SAMPLE 4All disputes, differences or claims in connection withthe construction, interpretation and performance <strong>of</strong>this Agreement shall be settled by means <strong>of</strong> cordialand constructive negotiation provided that if theparties cannot settle such dispute, difference or claimwithin thirty (30) days <strong>of</strong> first conferring, then suchdispute, difference or claim shall be submitted toarbitration. Unless otherwise agreed in writing by theparties: -(i)the arbitration shall be conducted by a singlearbitrator jointly appointed by the parties hereto inaccordance with the <strong>Arbitration</strong> Act 2005. If theparties fail to agree on the appointment <strong>of</strong> thearbitrator, the arbitrator shall be appointed by theDirector <strong>of</strong> the Kuala Lumpur Regional Centre for<strong>Arbitration</strong> whose decision shall be final and bindingon the parties.
