The 2005 annual review contains proposals todelete <strong>the</strong> words “without consent” from Articles 120 and 125, UCMJ, toestablish degrees <strong>of</strong> force for rape, forcible sodomy, and indecentassault, to add stalking as an <strong>of</strong>fense, and to consolidate various o<strong>the</strong>rsexual-related <strong>of</strong>fenses under Article 134, UCMJ. He added that o<strong>the</strong>rproposals under consideration would allow an appearance by an accused atcertain sessions under Article 39(a) by remote means, such asvideoconferencing, so long as a defense counsel is present in <strong>the</strong>courtroom at <strong>the</strong> site <strong>of</strong> <strong>the</strong> Article 39(a) session, amending <strong>the</strong> statute<strong>of</strong> limitations for rape, murder, and child abuse, revising Military Rules<strong>of</strong> Evidence 412 and 513, and giving authority to military judges overpost-trial processing.Senior Judge Robinson Everett also addressed <strong>the</strong> <strong>Code</strong> <strong>Committee</strong> andencouraged consideration <strong>of</strong> proposals to give <strong>the</strong> accused at courtsmartial<strong>the</strong> option <strong>of</strong> being sentenced by <strong>the</strong> military judge afterconviction by court members, to change references from <strong>the</strong> “law <strong>of</strong> war” to<strong>the</strong> “law <strong>of</strong> armed conflict,” to give <strong>the</strong> United States Court <strong>of</strong> Appealsfor <strong>the</strong> Armed Forces discretionary review <strong>of</strong> <strong>the</strong> actions <strong>of</strong> militarycommissions, to allow Supreme Court review <strong>of</strong> cases in which petitions forgrant <strong>of</strong> review have been denied, and to enlarge <strong>the</strong> Court’s jurisdictionto include <strong>the</strong> review <strong>of</strong> administrative actions involving service members.By motion, <strong>the</strong> <strong>Code</strong> <strong>Committee</strong> referred <strong>the</strong>se suggestions to <strong>the</strong> JointService <strong>Committee</strong> or a subcommittee for review.Separate reports <strong>of</strong> <strong>the</strong> United States Court <strong>of</strong> Appeals for <strong>the</strong> ArmedForces and <strong>the</strong> individual Armed Forces address fur<strong>the</strong>r items <strong>of</strong> specialinterest to <strong>the</strong> <strong>Committee</strong> on Armed Services <strong>of</strong> <strong>the</strong> United States Senateand <strong>the</strong> United States House <strong>of</strong> Representatives, as well as <strong>the</strong> Secretaries<strong>of</strong> Defense, Homeland Security, Army, Navy, and Air Force.H.
