legal updatelegal updateCourt Ruling May Increase The Importance Of Medical Provider NetworksContinued from previous pagesicians are inadmissible for purposesof determining necessary treatmentand adequate patient compensation.The Court reached this conclusion assumingthat a valid MPN was established.It is thought that this decision wasdesigned to limit or stop so called“doctor shopping.” Since the reform,some attorneys have attempted toobtain favorable reports by referringpatients to their favorite non-MPNdoctor. The attorneys that previouslyreferred patients outside of the MPN,in my opinion, will now be lookingat the MPN lists. Will they find yourname?WCAB cases are normally decided bythree member panels. However, “inorder to achieve uniformity of decision”on important legal issues, thechairman, upon a majority vote, mayassign cases to be heard en banc,whereby the entire seven-memberjudiciary hears the case. En bancdecisions are binding on all WCABpanels and workers’ compensationjudges (WCJs). The Valdez decisionwill therefore greatly hinder an employeethe ability to be treated andevaluated outside the MPN. In myopinion, though, Valdez does notpreclude treatment outside the MPNwhere notice requirements are notcomplied with. This will be morethoroughly explored below.The Valdez holding underlines the importance of gettingin the Medical Provider Network (MPN). I believe thatattorneys for injured workers’ will be turning to MPN listsfor referrals for treatment and to develop the record.The message of Valdez can really be boiled down to onestatement: join the MPNs.For those of you not familiar withworkers’ compensation law, I offersome background information onthis topic of discussion – The MPN:Under legislation passed in 2004, employersmay establish MPNs, withinwhich injured employees are generallyrequired to be treated. Employerswishing to utilize an MPN mustestablish a network of physicians,and have it approved by the AdministrativeDirector of the Departmentof Workers’ Compensation (DWC).After the network is approved, employersshall provide their employeeswith notice of the MPN at least 30days prior to its implementation; newemployees are provided with the listupon being hired. And when a coveredworker is injured, the employershall send a final MPN notification,listing all network providers and notingthe initial examination physician.Thereafter, the injured worker is free“to select a physician of his or herchoice from within the MPN” for furthertreatment and evaluation.The Valdez’s attorneys petitionedfor reconsideration, asking that theWCAB stay its April 20 en banc decision,while it revisited the factualand legal issues of the case. The attorneys,among other things, allegedthat the holding would produce “absurdresults” and cost the workers’comp community dearly.The WCAB this past July 14th grantedreconsideration. After reconsideringthe factual and legal issues ofthe case, the Court affirmed its priorholding and explained how the decisionwould affect the admissibility ofnon-MPN reports. QME and apportionmentreports from outside theMPN would still be admissible. Likewise,workers who are not providedproper MPN notice may still be treatedand evaluated outside the MPN.Workers who seek treatment outsidethe MPN at their own expense, however,will not have their reports consideredfor compensation purposes.Injured workers may be treated andevaluated outside the MPN at theirown expense. Furthermore, “the appealsboard may receive as evidence.. . reports of attending or examiningphysicians,” regardless of theirMPN statues. The law thus permitsadmitting non-MPN reports whereemployees pay for the treatmentthemselves. The majority in Valdez,however, held that such efforts arewithout merit and are not to be reliedupon.The WCAB in Valdez reached its conclusion“proceeding under the assumptionof a validly establishedand properly noticed MPN.” In myopinion, the Valdez case does notpreclude treatment outside the MPNif the notice requirements are notcomplied with. The MPN notice requirementsare elaborate, having 13separate subsections. Where failednotice amounts to neglect or refusalto provide reasonable medical treatment,the employer is liable for theemployee’s self-procured treatmentoutside the MPN.In this situation, it seems the employee’sventuring outside the MPNwould be authorized, thus reportsobtained in doing so would be admissibleunder Valdez.The Valdez holding is brand new,thus many questions remain as to itsreach. One such question is whetherunder section 4061.5, the primarytreating physician may designate hisreport writing duties to a non-MPNphysician. As discussed in the previousarticle (The Designated DoctorRule), treating physicians are permittedto designate their report writingduties. The rule form Valdez may ormay not restrict this designation toonly MPN doctors.The Valdez holding underlines the importanceof getting in the MPN. Therole of the treating physician is criticalto a fair adjudication of a workers’compensation case. There is morechoice available in terms of selectinga physician from an MPN list asopposed to the panel QME process.I know that many doctors have givenup on the idea of getting into MPNsand have therefore seen their workers’compensation practices shrinking.I believe that attorneys for injuredworkers’ will be turning to MPNlists for referrals for treatment and todevelop the record. A delightfullyfun, informative, inspiring timewas had by all. Dr. Mark providedfood that was healthy, filling and funto eat. We ate, socialized and sharedinformally about our miracle stories,our families and our lives. We aretruly family in what we do and howwe do it.After eating, we gathered in a circleand shared stories of our doing volunteerwork around the world.Dr. Marta Callotta, local <strong>CCA</strong> President,had us all in tears about herwork at ground zero in New York Cityworking with all the rescue teamsand heart broken citizens. Dr. MartaColattta and Dr. Jim Dohn both didvolunteer work with the Fire Teamsand firefighters during the Californiafires.Dr. Gregory Judd, The famous SantaToilet Seat Cover.Dr. Dohn has traveled into Baja California,Mexico, with the Flying Samaritansto adjust and care for thepeople there.“Being able to touch with only our hands endowspeople with health and well being that is thegreatest, most under-reported secret in the worldtoday.”Dr Khelly Webb with Dr. Bob Bonnell(age 88 licensed since 1946) in thebackground.Dr. Mark deDubovay spent threeyears in Italy seeing 200 patients aday some days. He reported, as dideveryone who shared, how gratefulthe recipients of this work were regardlessof the limitations of time orequipment.Dr. Barbara Shur shared about doingwork in rural Australia with horsemenand horses.Dr. Chris Turner shared about doinghouse calls in North Long Beachwhich is on a border of Comptonand can be considered a third worldcountry in it's own right.Dr. Callotta also shared about herwork with Olympic athletes and professionalvolley ball players.Dr. Gregory Birnie and Dr. Nate Lynottare both known as the Docs forthe Long Beach Police Dept.Dr. Khelly Webb shared of her experiencesworking and adjusting inChina, the former USSR and Europe.Dr. Webb has also worked extensivelyDr. Nate Lynott, The Light Therapyfrom 1949.with Youth at Risk programs and withPTSD in combat veterans.These shares were the inspiring part.We were all touched and movedby what it takes and means to be adoctor of chiropractic. Regardless ofmanaged care, Medicare or biasedreporting, we know that we truly dono harm and always are a beneficialpresence wherever we go. Often wedo this for fun and for free...volunteersfor humanity. And we are lovedand respected.After the sharing, we got to the"white elephant gift" exchange. Dr.Greg Judd proudly got the SantaClaus toilet seat cover and did hisbest to pawn it off on others. Dr. RobertBonnell, licensed DC since 1946and a strict vegetarian since then,ironically got the "Chicken Soup forthe Chiropractic Soul" books (which,by the way, contain greatly inspirationalchiropractic stories). Dr. Carterand his wife, Melinda got the 12inch tall, hand carved sculpture of aDr. Thomas Thomas and Dr. GregoryBirnie, “Doesn’t look like a white elephant?”DC reading an x-ray. Dr. Lynott, ouryoungest and newest member gotthe 1939 electric light ray treatmentfor God-only-knows-what. No onewould own up to bringing this device,so we were all guessing what it did -it looked official though. Dr. ThomasThomas of Doctor's Do Lunch fameat Tri City Hospital in Orange Countyreceived something so memorableDr. Janie and Dr. Chris Turner.I forgot what he got. Everyone receiveda treasure. We all laughed alot. Therein are the gifts of joy andlaughter. The camaraderie, the sharingand the inspirational stories wereas nourishing to us as any meal.Being able to touch with only ourhands endows people with healthand well being that is the greatest,most under-reported secret in theworld today.
