THE JAMMU AND KASHMIRFOREST (CONSERVATION&AFFORESTATION) RULES, 2000SRO 203, dated 13th June, 2000.In exercise of the powers conferred by section 6 of the Jammu and Kashmir Forest (Conservation)Act, 1997 (Act No. XXX of 1997), the government hereby makes the following rules, namely:1. Short title, extent and commencement(i) These rules may be called the Jammu and Kashmir Forest Conservation andAfforestation) Rules, 2000.(ii) They shall extend to the whole of Jammu and Kashmir State.(iii) They shall come into force from the date of their publication in the GovernmentGazette2.DefinitionsIn these rules unless the context otherwise requires:(a) Act means the Jammu and Kashmir Forest (Conservation) Act, 1997;(b) Committee means the committee constituted under section 3 of the Act;(c) Chairman means the Chairman of the Committee.(d) Member means the member of the Committee.(e) Section means a section of the Act.3. Composition of the committeeThe Committee shall consist of the following members:-i) Chief Secretary, Jammu & Kashmir State Chairmanii) Financial Commissioner, (Revenue) Jammu & Kashmir Government Memberiii) Principal Secretary and Secretary to Government, Planning andMemberDevelopment Departmentiv) Principal Secretary and Secretary to Government, Finance Department Memberv) Principal Secretary and Secretary to Government, Forest Department Membervi) Principal Chief Conservator of Forests, Jammu and Kashmir Government Membervii) Director Soil Conservation Memberviii) Chief Wildlife Warden, Jammu and Kashmir GovernmentMemberIx) Director Environment Memberx) Two eminent Environmentalists MemberXi A representative of Central Ministry of Environment and Forests Memberxii Conservator of Forests, Working Plan Circle Member Secretary4. Terms of Appointment of non-official membersThe terms of appointment of non-official members shall be as follows:-(1) A non-official member shall hold office for a period of two years.(2) A non-official member shall cease to hold office if he dies, resigns, become of unsound mind, becomes insolventor is convicted by a court of law on a criminal offence involving moral turpitude.(3) Any vacancy in the membership caused by any reason mentioned in sub-rule (2) shall be filled up by theGovernment for the remaining portion of 2 years.(4) Travelling and daily allowances shall be payable to the non-official members of the committee at the rate asadmissible to class - I officers of the Government under the rules and orders made by the Government from

Proposed steps to be taken to compensate for the loss of the forest area, the vegetation and wildlife with specialreference to(i) Compensatory Afforestation Scheme (if enclosed)(ii) Cost of land (Approx.) (if assessed)(iii) Cost of compensation for trees and No. of trees involved (Whether cost of compensation for treesassessed and species and dia class wise abstract of trees enclosed)(iv) Any other step proposed.(i)(ii)7. Detailed opinion of the Chief Conservator of Forests covering the following aspects, namely:out turn of timber, fuel wood and other forest produce from the forest land involvedWhether the district is self sufficient in timber and fuel wood(iii) The effect of the proposal on :(iv)a. Fuelwood, supply to rural populationb. Economy and livelihood of the tribals, backward communitiesSpecial recommendations of the Chief Conservator of Forests foracceptance or rejection of the proposal with reasons thereof.Certified that all other alternatives for the purpose have been explored and the demand forthe required area is the minimum demand for forest land.Signature of theSignature of theindenting Agency Chief Conservator of Forests (T)7.
