Q3.07Name and describe the legal entity of the Bid Committee.Provide a declaration from your city authoritiesconfirming that the Bid Committee is empowered torepresent the Candidate City and indicate the namesof the persons and/or their titles who have the authorityto sign contracts and other documents (such as theUndertaking and the Host City Contract), on behalfof the city.Bid CommitteeWith the approval of the Cabinet of Ministers ofthe Government of Sri Lanka, a company namedCWG Hambantota 2018 Private Ltd (CHPL) has beenincorporated to prepare the bid document and leadthe bid process for hosting the Games.The Government owns 51% of the shares of CHPL and49% of shares are owned by state-owned institutions.Accordingly, CHPL is the empowered to bid for theCommonwealth Games in 2018.The Government Agent/District Secretary, Hambantotahas also authorised the CHPL to represent the city ofHambantota in the bidding process.Please refer to Guarantee 3.07 within the Guarantees File.Q3.08Name and describe the legal entity (OC) that would beresponsible for the organisation of the CommonwealthGames, should your city be elected as the Host City.Organising CommitteeAs stated in Q3.07, CHPL is the legal entity set up to bidfor the Games.With the approval of the Cabinet of Ministers of theGovernment, a Bid Committee (BC) has been appointedto facilitate the bid on behalf of this legal entity.The BC is co-chaired by the Hon. MahindanandaAluthgamage, Minister of Sports and Mr. Ajith NivardCabral, Governor of the Central Bank of Sri Lanka. Fullmembership of the BC is detailed in Q2.05.Upon election as the Host City, the importance of asmooth transition into a properly constituted OrganisingCommittee (OC), the legal entity responsible for planningand hosting the Games, is fully recognised and this legalentity will be incorporated as a private company withlimited liability. The value of knowledge transfer andcontinuity of the leading personnel from bid to Gamesdelivery is also appreciated.To this end, and within three months after 11 November2011, an OC responsible for organising the Games will becreated and will comprise the following:• Chairman• Chief Executive Officer• An Executive Board• Key Functional Area heads for Communications,Finance, Legal, Operations, Project Planning andManagement.Primary objectives within this three month period will beto initiate the OC and its governance framework; defineits vision and objectives, including initial levels of serviceand priorities; and formalise regular meetings of theappointed Executive Board.Aspects such as a review of key timelines in relation tooperational expenditure and development of a businessplan in relation to OC operations will then be progressedin a diligent and professional manner.35Theme 3: Legal AspectsHambantota 2018 Commonwealth Games Candidate City File VOLUME 1 Theme 3
