things being equal, preference will be given tothese candidates. However, applicants should notbe refused on these grounds alone if similartraining and experience has been obtained in otherways.e) Evidence of sufficient financial support to enablethe proposed business to be established is to beprovided.f) The preferred age group is 23-40 with theexception of existing tenants on the County <strong>Farm</strong>sEstate. Applicants will not be immediately rejectedwhere they fall outside this range. In particular,younger applicants may be suitable for part-timeunits, while applicants over this range may havethe knowledge and experience to establishspecialist agricultural, horticultural or nonagriculturalenterprises.g) Applications from persons who are alreadyestablished farmers in their own right and whointend to run the County <strong>Farm</strong> as an extension totheir existing business, will not be considered inthe first instance.h) It is unrealistic to lay down criteria for the type ofperson required, but in practice it is of over-ridingimportant for the 21st Century that the individualbe keen, enterprising, adaptable and hardworking.i) Applicants will not be discriminated against on thegrounds of gender, sexual orientation, race,relationship status, disability or age (however inrespect of age see paragraph (f) above).j) The rent payment record of existing tenants will betaken into account when and if they apply foranother holding on the Estate.k) Applicants who can demonstrate care for theenvironment as part of their business enterprisewill have an enhanced likelihood of success.Council’s standard agreement is available uponrequest.Alternatively, where the tenancy does not meetagricultural tenancy requirements a business tenancyunder the Landlord and Tenant Act 1954 will berequired with a provision to contract out of the securityof tenure requirements of the legislation.USEThe Landlord is willing to consider proposals for nonagriculturalenterprises. Applicants should considerwhether planning permission would be required forany proposed alternative use.BREAK CLAUSEIt is proposed that the tenant will have an annual rightto break the tenancy. The Landlord will have the rightto break the tenancy upon the fifth anniversary of thecommencement date. Applicants may propose analternative approach, with reasons, if they wish.MAINTENANCE RESPONSIBILITIESMaintenance responsibility will be as detailed belowwith the exception of the redundant buildings wherethe tenant will have full repairing and insuring liability.SPORTING RIGHTSThe sporting rights will be included within the letting.PERSONAL RESIDENCEWhere a dwelling is included within the tenancy thetenant is to personally reside in the dwelling on theholding and to farm the land in accordance with theterms of the Agreement.AGREEMENTThe County Council will in most cases offer to thesuccessful applicant a <strong>Farm</strong> Business Tenancyaccording to the following table:ASSIGNMENT & SUB-LETTINGThe tenancy will contain a bar on assignment. Sublettingmay be allowed in certain circumstances withthe prior consent of the Landlord.New entrant to the Estate Minimum 5 years, maximum 15years.Existing tenant with either a 65Retirement Clause or a lifetimetenancyMinimum 10 years, maximum 20years or until the Michaelmasafter the tenant’s 65th birthday.The successful applicant will be required to enter a<strong>Farm</strong> Business Tenancy Agreement and meet the totalcost of any Stamp Duty Land Tax and registration (ofagreements for 7 years or more) under the LandRegistration Act 2002 if this is applicable. The termsof the FBT are not negotiable and a copy of theINSURANCEThe Council and the Tenant will be responsible forinsuring in accordance with the table set out below.RENTSRents will be due and demanded half yearly in arrearson the due dates of 11 October and 6 April.
