Why <strong>Michigan</strong> Encourages <strong>Wetland</strong><strong>Bank<strong>in</strong>g</strong>• Preferred method of mitigation under Federal<strong>Mitigation</strong> Rule and 2009 amendments to Part303.• Applicant benefits- Reduced permit process<strong>in</strong>g time and costs- Increases certa<strong>in</strong>ty of mitigation• State benefits- Provid<strong>in</strong>g for establishment of new wetlands <strong>in</strong>advance of losses- Consolidat<strong>in</strong>g small mitigation projects <strong>in</strong>to larger,better designed and managed units- Encourages <strong>in</strong>tegration of wetland mitigation projectswith watershed based resource plann<strong>in</strong>g


Process for Establish<strong>in</strong>g Banks• Contact DEQ todiscuss bank<strong>in</strong>g• Locate suitable site• Submit bank<strong>in</strong>g preproposal• Draft bank<strong>in</strong>gagreement• F<strong>in</strong>al bank<strong>in</strong>gagreement• Construct bank• Monitor, report,long-termmanagement


General Requirements• M<strong>in</strong>imum of 10 acres <strong>in</strong> size• Services specified watersheds or ecoregions• Must have signed bank<strong>in</strong>g agreement before construction• No more than 15% of credits can come from preservation• Credits are not approved until wetland is constructed andhydrology has been achieved for 1 year (more on this later)There are currently 15 approved bank sites <strong>in</strong> <strong>Michigan</strong>


Certification of Bank Credits•Credit approval is based on construction ofsite <strong>in</strong> accordance with plans and successbased on monitor<strong>in</strong>g•Monitor<strong>in</strong>g must be <strong>in</strong>itiated at least 1year prior to approval of credits•Three stage credit approval


Credit Approval/Certification1. 50% of credits are approved if construction hasbeen completed and design hydrology hasbeen achieved2. Additional 25% are approved when plantcommunity reaches 50% design cover3. Rema<strong>in</strong><strong>in</strong>g 25% are approved when wetlandreaches fully functional status

<strong>Wetland</strong> <strong>Bank<strong>in</strong>g</strong> ReformsThe DEQ proposes to establish <strong>in</strong>centives (throughadm<strong>in</strong>istrative rule) that would encourage the creation of moremitigation banks and ensure bank credits are available <strong>in</strong>develop<strong>in</strong>g areas, <strong>in</strong>clud<strong>in</strong>g:• Increas<strong>in</strong>g service area size of banks• Allow<strong>in</strong>g earlier release of credits (e.g. release credits sooner forprivately owned banks and allow<strong>in</strong>g the release of advancecredits to municipalities as done with <strong>in</strong> lieu fees programs)• Allow<strong>in</strong>g wetland preservation <strong>in</strong> areas where there are notwetland restoration opportunities• Develop<strong>in</strong>g state backed low <strong>in</strong>terest loans to municipalitiesutiliz<strong>in</strong>g the State Water Pollution Control Revolv<strong>in</strong>g Fund• Devot<strong>in</strong>g a staff person to wetland mitigation bank<strong>in</strong>g
