In addition, <strong>the</strong> Division Director, <strong>Code</strong> 20, serves as SpecialAssistant for Military Justice, Naval Legal Service Command (NAVLEGSVCCOM),and advises Commander, NAVLEGSVCCOM regarding policies, plans, resourcesand procedures affecting <strong>the</strong> military justice mission <strong>of</strong> NAVLEGSVCCOM. Inthat capacity, <strong>the</strong> Division Director assists Commander, NAVLEGSVCCOM, inArticle 6, UCMJ, inspections <strong>of</strong> NAVLEGSVCCOM commands and detachments. Infiscal year 2005, <strong>the</strong> Division Director, <strong>Code</strong> 20, participated in <strong>the</strong>Article 6, UCMJ, inspections <strong>of</strong> NAVLEGSVCCOM commands in <strong>the</strong> Mid-Atlanticand Nor<strong>the</strong>ast portions <strong>of</strong> <strong>the</strong> United States.The JSC 2005 <strong>Annual</strong> Review was forwarded to <strong>the</strong> Department <strong>of</strong> Defense(DoD), Office <strong>of</strong> General Counsel in accordance with <strong>the</strong> JSC’s ongoingreview <strong>of</strong> <strong>the</strong> Manual for Courts-Martial. Among <strong>the</strong> items forwarded in <strong>the</strong><strong>Annual</strong> Review were <strong>the</strong> creation <strong>of</strong> two new crimes prejudicial to <strong>the</strong> goodorder and discipline <strong>of</strong> <strong>the</strong> services. Washington, 541 U.S. 36 (2004); <strong>the</strong>scope <strong>of</strong> appellate review in cases remanded by our superior court; <strong>the</strong>impact <strong>of</strong> Lawrence v. Texas, 539 U.S. 558 (2003) on <strong>the</strong> UCMJ <strong>of</strong>fense <strong>of</strong>adultery; <strong>the</strong> constitutionality <strong>of</strong> 18 U.S.C. § 2257 requiring individualrecords <strong>of</strong> performers be maintained by operators <strong>of</strong> pornographic internetweb sites; application <strong>of</strong> <strong>the</strong> Right to Financial Privacy Act, 12 U.S.C. §§3401-3422; whe<strong>the</strong>r <strong>the</strong> lack <strong>of</strong> fixed terms <strong>of</strong> appellate judges is aviolation <strong>of</strong> constitutional due process.The court continued to submit for posting all published and authoreddecisions within one day <strong>of</strong> release and a digest <strong>of</strong> each posted case on itsweb page. The court also posts <strong>the</strong>se decisions on <strong>the</strong> Navy KnowledgeOnline intranet.APPELLATE DEFENSE DIVISION (<strong>Code</strong> 45)Mission. The Appellate Defense Division represents Navy and MarineCorps appellants before <strong>the</strong> NMCCA, CAAF, and <strong>the</strong> U.S. Supreme Court. Italso represents some appellants before <strong>the</strong> Naval Clemency & Parole Board.The Division provides assistance to trial defense counsel in <strong>the</strong> field byhelping to file extraordinary writs before NMCCA and CAAF, providing adeath penalty assistance team to advise field defense counsel facingpotential capital cases, providing training to trial defense counsel, andproviding advice on specific cases in litigation at trial.Organization. Captain Pamela A. Holden, JAGC, USN, and LieutenantColonel Joseph R. Perlak, USMC, served as <strong>the</strong> Division Director and DeputyDirector for <strong>the</strong> entire fiscal year. The Appellate Defense Division wasstaffed with 18 active duty Navy and Marine Corps judge advocates and 4civilian support personnel.3
