California Residence Requirement• A California Resident is defined as onewho has established both physical presence<strong>and</strong> intent <strong>to</strong> make California <strong>and</strong> theUnited States their permanent home, formore than one year from the ResidencyDetermination Date. The ResidencyDetermination Date is defined as the dayimmediately proceeding the opening dayof instruction. Physical presence is definedas continuous physical presence withinthe State of California, excluding temporaryabsences. Intent <strong>to</strong> make the UnitedStates the permanent home is determinedbased upon acceptable evidence submittedby the student, showing intent <strong>to</strong> makethe United States the student’s permanenthome <strong>and</strong> evidence showing the studentis not precluded from establishing permanentresidency in the United States. Forminors under the age of 18, residency willbe derived from their parent or legal guardian.Check with the Enrollment Center regardingyour particular status.• A Non-California Resident student isone who has not resided in the State ofCalifornia for more than one year <strong>and</strong> theday immediately preceding the ResidencyDetermination Date or who has shownconduct inconsistent with a claim forUnited States residence or who is precludedfrom establishing domicile in the UnitedStates. Non-residents, except those whohave temporary United States visas, stillmay attend the college subject <strong>to</strong> nonresidenttuition fees as established by theDistrict’s Board of Trustees.d. Residence ReclassificationStudents who have been classified as nonresidentsmay submit a SupplementaryResidency Questionnaire <strong>to</strong> be reclassifiedas California resident if their status haschanged. The Supplementary ResidencyQuestionnaire is available online or at theEnrollment Center <strong>and</strong> must be submittedprior <strong>to</strong> the semester start date withthe appropriate documentation showingboth physical presence <strong>and</strong> intent <strong>to</strong> makeCalifornia their permanent home, for morethan one year.e. Resident AppealA student may appeal the final residenceclassification determined by the college.The appeal must be made within 30 calendardays of receipt of notification ofthe residence classification. The appealmust be submitted in writing <strong>to</strong> the collegeAdmissions Office who will forward it <strong>to</strong> theDistrict Residency Appeal Officer.f. Fees for Non-Resident Visa Holders• Foreign Residents - Students with visaswhich require residency in the countrygranting the visa or who have not applied<strong>to</strong>wards United States residency status forover one year before the start of the semesterwill be required <strong>to</strong> pay an enrollmentfee of *$26 per unit <strong>and</strong> additional*$204 per unit.• Non-California Residents – United StatesCitizens <strong>and</strong> Permanent Resident CardHolders who have lived in California forless than one year will be required <strong>to</strong> payan enrollment fee of *$26 per unit <strong>and</strong> additional*$186 per unit.*Fees are subject <strong>to</strong> change at any time byBoard action.g. Non-Resident Tuition ExemptionsCertain Non-resident students may be exemptfrom paying non-resident fees:• AB540 – Non-resident students who havecompleted at least three (3) years <strong>and</strong>graduated from a California High Schoolmay be eligible <strong>to</strong> have non-resident tuitionwaived.
