STAATSKOERANT, 21 AUGUSTUS 2009No.3251474. DurationThe governing body may not employ an employee for more than ­(1) two hours per ordinary school day; or(2) six hours per day on any other day.5. Recording <strong>of</strong> work done by employee(1) The governing body must keep a record <strong>of</strong> the actual time additionallyworked by the employee for which the employee will receive authorisedremuneration from the governing body.(2) The record-keeping contemplated in subregulation (1) must be done in aregister similar to the one attached as Appendix 2.6. Remuneration <strong>of</strong> employee(1 ) The authorised remuneration that the governing body pays theemployee for the actual time additionally worked must be calculated byusing the following formula: The annual total package that the Statepays the employee, divided by 1 800 (as the number <strong>of</strong> hours a Stateemployee is expected to work in a full-time post), then multiplied by thenumber <strong>of</strong> actual additional hours worked.(2) An illustration <strong>of</strong>the formula is attached as Appendix 3.7. Agreement between employee and governing body(1) The governing body <strong>of</strong> each school must, with each employee affectedby these <strong>Regulations</strong>, enter into a written agreement, which mustcomply with the provisions <strong>of</strong> all the applicable <strong>Act</strong>s and <strong>Regulations</strong>.(2) The agreement must be kept in the file <strong>of</strong> the employee at his or herschool.(3) The employee must be given a copy <strong>of</strong> the signed agreement.


8 No.32514 GOVERNMENT GAZETTE, 21 AUGUST 2009(4) Disputes relating to the agreement between the employee and thegoverning body should be referred to the Council for Conciliation,Mediation and Arbitration for resolution.8. <strong>Prohibition</strong> <strong>of</strong> certain categories <strong>of</strong> remunerationAn application for authorisation for remunerating an employee for additionalwork may not deal with remuneration related to ­(a)(b)(c)(d)(e)(f)the <strong>payment</strong> <strong>of</strong> gratuities;the <strong>payment</strong> <strong>of</strong> bonuses;<strong>payment</strong> for hostel supervision;the promotion <strong>of</strong> an employee to a level higher than that at which he orshe is employed by the State;any benefit in kind, unless a monetary value is attached thereto; orany service that has already been paid for by the State.9. Pro<strong>of</strong> <strong>of</strong> additional work done by employee(1) The register contemplated in regulation 5 must be forwarded to theHead <strong>of</strong> Department or his or her delegate every quarter.(2) The Head <strong>of</strong> Department or his or her delegate must, on a quarterlybasis, verify the additional work done as contemplated in these<strong>Regulations</strong>.10. Short title and commencementThese <strong>Regulations</strong> are called the <strong>Regulations</strong> Relating to the <strong>Prohibition</strong> <strong>of</strong> thePayment <strong>of</strong> Unauthorised Remuneration or the Giving <strong>of</strong> Financial Benefit orBenefit in Kind to Certain State Employees and shall come into operation on thedate <strong>of</strong>publication in the Government Gazette.

With regard to applying for permission to pay additional remuneration,financial benefit or benefit in kind:1.1 On or before 31 May in the year in which the school budget is finalised interms <strong>of</strong> section 38 <strong>of</strong> the <strong>Act</strong>, governing bodies must submit their applicationsto the Head <strong>of</strong> the provincial education department for approval.1.2 On or before 31 August in the year referred to in item 1.1, the Head <strong>of</strong> theprovincial education department must communicate to the governing bodies hisor her decision regarding the application referred to in item 1.1.1.3 On or before 30 September in the year referred to in item 1.1, governing bodiesmay appeal to the Member <strong>of</strong> the Executive Council against the Head <strong>of</strong> theprovincial education department's failure to provide a response to, or againsthis or her refusal to grant permission in respect <strong>of</strong>, the application made interms <strong>of</strong> section 38(A) <strong>of</strong>the <strong>Act</strong>.
