<strong>Disability</strong> & <strong>Employment</strong> <strong>Law</strong> <strong>in</strong> <strong>New</strong> <strong>York</strong> <strong>State</strong>:Analysis and RecommendationsWhen the charge of discrim<strong>in</strong>ation <strong>in</strong>volves retaliation, whether for resist<strong>in</strong>gdiscrim<strong>in</strong>atory treatment, or for pursu<strong>in</strong>g a compla<strong>in</strong>t under the NYSHRL, the employeemust demonstrate that the employer’s action was motivated primarily by a negativereaction to the employee’s exercise of his or her human rights. 82 F<strong>in</strong>ally, when the formof discrim<strong>in</strong>ation is the failure to provide reasonable accommodation, a pla<strong>in</strong>tiff candemonstrate that the employer engaged <strong>in</strong> discrim<strong>in</strong>ation by establish<strong>in</strong>g that theaccommodation was requested, that it was reasonable and/or that the employer refusedor failed to engage <strong>in</strong> the <strong>in</strong>teractive process.F) Adm<strong>in</strong>istrative EnforcementThe NYSHRL established a state-wide Division of Human Rights. 83 When an <strong>in</strong>dividualexperiences discrim<strong>in</strong>ation, s/he has the option to file a written compla<strong>in</strong>t with theDivision <strong>in</strong> order to beg<strong>in</strong> a state <strong>in</strong>vestigation of the compla<strong>in</strong>t. 84 Although the Divisionhas jurisdiction over non-employment cases, employment discrim<strong>in</strong>ation casesconstitute the majority (83.4% <strong>in</strong> 2007-2008) of cases brought before the Division. 85 In2007-2008, 27.6% of the approximately 7000 compla<strong>in</strong>ts heard by the Division <strong>in</strong>volveda disability discrim<strong>in</strong>ation claim. 86a) Division ProcessCompla<strong>in</strong>ts with the Division must be filed with<strong>in</strong> one year of the alleged discrim<strong>in</strong>atorypractice. 87 Once the compla<strong>in</strong>t is filed, whether by the person who has experienced thediscrim<strong>in</strong>ation, or by an attorney act<strong>in</strong>g on his or her behalf, the follow<strong>in</strong>g processbeg<strong>in</strong>s.1. Notification and Investigation: The Division will communicate promptly with theperson or employer accused of disability discrim<strong>in</strong>ation and with any partieswitnesses, and proceed with an <strong>in</strong>vestigation of the charges <strong>in</strong> the compla<strong>in</strong>t. 882. Dismissal or Proceed<strong>in</strong>g: With<strong>in</strong> 180 days after the compla<strong>in</strong>t is filed, the statute<strong>in</strong>dicates that the Division will complete its <strong>in</strong>itial <strong>in</strong>vestigation, and decidewhether to dismiss the compla<strong>in</strong>t. The compla<strong>in</strong>t will be dismissed if 1) theDivision does not have jurisdiction to hear it, or 2) the <strong>in</strong>vestigation does not f<strong>in</strong>dthat an unlawful discrim<strong>in</strong>atory practice has occurred. 89 The Division might nothave jurisdiction to hear a compla<strong>in</strong>t, for <strong>in</strong>stance, if the compla<strong>in</strong>ant is a <strong>New</strong><strong>York</strong> resident, but the discrim<strong>in</strong>atory act did not take place <strong>in</strong> the <strong>State</strong> of <strong>New</strong>82 N.Y.
