster.37

By doing so, shemisappropriated over $11.6 million dollars from the company. When being sentenced,the District Court judge stated that the defendant had shown no remorse and thestarting point for such a serious offence should have been more than eight years.However, as the trial was in the District Court he could only sentence her to amaximum of seven years in prison.38

After being contacted by the buyer and a real estate agent whowanted to purchase several floors of the commercial building, she introduced thebuyer to the chairman of the board of directors and the sale was agreed. In returnfor her assistance, she accepted an illegal reward of $24,500 without her employer'sknowledge or consent. The goods were never sold to the borrowers andwere later re-sold by the trio for a profit. The trio was jailed for between 15 and 27months.39

The SFC suspected that bribery was involved.Investigations revealed that the solicitor representing the SFC complainant hadnegotiated compensation for the stolen shares and, in a clear conflict of interest, wasalso representing the share broker. The solicitor had instructed both the complainantand the broker to lie to the SFC investigators and fabricated evidence to show thatthe shares had not been stolen. Extensive enquiries by ICAC discovered that thebroker had stolen shares from other clients as well. The broker pleaded guilty to ninecounts of theft involving $530,000 and a conspiracy to pervert the course of publicjustice with the solicitor and was sent to prison for 14 months. The solicitor wassentenced to 12 months in prison for the perversion offence.40

He was sentenced to four and a half years in prison and ordered to pay$1.45 million in restitution to his employer. The manager had conspired with a villagehouse developer to accept bribes in return for granting the developer various loans,including ten loans totaling over $22 million. As part of the conspiracy he providedfalse particulars of the properties in question and, with the help of an inspectorin the Lands Department, provided forged documents. The developer and LandsDepartment officer were also jailed for 45 months and 39 months respectively in anearlier trial.(Pending appeal)41

Employees who worked for the contractor at another sitewere shown as working at the estate in order to avoid contract penalties for notsupplying sufficient manpower to clean the estate. By falsifying the records, thecontractor had defrauded the IO of more than $356,000 over a two-year period. Theproprietor of the cleaning company was sentenced to fifteen months’ imprisonmentand the manager ordered to perform 120 hours community service.42

Thecourt heard that the supervisor had solicited a $60,000 bribe from a subordinate anddeceived parents of the school out of more than $120,000 in tutorial fees. Whensentencing her, the magistrate reprimanded the defendant for breaching the trust ofher employer and the parents of students placed in her care.The nursery school was run by the Tung Wah Group of Hospitals. A child careworker of the school was informed by the supervisor that she would be transferredto another nursery school under the Tung Wah Group. The supervisor then solicited$60,000 from the child care worker as a reward for helping her to remain in hercurrent post.Over a nine-month period, the supervisor also conspired with another person todefraud the parents of 42 students at the school by falsely representing to themthat they had to pay for English and Putonghua tutorials organized by an outsideeducation centre, when in fact the fees were wholly borne by the Tung Wah Group.ICAC enquiries revealed that the fees deceived from the parents by the defendantamounted to $122,100 in total.43

Requests for assistance werealso made to the Supreme People’s Procuratorate (SPP) and Guangdong People’sProvincial Procuratorate (GDPP), resulting in 45 witnesses being interviewed in Chinaand 5 Mainland witnesses testifying in Hong Kong courts. Corruption in Hong Kong remains under control with an 8% increase in complaintsbeing recorded for the year. The increase in reports focused on the private sectorwith a corresponding decrease of 9% in the public sector. There was also asubstantial decrease of 23% in complaints against the disciplined services generally,however it was noted that there was a modest increase in complaints against thepolice of 7%. Notwithstanding the general downturn of complaints in the publicsector, 123 government servants were referred to their relevant departments forconsideration of disciplinary or administrative action after investigations. Buildingmanagement remains a problem area with a high rate of allegations of corruptionamounting to 27% of the total number of complaints in the private sector.During the year, 346 persons involved in 189 cases were charged with corruptionand related offences with an additional 7 persons involved in 5 election related casesprosecuted. The overall conviction rate was a high 85%.The independent 2007 ICAC survey indicates that 76% of the respondents consideredcorruption uncommon in government departments, which reflects the trend inreported corruption. The proportion of respondents who thought that ICAC shoulddeal primarily with corruption in thebusiness sector has been on a risingtrend over the past four years andagain reflects the reality of the rise incomplaints in this area. Nearly threequarters of those surveyed statedthat they would report corruptionwith over 71% willing to identif ythemselves when doing so. Over98% of those surveyed said that theICAC deserved their support andreflects the intolerance of corruptionin our community.49

2007 saw a rationalisation of our operational training within a newly re-structuredHuman Resource Management Group (HRMG). For administrative purposes, theOperations Training School, Firearms Instructors and Recruitment Unit becameone section within HRMG. A Physical Training and Self-defence Instructor was alsorecruited and joined that team.With the classroom facilities at our new building, we also have a Firearms Rangecomplex consisting of a 25 meter indoor range and a computerised mini-range fortactical decision making. The new Multi-purpose Sports Hall and Gymnasium hasgreatly benefited our staff in both their fitness levels and self-defence training.All frontline officers were trained on how to use the latest "state of the art" DigitalVideo Interview facilities in the new building. The advanced equipment installed inall the interview rooms will ensure sustained quality of recordings and the integrityof the entire interviewing process.Recruit training covers the first contract for new officers and is split into threecontinuation courses throughout that period before an officer is considered to befully trained.55

This trainingincluded tailor-made courses for new surveillance unit officers, intelligence unit staff,financial investigations staff, Detention Centre guards and Operations Departmentdrivers. In co-operation with the LondonMetropolitan Police Service, we also run a rolling programme of seconding officers tothe "Met" for six-month periods to broaden their law enforcement experience. Forthe first time, one officer was sent on a four-and-a-half-month attachment to theEuropean Commission Anti-Fraud Office in Belgium. A Training Officer also attendedthe Institute of Analytic Interviewing in the USA to become qualified as an analyticinterviewing instructor.亞 洲 地 區 執 法 管 理 課 程Asia Regional Law Enforcement Management Program2007 年 9 月 , 我 到 越 南 河 內 , 參 加 澳 洲 聯 邦 警 隊 與 皇 家 墨 爾 本 理 工 學 院 國 際 大 學 合 辦 , 為 期 20天 的 「 亞 洲 地 區 執 法 管 理 課 程 」。 這 課 程 提 供 了 寶 貴 的 機 會 , 讓 來 自 亞 太 區 18 個 執 法 機 關 的 參加 者 提 升 管 理 方 面 的 理 論 和 實 務 技 巧 。 能 夠 置 身 多 元 文 化 的 環 境 裏 , 與 來 自 不 同 國 家 的 學 員 切磋 , 分 享 彼 此 對 執 法 工 作 及 其 他 領 域 的 想 法 和 經 驗 , 是 我 在 這 課 程 中 最 大 的 得 着 。The Asia Regional Law Enforcement Management Program was conducted bythe Australian Federal Police in conjunction with the Royal Melbourne Institute ofTechnology International University, in Hanoi, Vietnam. The 20-day course held inSeptember 2007 allowed the participants from 18 law enforcement agencies aroundthe Asia Pacific Region an excellent opportunity to develop their theoretical andpractical skills in management. The most beneficial part of the training was thatit positioned me in a multicultural environment where participants from differentnations shared their concepts and experiences in both law enforcement and non lawenforcement contexts.57

I was attached to23 different law enforcement agencies including 11 units in the Metropolitan PoliceService and 12 others such as the Serious Organized Crime Agency, City of LondonPolice, Ministry of Defence Police, Border & Immigration Agency, Serious Fraud Office,Financial Services Authority, Royal Courts of Justice, Crown Prosecution Service andthe 2012 London Olympics Security Secretariat. I was also given the opportunity togo on patrol with the Air Support Unit; meet Prince Charles and Camilla, Duchess ofCornwall during their royal visit to London’s Chinatown; attached to the murder squadinvestigating two murders involving Chinese victims and assisted in managing guncrime intelligence at the Notting Hill Carnival. I attended courses on fraud, financialinvestigations and critical incident training and exchanged anti-corruption experiencewith UK officers.The attachment program requires extremely high levels of independence, selfdiscipline and problem solving skills, as well as an awareness of contemporary politicaland global issues. My investigative and management skills have been enhanced as aresult of this attachment.58

Its prime objective is to protect the financial interests of the EuropeanUnion (EU) against fraud, corruption and other irregularities, such as misconduct.OLAF achieves its mission through conducting fully independent ‘administrativeinvestigations’. It also enhances close and regular cooperation between thecompetent authorities of the 27 Member States, coordinates their investigative actionsand provides technical and professional support, including computer forensics andlegal advice, to European law enforcement agencies.My four-and-a-half-month attachment to OLAF was an eye-opening and interestingexperience. The fraud and corruption cases that I saw are of a completely differentnature from those handled by the ICAC. Examples include dishonest volunteerspocketing substantial EU funds intended for removing mines from mine fields in Africaat the expense of poor inhabitants; corrupt EC officials leaking confidential informationabout the selling price of sugar for private gain; cases involving sophisticated corruptnetworks within Europe for securing construction contracts from the EC and Non-Governmental Organisations (NGOs) pocketing substantial EU funds by submittingfalse reports on humanitarian work.59

培 訓 ... 續Training ...continued高 級 警 務 行 政 課 程Senior Police Administration Course2007 年 3 至 4 月 , 我 在 加 拿 大 渥 太 華 的 加 拿 大 警 察 學 院 , 參 加 皇 家 加 拿 大 騎 警 高 級 警 務 行 政 課程 。 這 項 領 袖 訓 練 計 劃 , 旨 在 培 訓 學 員 肩 負 較 高 級 的 管 理 職 責 。 最 令 我 印 象 深 刻 的 , 就 是 在 學院 採 用 的 尖 端 教 學 法 下 , 我 能 夠 迅 速 掌 握 從 課 程 中 學 到 的 新 知 識 。 如 今 , 我 肯 定 在 執 法 、 管 理技 巧 和 領 導 才 能 各 方 面 都 有 所 提 升 。I attended the Royal Canadian Mounted Police Senior Police Administration Course(SPAC) at the Canadian Police College in Ottawa, Canada from March to April 2007.The course is a leadership training programme to prepare officers for more seniormanagement responsibilities. I was impressed with the cutting edge delivery ofthe programme by the college and found that I was on a steep learning curve. Myknowledge of police and law enforcement services, managerial skills and leadershipability has definitely been enhanced.60

2007 年 新 加 坡 警 隊 指 揮 及 警 官 課 程Singapore Police Force Command and Staff Course 2007這 個 為 期 四 週 的 課 程 , 目 的 在 訓 練 參 加 者 的 指 揮 和 警 官 技 巧 , 以 增 強 我 們 作 為 領 袖 的 信 心 。 首兩 星 期 我 們 先 在 新 加 坡 參 加 連 串 講 課 及 講 座 , 之 後 兩 星 期 到 澳 洲 柏 斯 , 參 加 多 項 在 戶 外 和 戶 內舉 行 的 領 袖 訓 練 活 動 。 我 們 各 人 每 天 輪 流 擔 任 小 組 領 袖 , 過 程 中 頗 多 面 臨 抉 擇 , 需 要 作 出 決 定以 應 付 種 種 難 題 的 機 會 。 所 作 的 決 定 , 無 論 結 果 是 苦 是 甜 , 小 組 總 是 一 起 承 擔 。 有 一 次 在 澳洲 , 我 的 小 組 需 要 在 荒 廢 了 的 火 車 站 內 , 找 尋 預 先 藏 起 的 營 地 位 置 線 索 , 可 惜 無 功 而 還 。 天 寒地 凍 , 我 們 被 迫 瑟 縮 在 小 型 貨 車 裏 渡 宿 一 宵 , 共 嚐 苦 果 。 另 一 組 更 因 迷 途 而 要 在 戶 外 流 浪 20 多小 時 , 也 是 有 苦 共 嚐 。 總 之 , 透 過 跟 別 的 參 加 者 互 動 切 磋 , 我 學 會 了 不 同 的 領 導 模 式 , 也 更 瞭解 自 己 肩 負 重 任 時 的 具 體 需 要 , 對 我 日 後 在 公 署 的 工 作 , 肯 定 受 用 不 盡 。This was a 4-week course aimed at equipping participants with the command and staffskills to increase their confidence as leaders. The course started in Singapore withtwo weeks of lectures and presentations, followed by two weeks in Perth, Australia,where we did a lot of leadership training exercises, both indoor and outdoor. Each ofus was assigned as the team leader on a daily basis where numerous opportunitieswere presented to us for decision making and choices about how to go about varioustasks. All these decisions had very real consequences which we would enjoy orsuffer as a team. On one occasion in Australia, my team failed to uncover the clueshidden at an abandoned railway station for locating our camp site and we had to stayin a van overnight in cold conditions. Another team got lost and they spent over20 hours wandering in the open. Through interaction with other participants I havelearned different leadership models and understand more about my specific needswhen taking higher responsibilities. I am sure that it will be useful to my futuredevelopment in the Commission.61

培 訓 ... 續Training ...continued國 際 執 法 學 院International Law Enforcement Academy (ILEA)2007 年 4 至 5 月 期 間 , 我 在 泰 國 曼 谷 參 加 由 國 際 執 法 學 院 舉 辦 的 複 雜 財 務 調 查 課 程 。 課 程 有 多 個目 的 , 包 括 剖 析 國 際 洗 黑 錢 的 過 程 和 技 巧 以 界 定 洗 黑 錢 罪 行 , 學 習 最 新 的 反 洗 黑 錢 法 例 和 調 查技 巧 , 以 及 討 論 追 蹤 跨 境 贓 款 的 技 巧 等 。 課 程 期 間 , 我 有 機 會 與 其 他 學 員 交 流 經 驗 , 尤 其 是 有關 美 洲 和 亞 洲 地 區 打 擊 財 務 罪 案 的 經 驗 。我 們 又 深 入 探 討 不 同 的 財 務 調 查 技 巧 , 例 如 怎 樣 找 尋 、 取 得 和 剖 析 書 面 證 據 以 證 明 未 曾 申 報 的收 入 , 以 及 揭 發 犯 罪 得 益 的 方 法 。 我 在 廉 署 執 行 職 務 時 , 定 能 學 以 致 用 。I attended the Complex Financial Crimes Investigation Course held by ILEA inBangkok, Thailand from April to May 2007. The objectives of the course includeddefining international money laundering by dissecting its process and techniques;learning the most up-to-date anti-money laundering legislation and investigation skillsand discussing techniques used in cross-border fund tracing. I was able to shareexperiences with the other course members, particularly about the fight againstfinancial crimes between America and Asia.We spent quite some time on different financialinvestigative techniques, for example, howto locate, obtain and develop documentaryevidence to prove unreported income andmethods to uncover crime proceeds. I will beable to apply all these skills to my ICAC duties.62

廉 政 公 署 綜 合 招 聘Commission-Wide Recruitment邁 進 2008 年 , 廉 政 公 署 , 尤 其 是 執 行 處 , 已 作 好 準 備 , 迎 接 新 的 挑 戰 ; 而 其 中 一 項 挑戰 , 便 是 招 聘 和 挽 留 高 質 素 的 人 材 , 以 肩 負 肅 貪 倡 廉 的 重 任 。一 向 以 來 , 執 行 處 、 防 止 貪 污 處 和 社 區 關 係 處 各 自 招 聘 人 員 。 但 為 了 配 合 以 調 查 、 預 防和 教 育 三 管 齊 下 的 方 式 打 擊 貪 污 , 延 攬 新 員 時 , 選 聘 全 方 位 勝 任 並 樂 意 服 務 於 這 三 個 部門 的 人 材 , 更 能 符 合 廉 署 的 機 構 目 標 。2007 年 年 底 , 執 行 處 招 聘 了 26 名 直 接 入 職 調 查主 任 。 為 配 合 「 廉 署 一 體 化 」 政 策 , 他 們 會 接 受 全 面 培 訓 , 以 便 日 後 被 調 派 至 署 內 任 何一 個 部 門 工 作 。2008 年 年 初 , 執 行 處 計 劃 招 聘 約 70 名 助 理 調 查 員 , 按 相 同 政 策 作 職 位調 派 。展 望 2008 年 及 未 來 的 日 子 , 執 行 處 向 香 港 市 民 和 國 際 執 法 網 絡 承 諾 , 我 們 將 繼 續 以 堅定 不 移 的 決 心 , 打 擊 貪 污 。As we leave 2007 behind, the Commission as a whole, and OperationsDepartment in particular, looks forward to the challenges of 2008. Amongthose challenges is the need to recruit and retain high caliber officers tocombat corruption.Traditionally, the Operations, Corruption Prevention and Community RelationsDepartments recruited separately for their own posts. However, in line withour three-pronged approach to combating corruption through investigation,prevention and education, the recruitment of officers able and willing to workin all three departments complies with our corporate goals. At the end of2007, we recruited 26 direct entrant Investigators who will be trained fordeployment in any of the three departments as part of our “One Commission”policy. At the beginning of 2008, we intend to recruit some 70 AssistantInvestigators for deployment in a similar fashion.The Operations Department looks forward to the challenges of 2008 andbeyond and assures the Hong Kong people and that of the international lawenforcement network of our continued determination to make corruption ahigh risk crime.63
