THE JAMMU AND KASHMIRFOREST (CONSERVATION&AFFORESTATION) RULES, 2000SRO 203, dated 13th June, 2000.In exercise of <strong>the</strong> powers conferred by section 6 of <strong>the</strong> Jammu and Kashmir <strong>Forest</strong> (<strong>Conservation</strong>)Act, 1997 (Act No. XXX of 1997), <strong>the</strong> government hereby makes <strong>the</strong> following rules, namely:1. Short title, extent and commencement(i) These rules may be called <strong>the</strong> Jammu and Kashmir <strong>Forest</strong> <strong>Conservation</strong> and<strong>Afforestation</strong>) <strong>Rules</strong>, 2000.(ii) They shall extend to <strong>the</strong> whole of Jammu and Kashmir State.(iii) They shall come into force from <strong>the</strong> date of <strong>the</strong>ir publication in <strong>the</strong> GovernmentGazette2.DefinitionsIn <strong>the</strong>se rules unless <strong>the</strong> context o<strong>the</strong>rwise requires:(a) Act means <strong>the</strong> Jammu and Kashmir <strong>Forest</strong> (<strong>Conservation</strong>) Act, 1997;(b) Committee means <strong>the</strong> committee constituted under section 3 of <strong>the</strong> Act;(c) Chairman means <strong>the</strong> Chairman of <strong>the</strong> Committee.(d) Member means <strong>the</strong> member of <strong>the</strong> Committee.(e) Section means a section of <strong>the</strong> Act.3. Composition of <strong>the</strong> committeeThe Committee shall consist of <strong>the</strong> following members:-i) Chief Secretary, Jammu & Kashmir State Chairmanii) Financial Commissioner, (Revenue) Jammu & Kashmir Government Memberiii) Principal Secretary and Secretary to Government, Planning andMemberDevelopment Departmentiv) Principal Secretary and Secretary to Government, Finance Department Memberv) Principal Secretary and Secretary to Government, <strong>Forest</strong> Department Membervi) Principal Chief Conservator of <strong>Forest</strong>s, Jammu and Kashmir Government Membervii) Director Soil <strong>Conservation</strong> Memberviii) Chief Wildlife Warden, Jammu and Kashmir GovernmentMemberIx) Director Environment Memberx) Two eminent Environmentalists MemberXi A representative of Central Ministry of Environment and <strong>Forest</strong>s Memberxii Conservator of <strong>Forest</strong>s, Working Plan Circle Member Secretary4. Terms of Appointment of non-<strong>official</strong> membersThe terms of appointment of non-<strong>official</strong> members shall be as follows:-(1) A non-<strong>official</strong> member shall hold office for a period of two years.(2) A non-<strong>official</strong> member shall cease to hold office if he dies, resigns, become of unsound mind, becomes insolventor is convicted by a court of law on a criminal offence involving moral turpitude.(3) Any vacancy in <strong>the</strong> membership caused by any reason mentioned in sub-rule (2) shall be filled up by <strong>the</strong>Government for <strong>the</strong> remaining portion of 2 years.(4) Travelling and daily allowances shall be payable to <strong>the</strong> non-<strong>official</strong> members of <strong>the</strong> committee at <strong>the</strong> rate asadmissible to class - I officers of <strong>the</strong> Government under <strong>the</strong> rules and orders made by <strong>the</strong> Government from


forest area, <strong>the</strong> details of proposals for <strong>the</strong>ir rehabilitation and procurement of raw material, respectively should befurnished.6. Proposed steps to be taken to compensate for <strong>the</strong> loss of <strong>the</strong> forest area, <strong>the</strong> vegetation and wildlife with specialreference to(i) Compensatory <strong>Afforestation</strong> Scheme (if enclosed)(ii) Cost of land (Approx.) (if assessed)(iii) Cost of compensation for trees and No. of trees involved (Whe<strong>the</strong>r cost of compensation for treesassessed and species and dia class wise abstract of trees enclosed)(iv) Any o<strong>the</strong>r step proposed.(i)(ii)7. Detailed opinion of <strong>the</strong> Chief Conservator of <strong>Forest</strong>s covering <strong>the</strong> following aspects, namely:out turn of timber, fuel wood and o<strong>the</strong>r forest produce from <strong>the</strong> forest land involvedWhe<strong>the</strong>r <strong>the</strong> district is self sufficient in timber and fuel wood(iii) The effect of <strong>the</strong> proposal on :(iv)a. Fuelwood, supply to rural populationb. Economy and livelihood of <strong>the</strong> tribals, backward communitiesSpecial recommendations of <strong>the</strong> Chief Conservator of <strong>Forest</strong>s foracceptance or rejection of <strong>the</strong> proposal with reasons <strong>the</strong>reof.Certified that all o<strong>the</strong>r alternatives for <strong>the</strong> purpose have been explored and <strong>the</strong> demand for<strong>the</strong> required area is <strong>the</strong> minimum demand for forest land.Signature of <strong>the</strong>Signature of <strong>the</strong>indenting Agency Chief Conservator of <strong>Forest</strong>s (T)7.
